Much appreciated, I didn’t care to learn there’s an actual quota to be met. Makes me believe quality is compromised and raters do have an incentive to push a claim along at slightest or easiest opportunity. Not saying you would do that but every bunch has a bad apple or two. Thanks for the insight!
The only insensitive is to make sure you meet the production standards so you don't get fired. If you take your time to ensure you have everything right, you will fall behind. I saw that first hand when I rated. Yes, there are a few bad apples.

This was extremely informative and helpful, thank you for posting this! I now have a better understanding of which way to go with future claims should they arise.
My goal was to make things as easy as possible for the rating specialists: 1) Provide all records from military and civilian providers (and when I saw civilian doctors, I made it clear when the injury related to military duty so they could include that in the chart notes) so they wouldn’t have to put my claim in a tickler file and wait for records. I wanted them to have everything they needed to make a decision. 2) I used a highlighter and/or tape flags to make the most important parts of records stand out. Sometimes it’s hard to sort out the mundane from the important when you submit an inch-thick stack of medical records; highlighting and flags directed their attention to the most important evidence. 3). Wrote a clear narrative/timeline and pointing to the applicable records. I also made an index of attached records. The index comes in handy when submitting a claim online. 4) Explained how the injury was affecting me now and what I could no longer do or how the injury was affecting my life; think “before” and “after.”

If the Veterans STR doesnt indicate treatment or diagnosis for a claimed condition, does the DBQ from the C&P cover the diagnosis requirement ?

Hi DK, Thank You So Much for your insight-This information is Golden.. I just wish You were training current Raters.. seems so much black & white info is not seen or ignored. Attention to detail Right.. I currently have a deferred chronic sinusitis claim because the rater assumed it was a PACT ACT Claim.. Submitted by my two VSO's as FDC with 12 pages of str's..nobody mentioned PACT ACT. i dont like to bash others until I walk in their shoes but throughout my 17 shorts months of getting my claims in,I have seen denials for claims with more evidence and PVT Nexus denied yet what seems like a lower rating consolation for a claim submitted with only 1 str from 34 years ago. reminds me of football Referee make up calls.. I have 2 great VSOs-one was a 25 year Navy Corpsmen/Woman the other a Marine-both a well versed and tenacious. Thank God.. DK My feeling is these federal employess-VA Raters are overloaded and underpayed.. Garbage In=Rolling the Dice many times.. Okay my one Question is-Does Anyone actually LOOK AT Or QU the Raters decision/work? Thank You again. I went from 10% to 90% within 14 months. my Tinnitus 10% was my 1sttest/learning claim. Good VSO's are experienced but it is the Veteran who really has to put in the work and gather the doctors note and go to appoinments and honestly look though your entire Disk of STR's/C-File
Training other raters, I really enjoy educating veterans. Remember, RVSRs have to meet a bi-weekly quota and they are looking at a lot of information. Why didn't you submit the claim yourself. I feel I ve learned enough about the process to submit myself but Honestly my VSO is an employee with the county where I work and she was super persistent in a good way to offer help.. 1st I didnt trust but she proved to me rather quickly by getting my c&p and 10% +0% for my hearing/tinnitus claim when I had no clue or belief I deserved anything.. She is adamant about helping. personally i feel she really likes helping VETS so I felt bad if I would ditch her when she's actually doing good

I have a court order from the VBA judge and still they deny and never sent me to specialist but to those who are certified just for C&P exams but not specialized in my injury...the main injury that created all of my injuries... Now I have to join the class action suit for being low balled
What was the judge findings. If you go before a judge and lets say he tells the VA to obtain an opinion, that doesn't mean automatic approval. What was the reason for denial after you received a copy of your VA claims file after you submitted to get a copy of all the information in your file.

Dewayne I filed a letter of intent and then I did the spray and pray method for 7 different things all filed on the same date 3 were service connected at 0% and they went to the letter of intent to file date and then had 2 more service connected at 60 % and they put it from a different date and 2 that were not service connected do I have a case to get the 60% put back to my letter of intent ?
After 2 years , they denied my OSA secondary to depression headaches and tinnitus. I had over 15 pieces of evidence , IMO etc. They said my hypertension was denied and I was exposed to toxins at camp Lejeune and I was in pact act theatre of operations. . All of these don’t apply to me. The VA erroneously denied me. They are not held accountable. Smh

I certainly hope so, because I KNOW one examiner said sinusitis is not in my records and I was just at the ER 2-3 times last year, and sick call even more than that. Those C&P exams made me very uncomfortable to say the least. Regardless, of my outcome, if I feel it’s unjustified, I will keep fighting for my 25 years of hardwork.

@Mr. Oliver My wife is going through the med board process. We just reviewed her DBQ and nothing was correctly stated, so we are hoping we get a rater like yourself , who will see the evidence doesn't match the in correct DBQ smdh.
I have a claim that has been denied several times. I now have the claim with the boards of appeals. My problem is the M21-1 VA Adjudication Manual was not used in making the decision. I even referenced the applicable sections of M21-1 VA Adjudication Manual on my documents as well as the 38 CFR.
I notice it's mostly veterans that are raters. My question is since they're veterans and they know the struggle most veterans go through why do they denied so many claims 🤷♂️
My take away from this is that all raters do it their own way, and that is an affront to all vets. These claims are adjudicated based on law and a well established procedure manual. They should all be doing it exactly the same. This explains why so many claims have to be appealed and appealed only to be granted years later by the BVA or CAVC when they should have been granted initially. I try to write a letter as an addendum to any claim I file pointing to the specific portions of the adjudication law and M-21 that apply. My aim is to be as helpful as possible to the rater, but I don't know if they take it as that or in a negative manner.
There are hundreds of raters and have to follow all regulations. I can't think of any large organization like the VA where each employees does everything the same way. They should since all are looking at the same regulations but that is in a perfect world. That's good you know of the M21. Thanks for sharing.
I'M SERVICE CONNECTED { USMC VETERAN 21 YEARS FIELD ARTILLERY}. I am S/C @ 60% for Hearing Issues But I also was Diagnosed with PTSD and ANXIETY Military related due to Life-threatening issues that occurred on Foreign Soil during Active duty I have a Knee injury {OSTEOARTHRITUS} a back injury {DEGENERATIVE DISC DISEASE} I also suffer from MIGRAINE HEADACHES {as a result of my PTSD} and I have an E/D issue from the PTSD MED'S. I have an appeal coming up soon I filed an "INTENT TO FILE" over 6 month's ago and I am just now getting my appeal meeting with A VSO I use the V.A. for my health care they have all of my records MEDICALLY I am being treated for my back.. my hearing.. my PTSD... and the Migraine headaches I suffer from I am also getting a procedure for my Knee injury.. all of these things occurred during active duty. D.M.Z. 29 Palms, Okinawa Japan camp Pendleton etc.. I'm hoping that the appeal goes well. thanks for your videos...

I create an index of attachments so they can quickly find a record. I highlight or use tape flags to call attention to key portions in the records. Most importantly, I get copies of all records (military, civilian, and even the VA) so the claim is not set aside while waiting for a clinic to forward records. While the rater can access VA medical records, including the VA records directly related to the claim saves the rater time reading through the VA file.

I was seen in a combat support hospital tent for a hip injury that was xrayed there and the record of that evaluation is lost, as was the follow xray and record 5 weeks after I was injured (follow done at Landstuhl Army Med Center) that showed i had a hip fx that was healed. Just filed a claim 18 years after injury as my symptoms have gotten much worse. What happens with the claim when active records from 18 years ago are lost? VA acknowledged I had an incomplete medical record when I retired when I initially filed for disability on other problems.
If they informed you of lost records, in that letter they should have given you what you could do. I haven't seen one of those letters in years so I don't know if they changed anything that they put in that letter in this situation.
Do you have anything in your personnel file (not your medical file) that makes reference to the injury? If so, include that with your claim. At least it will help support the timeline of events.

What were your quota standards back then per day,,week, and month? Where they hard to meet. Did you get the same credit foR single and multiple issue claims? could you pick what claims to rate in order to meet quota standards? How many cue where you allowed?
It was daily but we had to make 79 production points every two weeks. It depended on what type of claims you were rating and how much evidence the vet sent in that the rater had to review. Sending tons of evidence that didn't have anything to do with the claim but the rater had to review, would slow us down. Sounds like you might be a rater or know the process.
Would I need to provide a nexus letter, if I was filing for an increase of a disability that’s already service connected but got worse over time, or can I just provide a DBQ and be good ? Do anybody know
You have to know what goes into a nexus, part of it is a medical opinion. If you are already service connected, why would you need another opinion (nexus statement).

I know vietnam war veterans nearly deaf at 10 pct hearing loss, men who served in the infantry, then I know national guards that are not even considered veteran's, that lied they got hearing loss in boot camp at 50 pct. Sometimes I wondered who runs the VA
National guards who were activated by a federal order, an article 10 are considered veteran's, at our veterans commission it says very clearly 180 days not including training, one day in combat or a DD form 214, National guards with 20 yrs are more have been given veteran status as of 2016
I want to say thanks. I currently waiting for a supplemental claim to be processed. When I submitted the original claim, they confirmed the diagnoses (back problems) but I just lacked service connection. 10 months after that I found my out-processing medical evaluation where I listed all the back and neck pain / problems , but denied further consultation. The rumor around out processing was that if you claimed anything the Army would keep you there for another 6 months. Well after a year in a combat zone F that. Plus I was on Flight Status... and we never said anything bad because we would be grounded and loose our Job. My question, do raters actually care or take into consideration someone who was on flight status? I wrote a letter explaining those circumstances and how the I went the the VA ER the day I was signed up... and told there was nothing they could do for me... Thank god I still had health ins thru work that I could get spinal shots from a back specialist. Sorry for the ramble.
Your welcome. I was told the same thing when I left the Army. Every rater may look at it different but they all have to follow the guidelines. Where does the back claim fall under and what evidence is required under one of the 5 way's of service connection.
Dewayne…question. I filed for ptsd increase 70 to 90,and tdiu, hearing and tinnitus and migraines secondary to ptsd. I had the exam for ptsd and hearing. NOW the VA wants to schedule an exam for migraines. Why didn’t they schedule it months ago like the other 2. I’m pretty sure I’ll get the tdiu based on recent exam and my va Dr and therapist notes. Why would they waited? Thank you

@@DewayneKimble Thanks, I got the answer I think. An SCT code in the "problem list" is not a diagnosis code such as an ICD code. That's basically what I was asking. Some say an SCT code for an illness or problem is a diagnoses but others say no it is not, you need an ICD code in there for whatever the illness.
Good day. I am curious and would like to know more on something you said. You said that the rater will put a difficult claim to the side and finish an easier one to meet his quota. (paraphrasing) I've always heard that rater quotas is a myth. It is horrible that veterans with the most complex issues and who need the help the most, have to wait longer due to those very condition. Is there any rater accountability or just a "numbers counting" system as far as completing claims?
The quota is real. I'm going to have to find some of my old evaluations to share in a video. Not only did I have a production quota, I had a quality quota. So there where 2 separate quotas.
This is why I went to a lot of trouble to make my claims easier to process: providing ALL medical records (military and civilian) so they wouldn’t have to wait for clinics to forward records, highlighting key parts so they wouldn’t get bogged down hunting for them, and writing a thorough narrative with a timeline.
Would two private nexus statements at least likely as not have any weight over a c&p examiner that gave me a less than likely when the examiner only saw me one time for less than 45 minutes? I’ve been seeing the private dr’s for 12+ months.
I got some conditions denied and no C&p exams since I accidentally claimed them as primaries. Can I place a supplemental claim for those primaries and tie them in as secondaries to my currently service connected conditions and also submit my own DBQ and nexus with the supplemental claim?

Dewayne, I filed for insomnia secondary to tinnitus. I was granted service connection for it but they linked the insomnia to the tinnitus and did not rate it separately as a mental health condition. is that wrong how they did it?
Dewayne are you familiar with ARPC Form 156, which I have documented in my C-File many times adjacent to my DD-214, which was an addendum for the early break of my 4yr. contract. VA raters for Supplemental & HLR don't acknowledge this document. 156 form contains a later date of my EOS vs. DD-214. How did/would you handle this as a rater or veteran?
Alot of private companies are also marketing that they provide medical diagnosis but if I get a sufficient and actionable DBQ then then will that be enough for a diagnosis especially for a secondary claim?
If a reopen previous denied condition makes it all the way to a rater without informing the veteran an 0995 is needed , then some vsr or PCR needs to be fired...
I been trying since 2014 to get compensation for my back. been treated with physical therapy etc and goijg over and over again t getr denied... sigh.. any advice man? They said they cant find my medical record.

Is the process the same for those of us that are currently going through the Retirment process and filing a BDD claim? Seems the way you handle a claim is to build a case in favor of the veteran. I have been told in the past it was the opposite, build a case to deny.
I never heard of building a case to deny as a former rater myself. I have a video on my channel where I talk about BDD claim. I think you are in the perfect position to maximize your benefits (still on active duty).
My claim was denied for a valid reason: I had no diagnosis. The denial letter said that. However, my medical records showed my many complaints about the issue. The denial letter also said, there was no evidence of complaints, treatments, or evaluation. Now, this I don't understand...I did complain...so why did they say I didn't?

Good info!! I had 2 exams for may back and osteophytes in my neck! The 1st exam was Feb 21st, and the examiner did a rush job! The second exam was on Feb the 27th, this Doctor took her time and actually did x rays, the 1st Doctor did not, the VA rated me off the 1st doctor, I hadn’t gotten the xrays yet from the second doctor! They also combined ddd and the osteophytes into 1! Any advice?

What I don't understand is the original title of my claim was for toxic exposure along with progressive aphasia/early onset ALZ. But DBQ is scheduled for Cranial Nerve? Why they did use my file that I am claiming for along with Nexus letter?

I guess this is part of the issue, every rater doing their own thing. there should be a step by step procedure for every rater to follow so they all do the same thing. it shouldn't be russian roulette for your claim to be rated. Same goes for the C&P process, that should only be used when you don't have a nexus and diagnosis from a doctor. seeing a C&P examiner when you have all the evidence already is just a way to block VA claims

Can a service member who joined the national guard in 1991 as a field artillery, went to basic training, attended 3 weekend drills, stopped going to training all together, no deployment, came back in 2004 to the national guard for 4 drills, and stopped going to training again, never attended other training, can the service member apply for VA disability and VA health care?

0% does not mean it is not service-connected; it just means that your symptoms do not meet the legal threshold for monetary compensation. Many conditions or injuries have a strict guideline that is not subjective, such as a joint with only X% range of motion gets a 10% rating but Y% range of motion qualifies for 20% rating.
I like your content and information. But the VA rating system needs to be overhauled based on such subjectivity. I think that AI should look at these DBQs for keywords that fit into a specific rating percentage. Then maybe an actual person can look it over. This would make the process faster.
As it pertains to the DBQs and the diagnostic code criteria, I've been saying that for years. Veterans have to understand that and look for that information.

Hi Dwayne, If my rhinitis was originally rated at 0% in 2013, will the Pact Act presumptive help me get an increase in rating? Since exiting the service I have attempted to file for an increase due to the worsening of my condition and the side effects that follow. I have since been denied increase in 2015 and 2021. Besides medical records from active duty, post duty VA clinic visits and personal insurance reports, I am not sure what else to provide. It simply has not been enough to try to explain the severity and the worsening of my condition. I have proof in my records of being in country and around burn pits prior to the initial reporting Your thoughts? Thank you for the work you do to help us all.
The PACT Act in and of itself will not help get an increase for rhinitis. Please review the rating decision that granted the 0 percent. It will tell you the criteria that must be met for the next higher percentage. In the case of rhinitis, I believe one must have polyps. If one does not meet the requirements for the increased percentage, the claim for increase will be denied.
Hey Gunz Up, Go Bucs. No, you are already service connected. in the rating decision that granted it, it states why they gave the 0% and why they didn't give the 10% and lists that criteria. For the increase to the next %, what is the VA saying is required per the criteria.
Too much subjectivity however the laws are not subjective so at the end of the day you may have to appeal and do a Higher level review where they’ll have no choice but to look at the law and hope that does the trick. Normally the law prevails however sometimes it can be a long arduous road to get there.

Much appreciated, I didn’t care to learn there’s an actual quota to be met. Makes me believe quality is compromised and raters do have an incentive to push a claim along at slightest or easiest opportunity. Not saying you would do that but every bunch has a bad apple or two. Thanks for the insight!
The only insensitive is to make sure you meet the production standards so you don't get fired. If you take your time to ensure you have everything right, you will fall behind. I saw that first hand when I rated. Yes, there are a few bad apples.

My goal was to make things as easy as possible for the rating specialists:
1) Provide all records from military and civilian providers (and when I saw civilian doctors, I made it clear when the injury related to military duty so they could include that in the chart notes) so they wouldn’t have to put my claim in a tickler file and wait for records. I wanted them to have everything they needed to make a decision.
2) I used a highlighter and/or tape flags to make the most important parts of records stand out. Sometimes it’s hard to sort out the mundane from the important when you submit an inch-thick stack of medical records; highlighting and flags directed their attention to the most important evidence.
3). Wrote a clear narrative/timeline and pointing to the applicable records. I also made an index of attached records. The index comes in handy when submitting a claim online.
4) Explained how the injury was affecting me now and what I could no longer do or how the injury was affecting my life; think “before” and “after.”

If the Veterans STR doesnt indicate treatment or diagnosis for a claimed condition, does the DBQ from the C&P cover the diagnosis requirement ?

Hi DK, Thank You So Much for your insight-This information is Golden.. I just wish You were training current Raters.. seems so much black & white info is not seen or ignored. Attention to detail Right.. I currently have a deferred chronic sinusitis claim because the rater assumed it was a PACT ACT Claim.. Submitted by my two VSO's as FDC with 12 pages of str's..nobody mentioned PACT ACT. i dont like to bash others until I walk in their shoes but throughout my 17 shorts months of getting my claims in,I have seen denials for claims with more evidence and PVT Nexus denied yet what seems like a lower rating consolation for a claim submitted with only 1 str from 34 years ago. reminds me of football Referee make up calls.. I have 2 great VSOs-one was a 25 year Navy Corpsmen/Woman the other a Marine-both a well versed and tenacious. Thank God.. DK My feeling is these federal employess-VA Raters are overloaded and underpayed.. Garbage In=Rolling the Dice many times.. Okay my one Question is-Does Anyone actually LOOK AT Or QU the Raters decision/work? Thank You again. I went from 10% to 90% within 14 months. my Tinnitus 10% was my 1sttest/learning claim. Good VSO's are experienced but it is the Veteran who really has to put in the work and gather the doctors note and go to appoinments and honestly look though your entire Disk of STR's/C-File
Training other raters, I really enjoy educating veterans. Remember, RVSRs have to meet a bi-weekly quota and they are looking at a lot of information. Why didn't you submit the claim yourself. Yes, the work is reviewed and I will explain that later. I have a Q & A on the PACT Act today and it's free.

I feel I ve learned enough about the process to submit myself but Honestly my VSO is an employee with the county where I work and she was super persistent in a good way to offer help.. 1st I didnt trust but she proved to me rather quickly by getting my c&p and 10% +0% for my hearing/tinnitus claim when I had no clue or belief I deserved anything.. She is adamant about helping. personally i feel she really likes helping VETS so I felt bad if I would ditch her when she's actually doing good

Great info. Can you do a video on what happens when a diagnosis is changed at a c&p exam? For instance, ear condition is changed to Ménière's disease.
If that happens, the RVSR should explain it in the rating, that's what I used to do.

I have a court order from the VBA judge and still they deny and never sent me to specialist but to those who are certified just for C&P exams but not specialized in my injury...the main injury that created all of my injuries... Now I have to join the class action suit for being low balled
What was the judge findings. If you go before a judge and lets say he tells the VA to obtain an opinion, that doesn't mean automatic approval. What was the reason for denial after you received a copy of your VA claims file after you submitted to get a copy of all the information in your file.
I surprise people and it shouldn't offend people but the Communists are the ones that got the veterans their rights this is historical reality

Dewayne I filed a letter of intent and then I did the spray and pray method for 7 different things all filed on the same date 3 were service connected at 0% and they went to the letter of intent to file date and then had 2 more service connected at 60 % and they put it from a different date and 2 that were not service connected do I have a case to get the 60% put back to my letter of intent ?
What you did would have to be reviewed to make that determination.
After 2 years , they denied my OSA secondary to depression headaches and tinnitus. I had over 15 pieces of evidence , IMO etc. They said my hypertension was denied and I was exposed to toxins at camp Lejeune and I was in pact act theatre of operations. . All of these don’t apply to me. The VA erroneously denied me. They are not held accountable. Smh

How much weight does a C&P exam hold for a rating? Do you look at the evidence or solely based off the C&P exam?
All evidence should be reviewed and weighed.
I certainly hope so, because I KNOW one examiner said sinusitis is not in my records and I was just at the ER 2-3 times last year, and sick call even more than that. Those C&P exams made me very uncomfortable to say the least. Regardless, of my outcome, if I feel it’s unjustified, I will keep fighting for my 25 years of hardwork.

@Mr. Oliver My wife is going through the med board process. We just reviewed her DBQ and nothing was correctly stated, so we are hoping we get a rater like yourself , who will see the evidence doesn't match the in correct DBQ smdh.
I have a claim that has been denied several times. I now have the claim with the boards of appeals. My problem is the M21-1 VA Adjudication Manual was not used in making the decision. I even referenced the applicable sections of M21-1 VA Adjudication Manual on my documents as well as the 38 CFR.
Sounds like that's the argument to the judge to obtain your service connection.
I notice it's mostly veterans that are raters. My question is since they're veterans and they know the struggle most veterans go through why do they denied so many claims 🤷♂️
Not all are. There are guidelines to follow but this is not a perfect system.

My take away from this is that all raters do it their own way, and that is an affront to all vets. These claims are adjudicated based on law and a well established procedure manual. They should all be doing it exactly the same. This explains why so many claims have to be appealed and appealed only to be granted years later by the BVA or CAVC when they should have been granted initially. I try to write a letter as an addendum to any claim I file pointing to the specific portions of the adjudication law and M-21 that apply. My aim is to be as helpful as possible to the rater, but I don't know if they take it as that or in a negative manner.
There are hundreds of raters and have to follow all regulations. I can't think of any large organization like the VA where each employees does everything the same way. They should since all are looking at the same regulations but that is in a perfect world. That's good you know of the M21. Thanks for sharing.
I'M SERVICE CONNECTED { USMC VETERAN 21 YEARS FIELD ARTILLERY}. I am S/C @ 60% for Hearing Issues
But I also was Diagnosed with PTSD and ANXIETY Military related due to Life-threatening issues that occurred on Foreign Soil during Active duty I have a Knee injury {OSTEOARTHRITUS} a back injury {DEGENERATIVE DISC DISEASE} I also suffer from MIGRAINE HEADACHES {as a result of my PTSD} and I have an E/D issue from the PTSD MED'S. I have an appeal coming up soon I filed an "INTENT TO FILE" over 6 month's ago and I am just now getting my appeal meeting with A VSO I use the V.A. for my health care they have all of my records MEDICALLY
I am being treated for my back.. my hearing.. my PTSD... and the Migraine headaches I suffer from I am also getting a procedure for my Knee injury.. all of these things occurred during active duty. I have videos on my channel on evidence. You can do a search on my channel.
I create an index of attachments so they can quickly find a record. I highlight or use tape flags to call attention to key portions in the records. Most importantly, I get copies of all records (military, civilian, and even the VA) so the claim is not set aside while waiting for a clinic to forward records. While the rater can access VA medical records, including the VA records directly related to the claim saves the rater time reading through the VA file.

I was seen in a combat support hospital tent for a hip injury that was xrayed there and the record of that evaluation is lost, as was the follow xray and record 5 weeks after I was injured (follow done at Landstuhl Army Med Center) that showed i had a hip fx that was healed. Just filed a claim 18 years after injury as my symptoms have gotten much worse. What happens with the claim when active records from 18 years ago are lost? VA acknowledged I had an incomplete medical record when I retired when I initially filed for disability on other problems.
If they informed you of lost records, in that letter they should have given you what you could do. I haven't seen one of those letters in years so I don't know if they changed anything that they put in that letter in this situation.
Do you have anything in your personnel file (not your medical file) that makes reference to the injury? If so, include that with your claim. At least it will help support the timeline of events.

How would they assign the percentage with just a diagnosis. The residuals would have to be known for the claimed condition.
What were your quota standards back then per day,,week, and month? Where they hard to meet. Did you get the same credit foR single and multiple issue claims? could you pick what claims to rate in order to meet quota standards? How many cue where you allowed?
It was daily but we had to make 79 production points every two weeks. It depended on what type of claims you were rating and how much evidence the vet sent in that the rater had to review. Sending tons of evidence that didn't have anything to do with the claim but the rater had to review, would slow us down. Sounds like you might be a rater or know the process.

You have to know what goes into a nexus, part of it is a medical opinion. If you are already service connected, why would you need another opinion (nexus statement).

I know vietnam war veterans nearly deaf at 10 pct hearing loss, men who served in the infantry, then I know national guards that are not even considered veteran's, that lied they got hearing loss in boot camp at 50 pct. Sometimes I wondered who runs the VA
NG are considered veterans in the eyes of the VA. Hearing loss are based on the threshold levels.
National guards who were activated by a federal order, an article 10 are considered veteran's, at our veterans commission it says very clearly 180 days not including training, one day in combat or a DD form 214, National guards with 20 yrs are more have been given veteran status as of 2016

I want to say thanks. I currently waiting for a supplemental claim to be processed. When I submitted the original claim, they confirmed the diagnoses (back problems) but I just lacked service connection. 10 months after that I found my out-processing medical evaluation where I listed all the back and neck pain / problems , but denied further consultation. The rumor around out processing was that if you claimed anything the Army would keep you there for another 6 months. Well after a year in a combat zone F that. Plus I was on Flight Status... and we never said anything bad because we would be grounded and loose our Job. My question, do raters actually care or take into consideration someone who was on flight status? I wrote a letter explaining those circumstances and how the I went the the VA ER the day I was signed up... and told there was nothing they could do for me... Thank god I still had health ins thru work that I could get spinal shots from a back specialist. Sorry for the ramble.

Dewayne…question. I filed for ptsd increase 70 to 90,and tdiu, hearing and tinnitus and migraines secondary to ptsd. I had the exam for ptsd and hearing. NOW the VA wants to schedule an exam for migraines. Why didn’t they schedule it months ago like the other 2. I’m pretty sure I’ll get the tdiu based on recent exam and my va Dr and therapist notes. Why would they waited? Thank you

I want to see a copy of my candp exam 2 yrs ago for knee increase During covid peak..it was a joke and I can assure you no knee dbq was followed. Doctor didn't even touch me. I am 70 total percent all static on several areas of body. One 40% Comments? Thanks
The increased is based on the range of motion or if you had a knee replacement. The rater put the reason for the percentage assigned in the rating.

That's basically what I was asking. Some say an SCT code for an illness or problem is a diagnoses but others say no it is not, you need an ICD code in there for whatever the illness.

Good day. I am curious and would like to know more on something you said. You said that the rater will put a difficult claim to the side and finish an easier one to meet his quota. (paraphrasing) I've always heard that rater quotas is a myth. It is horrible that veterans with the most complex issues and who need the help the most, have to wait longer due to those very condition. Is there any rater accountability or just a "numbers counting" system as far as completing claims?
The quota is real. I'm going to have to find some of my old evaluations to share in a video. Not only did I have a production quota, I had a quality quota. So there where 2 separate quotas.
This is why I went to a lot of trouble to make my claims easier to process: providing ALL medical records (military and civilian) so they wouldn’t have to wait for clinics to forward records, highlighting key parts so they wouldn’t get bogged down hunting for them, and writing a thorough narrative with a timeline.
Would two private nexus statements at least likely as not have any weight over a c&p examiner that gave me a less than likely when the examiner only saw me one time for less than 45 minutes? I’ve been seeing the private dr’s for 12+ months.

I don't know how many hours of initial training, but there are many hours throughout the year.
I got some conditions denied and no C&p exams since I accidentally claimed them as primaries. Can I place a supplemental claim for those primaries and tie them in as secondaries to my currently service connected conditions and also submit my own DBQ and nexus with the supplemental claim?

I am at 100% VA disability due to lung cancer caused by Agent orange, It has been 2 years and I am now in remission. I am being re-evaluated now. If I am in remission, will I totally lose my benefit? Thanks

Dewayne, I filed for insomnia secondary to tinnitus. I was granted service connection for it but they linked the insomnia to the tinnitus and did not rate it separately as a mental health condition. is that wrong how they did it?
The evidence would have to be reviewed to see why the RVSR did what they did.
Dewayne are you familiar with ARPC Form 156, which I have documented in my C-File many times adjacent to my DD-214, which was an addendum for the early break of my 4yr. contract. VA raters for Supplemental & HLR don't acknowledge this document. 156 form contains a later date of my EOS vs. DD-214. How did/would you handle this as a rater or veteran?
No, VSR should verify the service and make any updates to service if they see a DD215 correcting the dates of service.

Alot of private companies are also marketing that they provide medical diagnosis but if I get a sufficient and actionable DBQ then then will that be enough for a diagnosis especially for a secondary claim?

Is the process the same for those of us that are currently going through the Retirment process and filing a BDD claim? Seems the way you handle a claim is to build a case in favor of the veteran. I have been told in the past it was the opposite, build a case to deny.
I never heard of building a case to deny as a former rater myself. I have a video on my channel where I talk about BDD claim. I think you are in the perfect position to maximize your benefits (still on active duty).
My claim was denied for a valid reason: I had no diagnosis. The denial letter said that. However, my medical records showed my many complaints about the issue. The denial letter also said, there was no evidence of complaints, treatments, or evaluation. Now, this I don't understand...I did complain...so why did they say I didn't?

Good info!! I had 2 exams for may back and osteophytes in my neck! The 1st exam was Feb 21st, and the examiner did a rush job! The second exam was on Feb the 27th, this Doctor took her time and actually did x rays, the 1st Doctor did not, the VA rated me off the 1st doctor, I hadn’t gotten the xrays yet from the second doctor! They also combined ddd and the osteophytes into 1! Any advice?

What I don't understand is the original title of my claim was for toxic exposure along with progressive aphasia/early onset ALZ. But DBQ is scheduled for Cranial Nerve? Why they did use my file that I am claiming for along with Nexus letter?

I guess this is part of the issue, every rater doing their own thing. there should be a step by step procedure for every rater to follow so they all do the same thing. it shouldn't be russian roulette for your claim to be rated. Same goes for the C&P process, that should only be used when you don't have a nexus and diagnosis from a doctor. seeing a C&P examiner when you have all the evidence already is just a way to block VA claims

Who actually fills out the DBQ-the Vet or Dr?
The doctor, if you look on the last pages. It asks for the doctors information.

Can a service member who joined the national guard in 1991 as a field artillery, went to basic training, attended 3 weekend drills, stopped going to training all together, no deployment, came back in 2004 to the national guard for 4 drills, and stopped going to training again, never attended other training, can the service member apply for VA disability and VA health care?
Yes, but till have to qualify and go through the process. Also, have to meet the criteria as it pertains to the VA's national guard regulations.

Question, I and many are noticing people that have claims, and have completed everything such as c&p all evidence supported etc. Are being stuck in Preparation for Decision for sometimes 2 - 6 plus months. Why would that be? Also, how much weight does a report from a licensed vocational expert hold for TDIU?

0% does not mean it is not service-connected; it just means that your symptoms do not meet the legal threshold for monetary compensation. Many conditions or injuries have a strict guideline that is not subjective, such as a joint with only X% range of motion gets a 10% rating but Y% range of motion qualifies for 20% rating.
I like your content and information. But the VA rating system needs to be overhauled based on such subjectivity. I think that AI should look at these DBQs for keywords that fit into a specific rating percentage. Then maybe an actual person can look it over. This would make the process faster.
As it pertains to the DBQs and the diagnostic code criteria, I've been saying that for years. Veterans have to understand that and look for that information.

No, but it's a ton of information. As I stated in the video, there were two people in my challenge training that took time and explained some things to me and put me on the right track.

It wasn't a daily quota, but had to meet a quota every pay period.

If my rhinitis was originally rated at 0% in 2013, will the Pact Act presumptive help me get an increase in rating?
Since exiting the service I have attempted to file for an increase due to the worsening of my condition and the side effects that follow. I have since been denied increase in 2015 and 2021.
Besides medical records from active duty, post duty VA clinic visits and personal insurance reports, I am not sure what else to provide. It simply has not been enough to try to explain the severity and the worsening of my condition. I have proof in my records of being in country and around burn pits prior to the initial reporting

The PACT Act in and of itself will not help get an increase for rhinitis. Please review the rating decision that granted the 0 percent. It will tell you the criteria that must be met for the next higher percentage. In the case of rhinitis, I believe one must have polyps. If one does not meet the requirements for the increased percentage, the claim for increase will be denied.
Hey Gunz Up, Go Bucs. No, you are already service connected. in the rating decision that granted it, it states why they gave the 0% and why they didn't give the 10% and lists that criteria. For the increase to the next %, what is the VA saying is required per the criteria.

Too much subjectivity however the laws are not subjective so at the end of the day you may have to appeal and do a Higher level review where they’ll have no choice but to look at the law and hope that does the trick. Normally the law prevails however sometimes it can be a long arduous road to get there.
Are there private contracted va raters that are not government employees?
I haven't heard the VA of hiring any RVSR contractors, at least while I was there.
Some of the C&P medical examiners are contractors, but I don’t believe they outsource raters.
How did you become a VA adjudicator?
They were hiring and I applied for the position.
