First of all, love your videos. Question...I filed a claim for bilateral flat feet. During c&p i was diagnosed with flatfoot as well as bilateral plantar fasciitis. Claim for flatfoot was deferred & then denied. I then filed a supplemental claim which was also denied. I opted for HLR wich discovered a DTA. Once the HLR closed a claim was then opened for planter fasciitis as well. Does that mean that VA will rate for them both if the claim is awarded? I never claimed plantar fasciitis but my records say i came in with flatfoot and have treatment service records. What is likely to happen here? So confused.
Hmm..I just did my first HLR, also about an incorrect effective date for an increase that was granted for my lumbar strain & radiculopathy that was finally granted after, imho, 4 substandard C&P exams that didn’t note all my symptoms and lied about my range of motion. I argued continuity of condition within one year of the initial claim citing that none of my medical evidence, or even my STR ever indicated different symptoms…lumbar strain with radiculopathy flares. The HLR advised that he cannot override medical opinions from the C&P exams because he’s not a medical person and denied my claim to go back an additional 5 months which was the original claim date for the effective date. Since I’m unable to HLR an HLR, should I do a supplemental and include the case laws governing known secondary conditions to primary conditions, as well as the 38 CFRs for continuity of conditions, which I think is 3.2500?
What we are witnessing is the financialization of America, that includes the VA. We have to look beyond the rhetoric, and look at what is being done. Actions speak, louder than words. When the actions become evident and they cut veterans compensation, then you will know that it will affect those that receive compensation. We need to prevent this before that happens. I’ve heard that Trump told Doug Collins to protect the veterans at all cost. What say you?
what is the best way to file a c&p exam\medical opinion as insufficient due to conflicting information? is it submitting a 4138 and asking the 1800 hotline to submit a ticket to the regional office? this is for a disability that went through the hlr process and is still being denied - rather not go the BVA route and waste years on appeal

I am reading the CBO is recomenting , I sent this to my 2 us senators and My us repesanitive I am 73 Vietnam Vet Totally and Permanently disabled solely due to service connected disabilities this CBO proposal is to cut me and disable veterans like me compensation by almost $2000 a month 👉🏼{{veterans age 67 or older who were already receiving IU payments would no longer receive them after the effective date of the option.}}👈🏼 I understand being in the minority means your power to effective combat the lunacy of this administration . but I hope you will support the Veterans , I am not able to go back to work to survive I am worried that the tRump administration is also trying to dismantle the VA with a Buy out and hiring freeze . December 12, 2024 Option from: Options for Reducing the Deficit: 2025 to 2034 Mandatory Spending Function 700 - Veterans' Benefits and Services End VA’s Individual Unemployability Payments to Disabled Veterans at the Full Retirement Age for Social Security CBO periodically issues a compendium of policy options (called Options for Reducing the Deficit) covering a broad range of issues, as well as separate reports that include options for changing federal tax and spending policies in particular areas. This option appears in one of those publications. The options are derived from many sources and reflect a range of possibilities. For each option, CBO presents an estimate of its effects on the budget but makes no recommendations. Inclusion or exclusion of any particular option does not imply an endorsement or rejection by CBO. This option would take effect in January 2026. IU = Individual Unemployability. The Department of Veterans Affairs (VA) provides disability compensation to veterans with medical conditions or injuries that were incurred or worsened during active-duty service. The amount of compensation depends on the severity of their disabilities (which are rated between zero and 100 percent) and other factors. In addition, VA may increase certain veterans' disability compensation to the 100 percent level even though the department has not rated their service-connected disabilities at that level. To receive the resulting supplemental compensation, termed Individual Unemployability (IU) payments, disabled veterans must apply for the benefit and meet two criteria. First, they generally must have a disability rating between 60 percent and 90 percent. Second, VA must determine that the veterans cannot maintain "substantial gainful employment" because of the severity of a service-connected disability. Receipt of IU is not based on age, voluntary withdrawal from work, or other factors. This option consists of two alternatives. Under the first, VA would stop making IU payments to veterans age 67 or older (the full retirement age for Social Security benefits for those born after 1959). That restriction would apply to both current and prospective recipients. When veterans reached age 67, all VA disability payments would revert to the amount associated with the rated disability level;👉🏼 veterans age 67 or older who were already receiving IU payments would no longer receive them👈🏼 after the effective date of the option. Under the second alternative, veterans who began receiving the IU supplement after December 2025 would no longer receive those payments once they reached age 67, and no new applicants age 67 or older would be eligible for IU benefits after that date. Veterans currently receiving IU payments who would reach age 67 or older after the effective date of the option would continue to collect the IU supplement. thank you

Im a 100 p&t with 50 sleep and 10 tinnutus they denied my headaches claim due to toxic exposure and Asbetos yet it was documented in my claim since 2021 now awaiting HLR decision
it took me 6 months to move to step 6 and then they moved my claim back to step 3 without providing any information as to why :( I filed it as a full claim so I wish they'd just tell me what more information they need.
I just hold my breath every time I look at it , hoping for the best!

Fire workers round up program recipients once in streets n devs detention camps where u give em good ole oven therapy nazsti style. Maybr ur oven time gets s lgbt or Mexican immigrant in there so your ashes get spicy ! This is what happens when nszisty takes over your government, security agencies , courts n media. If you work at one these places u can take job as detention camp jailer or head oven operator n still serve your veterans 🤪
As a 100% p&t vet, I have little trust in the VA. My last 2 major ortho surgeries (l shoulder and l total ankle replacement (9-2024) had to be done by Medicare because of the ineptitude of the VA. In fact, one of my VA providers told me that if I wanted better VA service, I needed to move to other larger areas? WTF…..

I'm a drafted, disabled, and 1968 Republic of Vietnam conbat vet. I've got so many V.A. horror stories it would make ya head spin. I've had some good V.A. care. I had a private primary care doctor for 10 years in the early 2000s. Best care ever and then the V.A. put me back at the new clinic. I was put in community care for dental during Trump 1. The V.A. did not pay the bill and the dentist cut me off. Hahaha. I have not seen a primary care doctor in person in 5 years. Just got an appointment for May. It sucks.

Dewayne if you have 100% P&T would it be wise for you to cancel deferred issues? I say that because I’ve heard veterans mention it but I do not agree. I don’t agree because if you put in for something and it hurts you and you need help with the issue get the help. Another point is if you cancel or say use the information( records) you have and I don’t want to risk losing P&T that to me looks like a red flag. Thoughts anyone?

I went to visit the VA in Tampa during covid. Line of about 10 Vets trying to get in, had to get asked the questions of do you have a fever, are you sick, etc. They had at least 25 employees outside shooting the shit and only 1 person actually working. Looked like a huge waste of money.

We waited 17 months on a claim for A and A SMC. Denied! My vets 2680 was used to deem him incompetent but that same clear unmistakable evidence was not used that clearly showed he needs aid and assistance from me, his spouse. Make it make sense?!? So now we have even more years to wait at the board.

Won my tinnitus claim with back pay back to April 2023. Navy plane captain on ground air traffic and then Aviation Electrician. I got 10%. The audiologist said she recommended 20% but I am not going to let that get me down. Going back to challenge the ones deferred and denied. I sent a message to Tampa Bay Counseling asking for help. I am staying in the fight Dewayne “I got a video for that” Kimble. BTW I had a lot of favorable information for things they denied and the VA admitted I had toxic exposures at NAS Cecil Field as a peacetime vet. I had attached EPA documents and public health studies to my claim. I am continuing to stay in the fight.

I’m currently working with my disability retirement package from the government! Now that they are getting rid of telework, I have no choice due to my disability in severe ptsd, high anxiety and depression! I’m unable to perform my daily duties around many people due to my disabilities! I’m at 80% VA Disability and also looking for 100% TDIU or even better 100% P&T.
Have you tried to do an RA for your position.

What you are saying about private dbqs and what VSRs do is completely wrong at the end of your video. Coming from an actively working VSR.
As a retired VA rater seeing how some not all VSR's requested exams and what they are doing now. How is it that when vets submits sufficient DBQ's, some still request exams when they don't have to per 38CFR 3.326 (b), the vet refused the exam, denied, filed an HLR and the DRO stated the veteran was right. The VA should be the 2507 exam request back in the hands of the RVSR, they know what they need from an exam standpoint to rate the case. I still know VSR's, so yes, it's true.

What are your thoughts for those of us who are already through the process and have our ratings? My wife and I are concerned that VA disability payments may end up on the radar at some point in time. Thank you!
There is nothing set in stone now about vets that has went through the process. Stay informed of what is going on and pay attention to what your representative is saying about veteran compensation, do they support it.
If my examiner states that there’s no diagnosis but there is a clear diagnosis in my Medical Records will my RVSR ignore the DBQ and exam findings? This is for a PACT claim for Sinusitis so all it should need is diagnosis.
I can't say what the RVSR will do that is assigned to your case. Hopefully they see there is a diagnosis and request an addendum to confirm and ensure the examiner saw the DX.
We all should be contacting our congressman's and senators unlike myself in Texas and many other veterans and retirees We don't have anyone to contact All they do is ignore us Ted Cruz, John Cornyn. All they do is pass the buck We should all military tied veterans whatever branch men and women who fought honestly and proudly for our nation and our country and the Constitution. Be respected and listen to We have to contact the Congressman's, And our Senators no matter what. Let our voices be heard Do not give up Do not stop the fight.
These actions are illegal under the Civil Service Reform Act of 1978. No Federal employee can be terminated for their political beliefs. Period. This is exactly what this is. DOGE is illegally accessing personal data to identify Trump loyalists in the ranks and get rid of everybody who won't kiss his ass. They then will hire new people, less qualified, trained and experienced whose only asset will be loyalty to their Leader. We have already seen this President and Administration acting illegally and unconstitutionally. You can't trust Trump. Don't take this offer.

I don't see those proposals making things better for either the VA employessor the veterans. I found it to be rare to find an advocate VSO or other employees regarding veteran benefits. And with the proposed changes, I can see more work with less people.How does this help or improves the VA? Could it be that those who appear to not meet the standard of excellence would be due to the fact they are dealing with a heavy work load? Why the offer to resign? So resigning means what? Does it mean that you know that you are terrible at your job so you might as well leave now? Why not encourage and support employees to stay with incentives and hiring. It would cost a lot more to replace employees than it would be to keep and train to the VA'S definition of excellence. In addition, this adminitration is talking about eliminating veteran benefits once they turn 67. At that point they would be receiving only benefits from social security (VA benefits are only earned through serving you country and social security benefits are benefits that you paid into and neither should be eliminated once reaching any age). That's an example how well they understand the programs they are seeking to change. Yeah, I don't see these changes for the bettet😮.
