Good video as usual Sir - Dewayne i filed for TBI rating specialist denied the claim but stated that the VA examiners diagnosed me with TBI i didn't wait for the CD from my fioa request i filed a HLR because i knew the exam went 💯 i knew that the rater didn't reference the examiner medical opinion because it was positive - HLR stated a different of opinion he comes the shocker Dewayne i got the CD a few days again The examiner wrote me a positive medical opinion and the DBQ to rate the claim here is the daming part the VA examiner requested a headache DBQ and a medical opinion for dizziness/Vergo the other VA examiner wrote me a positive medical opinion about Vergo/dizziness she did the DBQ for headaches but i was already 50 percent for headaches she did a new one again i had 4 positive exams and the original rater still denied the claim - This is crazy with my claims crazy things been happening to my claims since 2011-2024 - I can't believe the raters and examiners put there shenanigans on paper guess they know checks and balances really exists at the VA

Inquiring about this for us Desert Shield/Storm era vets that were in Saudi Arabia/Persian Gulf areas.

No it doesn't. If it doesn't say P&T. You have 1 or more disabilities that can be reevaluated. Get your C-file. Or maybe the 1-800 number can tell you.
It will not say P & T, it will say chapter 35, if you see this. You are good to go, if not, you have an RFE on one of your conditions. In that case, watch my videos on RFE's.
My CP examiner stated less than likely for tinnitus. Will the rater read my statement and look at my records being infantry for 5 years, award me tinnitus.

Mr. Kimble, correct me if I'm wrong. I thought you had a year after you got to file primary claims? If so, you received your Cpap machine after 2 months after getting out. You are well within that year window.
Hey Dewayne I'm working with this lawyer firm Woods and Woods that appealing my claims for conditions that were denied by an hearing officer for IBS and gastritis that I was hospitalized while in service and I been dealing with stomach pain every since leaving service. It's documented in my service medical records but still get denied what could be the reason for denial
You have to request a copy of the C & P exam as the examiner has to provide a rationale for the denial. The lawyer should have told you this and they can see the medical opinion in VBMS. If they didn't relay this to you, that is a serious problem. You can call your regional office and ask for it.

Current diagnosis in the VA hospital, they didn't bother looking at it. Instead responded by saying I did not submit a current diagnosis

Im curious why you say you don't get c&p exams. I got all my c&p exams my vso did it but I thought they give you exams no matter what
VSO's don't do exams. The VA will schedule a C & P exam if you meet the criteria.

Can the VA be so cruel. Got denied OSA. made so many complaints and issued a cpap machine in service. Got diagnosed 2 months after discharge.
