    I opened 2 Claims with the VA, they went and combined my claims. I argued that each claim are regulated by its own Code of Federal Regulations and all have separate DBQ's. By combining these, they are preventing Injuries from being properly evaluated. The trick VA is using is not to deny the claim but to simply closed the Claim and attach/combine evaluated symptoms into a Single Claim although they are evaluated differently.

    Hi, I have a question if you wouldn’t mind helping me with an answer. So here is my situation.
    I filed for an increase for my right hip stain in June 2024 and the c&p examination was done in the same month. I had a 10% rating for the hip. I recently got a mri done for the hip as directed by my va pem in September. I had an appointment with an orthopedic doctor about two weeks ago. The orthopedic doctor discovered labral tear and cam lesion in the hip. The doctor also noted ROM for the hip. All of these diagnoses are new. The c&p examiner didn't know about all this. After seeing the DBQ, the examiner stated I have full range of motion, which is completely false. I did tell the examiner that I could barely walk and lift any weight due to the pain and the discomfort in the hip but he only stated pain in the hip with full ROM. He did use that goniometer but he lied on the DBQ. Yesterday, I submitted the report by the orthopedic doctor with my personal statement. The attached is what the orthopedic doctor wrote. My question is when the rater sees all this, will he go with the c&p examiner dog or the recent report by the orthopedic doctor? With my current condition, I think I should get at least a 30% rating for the hip. What are your thoughts? If the rater goes with the report by the orthopedic doctor, I should get at least 30% rating. I would be so thankful for your help. This is really stressing me outs

      What is the criteria for the next percentage for your hip and do you meet the criteria. The rater should go off the ROM that is provided. I can't say which examiner that rater would use. When I rated, I used the ROM that gave the vet the highest percentage. Hello,
    how much of a percentage are military working dog bites that scared my forearms, triceps, and stomach? I tried to look into it and there's not that much guidance on that subject, Thank you!

    I was told that you are not allowed to get a private dbq done for TBI.

    • @DewayneKimble
      @DewayneKimble  9 дней назад +1

      They have to be done by certain people and the VA provides the criteria in the M21-1. Do you want to be educated on the VA claims process, connect with us at www.kmd89.com "Don't Be Frustrated, Get Educated"

    I’m currently at 80 percent service connected for ptsd. I was abused by another service member and was often hit in the head. I now have mild memory loss. My VA records state the abuse but would this be a claim worth opening?

    Mr. Kimbal I have a serious question for you. I am rated at 90% with UI. On my rating sheet there are 8 conditions that I was given ratings on. One was for a TBI, second was PTSD, three tinnitus / hearing loss. Those are what put me at 90%. The others were all rated at zero. Is it in my best interest to file for re-rating to get that 100% or should I not worry about it, considering that I am paid at 100% already?

    • @DewayneKimble
      @DewayneKimble  2 дня назад +1

      Good question, and if you do that would be up to you. If you never go back to work and will never make more than the poverty level, what would be the reason. You will have to look at your situation and make that decision. If you do, just know what you are doing. What about reverse PTSD, TBI is secondary?

    • @DewayneKimble
      @DewayneKimble  13 дней назад +2

      An examiner would have to figure out how the TBI is secondary to PTSD.
