Mr Kimble, does your age make a difference when you file for an increase after age 55? I filed a claim for increase back in April and I'm 61 yrs old with 3 static disabilities that have been in place for 10+ yrs....can they still reduce me
My increase claim was for skin cancer but I currently have 70% mental health rating that I don't want reduced. I was wondering if they could reduce me for something I didn't even file a claim for and with only one exam? Seems to me that by me being over 60 with 10+ yrs of current rating with static codes I would have some level of protection?

I’m 90% and unemployable. I hired an attorney for my appeal. One item rated at 10% is my injury (Desert Storm) that doesn’t allow me to stand long, then my severe PTSD kicks in.

hello Brian im 60 now and was discharged from the Navy in 1984 one year and 5 months of active duty was in the beirut-Lebanon conflict/campaign, was denied any VA medical help in Miami, they said I didn't qualified, I was discharged under Admin separation for bed wetting onboard ship, harrased and humiliated by superiors and shipmates, this has led me into severe anxiety and depression, no job and hard on relationships, I now discovered that I am entitled to compensation, the Navy discharged me and that ended my career and well a lot of trauma because of this, even under honorable discharge my life never was the same, I have a family wife and daughter which I don't have any income except a few that send us help every month $400 which is stress and anxiety as well. i am filing a claim through the VA hopefully I can be approved to survive for the good of my family

Good information. I retired in 1999 at 30%. I then went from 50%, 70%, 80%, and 90%. I am currently working on getting my sleep apnea reevaluated. I was rated at 20% for diabetes in1999. I was taking one pill daily. It went to two pills daily. I was then prescribed one insulin shot daily, then two shots, then three shots daily. I have been taking 5 shots daily since 2013. I am putting an increase in rating with the insulin increase. Your video gives me confidence in my proceedings. Thanks.

sorry to hear about your kidney cancer, I also somhad a major surgery for Kidney Cancer, but I was on Ft Dix Nj for basic training, sp drinking wells was way over the epa allowed amount due to PFAS leached into the groundwater from the joint Air force base fire fighting foam, the gov knew of this cancer risk in the 70's and I was there in 1985 they didnt start trying to due anything about it until the following years, my cancer was clear cell no treatment other than surgery to remove a large part of the back of my right kidney, a 4.5 hr robotic surgery, it dont respond to chemo n now I'm being monitored for 5 yrs post surgery, Im not service connected for it, Its not a presumptive illness for that base, but imagine how many soldiers went to basic training there, its going to be a big health care prroblem once veterans start realising their cancer most likely came from there more likely than not, today its still a epa superfund clean up site, I wonder if a study has been done to try to determine how many soldiers that went thru there potentially got cancer or died from cancer connected to that base ft Dix new jersey, I pray for all of them, just part of my sacrifice is how I look at it. no I never filed for service connection
My DOS from the military was in Nov. 1976. For more than 40 years I avoided anything to do with the military as a result of my military experience. In 2019 at the age 66 I was experiencing some medical issues of a physical nature. I reluctantly went to the VA because I had no other options. This led to mental health evaluations and an initial diagnosis of anxiety and general stress disorder, This was later changed to PTSD. I fined a comp claim (something I had previously was not aware was even possible). The decision came back with a combined rating of 60 percent (I also have service related hearing loss and tinnitus). In 2020 an appeal was submitted. This resulted in a increase to 80% (combined). In 2021 a TDIU claim was granted which resulted in a 100% rating. In the decision letter it states my disabilities are permanent. I do not recall anything about not likely to improve being stated. At the time of my initial decision I was 66 years of age. My age at the time of the increase to 80 percent was 67 years of age. And I was age 68 when the TDIU brought me up to the 100 percent rating. Here's my question: In you opinion what, if any chance, is there I'd be looking at some kind of review in the future? I'd be at the very least 72 years old, possibly 73 before the 5 year rule could come into play. Although I have to say the severity of my symptoms are usually less crippling in terms of being able to work my way through them, it can still takes days to return to a more neutral state, as opposed to weeks, months, and even years. Yeah, I've had episodes that put me on a whole different planet that lasted for years in the past. For me, my PTSD is somewhat a life sentence. Some days are good. Sometimes weeks are good. But the things I lived with for over 40 years are deeply rooted and well reinforced. In short, they are like my children They ain't ever going away. They, both my children and my 'issues' will be a part of me for the rest of my life. So, what do you think? I would very much like to here what you, and even others have to say.

I believe that you are in a safe place if your VA award letter says, no further examination are scheduled in the future. Got tdiu 5 years ago at the age of 66 haven't heard the from the VA my VA award letter States no further examination. wish you the best.

I contacted my Senator Ted Cruz when my BVA Case had been sitting with no changes in status for almost five years. About a month after I contacted Ted, my case was decided in my favor. Coincidence? Perhaps. Perhaps not.

My advice to veterans from my experience, get examinations from independent private doctors. The VA contracted doctors that I had to see, pencil-whipped the examination. And the VA routinely violates their own rules.

A. and the outcome was totally different from the outside source,, but it was the same person that did my EMG and the diagnosis was totally different than it was from the Veterans Administration, I questioned the person on how it changed, and if I should be talking to a Lawyer, because the exact same exam was diagnosed for the Veterans Administration that there was absolutely nothing wrong with me, but the exam that was done for an outside Doctor was diagnosed that I had permanent nerve damage.... He never answered my question and he couldn't get out of the room fast enough, he costs me my disability, I never pursued it, but next time I will get a Lawyer

Thank You Dewayne, I am 73 Vietnam Veteran, I am 30% disabled but have a docket still in Washington a helicopter crash with my back injury continued to get worse over the years I applied with documentation including pictures and the 85 EVAC report. I continue to wait for a judge to review it. I just believe it takes this long.
72-year old USAF Vietnam Veteran. Total & Permanent IU since 2007 for Bipolar Disorder and Anxiety Disorder NOS. It only took me from my hospitalization on Christmas Day in 1971 in Thailand until 2007 to get the benefits I had earned. I was TDIU in 2004, raised to P&T IU in 2007. Work your claim honestly and earnestly and you too may become a member of the Hundo Club.

Hey Dewayne, I was diagnosed and given a CPAP for sleep apnea in 2013. I hired a lawyer a year ago to get it service connected, which they said it should be. BUT they said it can only go back to a year ago because that's when we filed the initial claim for OSA in 2024. So... why does it not go back to when they diagnosed me, I don't get it?

Bless Up! I'm 100% unemployable P&T (partial paraplegic). I need a modified minivan. Normally the VA will pay 1/2 for the van, but was denied because I am unemployable. They said that I can buy it on my own and that they will modify it. How do I get them to help purchase the van?
All that evidence would have to be reviewed. I never heard of them stating in a denying rating your claim for auto allowance is denied because you can pay for it yourself. Check out VA Form 21-4502 - Application for Automobile or other conveyance and adaptive equipment form and VA Form 21-4502

I am 82 just got 100 % heart plus lung cancer+ ptsd it adds up to over 200% but it does not say P&T. I also have 8 dd214s and am missing 18 months of service but the total is correct. It could be several times we were on classified missions one was the Bay of Pigs and several off Vietnam. Should I be worried that it doesn't say P&T? 🙏 Thanks Harvey

Do you know the success percentages on a Migraine supplemental appeal?? I did the supplemental and included much more evidence, like migraine logs, 2 more Nexus letters and Prescriptions. Got 70 %rating for knees, dysthymia and a few other things. I injured my back while in, a disc at L5- S1. It healed eventually. At 62 I'm having alot of back problems now. Everybody pushes me to get re- evaluated. I have other health issues as well. I have no faith that my rating would be pushed to 100.
I was discharged in 1981, injured in 1979. No medical files, and since 1992 been trying to get assistance. Every time I filed was told I made too much money. Until the PACT Act, I couldn’t even get seen by the VA. Thank you for these videos. Presently I’ve noticed my records said my neuropathy was caused by Agent Orange exposure, but have already been told I don’t qualify as no boots on ground. My neuropathy is from my injury in 1979. Now age 75, I continue with more PnC evals. I was just notified by VES another is coming. Likely records review only. I have had numerous heart evals this past year. Maybe 5 or 6. I have zero recourse.

I'm 73, been on 100% for 6 years. Had to appeal because they tried to cut benefits after year and a half but I have stage 4 prostate cancer and it's active. The adjudicator I talked with said keeping me at 100% no follow up and that was over 2 years ago. I still got a form letter that said they would reexamine me in 6 months but never heard from them. Not sure how much longer I will live but if they do want to reexamine me I have lots of medical records showing where cancer has metastized to bone and lung. I should be ok I think

I am planning on filing another claim and keep hearing conflicting information regarding the review of older claims by the VA even if it does not relate to the new claim filed. Does the VA review older claims if they don't relate to the new claim? I understand if the VA reviewed a prior claim if it is connected to a new secondary claim.

How do I request a claims folder? I am at 80% and now have Arterial Flutter and seeing a Cardiologist at University of Colorado Hospital. He said that my triangle of SC Diabetes, hypertension or SC obstructive Sleep Apnea most likely caused the arterial flutter. I now have early on set cataract that my eye doctor at UC health attributes to my type 2 diabetes I am about to open new claims and I guess need the claims folder

I don't collect medical disability benefits, and since the 'Shut-down', I don't even receive even an annual phone call, blood testing, or anything other than Meds prescribed! All the budgeted funds must be going to their promotions and bonuses!
I'm 71 years old discharged in 1975 with 10% for hearing loss which was raised to 70% in 2017 because nothing else could be done for me. However I have Meniere's Syndrome, Tinnitus, Migraine headaches and anxiety and Depression which I'm being treated for by private medical insurance. I do not know how or have anyone to help me file these claims with the VA. All I get is the run around. So I have contacted my federal Senator because I do not have the money for a lawyer.

Im 63 years old 100 % P/T for PTSD but got into trouble with the family court by calling my ex a liar, which violated a peaceful contact order. As a result i was required to participate in an anger management course through the VA. Ive been listed as P/T for over 5 years +. The VA required that I take a psyche evaluation prior to attending their anger management course which I fought out of fear that the new psyche eval might determine that I was no longer 100%. Can the VA use that psyche eval to reduce my rating? Or initiate a new review?

I am 66 years old. Active service time August 1974 - September1994 USAF. When I retired my VA retirement physical was nearly a year after I retired. It took another 5 plus years to get 10%. Kept fighting and in 2019 I got an additional 10% working Vet Guardian. Sleep apnea not listed while I was active because I didn't know about it until around 8 years after retirement. That's when my civilian doctor had me take a sleep study which resulted in my first CPAP machine. I told V.G., of sleep apnea and V.G. told me that sleep apnea could not be claimed because it was not listed in my records. There are several other items that they told me nothing else applies. Frankly, it seems useless to keep fighting at this point. Any comments would be greatly appreciated.
I got 50% for Sleep Apnea after over six years of fighting. I won because the diagnosis literally did not exist when I was on active duty. I got the award via nexus letters and buddy statements. It can be done.
I was getting 30% disability for a scar on my face and I was drawing this for over 5 years I’m 63 years of age and now they I’m not authorized that do to the VA not being able to find the documentation. What can I do now that they took it away.? They said it no longer meet the requirements.
If you have copy of everything they (the VBA) looked at, you can determine if that is correct. Have you submitted the FOIA request to the VBA to get a copy of everything and review to see if you meet the criteria for service connection for the scar.
So I’m turning 75 this month and requesting an increase. Currently 40% back (S1-L3 Fused) and 20% for each leg (radiculopathy) for a total of 60% due to funny VA math.I have an EMG that shows mild to severe neuropathy in both legs and Severe Radiculopathy in both legs. Plus neck issues related to the lower back injury. I’m being scheduled for a C&P hopefully within the next 20 days. I’m guessing my situation is outside of the rules not to get one?

Great info and thank u. I have 2 questions concerning my disabilities....I am 58 and a 70% disabled veteran. I served in the Army. I have 2 conditions that should be considered "static". My right ankle(chronic arthritis @ 20%)and my lower back( osteoarthritis @10%). What is the highest rating for each conditions? How would you explain medically that 1 condition affects the other?
Have you requested a disability breakdown letter which shows the diagnostic code for each service connected condition and wen to the VAs rating schedule to see the highest percentage. 800-827-1000 is where you can request the letter and they can email it to you.
How do I get a copy of my rating file? I have service connection rate of 20% & need to get this increased. My disability is Lumbar Spine L5-S1. My hips are severely damaged due to walking differently because of back pain. I don’t know how to do anything at this point.

hello Brian im 60 now and was discharged from the Navy in 1984 one year and 5 months of active duty was in the beirut-Lebanon conflict/campaign, was denied any VA medical help in Miami, they said I didn't qualified, I was discharged under Admin separation for bed wetting onboard ship, harrased and humiliated by superiors and shipmates, this has led me into severe anxiety and depression, no job and hard on relationships, I now discovered that I am entitled to compensation, the Navy discharged me and that ended my career and well a lot of trauma because of this, even under honorable discharge my life never was the same, I have a family wife and daughter which I don't have any income except a few that send us help every month $400 which is stress and anxiety as well. i am filing a claim through the VA hopefully I can be approved to survive for the good of my family

Good information. I retired in 1999 at 30%. I then went from 50%, 70%, 80%, and 90%. I am currently working on getting my sleep apnea reevaluated. I was rated at 20% for diabetes in1999. I was taking one pill daily. It went to two pills daily. I was then prescribed one insulin shot daily, then two shots, then three shots daily. I have been taking 5 shots daily since 2013. I am putting an increase in rating with the insulin increase. Your video gives me confidence in my proceedings. Thanks.

sorry to hear about your kidney cancer, I also somhad a major surgery for Kidney Cancer, but I was on Ft Dix Nj for basic training, sp drinking wells was way over the epa allowed amount due to PFAS leached into the groundwater from the joint Air force base fire fighting foam, the gov knew of this cancer risk in the 70's and I was there in 1985 they didnt start trying to due anything about it until the following years, my cancer was clear cell no treatment other than surgery to remove a large part of the back of my right kidney, a 4.5 hr robotic surgery, it dont respond to chemo n now I'm being monitored for 5 yrs post surgery, Im not service connected for it, Its not a presumptive illness for that base, but imagine how many soldiers went to basic training there, its going to be a big health care prroblem once veterans start realising their cancer most likely came from there more likely than not, today its still a epa superfund clean up site, I wonder if a study has been done to try to determine how many soldiers that went thru there potentially got cancer or died from cancer connected to that base ft Dix new jersey, I pray for all of them, just part of my sacrifice is how I look at it. no I never filed for service connection

My DOS from the military was in Nov. 1976. For more than 40 years I avoided anything to do with the military as a result of my military experience. In 2019 at the age 66 I was experiencing some medical issues of a physical nature. I reluctantly went to the VA because I had no other options. This led to mental health evaluations and an initial diagnosis of anxiety and general stress disorder, This was later changed to PTSD. I fined a comp claim (something I had previously was not aware was even possible). The decision came back with a combined rating of 60 percent (I also have service related hearing loss and tinnitus). In 2020 an appeal was submitted. This resulted in a increase to 80% (combined). In 2021 a TDIU claim was granted which resulted in a 100% rating. In the decision letter it states my disabilities are permanent. I do not recall anything about not likely to improve being stated. At the time of my initial decision I was 66 years of age. My age at the time of the increase to 80 percent was 67 years of age. And I was age 68 when the TDIU brought me up to the 100 percent rating.
Here's my question: In you opinion what, if any chance, is there I'd be looking at some kind of review in the future? I'd be at the very least 72 years old, possibly 73 before the 5 year rule could come into play.
Although I have to say the severity of my symptoms are usually less crippling in terms of being able to work my way through them, it can still takes days to return to a more neutral state, as opposed to weeks, months, and even years. Yeah, I've had episodes that put me on a whole different planet that lasted for years in the past. For me, my PTSD is somewhat a life sentence. Some days are good. Sometimes weeks are good. But the things I lived with for over 40 years are deeply rooted and well reinforced. In short, they are like my children They ain't ever going away. They, both my children and my 'issues' will be a part of me for the rest of my life.
So, what do you think? I would very much like to here what you, and even others have to say.

I contacted my Senator Ted Cruz when my BVA Case had been sitting with no changes in status for almost five years. About a month after I contacted Ted, my case was decided in my favor.
Coincidence? Perhaps. Perhaps not.

My advice to veterans from my experience, get examinations from independent private doctors. The VA contracted doctors that I had to see, pencil-whipped the examination. And the VA routinely violates their own rules.

A. and the outcome was totally different from the outside source,, but it was the same person that did my EMG and the diagnosis was totally different than it was from the Veterans Administration, I questioned the person on how it changed, and if I should be talking to a Lawyer, because the exact same exam was diagnosed for the Veterans Administration that there was absolutely nothing wrong with me, but the exam that was done for an outside Doctor was diagnosed that I had permanent nerve damage.... He never answered my question and he couldn't get out of the room fast enough, he costs me my disability, I never pursued it, but next time I will get a Lawyer

Thank You Dewayne, I am 73 Vietnam Veteran, I am 30% disabled but have a docket still in Washington a helicopter crash with my back injury continued to get worse over the years I applied with documentation including pictures and the 85 EVAC report. I continue to wait for a judge to review it. I just believe it takes this long.

72-year old USAF Vietnam Veteran. Total & Permanent IU since 2007 for Bipolar Disorder and Anxiety Disorder NOS. It only took me from my hospitalization on Christmas Day in 1971 in Thailand until 2007 to get the benefits I had earned. I was TDIU in 2004, raised to P&T IU in 2007. Work your claim honestly and earnestly and you too may become a member of the Hundo Club.

Hey Dewayne, I was diagnosed and given a CPAP for sleep apnea in 2013. I hired a lawyer a year ago to get it service connected, which they said it should be. BUT they said it can only go back to a year ago because that's when we filed the initial claim for OSA in 2024. So... why does it not go back to when they diagnosed me, I don't get it?

I'm 100% unemployable P&T (partial paraplegic).
I need a modified minivan. Normally the VA will pay 1/2 for the van, but was denied because I am unemployable.
They said that I can buy it on my own and that they will modify it. How do I get them to help purchase the van?
All that evidence would have to be reviewed. I never heard of them stating in a denying rating your claim for auto allowance is denied because you can pay for it yourself. Check out VA Form 21-4502 - Application for Automobile or other conveyance and adaptive equipment form and VA Form 21-4502

I am 82 just got 100 % heart plus lung cancer+ ptsd it adds up to over 200% but it does not say P&T. I also have 8 dd214s and am missing 18 months of service but the total is correct.
It could be several times we were on classified missions one was the Bay of Pigs and several off Vietnam.
Should I be worried that it doesn't say P&T?

Same here, but two days later, and to be honest, I shouldn't even be here right now, but you snooze, you lose.
Got 70 %rating for knees, dysthymia and a few other things. I injured my back while in, a disc at L5- S1. It healed eventually. At 62 I'm having alot of back problems now. Everybody pushes me to get re- evaluated. I have other health issues as well. I have no faith that my rating would be pushed to 100.
Do you know the criteria for the increase and do me meet the criteria.

I'm 73, been on 100% for 6 years. Had to appeal because they tried to cut benefits after year and a half but I have stage 4 prostate cancer and it's active. The adjudicator I talked with said keeping me at 100% no follow up and that was over 2 years ago. I still got a form letter that said they would reexamine me in 6 months but never heard from them. Not sure how much longer I will live but if they do want to reexamine me I have lots of medical records showing where cancer has metastized to bone and lung. I should be ok I think
If it's active, it will stay at 100 percent. If it's terminal, there should be no re-evaluations.

Does the VA review older claims if they don't relate to the new claim? I understand if the VA reviewed a prior claim if it is connected to a new secondary claim.

Hey Sgt.! I have a question about filing claims. This a topic that must be addressed. Some veterans like myself wait 5 to 10 sometime 20yrs after they leave the service how are those veterans claims and age play in the ratings process. I was 57 when I filed my first claim form.
There is no regulation on a veterans age and when they can file a claim.
My son got 100% va and at the time of death his wife was living in a different state I his mother was his dependent how do I claim to continue to get my claim benefits from his VA ? Please help me because wife is not helping at all

How do I request a claims folder? I am at 80% and now have Arterial Flutter and seeing a Cardiologist at University of Colorado Hospital. He said that my triangle of SC Diabetes, hypertension or SC obstructive Sleep Apnea most likely caused the arterial flutter. I now have early on set cataract that my eye doctor at UC health attributes to my type 2 diabetes

I am 66 years old with heart disease, COPD, PTSD, diabetes, etc. I've been diagnosed as permanently disabled via the Social Security Administration since 1993. What is the likelihood that my application can be approved and then the possibility that I will be re-evaluated as time passes? We'd d appreciate any response given. I don't collect medical disability benefits, and since the 'Shut-down', I don't even receive even an annual phone call, blood testing, or anything other than Meds prescribed!

I'm 71 years old discharged in 1975 with 10% for hearing loss which was raised to 70% in 2017 because nothing else could be done for me. However I have Meniere's Syndrome, Tinnitus, Migraine headaches and anxiety and Depression which I'm being treated for by private medical insurance. I do not know how or have anyone to help me file these claims with the VA. All I get is the run around. So I have contacted my federal Senator because I do not have the money for a lawyer.

For TDIU. There is no limit on income for compensation but TDIU has income levels (the poverty level).

Can you be an ihss provider for a family member if your already receiving your 100% for unimployability
That is on the VHA side, raters have no bearing on that.
Im 63 years old 100 % P/T for PTSD but got into trouble with the family court by calling my ex a liar, which violated a peaceful contact order. As a result i was required to participate in an anger management course through the VA. Ive been listed as P/T for over 5 years +.
The VA required that I take a psyche evaluation prior to attending their anger management course which I fought out of fear that the new psyche eval might determine that I was no longer 100%.
Can the VA use that psyche eval to reduce my rating? Or initiate a new review?

I am 66 years old. Active service time August 1974 - September1994 USAF. When I retired my VA retirement physical was nearly a year after I retired. It took another 5 plus years to get 10%. Kept fighting and in 2019 I got an additional 10% working Vet Guardian. Sleep apnea not listed while I was active because I didn't know about it until around 8 years after retirement. That's when my civilian doctor had me take a sleep study which resulted in my first CPAP machine. I told V.G., of sleep apnea and V.G. told me that sleep apnea could not be claimed because it was not listed in my records.
There are several other items that they told me nothing else applies.
Frankly, it seems useless to keep fighting at this point.
Any comments would be greatly appreciated.

I got 50% for Sleep Apnea after over six years of fighting. I won because the diagnosis literally did not exist when I was on active duty. I got the award via nexus letters and buddy statements. It can be done.
I'm a veteran disabled P&T. I'm 58 and my VA doctor keeps scheduling me for annual exams. Do I need to keep going or can I opt out
They are FREE but it would be up to you if you wanted to keep going.

I was getting 30% disability for a scar on my face and I was drawing this for over 5 years I’m 63 years of age and now they I’m not authorized that do to the VA not being able to find the documentation. What can I do now that they took it away.? They said it no longer meet the requirements.
If you have copy of everything they (the VBA) looked at, you can determine if that is correct. Have you submitted the FOIA request to the VBA to get a copy of everything and review to see if you meet the criteria for service connection for the scar.
So I’m turning 75 this month and requesting an increase. Currently 40% back (S1-L3 Fused) and 20% for each leg (radiculopathy) for a total of 60% due to funny VA math.I have an EMG that shows mild to severe neuropathy in both legs and Severe Radiculopathy in both legs. Plus neck issues related to the lower back injury. I’m being scheduled for a C&P hopefully within the next 20 days. I’m guessing my situation is outside of the rules not to get one?

Great info and thank u. I have 2 questions concerning my disabilities....I am 58 and a 70% disabled veteran. I served in the Army. I have 2 conditions that should be considered "static". My right ankle(chronic arthritis @ 20%)and my lower back( osteoarthritis @10%). What is the highest rating for each conditions? How would you explain medically that 1 condition affects the other?
Have you requested a disability breakdown letter which shows the diagnostic code for each service connected condition and wen to the VAs rating schedule to see the highest percentage. 800-827-1000 is where you can request the letter and they can email it to you.
