How many alternates did you have? When I was on Jury duty for a month, there were only a few alternates and we could easily have run out if people had started to just not show up. The length of the jail time seems excessive to me, but they likely wouldn't have held him in contempt of court had he called in and let them know that he overslept. Failing to inform them when he knew is really what the contempt was over in this case, not that he overslept as people keep claiming. That alone should speak on the man's behalf as credibility that he is not a careless or problematic citizen. All I'm seeing here is that this judge wanted to give this man a criminal record as opposed to a misdemeanor contempt of court. No the young man said it all, this is to show others that jury duty isn't stupid, he's just didn't give a damned if he showed up or not, I have experience with this generation of people they are lazy and not willing to work hard, they are passing up good paying union job's with starting salaries of 50k plus because they don't want to start at 5 am
The judge should've removed the probation.
I disagree. The original sentence was excessive, but the reduced one feels appropriate. Especially since he now has an option allowing it to be expunged from his record.
Remember, the court system is extremely backed up. Having jurors not only fail to show up, but fail to even notify the court that they'll be late or absent costs both time and taxpayer money in a system that is strapped for both.
They have backup jurors. 3 months probation can quickly be turned into lifetime probation. Hope he got a good probation officer and not one that messes with people on probation.
Complete bull sh**! Screw this system! Jury duty is stupid!
Yeah jury duty is a “civic duty”, but harsh treatment for a 1st timers mess up is totally uncalled for. I feel like most older judges have no chill at all.
So is voting but for one the government is more than happy when we skip it, and the other it's as if we tried to kill someone. The jail time and community service at least has a justification but the year of probation is just a waste of taxpayer money and doesn't make sense at all.
I got my first jury duty papers about 6 months. In bold capital letters it states that if you fail to show up or don't present a valid excuse for absence you will suffer severe consequences. I mean if you don't get the message that this is pretty serious you deserve what ever consequences are brought to you. 1st timers mess up... wtf so if i kill someone for the first time i should get a reduced sentence?
Neil Smith missing jury duty and murder are two completely different ballparks my dude lol. So you’re reasoning is a little flawed. Murder is obviously murder. Tis a bad thing. But a young person who messes up their first jury duty shouldn’t have a permanent criminal record, especially if they’ve had no previous criminal history. I’m not saying they should be set free with no consequences, maybe just community service and or a fine to teach them a lesson. But these two plus 10 days in jail and one year probation is way too exaggerated.
@@ORO323 let me repeat what i said in my first comment because you conveniently ignored it. I received the paper for jury duty recently and it stated in BOLD CAPITAL letters that if you fail to show up or do not provide a valid excuse for absence there will be serve consequences. WAIT so he received severe consequences after blowing it off and ignoring the warning. HOLY SHIT the system is so flawed
@@ORO323 well the probation got reduced but why does he need to be on probation for missing jury duty ? Seems kind of racially motivated imo I understand the fine and community service but the jail time on top of the probation is overkill

That judge is a jerk.

Maybe it’s time to pay a “living wage” for jury duty instead of 10cents an hour.
Just saying
Exactly!!!
Right. Jury duty does not pay enough to be wasting time to sit for hours because of someone else mistake he could of been at work making his money working
Never going to happen.
And financial hardship is not considered a valid excuse. Bankruptcy, being the only income, losing one's home or apartment, all not valid excuses.
But these do ensure that jurors reach to fastest decision even I'd it is not the JUST decision.

Maybe don't force people against their will, you know freedom. Maybe a hard concept to grasp.
I can see maybe community service for a few days but this is ridiculous. How is this fair?
Fair is a place you judge pigs when you are a person of color...
If you think the system cares about fairness you have a LOT to learn. Especially when it comes to sentencing people of color. It is well documented that they receive longer sentences for the same crimes as european americans.
@G O wtf are even the words coming out of your mouth? lmao

Malkiel Ysrael I mean, what would you expect them to do. It’s a civic duty, at least notify the court or something. He completely ghosted them. 45 minutes wasted.

@@XxShikuMikuxX Civic duty my ass..To a system that steaks from people and play God 🤣🤣😭
@@VIPK9 It's all on the judge. If he/she wanted to pursue it...they could legally. Usually if 1 or 2 don't show...they don't worry about it. But if they ask for 50 people to show up and only 30 do....expect to hear about your absence down the road. They won't come looking for you. They'll just wait for you to get a traffic violation to inform you on your missed jury duty and give you a new court date...but not for jury duty. Most judges work with you if you have a decent enough reason. Don't lie though...because sometimes they ask for proof of your excuse.
@@VIPK9 Oh and also this guy already agreed to be apart of the jury. When he didn't show....it delays trial and wastes a bunch of peoples time and money. You don't ever want to cost the state any money....that's what judges are for mostly. To get the state some sort of extra income. Justice isn't justice anymore.... at least not like it was meant to be back in the day.
So it's okay to cause him to lose his job. The judge was laughing about putting the brother through hell to show his power. I know he's not the first to miss an appearance.
He was sworn in as a juror. You can argue that you're unfit to serve in a jury because missing work will cause you severe financial problems and the judge will exempt you. But you do that during jury selection. Once you don't give any reasons for which you may not serve in a jury and you're sworn in then there's no turning back. You are bound by law to show up to trial or provide a reasonable excuse for not doing so.
As for why he got the sentence, he simply went to work after missing his alarm as if nothing happened, instead of alerting anyone of his circumstances. That's paramount to evading his jury duty, which carries penalties that go way beyond a week or two in jail.
Yeah he didn't really slap him that hard. For 10 days he'll play cards and do some pushups. That little stretch will actually help him reflect, and I dont mean about his case, but about everything. So honestly, by comparing himself to some of the ppl he'll meet, he'll come out as a better guy. I wish him the best

Honestly, being a judge is logistically a pointless profession. He may be “respected”. But honestly he’s a waste of space. Just like all other judges. You sit there and listen to the jurors who don’t actually want to be there. They literally have no meaning in this life.
Disgusting judge. Fire him immediately. A warning would've been in order or maybe a ticket. But thats it.

Not YET.
I have been on jury duty and this is uncalled for, that is why you have alternates.
I'm sure this judge has multiple people every year that don't show up due to oversleeping and other things that are only partially in their control and this is the one that's making the news.
What a joke!!! Yet we have an off duty police officer in a crowded Costco in Corona, California shoot up an entire unarmed family - empties his whole clip on them - 4 shots in their backs - 6 total shots go into them - their 32 year old mentally disabled man dies and both parents are critically injured with bullet wounds of their own and the shooter Salvador Sanchez of LAPD gets away with literal murder and 2 attempted murders - all over what you ask? An apparent push or shove that we have all experienced in a crowded Costco

@Connor G I once spent an entire month on jury duty. He screwed up by not just oversleeping, but by failing to inform the court that he had overslept.
@Jerry Ogburn You clearly don't understand the system. The jurors are there primarily to weigh the evidence and to decide whether or not the prosecutor/plaintiff has made its case. They are given all the necessary law they need to render a verdict. If they think there's more they need, they can and do send notes to the judge with requests for clarifications about their instructions.
Also, do you have a better method? Jury duty has issues in terms of fairness, but there aren't any real options that are any better.
