      @Shyen Blackson he's a soldier, they make mistakes and learn unlike most. That's the military training for ya. Only sad thing is that guy is suffering through something only he can feel and lost his troops and gained claustrophobia from that sinking vehicle. Such a nice judge for visiting him and releasing his stress and anxiety in that cell. 2 great people in one video

      BitterVoid sooooo what happens if he’s “deemed competent and kills again? Is that an “oops...looks like he needed more time on the farm”. “Let’s put him back to work and we’ll evaluate him in 3 more months” type of situation? (Because surly 3 he’d be good to go after 3 months).
      I mean c’mon. This is ridiculous.
      How many times should these officials let him reenter society?...
      Or should I say, how many killing opportunities would be handed to him before realizing he needs more than a farm, some manual labor and mental evaluations every 3 months??
      I do agree that the justice system is terrible. Especially for those who really need help and it’s a huuuuge waste of our tax dollars.
      Which is why I believe in something we don’t use enough....it’s called the death penalty. If someone murders/rapes a child; he needs to go ASAP.
      None of this feeding him 3 means a day for the next 10 years beforehand. It needs to be done immediately.
      Even better, “an eye for an eye”. I’m sure people would think twice about killing someone if they knew their fate would be met by being killed in the same fashion. Some need help. But their are a LOT of monsters out there. Monsters who shouldn’t be allowed to breathe the same air as us.

      Actually, the judge gave BOTH jail -to hold him accountable--and compassion to get him through it. Being too lenient has caused many criminals to continue on their path of destruction. People need to be held accountable in a fair manner, too harsh a sentence for some will make them feel like a victim and not take responsibility for what they have done. Too light a sentence and they think what they did wrong is no big deal, they will do it again.
      This is a wonderful story and this judge cared about the outcome for this former green beret.

      All alcoholic have a past to make them fall in alcoholism and is hard to get out. Even if he did not have a good reason for falling he needs help. Victims of dui drivers don’t feel the same.

    This is so sad, I can literally see the pain in that soldiers eyes. The things he's experienced, and the things he's seen. There are many Veterans like him, I pray for them 🙏.

      You act like veterans go through a lot! Their lives are the easiest on the planet. They only lie and say they have PTSD to get that check. None of them actually went through anything hardcore or dangerous get real. They all lie just to seen cool to ppl. It's very very rare soldiers actually get hurt like 1 in 500 million get injured.     Send people to war, traumatize them for life, offer them no aid when they return, then throw them in jail when they’ve lost everything. A+ justice system here. Kudos to the judge for trying to make even the smallest difference.

      That pause ..You witnessed a flashback occurring... and people wonder why the dude drank again ... an attempt to save his sanity. Unfortunately that bottle don’t mend a man’s mind. That judge did more for him than the VA would I assure you. I used to respond to a guy always sick from pain killers and alcohol all the time. Turns out he was the only survivor of an ied that blew up the humvee and his buddy’s. Spent countless hours trying to help him mentally. He finally got sober for awhile but then slipped. This is reality for some of our vets. Good guys that got so messed up they make bad decisions that feel like the only thing that can save them at the time is to escape

    I was facing 7 years in prison. Judge gave me one year in prison to get clean, and act right. Then they sent me to a lockdown rehab. Been clean for 8 years now. .

      Most judges care, its just in a messed up system, they lose sight or faith or both. Mandatory minimums have also reduced the ability of judges to exercise discretion, and in some jurisdictions they are elected and feel like they need to be elected to help. Its nice he did this but you can't help everyone and many won't have the same opinion of him if he sent them away. Not trying to reduce what he did here or even how great a judge he is, just pointing out that judging is complicated and not always as simple as from afar it ought to be.

      Sadly when there's moving water and drownings bodies often get lost or are not able to be recovered...

    I can't imagine being trapped in a drowning vehicle. The water stopped rising when it got to his jaw and being the only one to survive is very Traumatic.

      Judges are appointed and not elected. Once a judge is appointed, they can serve on the bench until they retire.

      In North Carolina they just started doing trial court partisan elections in 2017. This incident is from a couple years ago. The first election for trial judges wont be until 2018.

      Nobody said that spending the night in the cell was a fix all. People are commenting on the fact that the judge stayed with him and spent time just listening to him. You never know which acts of kindness will have the most impact. Not everybody is the same.

      I don't think it was empathy. I genuinely believe it crossed the line into true sympathy! There's soooooo much corrupt definitions out there in the Psychology world about the distinction between empathy and sympathy... But the greatest difference is the ability to "connect with" the struggle you're observing from the other person. Empathy is merely a cognitive recognition that you understand. Sympathy is where you can inter-relate it to some of your own struggles, and a greater depth of understanding a person's plight is not only acknowledged, but felt...
      This judge made one comment in particular, where you know he CONNECTED with Joe. Judge Olivera said "I just "Felt" I had to go with him"... This is when you don't just "acknowledge" but you partly take some form of ownership with the person going through the struggle. THAT is "Sympathy"... ;)

      Rough collies well we had one and in the late 80’s early 90’s they completely gave up. Said it was inhumane to lock up mentally ill people and force them to take treatment. Now we have a horrendous problem on our hands and again the people that created the problem “government” have no idea how to solve them.

      Don't look at it as being compassionate everyday. While that is a great goal, that is literally impossible. Everybody has bad days, says the wrong thing and lashes out.
      Break your major goals up. Look at it more like being compassionate EACH day. On the days you don't succeed, follow up with a genuine apology, give the other person the time they need to accept it, and never pester them to forgive you. 🙏😊

    Despite all the heart strings that the journalists used to pull at, the message remains the same. This judge is a kind soul and so is the accused. The judge did what no man would of done and gave this guy something a jail never could. His humanity back. Hopefully he stays true to his word and stays sober and can do the same for others!

      So it was noon 12:00 12:05 whatever you get the point the day has barely started yet I put in a call to the plug and noticed that I didn't have any shells left and I was short on a few things around the crib so I walked down the block to the store when I hit the door three n***as came out arguing loud enough for the half the set to hear them and if you live this life for as long as I have then you know what "I always carry this" means and how that "conversation" ends but since you obviously not about that life I'll give you a hint *POP* *POP*
      And when it happened nobody gave a s*** not the people in the store and not the people outside bringing in supplies wasn't a traumatizing or life changing experience just a Wednesday.
      TLDR I walked a block to the Arab store to get some swishers and walked past a crime scene on my way out.
      We're Worlds apart so don't you dare assume that your pathetic sheltered life applies to me.
      So keep your windows up and keep licking boots grateful that others out there fighting a hypothetical enemy that you will never meet in your life I'll keep surviving in the streets.
      You claim I wouldn't survive a draft? I know you wouldn't survive a trip down the block to get some cigarettes where I live so stay in your lane.

    I had a friend who served in Iraq who died in a similar incident. He was a medic that was riding in a convoy and his vehicle flipped into the creek and they could not get him out. I can only imagine how this guy feels. Hope he stays on the right path

      They went over there on orders that they didn't understand or question to oppress a nation and ensure it's continued political instability because decades of destroying and kicking it while it's down to accomplish political and financial interests and traumatising it's people and some of the kids you sent over there, literally thousands of miles away. I can't feel much sympathy for them considering what they chose to be a part of and how insignificant there suffering is compared to the native peoples who DIDN'T choose to be the victim of American violence and oppression.       I would agree with that if I knew he was a Christian because there's other religions out there other than christianity that could inspire a person, so I can't see a person doing a good deed and assuming that it had to be christianity that guided him.       @My name is Tim, I'm a lesser known character Apparently this judge was chastised in October the next year and had to resign for corruption, because he only changed the sentence because he corroborated with the church to try and get re-elected. So maybe not the best guy.

    As a soldier he understood being held accountable. in the army my leaders always got down with me when doing push ups. this is exactly what that judge did for this former soldier. he saluted the judge. thats the best way he knew to give the utmost respect. love it
