    How long does it take from the time that you file a claim of survivor benefit to receive the compensation? It’s been six months since I put theclaim I haven’t received notice.

      See if you can find your husband's organization that helped with his initial claim. It will be something like the VFW, or the VA (Thrift store) or something like that. Then use them to help with your claim. They really know what they are doing with claims and they should be able to help you resolve this. The VA has a one-time charge but the VFW charges monthly.     I have a 70% T&P rating, I'm treated like I'm at the 100% rate, pay, dental, vision, state benefits, DoD 100% military ID, etc. I've seen conflicting things with my rating combination. Most places state that because I'm T&P I'm 100%, no matter the actual rating, is that how the VA will see it when I pass?
    I'm asking, mostly because I have some heart issue that have gotten worse, that are service connected and I never got them added to my rating, since I didn't see where it would add any benefit and the claims process is so stressful.
    Over the past few months. things have started looking bleak for my future and I want to make sure my wife and son are able to get their benefits when I pass. I would prefer not to go through the claims process again to get it added, but if that's something I need to do, I will.

    I have been fighting for the benefits that my husband should have gotten. He passed 10-15-2022, he fought for these benefits himself for 7 years, I have been fighting for 2 years.
    He died of bladder cancer that moved to his lungs. Bladder cancer is on the PACT Act, he also had the Vietnam service medal which was only given to Blue Water Navy veterans and we found where 2 air craft carriers he was on was in the 12 mile limit of Vietnam. I don't know weed if you can help. My husband had a claim pending at the time of his death.

    Does the ten year countdown start from the date a retroactive payment is calculated or by the date of a decision letter?

      Yes the date of the decision letter. The "Caring for Survivors Act" (2024) is working way it's way through the the US Senate and it will shorten that time span to 5 years and the amount the Spouse will receive will be increased also.

      Did the act pass? I think there should be no waiting time because once a vet is 100% they may not live long after that. 10 years is unrealistic 5 years not good either. My husband just had a stroke and not at 100% yet, if he makes it to 100% he may not have long because he has an aneurism and blood clot ready to go off! Who wrote the bill?

    Hi
    I have a question maybe you can help
    My husband passed this past January and I do get DIC. But he had a claim for Agent Orange . He served in the Navy and put 2 tours in Vietnam in water on a PT boat picking up downed pilot's. They gave him a rating of 0% for hypertension and never raised it and heart disease is one thing he passed from plus breathing problems and ge never got to file for PTSD. But i know they have rasied some of the rating and i was wondering if his could be raised if i filed something and then would i receive his clam?

    I have a relative of my wife ( sister and her son ), That moved from their home Florida to our home
    . She was in the military and had not claimed any benefits. She passed away in a VA facility. Her son ( now 41 ) had never held a job, because he stayed at home to take care of his mother. His dad and older brother left them, with no farther contact from either. Is her son eligible for any of her benefits , like hospital benefits

    Applied for the burn pit crap from Iraq 20 months ago. Only responses from VA have been via phone between midnight and 4 o'clock in the morning. So far the VA has called 22 times during this period and the toll free number NEVER PICKS UP.

    I am in the same boat as many of the veterans here, only I'm 80% unemployable, paid at 100%! Dental, vision, and everything else, including breast prosthetics and associated special brassieres due to double mastectomy performed through the VA. I have recently qualified for VA provided hearing aids. Where is the answer to our numerous inquiries on this subject? I am a Vietnam era veteran, as well as a military retiree. Thank you.

      DIC for 2025 is about 1600 per month.

    Husband was 100% for prostate cancer he was a marine served from 1967 -1970 was in country after 4 yrs dropped to 70% for 4yrs. Then got 100% from 2014 until 2020 due to. Unemployability passed away at a V.A. hospital found out he had lung cancer ,but it was to late we t to brain also took him off of life support died on 10/9/2020 i get 1,600.00 a month, does the 10 yr. Have to be consecutive Thanks

    I’m a little confused. Are PACT ACT cancer folks survivors eligible for any of these benefits? To my understanding we only get benefits from when we filed until 6 months after remission and that we are reevaluated upon the end of cancer treatment. I don’t know if my 100 per cent could be reduced at that point and no chance for survivor benefits. I do have to kids under 18 either no mother, so there will be no marriage certificate and my sister will be doing the paperwork. Thanks for all the good info!

      I had 100% when I was treated for cancer from Agent Orange. When I went into remission, they took away 20 %. Now I have been trying to get it back, I had Kidney cancer and heart conditions, but I haven't heard anything back, after 2 months.

      No, only to spouse or child under 18 on record. Parents can get DIC if they are established on record before death.

      I think only if you are married or have a kid….. I don’t think you can pass it to others.

    Hi I have some questions about TDIU with college/VR&E. I spent hours on Reddit on this topic and most opined that you can’t go to school if you are on TDIU since if you are able to go to full time school, you should be able to work. That was their argument and that the VA will terminate your TDIU. I also saw most people saying you can’t get on vr&e if you are on TDIU because TDIU says you are unemployable and Vr&e is assisting you to achieve employment through education or other trainings. So they contradict each other. Some said vr&e reps refused accept the application because somebody was on TDIU. That was their argument. My argument is that I believe if a person with 100% p&t can go to college, anyone should be able to go to school. If you can’t go to college while on TDIU, it implies nobody with let’s say combined disability rating over 80% should be able to go to school because they all do have severe disabilities. Some said you can’t go school if you are 90% disabled because the VA will assume you have improved and Lower your ratings by scheduling c&p exams. Please tell me all of this is false. If you could make a video on this topic, it would be so helpful. I have found nothing on Google on this topic. This is useful for young veterans like me who want to go to school. There is not a single video on this topic on RUclips as well. Thanks.

    I heard there was something called replacement benefits. Where the spouse takes over receiving the benefit after the veterans passing. You mentioned it for pending benefits but I thought you could apply with just limited income.

    Good topic. I am a US Citizen age 76, married to a Costa Rican Woman,. Also a US Army Veteran. My wife has no SSN so apparently cannot collect either Veteran's or SSA Survivor benefits. She was denied a Tourist Visa 3 times so no longer has any desire to go to the US to get an SSN. Nor can I file US Taxes as Married because again she has no SSN. Or do you have a way around this. Each time she applied for a US Visa with travel, hotel, fees it cost $1500. So having spent $4500 no way will she try again. Last time denied she was told "Happy Birthday Your US Tourist Visa is Denied." She is a University Professor of Languages and Administrator. Now 6 years from Retirement.
    I should add no Government Offices in the US will respond to me. I have no Representation nor can I vote.

      @@bigsasha500 Wrong! She cannot ask for a US Tax Number without going to the US and has been Denied a US Tourist Visa 3 time, the last being 8 years ago. She in now the recipient of all my former income from Patents and Copyrights Registered in Panama and Manufacturing and Sales Contracts from China. It would be insane to begin paying US Taxes on a $2.6 Million Tax Tax Free Income. No thanks to that advice. The Tax Payer ID is only for Foreigners having Business Dealings in the US. She has none at all. And again a US Id and SSN can only be obtained in the US with the exception of children of US Citizens born outside the US.. Not Spouses of US Citizens. Also for your information no Foreign Spouse is recognized as a Spouse in the US until and if they live together in the US as Spouses for 5 years. And sure as hell that won't be happening as I wouldn't care to even spend 1 hour in the US. All 3 times the only reason my wife applied for US Tourist Visas was to fly to Canada as well as Europe with the briefest under 4 hours layover possible.

      @@bigsasha500 Another thing. No one can file for a Tax Number but the person involved. A husband has no authority except over himself. Also it is a 3 day trip for an Embassy appointment. 2 nights in a hotel in San Jose and a $100 taxi ride each way (normal would be $250) Plus Embassy Fees. Like application for a Tourist visa is $550. Declined all that money and time is lost.

      @@riskyron1416 Your income is taxed as a US Citizen on a worldwide basis even if you are married outside of the US to a foreign National. The IRS considers your income to be together even if she never set foot in the USA. If you are filing married separately they will be looking for her separate filing of her tax return! Look at what happened to former British Prime Minister Boris Johnson!

    Your statement regarding automatic payout of DIC to
    Spouses for veterans with 100% for 10 years, etc isn’t quite in line with the VA Website. It states that the disabilities made the veteran unemployable.

    I have a Survivors Benefit (SBP) question. I chose the option for my son only. If I were to die after his 18th Birthday, will he get the “55%” of my pension? Another thing is my child has Autism, I was told at the SBP briefing that he will receive this benefit no matter what his age will be because of his Autism disability. It’s not totally disabling but, he does have an Independent Education Program…..Is this true?

      No. Divorce severe all ties with a previous spouse including any veteran benefits.
      The only government benefit a previous spouse may have is social security benefits.

    I didn’t know about DIC. My dad passed away on 1/30/2024 from cancer. He wasn’t married bc mama passed in 2022. I became disabled at age 9, and have never been able to work. Would I qualify for daddy’s VA benefits? He was receiving VA disability and pension bc he was a Vietnam war veteran.

      A recent visit to our local veterans service office provided that IU applies if been awarded for 10 years or more in which my spouse will receive DIC in the event of my demise.

    I am a retired military Veteran with an 80% Service connected disability.
    After 20 years in the civilian sector I am also receiving temporary disability benefits from the Railroad Board (RRB) due both a physical and resulting mental health issue. I am restricted from working because of RRB regulations. Am I potentially eligible for TDIU or other VA benefits.

    Question, if a veteran is 100% disabled it’s been over 10 yrs since disability and passes away from service connected illness will the surviving spouse that has been married to veteran over 10 yrs receive the full 100% like the veteran has been receiving?

      No, only a portion of their monthly compensation. Right now it's somewhere around $1,200.00 which is way to short! BUT as of late 2023 a Bill is working it's way thought the US Senate (The Caring for Survivors Act) will reduce the the time span from the day the Veterans Rating was awarded to just 5 years (I think there should be NO waiting period) for the spouse to receive that benifit.

      Now 50 percent. My wife would receive around $2,000 per month tax free starting in 2025 with the new COLA. I am 100 percent P&T

    Wonderful instructional video. I’d like to know if everything you talked about today is retroactive for the dependent spouse. At the time of his death, the veteran was receiving compensation for a service-connected disability. He had been exposed to Agent Orange but had not received compensation for it. He was honorably discharged and had dependent children under the age of 10 at the time of his death. Additionally, his wife has not remarried.

    Question, if a veteran pays every month into their survivor’s benefit plan thru DFAS, and they die before completing it ? I was told the spouse must pay taxes on money that the veteran paid taxes on while they were alive, how does that work ?

      Are you talking survivor benefit for a retired military veteran? VA monthly compensation payments do not have survivor benefits.

    What if my husband is 70% but gets paid 100% by unemployability over 20 years? Would I get DIC automatically too?

      Veterans rated 100% are eligible for DIC. Not those Veterans who are being paid 100%!

      I'm 90% disabled I get paid 100% cuz I'm unemployable what will my wife get I've been on disability for over 10 years I'm 74 years old

      @@robertziegler3006 She would get DIC, ChampVA if you pass after the 10 year mark. You don't have to pass from service connected death after the 10 year mark you could get hit by a bus and she would still get paid DIC benefits.

    I’m 90% disabled and receive 100 % disability pay from the va so I have collected for over 10 yrs can my wife collect dic compensation and what does she need to do if so .

      My husband died sept 2024. In went to am vets at the va medical center. They took care of everything h very quick to. Fair with everything widows pension. An8th of burial expenses. Everything else moving very slow. Va was very good to my husband Vietnam era.

    What is going on with the Camp Lejune payments.I have been approved my paperwork has been sent to the Naval office for payment.Still have not heard from them it's been 2 years. Is there a phone number I can call to see were I am on their list for payment?

    My husband was I the army he finished his term in 1989. Than he was in the reserves we got together in 1989 moved in together in 1992 we were married in 1995, he passed away in 2017. He received a military burial in Beverly national cemetary in Beverly New Jersey or it is also Edgewater park New Jersey. My question is am I untitled to any of the va benifits.

    What happens to the Veteran's benefits if the spouse died also I.E. the veteran was killed in action the wife collected benefits but now the wife is dead where do the benefits go after that??

      Benefits are ended, and claim folder is closed and archived.

      100% is the standard.

      @@gracesmith9125 Nope, nada. Just additional money for you in your comp. payment for a dependent. That is it, but no DIC benefits.

    So no equal protection under the law again. Has to be "service connected" to help spouse. Non service connected right violate "nor deny to any person within its jurisdiction the equal protection of the laws." What a Congress huh?

      Different types of benefits. SC is compensation. NSC is essentially a welfare benefit.

    Actually the answer is; nobody gets the Veteran's benefits after he or she passes away. The Surviving dependent can apply for their own benefit not the Veterans' benefit.

      No, the only way to get 100% benefits is at the 100% scheduler or 100% TDIU.

      TDIU = Total Disability due to Individual Unemployability. In essence even if you aren't 100% scheduler out right. You can get 100% pay and benefits under TDIU benefit. You must be 60% rated for a single condition or 70% rated for multiple conditions with one condition rated 40% to qualify for TDIU benefit. ​@@jonvilar7284
