All surviving Korea and Vietnam era veterans who served in those areas should just automatically be rated at 100% and their surviving spouses should receive those benefits until they pass on.
Still gathering missing records since 1990 thanks to military and VA mishandling. All paper records, 90% handwritten medical notes. Now you all know why nothing is filed or filed right. The military and the VA stole out time, lost records, they should just pay Vietnam and VEAP 100% now before we die.

Facts. Had a head injury 33 plus years ago while serving in the military. Long story short, started having some severe balance issues. I made a claim for my long ignored tinnitus only to be diagnosed with both tinnitus and hearing loss. I was told by the examiner that my balance issue could definitely be a connected claim. Presently at 100 % P&T due to that connection. GI do you research and fight the VA. "If they broke you they need to fix you" no matter how long you've been separated from the military. It's not a handout "you serve therefore you deserve these benefits". Connect the dots. !!!
VA didn't break you. Your service did. VA is here to help. You shouldn't be fighting the VA. You need to figure out the process and work within it. Congress sets the rules, not VA. Make the VBA employees life easy and provide everything's they need to make it an easy approval. Take ownership of your claim. Don't rely on people that might have just been hired and know next to nothing on how a claim works. Thousands of new hires to work the flood of claims generated by the PACT ACT! It's all about production and not quality.

I have a problem have been fighting with the VA for 13 years. The last go around about three years and it’s because to 1985. The Coast Guard has standard operating procedure physically destroyed all small boat records. Yes you heard me correctly. I have this directly from Homeland security That the records at the VA keeps insisting they need to finalize my claim or to grant me my claim have been destroyed. They are not archived anywhere in any way shape or form. The VA knows this. They admit that there are no records, but they insist and they keep denying, my dis claim they say they are still looking for the records that they know don’t exist. Not only is it frustrating to me, but this has the effect on tens of thousands of Coast guardsmen before 1985. Everybody including the secretary of the VA which I had Townhall meeting with was totally unaware of this fact the Coast Guard says they’re unaware of this fact, and the list goes on and on and on well, I have made everybody aware of the fact and putting all the paperwork I meet all the Nexus, I meet all the stressors I’ve done the buddy letters i’ve written out my story and have proved that it is more likely to have happened than not. That’s one of the VA criteria whenever I reach out to everybody they all pass the buck and say well that’s not our area. That’s not what we do call this person, literally called and emailed everybody and I do mean everybody. I’ve done a little research with getting a lawyer have not been impressed. Not only that I found out that it stops everything and restart it from the very beginning when you get a lawyer involved and I understand lawyers need to make money too but when you if you do, it’s not guaranteed that you are going to win, but if you do win, they take a substantial amount of your settlement. This is why veterans have such a hard time. Somebody a law firm has to start a class action suit against the VA and get these problems addressed and taken care of and streamline the process. I understand that a few people will read this, but I also understand nobody at your office will and nobody will contact me. Thank you. Have a good day.

VA gets the records from service. Your first issue is with the Coast Guard, not the VA. ASK for an appeal. File a VA Form 21-0996. ASK for a higher level review and for your claim to be heard by the BVA.

@@rachelharriscoward1752 trust me after 13 years I know exactly who I’m dealing with. Once a week I send letters to the president the vice president the secretary of the VA, my governor Senator congressman state VA deal with all the other resources and I do this every single Monday. But if you think you have a better route or a better way to go or a better way to get this resolved, please explain in detail exactly how and who I should contact to resolve this problem. Thank you.

Yea...I've been worried about that for decades...trying to say my Ischium fracture is healed and shouldn't be a problem...but I've complained for decades that the hip injury wasn't just the fracture...I'm now to understand that I have arthritis in my hips area...it looks like they were trying to minimize my knee injury as well (have had 2 knee surgeries on rt knee soon after discharge from the army ...I also had a back injury (NOT listed originally even tho I have medical records from the Army hospital) as well as a right hand injury because I was forced to mop floors while on crutches after they found out I had fractured my pelvic!...frustrating

Just like my back pain its in my military medical records treatment but they denied it cause I don’t have nexus letters I just send my military medical records of treatment and civilians orthopedic now I still suffering from back pain, hip pain and knee pain.
The VA probably wants to see if your back pain is chronic. If you had back pain in your military medical records in 1990 for example then separated from service. 10 years later in 2000 you went to your doctor and got diagnosed for some type of back related injury. The VA will claim the injury is not related to your service because you went 10 years without complaining. You must have continuity of treatment and chronicity of injury. Several years of no treatment won’t be considered chronic. This is an example I don’t know your specific situation.

I hope my suggestion will get to the secretary, Mr. McDonough. It would be nice if veterans could go to a; Patience First, Urgent Care, Community Care or a Doctor that he/ she chooses. It seems like the deck is stacked against veterans walking through the door. I think this way would save time and money. The Disability Benefits Questionnaire (DBQ) could run though a database and tell the rater within minutes whether a veteran claims are denied or granted and it would be coming from a neutral party. Optum Serve/LHI gets paid from the VA and then they subcontract to a Nurse Practitioner, who then gets paid.
I have one more thing to add, how much is a C&P exam? I’m curious as to how much money is being spent weekly, monthly and yearly, because someone is getting rich off C&P exams whether it’s Optum Serve/LHI or Nurse Practitioner or both.

If you only knew who the VA hires to work claims. It is FAR easier to approve your claim than deny. Congress has set rules that the VA must follow. The VA would much rather grant than deny. There are laws that must be followed. BVA has a much more flexible set of laws it follows. Ask for your claims to be seen by BVA.
Hi Shannon: I’m 74 yr old Vietnam vet w/stage 4 prostate cancer w/metasis lymph nodes m. I’m 100% for cancer&100% for metasis. Also 50% major depressive order&ptsd. I have 1 smc k for housebound criteria & 1 for loss of external organ. I understand i can file for smc s as i have 1 rate for 100%& 1 at 60%. Does the money award for smc s get added to my present 100% rating? Thank you for any help you can render.
I have SMC-S and am also 100% P&T. SMC-S adds about an additional approximately $400 a month to your 100% pay. It also SHOULD be automatic once you meet the criteria...which you clearly do.

If I go with this law firm it Will only be because I want you to represent me🎉....I had a lawyer that didn't do right by my, he released me from his service, but he stated that he would not release the 20% contingency fee, but the latter part is not in writing, nowhere did we agree to him getting 20% of any claims granted in the future (in writing)! What's the best recourse? I'm looking at (cfr 38.14....) to figure out how to dispute this, I don't mind paying for professional service but a fool I ain't....please advise and Great video!

You literally made it sound like it behooves the representatives at the VA to deny service connection. It's 1,000 % not that way. The VA HAS TO stay within the strict guidelines given to it by congress & the administration. If you want proof of that, look at the timeline of total benefits benefits awarded per month or year. It will match up perfectly with changes of administration & in the budget approved by Congress. The people who work at the VBA do not get raises because they deny claims, theirs only the threat of being canned for not processing enough claims. They literally celebrate when they get to give large checks to Veterans that have been forgotten. So why don't you take a break from your job of taking 20% - 30% of a Veterans award & take a job at the VBA for a bit.
Guess it shows that your law firm is doing something right when u have the VA basically spying on what people are saying about the VA . I saw a response on Combat Craig's RUclips channel about how the VA isn't the enemy. I could use a lot of terms way worse then that to describe my experience with the VA since I got enrolled in 2008...
Bro my cp docs were literally treating providers. They lie through their teeth and care more about compensation than treatment. Admins just gave themselves bonuses with PACT money. They’re self serving.
