    I was 30% since I got out in 2007. I just went through the process and was awarded 100%. The key was looking up each item by code BEFORE filing my claim. I made sure the evidence was irrefutable with the verbiage needed to be awarded what I needed and deserved. Had three items in 2007, now I have 9. It was pretty straight forward because I came in prepared. I didn't file and then prepare, which is how many approach this. Good luck everyone!

      Can i ask how in the world you managed to get to 100% I am in the process of researching because my feet and ankles are so bad that it even hurts to sit in a chair with the feet on the floor most of the time.

      @@toddhill8543 From my experience with the VA you are better off having your own private Doctor's diagnosis and Nexus. The Lawyers can help with that Nexus and DBQ for your particular disability. IF the VA's C&P exam says one thing and your Dr.'s says another the VA has to go with your Doctors opinion. If you file for a disability and 'trust the VA' you'll likely never get where you need to be.

    Dec 14 2021 Asked for HLR with teleconference
    Dec 22 2021 HLR teleconference
    Dec 27 2021 MH changed from 30% to 70%
    This took me to 100% PT
    Backdated to Oct 9 2020
    Get educated brothers and sisters, the VA isn't going to just give it to you. I got out in 1991, first rating 10% in 2014. Started learning in March of 2020, now here I am!!

      I just got bumped up to 90 so a HLR teleconference could get me to 100%. I claimed a good amount of things and I feel like I’m still getting the push back for that 100%

      @@youlookgreattoday 90 to 100 can be difficult. It matters what various ratings you have and if those cra be increased. Hlr doesn't automatically increase you

      What is HLT teleconference? I like you got out in 92 with a rating of 10% in 2014 went to 50% have had other life events happen because of it so now trying to get in creased but hitting a roadblock.

    Thanks for all the easy to understand information on the v.a. claims process. Me and many other veterans struggled and fought the v.a. for years to get our proper ratings. It seemed to be that they knew you were entitled but would string you along just to not have to pay us. DON'T GIVE UP VETERANS !

      This is so true VA got me from the start I filed for a head injury in 1983 I was denied then given 30% in 2020 for the scar on my forehead due to the head injury now I have all kinds of issues one of them was MDD this is in the PTSD file they ended up giving me 50% 2021 that caused all of this from my head injury so I say "Don't Give Up" read and look at video's and apply what you learned. God bless Vets!

      Another thing that helps is talking with other vets who have a rating. A VA nurse/veteran told me file for an increase I’d hadn’t known about. It got me increased 40% to 70%. Don’t let the process discourage you. Get help from free Service organizations if red tape isn’t your strong point. Good luck everyone!

    I worked with my dad for 3.6 years to get his Korean service time, straight out with the VA. I had (2) four inch binders. VA kept losing same paperwork. I kept a list of date, time, each document was hand delivered, to whom & what time. It became a full time job!
    He had been exposed to moe gas & agent orange. We could never get his VA benefit before his death.

    Great video. I'm just starting out, as I just recently found out about Thailand. I had 2 tours at NKP and tdys to Korat and Ubon. I was a Security Police augmented on perimeter and also delivered lighting equipment to the perimeter. I gave up checking on Agent Orange years ago because Thailand was denied even though we saw them spraying it. ( I was just told it was weed killer). I've had three, possibly four of the presumptive conditions for many years and have been unable to work for the last ten. I am very thankful to have found your website and have watched many of your videos. I have been advised by ret. military friend that I should immediately go see a VSO, but from what I've read I may be better off getting a hold of all my civilian records. ( Various Hospitals in various states) than rely on VA to find everything. I'm 70 now and would like to get some benefits before I croak. I also have a dependant spouse, disabled adult child and a 10 year old adopted child. My social security is $513.00 a month ----- Wish me luck!

    I'm so glad I found this video. I was going to file a sinusitis claim as a secondary to my rhinitis claim on the 21-526ez. I thought I could do this because it was one of the PACT act presumptive conditions. Sinusitis was on my original claim, and they said it was not service related. I will now file it separately on the 20-0995.

    I was 10% rating it was from, April or May- 2005, It took almost 15 years, I got 100% rating in April -June 22, 202l, thank you, for your info. Hill and Ponton, PA.

    Your information presented here is so easy to understand & extremely informative. Thank you so much for helping us out. The V.A. system is frustrating and difficult to maneuver. We are often left in the dark and must fend for ourselves. I am going through such an ordeal. I believe I will be granted the SMC rating for my current situation.     When I received my C-file. It didn't tell me everything I was looking for. So I called the my local regional VA office and had them email it to me. Just another option. When all else fails. Very informative video. Thanks.

    It literally took me 30 years to get 100% and I am utterly convinced that the state in which you apply for makes a difference. I'm from Texas.

      Why 30 yrs and why the state? At some point, the VBA began using that national queue method.
      It took me about 16 months from first claim filing. Not incl. the prior 6 to 9 months of reading VBA process and forms, going to appointments and ER, and watching vids to learn the process.

    This is very interesting, my original filing was 2015 and denied in 2019 the new form I submitted and signed deleted everything I submitted before 2019. Then I was approved in 2024 for the same condition but the benefit was back paid to only 2019. I see and experienced these facts. Thank you.

    Ms. Cheek didn't quite elaborate on what a Supplemental Claim was, but what was needed. A Supplemental Claim (0995) is exactly what it says. You include additional evidence (the Supplement) to bolster your original claim (526EZ) that wasn't included in the original claim. But, you MUST have additional evidence for the form.

    Continuing the VA keeps tons of secrets like any Hospital does. The most important secrets are the complication rate for both surgical facilities and surgeons as individuals, it's impossible for the veteran to make a decision based on fact when the facts are being withheld. When there isn't teamwork patients suffer.
    When the veteran doesn't meet and talk with the surgeon before the day of surgery he's not in a good position to decide if this is a surgeon for him. The whole of services are a little bit to factory like.

    I am at 30 percent since 2004, I filed a new claim 77 days ago. Currently waiting a reply. Gulf war combat vet, burn pit supervisor, chemical agent exposure, ankle deep in crude oil for at least six weeks, anthrax vaccines, malaria pills, chemical agent pills, multiple explosions…. Etc.

    I sent in for my C file, received it six months later. That’s where I found my rating sheet. They didn’t include it with my VA rating letters. That was in 2020.

    I have never received a code sheet/rating sheet in my 4 or 5 decisions from the VA, most of which were in the last 2 years. I will definitely go to the regional office and try to get mine. Thanks

    I applied for plantar fasciitis secondary to my service connected pes planus, which was also Static on the code sheet. After the C&P exam for my plantar fasciitis, I received a reduction. Long story short, they claimed that I submitted an increase and that my pes planus was not static, therefore I was subject to a reexamination for that condition as well. My point is, even with a static disability, they still went ahead and conducted a reexamination.

    I think the whole thing should be investigated as I was Discharged in 1985 at Ten Percent never got no money then got Bladder Cancer in 2013 I was in Camp Lejuene for fourteen days but was told that it takes thirty days of exposure to get that disability so while having Cancer they took my Ten percent away.I think it is corrupt and can clearly see why Veterans Struggle in Life.

    The paperwork says he was expised to tce,pce,benzene. These solvents can cause autoimune desease . Myasthenia gravis is a autoimune desease. Stationed at camp lejuene

    I really appreciate your videos and want to get more information on claims, your fees, etc. I do get a monthly stipend, based on my own Vietnam service with the USMC in 1970, but quite frankly, I am really in the dark as to making certain my own benefits are where they should be. Thank you!

    I wished I had watched these types of videos. I have had three C&P exams. The first one combined two claims to increase 10% on each. The Medical Examiner was rude and antagonist. I am in the process of sending a FOIA request to review his report to be able to rebut his conclusions. Also I had a second C&P exam for Tinnitus. I am also requesting the Audiologist report.

    I'm very concerned about my future ratings....I among many of us came up in the Army being told to "suck it up" I do have several issues that I have been seen for however not on a consistent basis. I'm now in my 22nd year Active Duty and recently diagnosed with Multiple Sclerosis which is considered an automatic disqualifyer and now facing a Medboard. Apparently I've had MS for many years without recognizing the symptoms until they've gotten worse....I have several other issues however, this whole claims experience is stressful and worrisome because due to MS symptoms getting worse...I may not be able to work once I'm kicked to the curb.

      If MS is an automatic disqualifier, then it seems to me you should apply for 100% disability & Inability to Work, Permanent.
      Basis could be secondary claim? That is, MS was made worse by service.
      Rule from Federal Register:
      Section 3.306(a) 38 U.S.C. 1153

      If you are still in, then get as much documentation as you can before they med board you. You should be able to get 100% plus your retirement. That ought to be enough to sustain you if you are unable to work.

      Va form 21-4138 the VA support form, is the general form to ask or tell them about an issue.

      THERE IS A SPECIALFORM 20-10206 WHICH YOU CAN FILE AND REQUEST INFORMATION ON YOURSELF, C-FILE, OR DD214, OR SRB, etc. it is on the va .gov website

    Hi, I served the Army on Vietnam era, had an accident, right leg and knee, was sent to hospital for 10 day. Next thing I know I was on a plain back home. It was a service connection injury. This was in 1974. I file claims like for ever. After I submitted a claim they always ask for more evidence. They already had the evidence since day 1. After more than 8 surgeries and a lifetime of claiming they gave me a 30% for right knee. They only pay me back pay for 3 years. I waited for this 40 plus years. Can I make a claim for the lost years?

      You only get benefits back to your original claim date , a new law went into effect and stops back pay to 1998 , but that may only be in my case , I originally applied in 1980 on injuries from 1977. VA " lost ".all my medical files after 2 years post service, it has taken me 40 years to find evidence of my injuries.

    I should be getting my notification letter from the VA any day now after attending my C&P exam I just recently had for secondary claims. I'm currently at an 80% disability shooting for 100%. If I receive a rating other than 100%, I'll be contacting your firm. I felt comfortable and confident that my current C&P exam went well. I'll be aiming for more secondary claims after I receive my notification.

    I appreciate this information. I have been rated for 60% (Thanks to Hill and Ponton!). I had several issues with additional claims because of an unscrupulous VSO who was finally dismissed. How can I now try to process my claims? I am now living in Panamá because I was medically retired by SSN and I could no longer afford to live in the states. Any suggestions?

    Thank you so much for your video I learned a lot today. My husband, a Blue Water Navy Veteran has a Rating Code Sheet dated 10/18/2011. Since then, the VA has added Tinnitus to his disabilities. He also had a denial for Unemployability which is not listed on the Rating Code Sheet. On the Rating Code Sheet, they also denied Hypertension as indicated on the Rating Code Sheet. Can you tell me what form I need to request an updated Rating Code Sheet. Since the PACT ACT added Hypertension to the Agent Orange Presumptive Disability list, he will be filing a supplemental claim for Hypertension. The V.A. denied his Hypertension claim in 2007 on the claim they received in 2005. Thank you.

      Did you get an answer to your question, about what form you need in order to request an updated Ratingg Code Sheet? I saw someone else respond under a similar question, that one would need to submit a FOIA form (Freedom of Information Act) to get the Code Sheet.

    The VA said I was not eligible for disability claim since I out processed with no health issue. Five strokes later and tinnitus I question their decision.

    I served in the Navy and was honorably Discharged in December of 1989. For YERAS I have tried to obtain medical records but they only send me medical check in sheets. The Navy experimented on me attempting to treat TMJ. They created splints that only made my condition worse! The Navy then extraxted ALL 4 wisdom teeth during a single surgery and I have experienced terrible Tinitus every since. My DD214 states "more dental work needed". Durig this time TMJ was a dental issue not a medical issue. I have been chasing this in circles getting nowhere! Can you help!?

    I just ran into this problem. I missed my year to appeal by 5 business days for filling out the wrong form before they notified me the form was wrong because 2. You also cannot add additional claims with the claim you appealing or reopening and final date is the later date the claim was re-processed on the corrected form missing the yearly deadline by 5 days. I am still waiting on them to send me the hard copies of documentation of my service medical and personnel file. While they have already decided the claim.

      We didn’t tell st Mary’s VA to do criminal behavioral we just reported it now being retaliated against not to mention their extensive cover up , I have it by documents

    The VA decided in 2019 that too many veterans were approved for benefits and that the system was not well enough designed for failure so they made it more complicated so it would be more likely for failure.

    I’m a veteran, I can’t stand to deal with the va. Went to the local ER in my town the other day, not feeling good and I refuse to go to the va. I ran up a $20k bill on their dime. I’ll keep on dong it too whenever I feel a little unwell.

    If I was denied for “neck and back pain” in 2010, but was granted a rating for Psoriatic Arthritis and Spondylitis I’m 2023. Will they look back at that claim and deem it rateable?

    I'm 70 percent ptsd but just got my TDIU decision. Now, what I'd like to do is just get to the natural 100, so I can hopefully get back out to work again someday. My mental health just gets worse and worse, the longer I feel like I'm not contributing to my community in some productive way. Just want to be a part of something bigger than myself again. I feel like I have a bit of brain power that's being wasted.

    I just called the VA and asked for my VA Rating Code sheet. I was told that it's an "internal document" and they cannot provide it. Any idea why they will not provide it to me? Thanks. Great video.

      That's true it's an internal document. However, if you request a copy of your "c" file it will be in your file.

    I have a question. What form would you use to revisit a claim that was deferred but was never addressed the first time? Would it be VA form 20-0995, VA form 21-526 EZ or did the VA (in all of their infinite wisdom 🙄😂)decide to make another form for that particular situation?

    If I have 50% VA rating for my disability then I got 10% for tinnitus and 20% for hearing loss. But I only get money for 60%. This doesn’t sound right. What do you say. Can I get unemployability?

      The 10+20 took you too 60, the way they rate things is not the simple 10+10 =20.. so you still need a high value claim to get you to at least 80. If you happen to have sleep apnea I would go with getting a sleep study done through the Va. that’s atleast 30-50

    The most important document is your military service medical records. I check my medical records out on my last day in the military and hand carry them right to my VA. Do trust the government. If not copy it before you leave the military and keep it with you.

    I acquired Covid19 Delta in 2021. I was hospitalized for 106 days. All of my Dr's told my wife I had an underlying condition that caused me to get covid as fast and hard as I did. I had a former va record reviewer look at my medical records. I was diagnosed but not told about or treated for copd in the 90's while on active duty. I was medically discharged and told that I could not file anymore claims. What a lie. My "friend" sent me a completed va claim form. I have been increased from 10% to 60%. That's great, in a way, but they still gave me 0 for my lungs. My "friend " is working on my "appeal" that is bypassing the VA and going to my congresswoman. Sure wish they would give me backpay from '99 to now...

    What if a claim was neither denied nor adjudicated? I have a claim from 1976 for hearing lost and it was never denied pending a hearing test that just was done and be found to be the case with tinnitus also? I filed as a new claim, but should I file a 20-0995?

    Thanks for the information in this video. I'm 100%, but not P&T and I've had this status since 2015, and I thought after 5 years, these would shift it to static. Here we are in 2022, and they still have some might improve, which I can't figure out why they believe that, but I'm cautious about trying to open my case and risk them lowering my rating.

      @@toddhill8543 I guess I was thinking of getting to P&T to forgo worrying about them ever opening my case again. With the recent changes announced, I shelved this idea for good, 😂.

      @@hiruu Even with P&T, they can still lower your rating if you haven’t had 100% for 20 years.
      Now if you don’t have P&T, like my state Florida, you can’t get your property tax fully exempt, Champ VA is not available neither, or DEA for your kids to get their school paid for. That’s more of a reason to fight for P&T to me.

      "You can request one from the VA." Ok.. Where, how or what Site? I was one of those that did not get one 20 years ago. It's not the same area/web site for VA letters.

    I was sent my Narrative letter by VA personnel, it had my new percentages but it wasnt a decision letter, my file hasnt been closed so I dont have a final decision just this letter, it was sent by accident but has all the information a decision letter would have, file is still open!
