I noticed that no one has given you an answer to your question. I think the biggest factor is proving liability. Did the plaintiff do everything they could in order to mitigate damage. Inability to prove that the defendant acted in a negligent manner. Failure to capture the dangerous condition which caused injury (photos). It has to one of those three and probably all of them.

My husband just had a slip & fall. He broke his humorous 🦴 bone & needed screws to hold in place. What happened was it snowed & the construction site must have failed to shovel, & a week later it snowed again leaving under the snow nothing but ice & he walking and fell. The private investigators too pictures of where he fell so they can present the case.

Can you still have a law sue someone and live in a different state?
Just a question about past settlement you dealt with. Slipped and fell at a parking lot at a gas station. I had a lumbar strain and a hairline scaphoid fracture. $5,000 in medical bills and $1000 in lost wages. I still have pain from week to week on my back. What is the value of past cases that is similar with mine or your estimate... Thanks in advance. Your videos are very informative.
My reply assumes that your slip and fall happened in Florida, which is where I'm licensed.
When I look at a slip and fall case, I estimate the likelihood (if any) that a jury finds that the gas station or responsible party is not negligent. I also estimate the percentage, if any, that the injured person was negligent (careless) for slipping and falling. Those just a few of the major factors in my case evaluation.
You haven't given the facts surrounding the fall to me. Thus, it is impossible for me to estimate the claim value.

Check with a lawyer in your state. You can get a recommendation from family and friends, or from a lawyer that you used in the past-even if it was for a will or house closing.
You would love my case...5 stairs a turn and 9 stairs hardwood varnished floors in a rental ..no handrails nothing and no wall on one side...broken elbow in 3 places screws and a plate 1 year est in therapy.......required in my area in canada anything more than 3 stairs by the ontario building code must have a hand railing or banister... my only worry is the townhouse i rent is 50+ years old and if it applies to buildings of that date reguardless .. i took video of the staircase and mesured th steps working on a law office soon

I had a slip and fall at work in a freezer due to a leak causing the floor to be icy herinated L4 L5 I recieved injections in need of surgery I'm settling my attorney is telling me 50xxx?? This wont even cover surgery how is this possible idk what to do please help

I don't know if you are referring to a workers' comp, or whether you also have a third party claim. Either way, I don't know the value. Your attorney is the one who knows the details. Get him to explain to you the reason for whatever he amount he is suggesting. Maybe he can show you past similar verdicts.

Some states have laws that don't allow this. As JZ said, check with a lawyer in your state so that you know.
