Had to have an MRI on my neck(3 bulging discs)and back(1 bulging disc) injections in neck and back and going to do a discectomy on back. Still waiting to see if the injection helps the neck.

I was rear ended on 2/16/24 and was transported by ambulance wearing a C-collar. I had surgery on 3/18/19 in which C2-3-4-5-6 were fused. When I was struck, I felt moderate additional pain in my neck and lower back. I had a CT of my neck at the hospital. No additional injuries were found. I’ve been sore for 3 days now. The other driver did have insurance. What say you?
Hey so I just got my 5 MRI’s back most of them are good except I got 2 building disk in my back a swollen nerve in my lower back my right arm has a torn tendon … scarring all over (motorcycle accident) brand new motorcycle totaled loss… I’m up $45,000 in medical bills.. others driver 100% at fault and cited multiple times… what kinda shape am I in? Good or bad you don’t have to go into detail
I was denied up front an MRI, on 3/4/12 & when I snuck away after being terrorized by even living circumstances. I got one but was raised one on my hip where the passion was greatest, instead they forced on on my had where I had no injury from that and was fine at the time of this particular injury. Being forced off my own property, I was neglected due to nobody caring.
Referral would help....I thought I had one & that went bad, tried to hire another, he was murdered...hmmmwhat to do?
Me, I am letting it go to court taking the healing that has recently been recommended. Bet after that the lawyers will be like flying fish.

hey , i was recently in a wreck with a fedx 18 wheeler the report says i was not at fault . i have a fractured wrist and my passenger has a fractured knee and has to go bk for a ct scan . our car was totaled out and our lawyer has made a claim , what should i expect during this process ? and how much could my settlement range between ? also how long should i expect to wait before knowing who the adjuster will make liable for the wreck ?

I live in Florida I fender bendered a car in front of me in stop in go traffic going about 3 mph i had no insurance. Little paint was exchanged slight bumper damage which i offered to pay for out of pocket when I notified the driver it was a low cost fix he is now claiming physical injury when he stated he was fine directly after the accident and had me drive to another location to get insurance info while he picked up his child from school . what do i do?

I was making a left turn into my neighbor hood and was hit by a company tow truck(going approximately 50mph)my car was totaled and I was taken to the hospital in an ambulance, I also lost consciousness. They found herniated disks in my lower back and neck and possibly my spine. I had to get injected in both my back and neck. I also later got a scan of my brain and the doctor says there is something wrong(still pending results) i have an appointment this month. Any estimate on my case value?

I was at redlight seat belt on a woman hit me totaled my car I bit a chunk out of my tongue my neck snapped like a whip I had to change tire to donut & immediately I felt pain because car wouldn't drive on regular tire because frame was bent and pushed exaust into tire I got home bent down take off shoe felt sharp pain shoot through my fingertips I made it to hospital next day got MRI I started chiropractic visits immediately went 8 weeks stopped because i wasnt getting any better.Here I am 2 months later still waiting on George sink ( my lawyer) to do what he can o and I lost my job. This accident was worst thing happen to me in a long time and the car I bought with $ they gave me from other one turned out to be a lemon so yea this sucked I just they offer me atleast 10 grand

I was rear ended by a Uber driver that fell asleep at the wheel. I was at dead stop and red light started to proceed moved about 2 feet he hit me doing around 60 in a 45. I also was in a commercial vehicle that has a dash cam that showed me hitting the roof and that has given me severe whiplash and shoulder pain. I go for MRI tomorrow. My attorney seems to think the max is $50,000 on the policy. If my injuries require more physical therapy and chiropractor can I sue for more ? I'm in Louisiana.

In Florida, which is where I'm licensed, if a hospital acts below the reasonable standard of care and this causes or aggravates an injury to a patient, then the patient may have a medical malpractice case against the hospital.

If one is rear ended by a driver with no license, does the no license play a factor in the settlement value?

My reply only applies if the accident happened in Florida, which is where I'm licensed.
In some Florida injury cases, judges have let the jury hear that one of the drivers did not have a valid driver's license at the time of the crash. It usually will depend on whether the evidence and theory of the case establish the required causal connection to support the admission of evidence that the driver was an unlicensed driver.
Here are two (of several) personal injury cases that have discussed whether the jury can hear that a driver was unlicensed, or didn't have the proper license.
In the case of Stewart v. Draleaus, 226 So. 3d 990 (Fla. 4th DCA 2017), Reagle's temporary motorcycle license didn't allow him to carry passengers. He was injured when he claimed that a car, driven by Stewart, crashed into him.
Reagle had significant injuries from the accident. He sued Stewart for pain, suffering and other compensation.
Stewart denied liability. Stewart blamed Reagle for negligently causing the accident.
Reagle admitted that carrying a passenger can change the unique dynamics of a motorcycle. For example, the manner in which the motorcycle is operated.
The appeals court said that in this particular situation - the motorcycle license violation was relevant to the case at hand. The evidence should have been presented to the jury for a determination of whether the violation proximately caused any of Reagle's
injuries.

In another case, Lopez v. Wink Stucco, Inc., 124 So. 3d 281 - Fla: Dist. Court of Appeals, 2nd Dist. 2013, discussed whether a jury could hear that one of the drivers was unlicensed at the time of the accident.
Lozoya was riding in a red Nissan Sentra driven by her eighteen-year-old nephew, Jesus Rivera, III. As Rivera was attempting to turn left onto S.R. 674, he collided with a white cargo van that was driving southbound on U.S. 301.
Ramiro Pantoja-Vega, an employee of Wink Stucco, Inc., was driving the cargo van and was hauling a cement mixer affixed to a trailer.
Lozoya died at the scene from her injuries. April Lopez was appointed as personal representative of the Estate of Amalia Lozoya.
Lopez sued claiming negligence and wrongful death against Wink Stucco, Pantoja-Vega, Rivera, and Rivera's mother, Yvette Rivera.
Lopez went to trial against Wink Stucco and Jesus Rivera on the issue of whether Wink Stucco and Jesus Rivera were liable for causing the death of Amalia Lozoya.
The trial court let the jury hear Rivera's deposition testimony, where questions were asked about whether Rivera had a Florida driver's license, when he first drove a vehicle, and how many times he had driven a vehicle in the past.
The appeals court said that in this case, Wink Stucco's theory of defense was that Rivera was an unlicensed driver without enough experience to safely judge whether he had enough time to make the left turn in front of the white cargo van.
In support of this theory, Wink Stucco presented testimony that Rivera followed other cars into the intersection after the green arrow went off and made a left turn directly in the path of the white cargo van.
Rivera was eighteen years old and had only driven occasionally since he was fifteen or sixteen because his parents did not like for him to drive their car.
Wink Stucco also presented testimony that the white cargo van had the right of way with a solid green light, was not speeding, and did not have enough time to avoid the collision.
While there were factual disputes at trial, Wink Stucco's evidence and theory of defense established the requisite causal connection to support the admission of evidence that Rivera was an unlicensed driver.
Thus, the jury was allowed to hear that River was an unlicensed driver.

I haven't yet had a case where the fact that the at fault driver was an illegal immigrant added value to my client's case.
I don't see that fact that the at fault driver was an illegal immigrant coming into evidence in Florida personal injury cases. I don't see how it is relevant to the injured person's claim.

It's not that it's a secret. It's that there are many, many variables that determine the answer.
One of the big factors is the state law where the accident happened. I'm only licensed in Florida, so I can just comment on Florida cases.
Every state has different laws. They can have a huge affect on case value.
One factor is liability. What is the percentage chance that a jury finds that the defendant did nothing wrong or the case is dismissed before trial?
What is your percentage, if any, of negligence in the accident?
What is the percentage chance that a jury believes that the crash didn't cause or aggravate the herniated or bulging discs?
What is the percentage chance that a jury find that the injuries aren't permanent?
The list of possible factors goes on and on. That's why your attorney is the best person to answer this question.

I don't think the hitter is negligent. If anything, it would be the stadium operator who has liability for failing to prevent this event from happening.
Also, there is a defense called "assumption of the risk." When you reach out to catch the ball without a glove, you assume the risk that you could injure your hand. Plus, being hit by a foul ball is a known risk of going to a ball game. Most ballparks have netting around the stands to protect fans.
I was in my semi and was hit head on at 65 miles an hour by another semi. The other driver was at fault. He hit me and two other semis, but I was the only one that got hit head on. I was the only one that sustained injuries and my truck and trailer burned to the ground approximately how much do you think I will get? I like injury cases against drunk drivers because (in Florida) the injured person can also make a claim for punitive damages. This typically adds value to the personal injury case.
All things equal, someone who suffered a torn disc due to a drunk driver usually has a better case than if the driver wasn't drunk.

A passenger can claim injuries from both the driver of the car he or she is in, or from the other car(s) that were involved in the crash. You should hire an attorney that is different from the one that the driver of the car you were in hired, to avoid a conflict of interest.
What tips do you have about dealing with Travelers? Their reviews are not good to deal with. I was hit by one of their insured. I do have a lawyer.
Travelers is one of the better insurers based on my past experience with them in Florida accident cases.

Based on your comment, I assume that you live out of state and your accident happened there. I can only comment on what Florida lawyers must do since I'm only licensed in Florida. Thus, you should ask a lawyer in your state what the rules are.
That said, for people wondering what Florida lawyers must do, they need to "reasonably" keep a client informed.
Clients can check in on their case whenever they like. We love when our clients call. Our client's our part of our extended family. 😀
However, we send our client's every email, fax and letter that our office sends and receives. This often decreases our clients' desire to check in.
In Florida, there's no an exact time frame of someone getting their money after the attorney has gotten all the medical records and negotiations have begun. It's on a case by case basis.

Well, I had paid it using what I have & I can & have proven it. They forced me from my home & affordability. They hassled my credit, and I have proof I was in perfect health before the injury. And there is damage from both injuries.
The lack of replacing my cycle & the current continued damage from keeping me uprooted from home & safety & ability to salvage an appeal to my divorce. The last doctor kept it for documentation.
Then the neglected responses from other personal injuries has kept me from prolong work & being hassled & hustled.
Every case, they have it in order but I need a new lawyer, the one I had neglected me & the one I tried hiring was murdered right after my proof was accepted.
Thank you, what do I do about an attorney, my family is torn in this intrusive fight. I have been sexually ashamed & it kept going past normal. Staying where I am until I get a settlement & repaired.
