    I tripped on a raised asphalt patch repair in the asphalt in front of the fuel island at a major truck stop.
    When the store manager and I walked outside for me to show where I tripped, he said, “oh, you mean in front of the fuel island?” “That’s where trucks pull forward and hit their breaks, tearing up the asphalt and we have to patch it.”
    My wife did take pictures of the patch, with me holding my knife blade to show the height of the 90 degree or so step up.
    The patch blended in very well with the surrounding asphalt, and appeared to have been there for some time.
    Workers of the truck stop have to walk in the general area often, each and every day, due to the proximity of the patch to the front of the fuel island, which the workers clean, empty the trash cans at every station, change the windshield washer buckets, etc.
    The fall resulted in my left rotator cuff being torn, as well as the bicep tendon being torn. I had repair surgery to both and had to endure 5-6 months of physical therapy, usually three times per week.
    I felt my shoulder wasn’t getting any better and finally convinced the surgeon to order another MRI, which should both repairs had failed.
    I now must go through a total reverse shoulder replacement surgery, followed by weeks of additional therapy.
    The trip and fall occurred 11 months ago and I still have almost constant pain in the shoulder, limited movement in same and no strength in it.
    I am awakened numerous times each and every night, at times lying awake for hours.
    My wife and I owned our own truck, leased on to a large, national truck line, in their government division, which required two drivers with government clearance.
    I have been deemed permanently disabled and ordered to not operate a commercial motor vehicle with a front axle weight in excess of 5000lbs. Not to push/pull anything in excess of 20lbs. Effectively ending my career.
    As stated, the cargo we transported required a team, ending my wife’s career as well- plus she must be home to assist me. We had to sell our truck, closing our business.
    This occurred in a southwest state and we do have a highly reputable law firm handling our case.
    In your experience, does this sound like winnable lawsuit?

    That's because you guys didn't have gross negligence, and was able to sue for premise liability / punitive damages.
    Because had you had premised liability gross negligence claims.
    Your client's injuries wouldn't have surgery, and could even get more. Isn't that correct counselor?

    I reported the accident to the two management. They knew that that water main was uncovered and still did nothing about it. And also mine was through covid so I couldn't just walk into a hospital or going to emergency room. I had surgery on my knee I fell in the hole 17 inches deep 32 wide fractured foot 2 I just did a deposition now have to go to their medical doctors.

    Hello on slip trip fall an uneven un painted raised speed bump serious concussion and slap tear if you do not want trigger injections being allergic or want to get any other invasive treatment could this greatly effect the case

    Question: Let's say in a slip and fall case, "Walmart" wants to try and have the case dismissed, and we go to court for "judgment of dismissal" and walmart loose and the case continues to the trial, will walmart be more inclined to increase the settlement offer? Say they offer 66k, and the Client bottom dollar is 600k. Will they be more inclined to get closer to that number? Being that they most likely will lose the case based on the fact they lost the "judgment... Thank you, sir.

    My 64-year-old mother slipped and fell at McDonald’s today with no wet floor sign and bruised her knee and tail bone badly we took pictures. I know it’s going to be an issue in the future so we are going to try to get a case going. First step would be to call someone I guess? Can you take the case?

    Hello great video. Question. Can costs still be collected if no settlement or award is granted? I have a retainer agreement that states cost will come from the recovery settlement but it doesn't state if no recovery will I independently be responsible. When I contacted the attorney's office they said if I don't collect I don't pay but that's only the verbiage for the attorney fee. They never specified specifically in the contract about paying the cost if no recovery. I asked for them to modify the contract and add the verbiage and I am still waiting for a response. What are your thoughts?

      I don' t know the answer.
      However, my fee agreement states in *bold* and capital letters:
      "IF NO RECOVERY IS MADE, I WILL NOT BE INDEBTED TO MY ATTORNEY FOR ANY SUM WHATSOEVER AS ATTORNEY FEES OR COSTS."
      I don't want my clients worrying about anything like this. Getting injured is enough of a pain and worry in itself.

    I have a question do you take cases in Texas if not can you recommend somebody in Texas a fall and a parking lot I injured my neck and my right shoulder I had surgery on my right shoulder already please reply thank you.

      I’m sorry that you were seriously injured.
      Unfortunately, I don’t handle cases in Texas. The only exception is I may be able to handle an accident in Texas if a Florida auto insurance policy or Florida resident is involved.
      I heard Texas attorney Quentin Brogdon give a premises liability seminar (e.g. slip and falls, etc.) over a decade or so. He was fantastic.
      Of course, do your own research and make sure that any lawyer who you hire is actively licensed in Texas.

    so my friend slipped in the big supermarket in california as they left a cart dripping water in the aisle, and he had knee surgery and many other treatments, which generated a medical bill of $178,000.00 and that lasted over a year in treatments, however the lawyer already sent the demand, but did not inform the amount to my friend, the question is these: 1- is the lawyer obliged to mention the requested amount? 2- What would be the approximate amount to receive? 3- Should I be suspicious of the lawyer and how can I be sure that he will really send me the amount that the insurance company paid? 4- The value in this case is multiplied by how much of the value of the medical bills? he is concerned because he signed a document giving the lawyer full rights to negotiate on his behalf. could you clarify me? thanks

    I just fell by stepping on a aerosol can at a local big name store.Ive not been to the hospital or seen a doctor because the pain was so great..The stores Insurance company called me today and offered me 500 dollars.Sgoulf I take this to court or accept the five hundred dollars..I am still In pain and need to go to the hospital but I just don't know what to do.

    Having surgery and screws in your body? Is a settlement of $175,000 any good? If the medical expenses are around $25,000 then the person who had the accident barely gets $100,000 and the attorney receives $50,000. Ridiculous to say the least. The justice system favors the attorneys and the insurance companies

    Here is my story. December 2021 I slipped and fell in Mcdonalds on my way to work. I was hurt but nothing broke or anything like that. I was more so embarrassed more than anything and left. Can I still sue for that or was that something I should've did then?

    Had a slip and fall on a wet floor in a supermarket with no signs. Photos of area were taken. Ambulance came. Had a contusion of elbow that ended up with neurosis of the ulna nerve. Also back pain. Both injuries required PT and medication. What is case worth approximately ?

      I'm not a lawyer but I'd assume when he got the 2k he signed papers saying that was that I git 800 fir a fender bender and when I agreed to take the 800 I signed a paper saying blah blah case resolvedblah I can no longer sue essentially for any pain or injuries that may arise after blah

    I had a bad fall cause I stumble over the curb which was supposed to be painted yellow, in LA. My face is bruised, my lip is cut, my teeth are aching, my head hurts, my knees hurt and my neck is stiff and I have a concussion. The curb belongs to a business building(about 10 shops). I’ve been to an emergency hospital, checked me. Payed 700$ there. How are the chances for the claim? Do I need a lawyer or I just do it my self? I’ve heard that my injuries are too small for a lawyer, and I need to wait for 1 week, and see I anything else is found out from my examination. How big is the chance to win without a lawyer with all this? Thank you, have Blessed day.

      The quetion to you: who owns or maintain the curb? In California, there’s a 2-year statute of limitation of which you can file a lawsuit against a private entity…. If the curbside is a city/public property, you only have only 6 months to file an injury claim after the date of loss/date of injury.

    I slipped and fell at work which caused a radial head fracture on my elbow. I did not mop the floor and work says an adjuster will be in contact with me soon...
    Idk if ill have to get screws or plates yet so i might have to aettle for $25,000 or $50,000 if im lucky

    But that's Florida, Texas have a different law on trip and falls. If you hear the herniated this, 80 to $100,000. But gross negligence or negligence and punitive damages., Also medical bills of $100,000, also pain and suffering? They said about that counselor, Texas?

      Are you saying that in Texas the fair settlement value for pain and suffering of a herniated disc is $80,000 to $100,000 before taking into account fault, if any, of the injured person?

    Hey man, there was a pot hole by a sewer I fell down on my scooter because they failed to fix the pot hole/cement for many years. Ambulance and paramedics were there, and I have multiple fractures on my humerus with major arm surgery, a six hour surgery with the nerve surgeon in there too. Not only have I got plate in my arm, but they also had to drill down the top of shoulder down humerus to install a titanium rod. Not to mention I have palsey on my left hand too now that may take a very long time, or may not even come back. Tomorrow I see the plastic surgeon/reconstructed surgeon doc tomorrow. I sent over video and pictures of this stupid pot hole in the parking and video of the site. It was in a huge strip mall gas station albertsons parking lot. I also have health insurance and a witnesses (paramedic) and a buddy that was riding behind me he called 911 and some other on lookersasked if I was ok. I also happened to capture great footage of the painful set they tried to do at the emergency, my arm literally looked like a horse shoe and the bone dam near popped out of my arm. So not only were bones broken but nerves are damaged in my dang arm . Do you think I have a good case? No amount of money replace the function of my arm. I need my arm and now probably going to suffer life long pain because of it sadly , oh yeah the law firm I have said they discussed my case and “round tabled” it out and said they would “love” to represnt me. Also another law firm wanted my case so bad they told me to fire the firm I went with. Like what the heak lol ps also I hut my head sooo dam hard but my arm is what took the fall

    Most non-catastrophic slip and fall injuries need not any lawsuit be filed…. Almost 70% of slip and fall cases can be settled pre-litigation… Ive been on both plaintiffs and defense side and I can assure you a lot of claimants tend to exaggerate their injury…. Ive encountered morons who insisted to file a lawsuit on a soft tissue injury…. When I was doing plaintiffs work, I tell them the actual face vaule of their claims and it can be settled during pre-lit without going through the court…

      Appreciate your perspective and it’s true, a significant number of slip and fall cases can and do settle pre-litigation.
      However, it’s also important to acknowledge that each case is unique. While many cases might settle without filing a lawsuit, there are instances where litigation becomes necessary to achieve a fair outcome, especially when insurance companies are unwilling to offer a reasonable settlement.
      No one wants to go through the stress of a lawsuit without good reason. In my experience, claimants don’t ‘exaggerate’ so much as they seek acknowledgment for the real and often lasting impact of their injuries, which sometimes isn’t fully appreciated until further into the claims process.
      It’s all about finding the right balance and ensuring that people are fairly compensated for their injuries.

      What if one suffers TBI that clearly showed and confirmed by neurologist, neuropsychologists and various neurological tests? Then you don’t sue as well? Why then so many lawyers push to file a lawsuit right away

      @@Gigi_fromNY two usual reasons: statute of limitation to file a lawsuit is coming up and/or claim did not settle in pre-litigation process. For TBI claim, it is usually do not settle during pre-litigation, so lawsuit has to be filed. Medical experts would be needed to determine the damages, cause and the effect of head trauma. Ive not seen a TBI claim that settles during arbitration.

      @@OperationEndGamethank you for your response! Really appreciate it! I’m hearing tho that Publix usually settles out of court?? Is that true? It’s been a year since my accident and just recently few months ago I got my brain MRI done that showed changes indicating TBI and then the doctors and testing started which also confirmed. My lawyers haven’t filed a lawsuit yet but also haven’t try to settle yet since they are waiting for me to finish treatment. Do you think it’s a proper course of action? Waiting to file? Do these cases with Publix go to trial often?

Since you already have an attorney representing you, listen to what he says and their recommendation. The most likely reason why they want you to finish your treatment before filing a lawsuit is to determine the medical costs incurred, the damages, and pain and suffering…. TBI cases are complex… good luck.
