    I provide 11 Immigration Lawyer Tips for completing your form I-130 Petition for Alien Relative in a way that makes it safer for you to file, and more likely that your application will not be sent back due to formatting mistakes, disorganization, or sloppiness.

    Please note, I avoid giving legal advice on purpose, and my preference is that people who can always think about finding a professional, whether that's a BIA rep or a lawyer, to help them with the I-130 petition, or any other form.
    But, I also have way too many people that come find me after they bungle their I-130 themselves, so I've made this video to give those of your out there that insist on DIY a fighting chance for success. Our channel's mission is to provide reliable information, to help immigrants make better decisions, and avoid costly mistakes, and this is the sort of content that advances that.
    Finally, please also note that many of the tips here apply to other immigration forms you may fill out, like the I-129, the I-129f, the I-140, the N-400 naturalization form, the I-485, voluntary waivers, and others.

    These 11 tips start with three tips that really apply across any immigration you may file:
    1:02 - I-130 form Pro Tip 1: Don't do it by yourself and have it reviewed (by anyone, not just a lawyer)
    Your form I-130 petition for alien relative is important enough that you should take the time to do it right, and this means triple-checking every response for absolute accuracy, and having an outside person check for grammar and spelling, where appropriate.
    Perhaps more importantly, having someone with experience and training in immigration is critical because there are potential issues in anyone's background that can be barriers to having an I-130 approved, and potential triggers for more serious immediate consequences, like deportation.

    1:50 - Pro Tip 2: Do NOT file first and ask questions later
    Too many people file immigration forms with the assumption that they can either omit information or put in false information and then deal with the consequences later. The truth is that every year the background search process for all applicants gets more sophisticated and better at discovering untruths and half-truths. As a result, if there is anything on your file that needs to be explained or you're not sure about, you need to address it before you file.
    2:30 - Form 130 Tip 3: Never lie or say something you're not 100% sure of
    This piggy-backs on point 2, but is a point that bears emphasizing. If you knowingly lie on your application, not only is that a crime, but you are jeopardizing the rest of your immigration process and your ability to stay in the United States.

    Tip number 12 call immigration layer and pay thousand of dollars. Stop scare people dude. USCIS instructions is very clear. It isn’t that hard. I did a few times for me and for my family. My English also isn’t great either. Thanks for video anyway

    So whn they said we could provide them with copies of documents could we actually provide them with the colored Scan copy documents or better just provide with black and white ink copy documents? The terms scanned and copy are different here in my country. If it copy means black and white ink only and not scanned

      What a great question! I didn't know this. USCIS does not make that distinction, so I would day go with whatever creates a more legible copy, which in many cases will be scans.

    Hello I am a self-filer and because of the upcoming 'public charge' policy, I am trying to get everything submitted before the 24th of this month! Please give me some tips or advice on what to include in my I-130 packet since my husband has a detainment and voluntary departure history. I realize I really need a lawyer but unfortunately I cannot afford one at this time. All the info I get online about assembling the packet pertains to the cases that a straightforward. I won the lottery green card , then after 5 years I applied for citizenship and I became an American citizen. Now , I want to apply for my wife.     I met a girl this summer. She is on a work visa from Russia . This is her 2nd time on a work visa and know how had it is to get one especially a 2nd time . If we decided before she goes back to marry what forms must be filed after marriage and can she stay in the USA or would she still have to go back . What's the best course of action .     I will be applying for I-130 for my spouse to be in a couple weeks. I read it can take 3-5 months to get her here. Should I consider applying for K3 Visa as well if we would like her to be here sooner?

    My husband is currently a DACA recipient and has been since 2013. I am a US citizen and am hoping to petition for him. If I am filing the paperwork by myself, is it better to include all the DACA filings as well? I went to a lawyer that said we should leave it out entirely but I feel it might make our case a little stronger. Even though he did enter illegally at the age of 5.

    Hello, i came here to US with a J1 visa (expiration October 31 2018) and as we know as a J1 visa holder I have a 1 month grace perion (my expected stay is up until November 30 2018). During my internship i found this guy who become my husband and we got married last November 26, 2018 (my field is not cover with the 2 year rules that i need to go back to my home country). Up to this point we still didnt process the papers because of my husband schedule but we are planning to send next week. Any advice that you can give. Thank you so much

    Spanish firm and any other source of translation cost too much, I sent all the documents that needed to be translated, like birth, death certificate from her husband, because hospital bills, bank statements, leases and all other documents together was going to be just ridiculous expensive, Spanish group gave me a quote of $1,763 dlls.
    What I was going to do is translate the rest of the documents my self and sign them. Will they return her package even if they're accurate translations?

    Great video!!! I need your advise. I am filling up I-130 for my husband. I am green card holder now, but I came to US in 2001 with H1B visa. What should I write in section 14, as my class of admission, place and date. Is that will be E37 (from my GC). I do not know place and date?

      Your place and date will be the seaport/airport you entered into the United States when you first arrived, and where you would have then been admitted by Customs and Border Patrol. Your class of admission will be whatever status you were admitted in, and it pertains to your visa type.

      There will be an "additional names" space. Write alternate name there. Passport name and/or birth certificate name control for primary name space

      You should get a letter for any denial. It will contain instructions for options on what you can do next. For appeals and denials you should always get help.

      So what you really want is for a lawyer to evaluate any red flags on your app. Typically this would require a 1 hour formal consult and you should ask the lawyer to review the file you send her beforehand. Cost will be 100-300 or more depending on lawyer.

    Hi, I have a question. I checked through the USCIS website for the price of filling for a spouse after marriage. and the price for the i-485 is $1140+$85 biometric, i-765 is $410, i-130 is $535 = $2170. which I submitted with all necessary documentation. to my surprise, it was sent back to me that the amount is incorrect or has not been provided. please, how much is the total fee that needs to be sent? thanks.

      Charlie Paul it should be 1760.00 (as of today, July 8, 2018, for those others reading in the future) and that’s because with the one step you don’t need to pay for the 765 and the 131.

      Yup, with the one step. This is in the directions for the one step process. Read those instructions carefully! That’s rule #1 of immigration.

      Isiah Rosalez, yes she can. She should attach your current marriage certificate for you and her step dad, Also attach divorce and marriage certificates of your first marriage with her dad (if you were married before)

      Put "Unknown" and in the time between your interview and the time you've filed, if I'm you, I'm looking to have someone that knew my parents write an affidavit attesting, as accurately as possible, their birthdates.

      Depending on if you are beneficiary or petitioner, and your immigration history, this may or may not be relevant.

      Damjan Denoble I am the petitioner. All this paperwork is just overwhelming and scary. And there's no way I can pay for an attorney

      You should look for pro-bono clinic and providers in your state. Depending on where you are, you may have many or a few of these options available. You should also try using forums and resources like this one. If you are petitioning, also bear in mind that you will have to show income that qualifies you to sponsor the beneficiary. If you feel you can't do this, you'll have to find a joint sponsor. I mention the last bit because this part is often overlooked by petitioner's. For more info is I-864 and I-864P, affidavit of support forms and their directions. Good luck!

    I am confused with the class of admission and place of admission.. I gained citizenship by Naturalization, do I still have to fill out this part or just write n/a and what is the place of admission? I enter by miami.. is this the place of admission or not?

      So the place of admission box in Part 2 for the petitioner should be filled in by green card holders but not by citizens.

    Awesome video. I am from Brazil. I have two question. Do I have to write my name on the application the same way it is in my passsport? Example:
    This is how my name really is (after I got married)
    First name: Priscila
    Middle name: Jael
    Last name: Navarro Webb
    but when I went to renew my passport in 2013 my name came like this:
    First name: Priscila
    Last name: Jael Navarro Webb
    It`s a mistake that the federal police agent did it
    What should I do?

    Hi. I want to ask one question.So please help me. I am a US citizen. iI want to file green card for my parents. They already have 10 years visitor visa for US. And they came in US for one time. So if my parents are alredy here in US for about 40-60 days and after that time of period if i want to file I-130 for them then what will be the process. Because after 60 days their 6 months entry time will be less. Please help me to answer my qustion. Thank You.

      Don't pay attention to expiry date on the form. Go to the USCIS page for the I-130 and see near bottom of page where the Edition Date instructions are : www.uscis.gov/i-130

      You should aim to put it on questions that say "if applicable". Each form is different, and this applies mainly to I-130/485

      @@esewey7955 If you're an American citizen, your son is automatically eligible for citizenship hence no sponsorship required however there's paperwork & fees that must be filed and paid.

    Hi sir, I have a question. I’m filing for my wife and two kids. Do I have to pay a separate fee for each person? That is , the filing fee is $535, should it be multiple by three(535*3=1,605), OR should I pay just my wife filing fee?

    Please I have a question I tried using this form using adobe reader but not all information CAN be TYPED in. It’s it okay or does it look right if I’ll have to fill in some information using the pen. Like for example I couldn’t typed in my certification number and the apt #. Please help I want to type it not write it in I don’t trust my handwriting

      This is normal! The forms have glitches in certain fields, and the Apt # in particular is very glitchy across the entire I-130 form. So just print it off and fill it in. This is a great tip to put in another video - thank you for highlighting it!
