Driving with high-beams on in a well illuminated street of a city and being in possession of pot in a car, when DL suspended and already under indictment for another crime? How stupid an adult man can be?

And if someone dies at the hands of your 'intentional' bad driving (or drunk/drugged driving), it's treated as murder, not manslaughter. The law argues that we all know that cars can be death machines in the wrong hands, and if you commit a crime that you know does have the chance of ending in the death of other people, you are a murderer, and you will be sentenced as such. This guy would get at least 20 years (probably more) in Australia for killing that child.
This is simply false. The jurisdictions that have a culpable driving offence have it completely separately to murder. The elements are entirely different, and they have different maximum sentences (20 years for culpable driving, and life for murder).
I'm no kangaroo lawyer (I am an American lawyer) but in common law jurisdictions unless you intended to kill you aren't in the realm of murder, but instead manslaughter or some other lesser charge. Knowing death or greivpus injury was likely doesn't put you in the "intentional" catgeory, it puts you in the reckless or grossly negligent category of offenses, i.e. manslaughter.

I was 5th in line, and every single guy in front of me were already on some kind of probation or supervised release from an earlier charge the were facing. the second time might have not been accidental but instead a way of making sure that the boy could never identify the car or their faces. Its possible he was conscience after the first hit and was looking at them. Anyways its just a thought.
