And if someone dies at the hands of your 'intentional' bad driving (or drunk/drugged driving), it's treated as murder, not manslaughter. The law argues that we all know that cars can be death machines in the wrong hands, and if you commit a crime that you know does have the chance of ending in the death of other people, you are a murderer, and you will be sentenced as such. This guy would get at least 20 years (probably more) in Australia for killing that child.
This is simply false. The jurisdictions that have a culpable driving offence have it completely separately to murder. The elements are entirely different, and they have different maximum sentences (20 years for culpable driving, and life for murder).
I'm no kangaroo lawyer (I am an American lawyer) but in common law jurisdictions unless you intended to kill you aren't in the realm of murder, but instead manslaughter or some other lesser charge. Knowing death or greivpus injury was likely doesn't put you in the "intentional" catgeory, it puts you in the reckless or grossly negligent category of offenses, i.e. manslaughter.

The first time I was arrested I had a bond hearing with a judge along with about 15 other guys. I was 5th in line, and every single guy in front of me were already on some kind of probation or supervised release from an earlier charge the were facing. It blew my mind how habitual criminals were. They didn't seem like they wanted to change and destined to grow old in prisons. It was kinda sad but at the same time glad I was not like them
