VA C&P Exam - Frequently Asked Questions
What is a VA C&P Exam?
After you file a VA disability claim, chances are, you’ll be contacted and scheduled for one or more C&P exams by one of the following:
1. VA doctor who works for the VA
2. Contracted doctor who works for a private contracted company
Why do I need a C and P Exam?
The C&P exam helps the VA Rater (RVSR) rate your disability claim.
Your final VA rating will be based on the severity of your symptoms and will affect how much disability compensation you receive.
There are 5 primary reasons why veterans get a VA c and p exam:
1. Independent medical evaluation by a doctor.
2. Make or confirm a medical diagnosis of a disability.
3. Determine the approximate timeframe of when the veteran’s symptoms began.
4. Determine how bad the veteran’s symptoms of the disability are on C&P exam day.
5. Try to decipher if the veteran is telling the truth.
Does everyone who files a VA claim need to have a VA disability claim exam?
No, not all veterans need a VA C&P exam.
If you have enough medical evidence in your file to support your claim, the VA might not need to schedule a C&P exam.
Medical evidence may include Disability Benefits Questionnaire (DBQ) reviews, Medical Nexus Letters, doctor visits and hospital reports, test results, and other documents.
This is why we talk a lot about the importance of medical evidence in your VA disability claims strategy!
What is the VA wait time after C&P exam?
Depending on the VA Regional Office, veterans can normally expect a rating decision within 2-3 weeks after their last VA C&P exam.
The total VA claim process, which consists of 8-steps, usually takes about 3 months or 90 days from start to finish.
How do I get a copy C&P exam results?
If your VA comp and pen exam was conducted by a VA doctor at a VA facility, your exam results will flow into your Blue Button Report on MyHealtheVet within 24-48 hours of the exam.
Veterans can also make a written request to the VA Regional Office (VARO) in your state to request a complete copy of your outpatient medical records, to include C&P exam results.
If your VA C&P exam was conducted by a private medical provider at a private facility, your exam results will NOT flow into your VA medical records.
The fastest way to get a copy of your C and P exam results from a private provider is to ask your VSO to login into the Veterans Benefits Management System (VBMS) and print out a copy for you.
If you don’t have a VSO or designated representative, you can file a Freedom of Information Act (FOIA) request to the VA Regional Office in your state and ask for a complete copy of your VA Claims File, also known as your VA C-File.
You can also call the VA hotline at 1-800-827-1000 and speak to a representative.
We also recommend calling the White House VA Hotline to request a complete copy of your C&P exam results.

C&P examiners are judge jury and executioner. Even worse, you have to file a Foia request to see what they said about you (if your c&p exam was conducted by a private contractor)

Unless you have someone who has access to VBMS. I always have someone with vbms access get my c&p contract exam report.
The records are in your C-File when you get it....so ask for your C-File yearly if you are active with the VA....also a VSO has excess to the file

Hey thanks for your videos Brian, I would like to add a little something. My experience with the C&P exams has ranged from bad to great, but when I went to a third party contracted company like QTC I found that sometimes they don't have the details about why you are there. What happened in my case last year I went for increases to already service connected disabilities, but the C&P examiner was asking me questions trying to establish service connection. I told her that my joint problems were wear, and tear from the physical nature of my training, and that I couldn't remember one specific event. Keep in mind I was already service connected so I was scratching my head wondering why I was answering these questions already having service connection. Long story short she basically said that the information I was giving her about gradual wear, and tear wasn't enough for her to recommend any rating, so the VA didn't give me the increase. I guess my point is if veterans are being seen by a third party company they have to make sure they break the ice by letting the examiner know what their specific situation is because it could hurt their case.

Tired of 10% ..TENITTUS denied most claims including PTSD MDD INSOMNIA ..I HAVE PROOF FROM VA psychologist. No nexus letter I asked her she said what’s that..yep no help on that part .. seeing outside shrink he will help me.. but I’m in appeals now so I have to wait till I’m excepted or denied for round 2.. then go from there

I also want to say that C&P exams are all different, because of the human factor, and the facility you go to. I went for a social security claim in the same facility, and the examiner told me that they are harsher, and more strict with veterans than when evaluating social security claims. I was shocked to hear that come out of her mouth. The impression I got was that some of these third party companies are actively applying harsher evaluating methods on veterans, but don't just take it from me, that's literally what the examiner told me.
I've had a better experience with Contractors than VA employees...a LOT better.

I have a question about total disability rating and unemployability for a Blue water vet. If the veteran gets only say, 20 or 40 percent on his rating, (and not the 70% qualifying, as I read it in the e-cfr 38 part 4 sections 4.16 & 4.17) but is not able to seek gainful employment because of his service-related illness, can he still get the unemployable status and 100% ratings benefits? I don't quite understand if he must have the 70% rating to be considered unemployable, or if a lower rating is enough. Thank you. Wonderful video.
You're correct! We had a veteran with a 10% rating for a serious heart condition, who couldn't work because of it (unable to hold substantially gainful employment) get 100% IU benefits, even though he didn't meet the standard TDIU criteria.
I'm thinking it gets referred to another dept for review, prob lots more time involved waiting, do you think? Thanks so much for your answers, really appreciate it.

You don't have to go unemployability. Theres 100% scheduler rated and there's 100% P&T. With both you can still work full time with no consequences.
A Brian I have a ?.My PTSD is in deferred ,I called the 800 # and the told me I can’t put in for a Higher Level Review till they send me a letter of what they decided. Do I wait or do I send it in.I had a great C and P. I got a copy and it looks good.
If no decision yet,,you should file any and all evidence you have now before they decide, you can down load or fax them in and call the 800 and tell them you faxed the papers......as long as it is deferred you can add evidence......if Denied...what you have in will be huge on appeal on any lane.

Jason Youngblood There is no secret sauce Jason. We can write a letter but this is a decision that VA has to make for you.
I have a coworker who’s father is 90 years old a Korean War veteran who is 40% disabled. His records were destroyed in a fire in a VA Springfield Ma facility how can he be help.

@@CombatCraig RFE is a routine future exam. Pretty common in VA ratings that aren't p&t.
@@CombatCraig A Dbq will be completed at your RFE which is a c&p exam. This happens usually after a proposal to reduce or before hand when the VA re evaluates your condition. I was asking if this company does DBQs for routine future exams.
Well I told my story but got denied for IU ....I'm 70% and still new to the VA claims. I just got out of the military in October . Anyways, I think I will need some help in trying to get IU. I'm also going to see a podiatrist since I have pain in both of my feet.

The range of motion is so easy to pass though. It’s not a fair assessment. I have a hurt shoulder, they just checked if I can lift my arm parallel to the ground. They never checked how fair above my head can I lift my arm and that was my issue in the first place

@Clarence, in the case of lack of records this is where buddy letters and statement in support of a claim all come into play. It'll also be important to get an independent medical opinion and medical nexus letter. They all must be used as medical evidence in support of your claim.

I am rated 10% for Right Patellofemoral pain and 10% Left Patellofemoral pain. I was rated this back in 2016 and didn't know about the bilateral factor rating. Since the window has passed for an appeal, how should I go about refiling for reconsideration under the bilateral factor ( I'm rated at 94% service connected currently)

Brian, My claim is at regional ready for a decision, but the C P examiner did not do a ROM test I have a Dr appointment should I get a ROM test then and will the examiner take that into consideration?

@@LITTLEROCK2517 And the call came in yesterday on Saturday. The call lasted all of 3 minutes. The Dr. told me who he was and then asked me about my symptoms. He asked as if he was reading off the DBQ symptoms list. Then, he said thank you I'll let the VA know and ended the call. On Friday, the day before, I received a call from the VES scheduler. He told me I could have this C & P exam over the phone if I wanted and I said yes. I didn't know the Dr. would be calling me the very next day but he did and the interview was less than 4 minutes. I don't know the results yet as this happened yesterday.

Is it better to do a C&P in person or on the computer
If you are going for a range of motion C&P you'd want an in person. For all other virtual is fine, just make sure you're able to convey how your disabilities affect you on a daily basis. Best of luck!
How's the breakdown if you get about 300$ extra a month??

Hey is it ethical for the VA to force you to attend a second C & P Exam for Anxiety/Depression, 3 months after they sent me to the first one for the same Claim & Diagnosis, and which the 1st C & P Exam went totally in my favor?
David, this sucks I agree. Sometimes they schedule a second C&P exam to clarify something in your favor. It's not necessarily a bad thing.
Happened to me....they had the examiner or pressured her to change the favorable C&P exam and I was denied.....long story short.....they said it was due to my back not my service connected legs.....well I got the back service connected and now I'm asking the VA to approve the claim due to the fact that my back is now service connected...SO...never give up on these pencil neck pricks at the VA....
Not sure if it’s ethical but that is the process and you prepare for it, move through it and get to the RVSR to get your rating.

Ethical and VA don't go hand in hand......it's their game and we have to play it...under their rules and a vet gets lucky when the court over rules their legal game....Remember that the VA likes their vets dead.....can you feel the love I have towards the VA..we, the vets are honest towards the VA and they are deceitful at every turn...Don't get me wrong...I had some good ROs that got some of my claims approved right from the gate....
