    What the cashier is trying to explain is if you identify yourself ie take the mask off and let the cctv see your face so positively identify you and your vehicle reg number then should the bank not accept the coin they have your details to contact you!

      @The Oracle I am sure you are aware the exchange of goods has been made, so it is a debt/contract. The person in debt is willing to pay with Royal Mint Coins. But the bottom line here is not the coins, its a Civil matter and not a Police one. Which the Custody Sergeant has backed up. The WPCs got it totally wrong, and had no power to take the action they did. What they should have done was tell the Petrol Station Staff to put it down to experience and learn from it. End of the matter and don't waste police time again on civil disputes!

      The confusion has arisen from the fact that Royal Mint, a now private company, has produced these commemorative coins in order to make a profit, never intending for the coins to enter circulation.

      Money owed as the result of a commercial transaction is not debt in the legal sense.
      If the garage took a customer to court over an unpaid bill, and the court found in their favour, then it would become a debt and bizarrely the coins could then be used.

      @@EyeSpyAudit You could send a letter before claim, which the arrest being soo clearly wrong. They may opt to settle quickly. Especially if you may the claim directly again both clowns. They definitely won't have to money to go into a lengthy legal fight, especially knowing that the Duty Sergeant didn't authorise the detention, that alone blows apart any legal defence they may have.

      You obviously haven’t had any interactions with the police,or know anyone who have unfortunately there is many instances where police have made up stories, collusion with other officers, and some have even lied on oath, and a little research will back this up, so I respectfully suggest you maybe think about what your writing when telling someone they’re wrong, if you wish to point out how the person is literally wrong, then I’m happy to be corrected. 👍

    That is a £3000 settlement for sure. Although not actually detained under arrest, the 30 mins spent in the shop was detention under the threat of arrest if you left.

      @@John.Spandli Hi John, yes, I did know he was arrested but I just meant that the time spent in the shop was a detainment even if they never actually said so. This was because he was kept there under threat of arrest. Yes, he was eventually arrested but that extra time when he was unable to leave should be added to his damages claim. Time spent in unofficial detainment plus time before release plus damages for public humiliation in what may have been his local garage where people he knows may have seen him.

    As suggested by some others go for s claim. The fact they arrested you for making iff when you didn’t and the custody Sgt supported you means a settlement out of court. They just cannot fight the evidence you have. In addition a letter of apology from each constable.

    Taking the fuel forms a contract. Unless there are terms stating that £20 coins are NOT accepted then its reasonable to assume they are. The arrest is unlawful. Payment was made and there is a civil dispute about what is acceptable. The coins are legislated as acceptable "for payment throughout our United Kingdom" Pinky and Perky admitted they don't know anything about it but still think they can dictate their own rules. I hope you are successful in suing them for their disgusting disregard for your civil rights. We don't live in a police state. (Or do we?)

    The only time it becomes a criminal matter is if you’ve shown criminal intent not to make payment for that fuel. The offence is only committed when there is an intent to make off without payment, which you haven’t done because you’ve shown you wished to pay it. The offence of making off without payment therefore requires the suspect/person to dishonestly make off without paying for goods received or services done. You offered to pay, they didn’t accept so it’s civil. Jesus Christ some police officers make us have a bad name!
    It is a civil matter all day long.

    @2:28 the panic button is for armed robberies only. If they press it 3 times for non emergency reasons they never get a response again via the panic button. I used work for a security company and Asian shop keepers were the worst for this behaviour. Here we see how they will alert an armed response team for nonsense over a £20 dispute.

    Under UK law, a person cannot be sued over a debt if they have attempted to complete the transaction in question using legal tender. All Royal Mint coins would be considered as such in the eyes of a court. Whether the coin is ‘circulatory’ is immaterial.

      You're right, the Royal Mint website clarifies the the filling station did not have to accept the £20 coin as payment: "Please note that whilst these coins are legal tender, they are not designed for general circulation, so banks and shops are unlikely to accept the coins."

      That's the bit of law which always annoyed me when I worked in a supermarket...
      In the mid-2000s it was pointed out by the local cop in that area (my area has no local cops at all) that a thief can't be charged with theft until they've left the store.
      I never gave them a chance to leave, as I'd take the stolen items out of their hands/bags/coats before they walked out the door.
      However once that new or old law was pointed out, if we really wanted to get a persistent thief arrested, I'd have to let them walk out the door, before dragging them back in again.

      Legal tender does not mean what you think it does.
      Shops are not obliged to accept any form of payment you want to offer, YOU have to pay in a form they accept. Why? Because you are filling up your car with their fuel and using their services as a result.
      A lot of fuel stations still give out the "i owe you" forms for fuel, I've driven fleet vehicles whereby the fuel card for that vehicle doesn't work, we are given a sheet and either come back later to pay or it can be paid online. It's not uncommon and a lot of the time they will issue them. The problem is those people who think "they know" and would rather stand there arguing (wrongly) that as it's "legal tender" they MUST accept it, that's not the case at all.

      And a shop can decide what money to accept or decline.
      I often have Scottish bank notes.
      Despite being Sterling promissory notes, shops are under no obligation to take them.

    They said it would be a criminal matter once you walked out of the door a number of times. They did however arrest you before you left through the door therefore arrested you when it was still a civil matter. Common sense would dictate that the decision to arrest should only be made (if at all) once you left through the door. Their words and you had not made any attempt to leave at the point they mumbled your rights.

    £20p coins are legal tender for amounts up to and including £10. However, in the UK, "legal tender" has a very specific and narrow meaning which relates only to the repayment of debt to a creditor, not to everyday shopping or other transactions. In practice this means that although the silver UK coins we produce in denominations of £5, £20, £50 and £100 are approved as legal tender, they have been designed as limited edition collectables or gifts and will not be entering general circulation.     The prolific issuance since 2013 of silver commemorative £20, £50 and £100 coins at face value has led to attempts to spend or deposit these coins,[2] prompting the Royal Mint to clarify the legal tender status of these silver coins.[6][7] Royal Mint guidelines advise that, although these coins were approved as legal tender, they are considered limited edition collectables not intended for general circulation.
    Even a bank won't take them.

      £20 coin is legal tender. But just because something is legal tender doesn't mean it has to be accepted as payment. I.e a business doesn't have to accept £50 notes or even cash notes for that matter. BUT if a business provides a service before taking payment (for example pumping gas before paying) the business as to make clear which form of payment they do not accept. Since BP as not done this, they have to accept any form of legal tender.

    Police ignorance... like I’ve been stopped twice in my 57 year old classic car for not showing a current MOT certificate, even though it showed a current road tax exempt application and insurance renewal, 3 police officers jumped out of their car and approached me like I was a terrorist! Talk about the law not knowing the law! Police state? It’s not my place to educate them, but I did advise them to update themselves on the current road laws, which they did, told me to drive carefully, as I always do, then climbed back into their car and off they went, I was dumbfounded, embarrassed and frankly pretty furious!

    The petrol station can refuse any form of payment as long as it’s not discrimination, just because it’s legal tender doesn’t mean they have to accept it so you needed to agree a form of payment with them that satisfies both parties, with out that agreement you did commit the crime of making off.

    These officers failed to do the most important part of their job "investigate" all they needed to do was to contact BP head office for answers. Her supervisor needs to answer a few questions as to why he agreed to the arrest. A disgrace.

      They'll do everything possible to find any evidence against you and prove your guilt, but not a single thing to prove your innocence
