- On October 28, 2023 in Florida, police received a call about a woman threatening store clerks, because she was unable to get her payment to go through at the register. The woman was asked to leave but refused to do so and continued to be verbally abusive and began making threates to stay until close and bring people to "handle" the clerks. When officers arrived, they located the woman just outside the store. This is body-cam footage of the events that followed.

The subjects in these videos are to be presumed innocent until proven guilty in a court of law. As obnoxious as she is , she is actually correct. Failure to identify is a secondary charge. They can order her to leave and if she complies there should be no arrest. If there is no arrest she is not obligated to identify. There are videos on YTube where 1st amendment auditors specifically test this premise and win lawsuits in court.

If there is a party that has made a complaint against you the police are REQUIRED to investigate, if you obstruct their investigation then you have committed a crime.

The purpose of the 4th amendment is to secure citizens in their effects, documents, ID etc. The officer can only compel ID when he can articulate a crime they committed. If this woman refused to leave after warning, then it would be a crime. Here's an example of case law.
When law enforcement officers are just trying to issue a trespass warning on behalf of the property owner, then you are not required to provide them any information. However, if they ask you to leave and you refuse, then you are committing the crime of Trespass After Warning and you would then be required to identify yourself. S.N.J. v. State, 17 So. 3d 1258 (Fla. 2d DCA 2009) ("The officer was merely acting as an agent of the property owner to issue a trespass warning. Until the officer asked S.N.J. and S.F. to leave and they refused, they were entitled to refuse to identify themselves.")

I've had a driver's license for 41 years. In those 41 yrs I have never left my house without my ID. Does this age group purposely not have an ID just to be a hassle to law enforcement? I'm truly baffled. They are all so immature, they want everything given to them and will not take responsibility for anything.
