Another developer (if we stretch the meaning of the word) initiates a copyright takedown strike, then doubles down on stupid with an astounding confession of spite.
If there was any doubt that these takedowns came from a place other than petty attempted vengeance, let the story of Digpex Games put it to bed. Wow, these people.
RUclips isn't letting me directly reply to this comment:
"The problem here is, why is Jim not taking these guys to court? If they're making fraudulent claims, they're committing fraud - which is a crime. Why just whine about RUclips not doing it's job when you can make the courts do the job and actually provide a punishment for these people and an incentive for others to not try it either?"
So, here's how the law works, as I've been made to understand it.
I don't take them to court because I can't take them to court. What has to happen is they have to escalate it first. I get to counter-sue when a developer takes this far enough to turn their copyright strike into a full on DMCA case. If they take me to court, and fail there, THEN I get to fire back for damages. This is what legal folks have said on the matter.
So this is why I just "whine" about it on RUclips for now.
Too bad you can't get some kind of wrongful prosecution type thing on them. That shit needs to change!

This is obviously pretty damaging to many peoples livelihood and youtube willfully ignores this.

thelaughingrouge This copyright strike is not a legal action, it's something you trigger and which RUclips invokes under their ToS. As long as everyone's following the ToS, you can't really go after the developer as a legal action. You could go after Google, but you'd lose as what they are doing is shit, but not clearly a violation of any law; in fact all of this is in line with the Digital Millennium Copyright Act and its stipulations as to the responsibilities of content hosts in responding to copyright claims. The issue here is that the way RUclips is choosing to operate their response to this law is with complete disregard for the original content producers here. But none of that is on the developers, not legally. Ethically, yes, but not legally.

Jim's speech at the end was brilliant. He's absolutely right. The ONLY thing these developers will be known is via association with Jim Sterling. They're only known now for the story that people know through Jim. It's a legacy they brought upon themselves and it's a legacy they deserve.

And personaly I would hate my hard work, months and moths of work, to appear on this show, Because I put a lot of hours into my game. And it may look like shit, my game has a possibility fall into the categories that fit the games that apear on this show. And in a way I woud hate Jim Ster for that,

Say whatever you want about his magnum opus, he clearly did put a lot of hard work and dedication into the franchise and, while Jim's not a fan, he does admit a certain level of respect for Scott... then again, if it weren't for Jim's harsh criticism of a game he had made prior to that, Five Nights at Freddy's may not have existed.

I don't think this system has changed at all since it was introduced, what, 2 years ago? Besides, it's based on the "guilty until proven innocent" which is bullshit. If they had a complicated procedure that required actual effort to make a complaint, they could reduce their number and maybe even be able to have actual people checking if the complaint has any validity. This is an issue with the SYSTEM, not the law, that automatically thinks that you are guilty just because someone made a claim, removing your video and then making you go through the hassle of getting it back up.
In the real world, if things worked that way, you'd see people go to jail just because someone accused them of something, and then THEY have to wait 2 weeks in jail to see if the accuser will back it up with some evidence.

I saw that Peter Silk guy saying he reckons RUclips should fine any content "owner" that makes spurious or false claims and issue a 3 strikes system on them, meaning if they continue they're unable to claim on anything. I'm all for that idea. I'd bet it would wipe out a ton of them in a matter of days. I've had E-sports networks claim on my videos. Music licensing companies claim my gameplay VIDEO, not music, is theirs. I've even had other RUclipsrs (Hello Tbonepearson you twat). All eventually cave and give up their claims because they know they have no standing. Luckily I've not been hit with the DMCA yet, not on this account anyway. They really need stopping, especially as they aren't automated.

Daniel Linger There is an easy way to do such a thing. RUclips simply turns off the copyright claim system for all users who don't verify their account as a "digital content owner". To verify they simply need to send RUclips a copy of a valid form of ID and the copyright information for confirmation. Then once you are verified you have access to the take-down button in RUclips. Once you've abused it 3 times you are removed from the service for a period of say 5 years. Problem solved.

Do a review of a famous song, lets say Stairway to Heaven. Play the entire song while riffing it. Let's see if the video gets content id flagged. You should be able to exploit & profit from indie devs because they don't have the resources to use content Id?
Jim is profiting by using content that others have created. If he wants to film himself talking about how the game sucks without using the trailer, then there would be no issue. But if he is going to to make a video where he riffs the trailer and collects ad revenue, the developer should get also get a check. Some sort of revenue splitting.

As a budding visual novel developer with an interest into afterwards getting into full on game development, I can say with certainty that if you can't stand criticism, you're in the wrong business. Any developer worth their salt goes by the credo of 'Fail Faster'. Let other people test out your game, listen as they tear it a new one and find where the faults are so you can fix them as you're developing. I've done some small games as a learning experience, none of which will see the light of day as they were made simply to learn the ropes. Any real developer will listen to criticism to learn where the error can be found and problem-solve how to fix it. And no game should be released in a buggy, unplayable state and ask money for it, even if it's an alpha build.

But they don't deserve to take the shit of someone with some cult-following just because. Specially because, I know Jim made it on purpose. He knew the game was bad. He knew it was an easy target. ***** If you pay attention to what I've said, I do consider the game bad, I do think they should have never shown it to anyone. But I don't think Jim's position is correct. He should have just let the Devs alone. And criticized the Steam Greenlight system instead (yet again).

And yes I do defend the buggy and unplayable. As long as you keep it to yourself. I'm sure every book author kept their ugly and unreadable books to themselves. And that is essential for growth.
Steam Greenlight gives the devs the misunderstanding that it is okay to show your not so good creations with everybody. And that culture is bad.
But it isn't going to affect gaming as a hole if a bad game is trying approval on Greenlight. Maybe if Konami released an unplayable Metal Gear game, than that kind of criticism would hold important. Because we expect more from Konami.
But I do believe the devs that made this consider it to be their best work. So a little bit of sensitivity wouldn't hurt.
While making a game is difficult, the way that these 'developers' handled this matter was something I would expect of a spoiled brat. Yes, Jim makes money from his videos, but he doesn't just single out the bad ones. If you've actually watched his channel, there are a number of good ones he's reviewed. He has a biting humor, but that's part of his appeal. If as a developer you don't like someone's review, a professional shrugs it off if they feel a review is a blatant troll, or they take what the critic says and at least considered the points that are brought up. If they were in the right, they would not have done a copyright strike, as that is something you HAVE TO HAVE A LEGAL REASON TO USE IE THERE HAS TO BE AN ACTUAL COPYRIGHT VIOLATION. And if you listen to their 'reason', it reeks of butthurt. They sound like Anita, claiming to be on the side of a cause, while at the same time demonstrating that they have no real knowledge of what they're talking about.
Lucario Robert Yes it is true. This dev answered in quite a horrible way. But I don't they should have been attacked in the first place. You see, even if they answered Jim with the picture of a Platypus, it wouldn't make a difference.
So I hope you guys understand I'm not defending the actions of the devs. I'm defending their right to do so without being bullied. Which they were.

They are games made by punk ass developers who will undoubtedly censor have reviews using RUclips's and Steam's systems against them.
It's fucking dirty what these people are doing, especially a game trying to get greenlit.
What point is it to pull this type of shit when they all lead to same end result, the video comes back, the company is ridiculed, and gamers will be reluctant to buy a game from that company in the future.

Some creative types are under the impression that because they're produced a thing they should be immune to criticism because "I made a thing and you didn't". But really critiquing is the easiest way to lead to improving things. People tend to have blinders on that prevent them from seeing the flaws and foibles of their work, and you need an outside opinion to gain perspective. In some cases that opinion will be "You seriously can't expect people to pay money for this."
And really if this dev was genuine all they had to do was say "This is an incredibly early build, we're constantly working on it." But somehow I kinda doubt they're that self aware.

Nintendos stupid system only works as automated not sentient so it detects part of game and claim it; amiibos are borderline impossible to get claimed - for the figures that is.
It also doesn't take the video down, just claim as revenue otherwise a gianormous fuss would be raised.
If you're going to make a game, make a good one. Games will have standards, just like food, movies, paintings, and everything else. Games take a while to make and probably take more resources, but if you can't make the game you want, start smaller. Don't go for the big kill and try and make your dream game with an awful engine and awful coding. 15 frames a second and awful graphics and movement will not cut it in the industry. It doesn't matter if you're an indie developer or not. There are plenty of indie devs out there that have made great games. Just because you're indie doesn't mean you're safe from a review.
