Secondly you’re referring to character evidence also known as hearsay. “Because he did it there or someone else did the same thing in this circumstance” doesn’t fly unless it’s in a motion and generally it’s not primary authority that a court would base a ruling on. In the law everything is set by precedence.

      We def sympathize with the owner. 100% but a jury will certainly convict unless they decide to partake in jury nullification (seldom happens though). A lot of us live life under the presumption of fair play but this world doesn’t work like that. There are mechanisms (insurance, lo jack etc) to cover you for potential property loss. No matter how an individual values something.. it’s still property and the only way you make property damage right is with a check..$$$. Can’t make right someone dying. Again I’m not co-signing the thief. Simply explaining the legal co sequences.

      They didn’t make them easy to steal, they made them easy to repo which unfortunately made them easy to steal. The financing terms that were offered at the dealer attracted a lot folks that were low income and low character. Considering the demographics that these vehicles attracted, Chrysler knew they were going to have alot of repossessions so they made it easy.

    Knockout doesn't matter that he chased him. Texas law allows you to pursue. A grand jury won't indict this guy. The spirit of the law is that you believe only deadly force is possible to retrieve your property. You legally can give chase. Seems the only reason he was arrested was because they thought it was road rage and it was a teen.

    FYI, in Houston, you are allowed to use deadly force to protect your property. Also in a hearing, it was reported that Mr Cables had presumbly saw the thief reach for something, which prompted him to shoot the thief.

    In Washington DC, a young teen was killed for trying to break in a mans car, in the driveway. The case never made it to court, the shooter was arrested, but the case was dropped after the 9 month mark 🤔.

    You can’t just take insurance money and replace it. Insurance is gonna give you the used car value of your vehicle. So if you bought a hellcat for 65,000 and they give you 50,000, you better have gap insurance or you are on the hook for $15,000 to buy a vehicle if you can find it at the price that you paid for the original one. You might have to come up with $50-$80,000 to get the like vehicle nowadays. So insurance is not going to help you. If you modified it, you better have documented it.. And of course reported those modifications to your insurance company

    A great channel that covers guns, self defense and the law is Law of Self Defense with attorney Andrew Branca. In most states you can't use lethal force to defend property, but in TX you can (not if you chase them apparently).

    Im from Houston Texas He's going to go free...Texas Penal Code allows deadly force if:
    (2)
    when and to the degree he reasonably believes the deadly force is immediately necessary:
    (A)
    to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
    (B)
    to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
    (3)
    he reasonably believes that:
    (A)
    the land or property cannot be protected or recovered by any other means; or
    (B)
    the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

    Lawyer here 🙋🏽‍♂️. I think it’s important that in a situation like this that you verbalize that the rule regarding the use of deadly force to protect property is ONLY the rule in the corresponding jurisdiction. In this case, Texas. Everyone else who lives elsewhere, should check the rules in their respective jurisdictions and govern themselves accordingly.

    I wouldn't chase it down, but as someone who has had a car stolen in NC. If the insurance pays anything out you take a hit on your record. My insurance shot up after I filed the claimed. It actually almost doubled.

    If you don't follow those 3 simple things you could end up on the wrong side of the law...
    Unless your life or people around you aren't in threat of serious bodily harm or death you can not use deadly force

    I’m a Marine Corps Veteran military police/SRT. Unfortunately the law is the law. Yes we are all tired of people doing dumb shit to all of us but you have to think before you react. I’ve been situations similar and if I fired my fire arm I’d be in jail but I thought before I fired. It’s an unfortunate accident.

    Yes that’s the law, there was no immediate threat to the owner to discharge his firearm. If you own any weapons this is one of the first rules of owning a deadly weapon.

    One can make the argument that a 17 year old behind the wheel of a Hellcat is potentially more deadly than any civilian firearm could be. Let's start with the fact he caught up in his "wife's car." Now, unless his wife is driving something kind of on par with the Hellcat (maybe a Jeep Trackhawk), he'd never have caught up if the driver could actually drive well.
    These cars are stupid powerful. It would seem the kid knew this to some degree as he didn't take off and disappear. Just the same, it's pretty clear he didn't have a handle on the car. Otherwise, homie wouldn't have had the opportunity to squeeze a few off.
    This is an ugly situation, but the fact is that choices have consequences. On both sides. Kid stole the car, and lost his life. Man had his car stolen, and is now facing a felony because of his chosen response. Unfortunately, until they start cracking down on crime in general, we'll be seeing more vigilante responses as time presses on. People will not take it laying down, and I can't say I blame anyone for maintaining such a stance.

    Man if they break into your house let alone car, empty a magazine, drop it and leave...you cant shoot back..here in Texas..and you damn sure cant chase after them and do anything because now "they don't pose a threat." It was the same case in Afghanistan, if we had pid on someone shooting at us then they dropped whatever they had we weren't allowed to return fire or even go after them without risking going to the brig. These days, the only one's that can get away with harming someone that doesn't pose a threat are the police who enforce that same law

    Some people take it to street justice and prefer not to snitch ,unfortunately in this situation the car owner met his demise via going to jail. In his defense he could make the argument and say he saw the thief point a weapon at him while trying to to follow the vehicle so he fired in defense.
