      If a debt collector is trying to collect a consumer debt from you, the federal law applies.
      If "any person" is trying to collect a consumer debt from you, Florida state law would apply if you or that person is in Florida.

    I’ve asked a question previously with no response but we keep being hounded by a a company that’s refused to provide any verification of account we’re asked to cease and desist contact until providing that they’ve never done so or provided my rights as consumer to dispute I did send fraud packet police report etc showing this was a fraudulent account and they just emailed saying they don’t care the name on the checking account used had my name so it’s my problem now even though I had to close that account because the same person that opened the fraud account was draining that act and they are still reporting collections on my reports and is costing me closing on my house and the agencies have been provided everything as well and done nothing cFPB complaints filed nothing done still

    what if you ask for proof of the amount an what debt is for an they do not they just do not contact you anymore but put it on your credit report

      When a borrower disputes the amount of the debt, the debt collector cannot report that to a credit reporting agency unless they also report the factors disputed.
      So check your credit report. Are they reporting that it’s disputed? Did you actually dispute it or just ask for proof? Is there something else about the credit reporting that’s in accurate, incomplete, or obsolete?
      If so, your next step is to dispute to the credit bureau, and if the credit bureau refuses to remove it, then you probably have a lawsuit on your hands.

    Hello, I had a so-called foreclosure back in 2009. I was not aware of consumer protection laws back then. Can I now go after them for damages?

      Not in Florida, you couldn’t. I don’t know of any other state where you could.

    Another great video! was wondering if it were legal for a debt collector to repeatedly remove your collection from your record and put it back on in the same day and cost you a serious deduction in score and if so which direction i could start looking to be better informed thank you again for your time, and as usual fantastic video!

      By itself, this isn't a violation unless something about the new report is inaccurate, incomplete, or obsolete, in which case it can be disputed.

    One they got my validation letter they removed the account from Exp, Eq and started reporting to TU is this legal??

      Debt collectors are allowed to report to bureaus, as long as they report correctly whether or not you are disputing it.

    Thank you for your video please answer my question is a phone call sufficient I have been calling them for 6 months the paperwork is is tremendous and frustrating I have proved to them that I do not owe the balance then they send me a letter a settlement letter saying that I could pay like a third of what I owe which is $500 so they say but they can't prove any charges a question is they have been called and been called out I have not sent anything in the mail

      A phone call almost never works in your favor. (We’ve mentioned this is many of our videos)
      If they are sending you letters with false amounts or amounts not owed, that’s a sign you should have a lawyer evaluate your case for FDCPA violations.

    Hi Michael thank you for the video, I have a debt with Bank of America and was reported to a credit bureau with the amt. of $3,304 and the collecting agency is trying to collect the amt. of $3,304.33, so there is a difference of 33 cents. Is this still valid.

      Credit reports usually round to the nearest dollar, and that's considered accurate.

    Hello what if I disputed the account on Experian and they have listed dispute by consumer wayy before I started disputing with the credit Collectors ? do the collection agency have to state the account is been disputed by the furnisher now that I’m disputing the acct with them now?? Thank you

      When you send a dispute to a debt collector, the debt collector hast to report to the bureau that it’s disputed.

      1. Disputing through the website is trash. Don't do it.
      2. There is no "twice disputed" status. It's either disputed or not.

      phone has a mind of it's own asked to stop calling 5.2022 my phone only goes back to Nov 23.2022 to today 1.9.2023 but the same since may 22 so 37 calls in 48 days help still homeless in ohio

      Once you tell them to stop calling, if they call you again, you can sue them.

      Unfortunately, we can't help Ohio because we're only licensed in Florida.
      But if you're currently homeless, it sounds like phone calls are not the highest priority for you right now. I'd focus on finding shelter, and food, and income first.

    Isn’t phone accusations just “Hearsay”? In Ohio I can record the phone conversation, but in Florida, BOTH parties must know and agree to the recording, yes?

      @@RWlawFL I guess I am not seeing the answer. I have the capability to record my phone calls. Can I record the call with a debt collector? Or as I understand, in FLorida, I have to make them aware the call is being recorded, yes? I would think that a recording of the call would be proof of what they say to me.

      Florida is a two-party state and generally requires knowledge and consent of everyone on the call.

    Just record the phone call. They can’t lie about what they said that way - although they’re likely to try.

      Every minute you spend on the phone with a debt collector‘s a waste of your time.
      We recommend putting everything in writing, and mailing it certified mail return receipt requested.
      Remember that in some states, it can be illegal to record a phone call without permission of all parties.

      @@RWlawFL that’s true. Always a good idea to check the laws in your particular state. Where I live, the requirement is that at least one party knows the call is being recorded. If you tell the collector you’re recording the call, it’s highly likely they will terminate it immediately.
