I have a dog attack claim two years ago to date. I had an infection and surgery putting my in the hospital for a week. I was off work for three months and had an injury on the job do to my arm and my permanent injuries… that is in my doctors notes. I haven’t been able to work and I have being seeing my therapist twice a week do to ptsd. I worked at Ford motor company for 5 years as a temp and the day before I got hired in I was attacked. The dog that attacked me is a 160lb XL bully and I am the dogs second victim… the dog was been put down. I had a evaluation on the 27th of April but the insurance company sent the wrong policy and we filed an motion to compel and the judge gave the insurance company 60 days and changed my trial date.
The policy was for 300,000 each occurrence but in my county with a dog is declared dangerous you must keep a minimum of 1,000,000 and they are not trying to give that policy and this is an Homeowner association.

If a person who is 76 years old and falls in a supermarket due to negligence after a freezer draw was open and she fell over it and got a full tear in her Rotator Cuff and a labrum tear.
Now 3 years before she was treated for arthritis in this shoulder. My question is, does the age hurt her in court. And how much in the vicinity is she looking at. The supermarket has a video and the fault was 100% them or if any 90%. This happened in NY State.
Hi, I wouldn't say her age hurts the case if it is handled correctly. Of course a young person will statistically have more years to live and to be compensated for pain & suffering but an older person has their golden years and no one wants to have their golden years of life taken away due to negligence. That should have tremendous value as well. Ill see if I can discuss this in an upcoming video. Its a good topic. All the best !!

Can you please tell me if my spouse, who had a seizure at the post office while delivery his daily drop-off there and broke his right shoulder rotory cup and broke his lower back L 1Lumber. He was in the hospital for almost 3 months. We found out that he has brain cancer, which caused the seizure. But Hartford insurance company, which is giving him workman's compensation, said they will cover the shoulder operation but not the Brain tumor, which. I understand. But until this day my medical insurance, which my spouse is on has paid for everything. Do you think we have a case for law suit, to make them pay for what they said they would pay? We have it in their E-mails to us. Thank you.

Inactive means they are not handling this particular case. Maybe they were in the past

Some of these verdicts are chaep. I know times are different but come on the lawyer gets 1/3 plus you have to take into account of medical bills. After all that the client probably only receives a little over 100k. Waiting six years + is crazy for such a little amount.

The doctors and hospitals bills are usually cut 2/3 to 3/4 of what was billed. If case goes to court, lawyer charges 40% to 50%. 5 year wait is common.

Thanks for watching. Yea if there are multiple insurance policies that are applicable to the loss you can obtain funds from both. With work it’s usually one or the other. If you are working it’s workers comp but if you are not working then it’s your personal auto insurance.
I had fell down a storage hole on the sidewalk in 1988. Never sued anyone. Was young and no knowledge back then. Is it too late to get something for my injury now?
The statute of limitations in New York is 3 years. Most states are about the same anywhere from 2 yrs to 4 yrs. the only way you could do anything from 1988 is if it happened when you were a child. Then the SoL would run from when you turn 18

Hi attorney good day. All videos are very helpful. I just have a question. I got injured at work lifting patient. A bulging disc or herniated disc that leads to fusion surgery and discectomy. I got 6 screws and a rod on L4L5S1 fusion. I got injured July 28 2020 and suffered so much . Injection and therapy are given. After at least 6 months of injury and therapy doctor ordered a reconditioning therapy to go back to work even my my therapist was so surprised because my back is not ready. So it not work that way worst pain ever developed scoliosis and more shooting pain and numbness so doctor finally decided to do fusiion abd discectomy in my lumbar it give a little relieve for a shooting pain but it give a different debilitating pain in my lower back buttocks hips and leg and even sciatica. the doctor then said he had ti discharge me because theres nothing he could do in regards of surgery and refer me to pain management. the question is . mg last mri shows mild disc bulging on l2 and l3 and pain management stated nothing to worry but I can feel the pain in my l2 l3 area . can I bill the workmans comp for an ortho doctor to check my l2 l3 even do the injury is only l4l5s1. thank you so much and sorry for my long message
Hi. Sorry to hear that. Which state did this happen in ? I’m not too familiar with workers comp as I specialize in the third party personal injury lawsuits. But it definitely sounds like you have a serious case worth a substantial amount. If this was in New York then yes you can have the ortho doctor review it and it will be paid by workers comp. You just need to get authorization from the WC judge at a hearing.

Auto injury is limited to 20 thousand. Rare to get that verdict. Texas
Auto injuries can be many many millions. Just settled an auto injury for $1.4 million. 20k if it’s a 25knpolicy sure but that’s the minimum.
Fender benders don’t bring big settlements. I worked in this field for 35 years.

If your arm was torn off and reattached, maybe a few thousand dollars. Remember, you are partially at fault for driving. That’s what the insurance lawyer will say. Remember, the word INSURANCE cannot be used in court. The jury will feel sorry for the poor driver that hit you and the insurance lawyer will use whatever he can find in your past to make you look bad.

I served on a jury where a lady suffered a back injury from accident that was obviously not her fault. I keep falling asleep during the boring trial. It was sad , the hurt woman was very obese and medical records showed going to several doctors and getting plenty of prescriptions for options, making her appear to be an addict. One the jurors was assisting that we not award her anything and the rest were agreeing and wanted to home. I wanted to give her at least medical bills and some money. In the end we all agreed to the medical bills and basically no money. I think the judge did changed our decision and had more money awarded for pain and suffering.
