I fell and ended up herniated my disc in my lower back. I went through all the treatments and took 4 epidural shots. Now I am going to get surgery next week. I lost my job 😕 and in so much pain. I hope I can get half of what this guy got.
What if someone has alot of medical history , pre-existing condition that is similar to accident but got then got hit by a commercial truck and then now has bulging discs on neck and back ? How much you think its worth and good to go trail or bad ?
As long as the truck crash made the prior medical condition worse you can sue for the aggravation of the condition. I have made some videos just about this topic

Hi. Definitely ask your lawyer as they will have more indepth knowledge of the case. If your insurance is filing the claim then it could be subrogation to get reimbursed and shouldn’t affect you. With UM once you’ve obtained the full amount of money from the defendants policy then you can go after your own if your policy has higher monetary limits. And your passenger should not be liable personally since they are filing against the insurance. Sometimes household auto insurance plays a role if they have different insurance from the one you have.

@@Tekevin I don’t think it should raise her insurance premiums. Yes it should be under your insurance but possibly the passengers insurance gets triggered as a household policy. I wouldn’t worry about it.

Semi and trailer were mine. Business is mine. My truck and trailer burned to the t hit my e passed away iground. Man who caused crash passed away in crash. My entire life is upside down. I have a lawyer and he doesn’t believe it will go to travel. Do you think this will turn out in my favor? There were witnesses that saw driver all over the road 5 miles before crash. He initially hit the first Semi then hit a second small box moving truck and then hit me head on. He had something in his truck that was feeling the fire because my entire truck was burned to the ground along with his truck and trailer and only 18 minutes. It was horrific how I didn’t die that day. I will never know but thank God somebody helped me out of my truck otherwise a few seconds later I would’ve died because my truck was in flames.
I was rear ended by a dealership mechanic because he said his truck had bad brakes and he still took it out on the road am I able to sue on the note of him being reckless and taking a bad truck on the road knowingly this is in Florida

Question: I was hit by a drunk driver , I already have 3 herniated discs from 18-wheeler accident that hasn’t been settled, but This drunk driver who hit me has the minimum of $25,500 and my hospital bills came out to be $46,789; will I only get the drunk driver policy limits . Also the drunk driver went to jail for that along with hit-and-run charges, so the Drunk driver got all the tickets and went to jail
Usually if the policy is only 25k you would be limited to that unless you could open the policy under bad faith law or if there is UM coverage. For example if your own policy has more coverage you could get more once you obtain the full 25k. Definitely speak to a local personal injury attorney !

It was a company work truck so there were many layers of insurance coverage $1 million then $10 million in umbrella/ excess I believe. There is also the bad faith open policy issue since the insurance co did not pay in response to a prior settlement opportunity so when all is said & done the verdict is worth $12 million

If they don’t pay quickly gonna tell my attorney to use the good faith trick I learned on RUclips! . You pay insurance your entire life and when it comes time for them to pay you they try to dodge! Yes. It’s different in every state. In New York it gets paused for kids until they turn 18 years old. In some med mal cases the statute is 10 years from date of malpractice or when they turn 18 whichever comes earlier. Have to research it further but that’s what I recall off the top of my head

My case is near this except the person (driving an Amazon wrapped vehicle) ran a stop sign, totaled my suv, I lost my job because of the injuries (but they actually sent an important document with deadlines after the deadlines ended which would’ve caused me to lose my job although I never missed a day= they never sent me the email. I just do happen to get into a car accident that morning before work.) I had to appeal unemployment to the top tier and finally won the case 7 months later. In the process, I’m now losing my home from all of the time in between. My case is in negotiations but there were 6 claimants (myself and my 2 kids and another car was hit while sitting at the stop sign with 3 people in the car.) the policy is a minimal policy. I went to therapy from September to March 2022. I received 2 injections in January for the herniated discs. I have 3-5 in my left side of neck. Am I being treated fairly in this? What else can I do?

Yes because a herniated disc is without surgery or pain management intervention procedures it is considered soft tissue.

The longest time period would be the state statute of limitations which starts to run when you turn 18. So 38 years would be too late unfortunately.
