Question sir. So ive heard some things about how this works. If someone trips and falls in a workplace (faulty floor mats) . Been complaining about the mats for months and nothing was done about it. How does one sue the employer if once you accept workers comp it prevents you from the ability to sue. According to Florida law it says once the person is on workers comp it automatically prohibits the employee from suing the employer. So who exactly is the employee suing
@@rindershow212 The handling attorney needs to do a full investigation and see if any third party is responsible. Sometimes there is no one except the employer so that is known as a straight workers comp case. But if there is a third party then you can have both a WC & a personal injury case. For example if someone falls at work because a cleaning company leaves a puddle of water. So its an accident at work but the cleaning company is not the plaintiff's employer so that becomes a personal injury lawsuit. Hope that helps

I was involved in a car accident where a tow truck transporting a vehicle lost its tire and hit my vehicle, so far I never got a call from the tow trucks insurance. Been going to physical therapy for 2/3 months now. Is it possible this could be a lost case?
Yes I am very familiar with this type of crash. The tow truck's insurance is not just going to reach out. You need a local lawyer to send a letter of representation, start a claim, & perhaps file a lawsuit. This is a good question so Ill try to shoot a video to answer it and post it next week. I can't believe you would suggest a fusion surgery!!!! Don't do that people!!!!!! It's painful and barbaric!!!! Usually it leads to another and another..... I can't believe it's legal, pun intended!
Not sure what you mean. We never suggest any surgery. Patients decide what to do based on their doctor’s recommendation as well as their symptoms. I only mention common injuries and procedures as part of the explanation of the lawsuit process. Fusions are very serious and usually the final step only to be done if nothing else works.
@@AttorneyArkady you specifically mentioned fusion surgery at the beginning of your video. Maybe re-do that part if you really don’t know what I’m talking about. My brother had “2” & is considering a 3rd because he’s in so much pain due to the first two. Unfortunately I didn’t live in the same state and lost touch with him and didn’t know he had already had 2, I would have blocked the hospital doors. I’m really mad at myself, not you sir. But yes, you mentioned it at the beginning. Doctors are mere human. That’s why they call it practicing medicine. I don’t mean to be rude but thank you for the rest of your advice.

Question for you! My attorneys office called after signing with them 5 weeks earlier to tell me that the litigation attorneys are taking the case on since it’s a big company. The initial attorney informed me the case may go to them but I don’t remember why that would be needed? Why would this be? Is this indicating it’s going to trial? I am the lady who was hurt in an elevator by the door crushing me in Vegas.

Any third party. You cannot sue the employer but you can sue anyone else that was negligent or contributed to the fall
