  • The plaintiff gave the defendant a deposit for a car. Unfortunately, the plaintiff found out the insurance was too expensive, so the plaintiff asked for her money back, but the defendant refused. The plaintiff is suing for the return of her deposit. The defendant argues the plaintiff is just being indecisive about the vehicle, and he believes he owes her nothing.

    I've seen on here before where the judge denies them anything if they turn down the offer...she says you should have taken the offer and awards nothing...must have been in a generous mood

      @@Stressless2023 Not hypocrisy, the defendant outed himself and obviously was an honest person to say that 1) he offered to give her $1,000 back and 2) Admitted to selling the car so he doesn't get free money to profit off the plaintiff and whomever he actually ended up selling the car to. Think before typing, please lol. 🙄

      From what he said in the hallway interview that car didn't help him get any dates so I don't think he's been sleeping around, at least not when he was driving that car. 😆😅🤣 I also agree with you sleeping around with random people 🤮. I don't understand how people can just go out and do that every weekend and not even know the person. 🤔

    Each and every time before I've bought a car, I checked my insurance carrier to see how much it'll be to add the car to my policy.

    This doesn't make sense because a factor is missing unless I missed it. They didn't say how much plaintiff was buying it for in order to determine defendants losses from the sale.

    When i went shopping for my last car before i even looked at them i called my insurance agent to see how much coverage will cost i also look up make, model and year online to see if there was any major issues reported or recalls. When making a large purchase like a car you should do all the research you can so you understand the financial decision your making.

    The defendant is lucky the plaintiff was able to sell the car before they came to court or she would have gotten nothing. I check the insurance rates of a car I’m looking at before I purchase it. Lol 😂

    I think that the Smart car 🚗 wouldn’t be safe in an accident especially if a big rig 🚛 any large truck 🛻 SUV 🚙 hit it.

    PLEASE EXPLAIN - deposits are non refundable by default. Also, making a promise to give something is not legally binding. Why is it on this case? Why did the defendant have the responsibility to mitigate the damages?

    Guess what I did Ms. Plaintiff lady. Before I bought a new vehicle I called my insurance company to see how much my insurance would be before I purchased it. Took about 5 minutes!! lol

    Where do car delearships take deposits to do their job? I have 2 cars leased and neither required a deposit when running credit and numbers. Why would it? So weird..

      Why lease? It's triple the expense and you never own it. Just rent a car from enterprise. It's way cheaper

    I would not offer to give anything back. She put a deposit on it then later said don't want it. That's her problem, if she doesn't want it she can list it for sale.

    this dumb lady should have gotten ZERO back. she is lucky the defendant is a genuinely good honest human being. it always baffles me when they try to say "but it doesnt say its non refundable!" and then the judge asks "does it say it is refundable?" and then they look dumb lol.

    Why do people give a deposit AND THEN get insurance quotes or have it checked out by a mechanic afterwards? Being unable to insure it is her problem, not his. He'll probably have to give back some of the deposit, but she should have to forfeit most of the deposit due to her own stupidity.

    I don’t understand why Harvey is always saying the exact opposite of Judge Milan. Every single time she talks about deposits being non-refundable as the default in a case, he says in the wrap up that if it doesn’t explicitly say non-refundable, then you get the money back.

      Actually insurance on smaller cars like that is ridiculously expensive. They're usually a total loss when they're wrecked and the occupants are hurt/killed. Therefore it cost insurance companies more.

      @andred7415 I will agree there. If it really was that much then something is up. But we had a 15 mitsubishi mirage hatchback which is a tiny 3 cylinder car. We were in our late 30's with no tickets and it was our most expensive car to insure. When we asked we were told it was because of the low safety rating.

    The car wasn't a Mercedes, it was made for them. Thats why it never had a Mercedes badge.
    It also only got like 36 mpg and had 2 seats. It bombed.

    Not even 30 seconds in and I know who's wrong. Why don't people know that leaving deposits is non-refundable unless it is stated in writing that it is refundable? We live in a time where everyone has mini computers in their pockets. Why don't people use them before making financial deals? I see it all the time here on people's court. How do we live in 2023 in people still don't know how to make financial deals?

      Well, it's quite simple. People are DUMB. I know this because I am, unfortunately, one of those people at times. However, even the dumbest amongst us know how to operate a cell phone and figure out a quote or at least I think so. Evidently, she may not know how to, and considering her age (most likely 50+), not have a single clue. Maybe I'm wrong. I don't know. I'm no genius.

      Because the defendant was honest and said what he said, Milian's hands were tied by what he said cause he admitted to a verbal deal with the plaintiff. If he had stood there silent, he wouldn't have paid the plaintiff anything. All depends if you can live with yourself by not telling the whole truth at the risk of getting caught. If the plaintiff had known he had sold the car and lied to the judge, then he'd have had to pay the 1500 entirely.

    WHY does she ALWAYS rule differently? She FORCED one man to buy an item for thousands of dollars after he put down a deposit and changed his mind. He didn't just lose the deposit, she made him complete the sale and buy the item! She told another guy he gets ZERO of his deposit and said Nothing about "mitigating damages". She never even asked if it got sold. She can have 10 IDENTICAL cases and make 10 completely different rulings! How did this show last for so long? How did they not get sued for blatant disregard of the law?!! Honestly curious how she hasn't gotten in trouble even once?!

    Harvey was nasty and rude to the gentleman who tried answering his question during the break. He's just like Milian and Doug! But overall this case ended on a high note because of the defendant's honesty about returning $1000 which is a rarity.
