I’m with the plaintiff. There’s no way the lug nuts should have fallen off in a day. He should not have had to make a second trip to the shop for a job done poorly the first time around. Period.
I was a mechanic for 10 years automotive and diesel. They didn’t put those nuts on tight enough. Most of those cheap tire places don’t even use torque wrenches. Every car has a different tightness for the lugs. Not torquing them enough can allow them to back off. Tightening to tight can cause your rotor warp causing vibrations.
My dad taught me how to change tires and and change oil at 14 before I got my license at 16. At 4'9"/90 lbs soaking wet, I've had to stand on my star to get lugs off AND to ensure they're on tight enough for me to trust anyone who might've stopped to help me change it (just because I know how, doesn't mean I want to do it in a dress😂) Then I worked for a dealership in the service dept my last 2 yrs of HS & 2 yrs of Jr college. My mouth kind of dropped when the defendant's guy said that they have a 'really expensive impact gun.' Like the cost of the impact gun is somehow going to make the person using it competant🙄

I commend the plaintiff's patience with the judge because i really like the way the man basically said he could only afford 2 tires which were obviously used for $80 and later when he states he still had to drive the car while it rattled she says "because you didn't want to pay for a tow!". No, lady, if the man didn't have the money for a full set or at least 2 brand new tires, what makes you think he had the money for a tow? Yeah its dangerous for him to drive like that but sometimes life hits you out of nowhere and the answer isn't so cut and dry. I do think she makes sound judgments ultimately and does right by the law but sometimes her side comments sound ignorant and, even worse, ill-intentioned.
This is unfortunately very common for people who are, and have been, wealthy for a long period of time, not having to worry or think about their finances and because of that, they've kind of lost touch with reality and the ability to relate to the average person. I see it all the time with Judge Judy as well. She will make comments about how a few hundred dollars isn't that much money, when in reality, it's a lot of money to the majority of average people. I have also noticed how it has hindered her ability to properly determine the value of certain things, typically significantly undervaluing them, most likely because she probably doesn't do her own shopping or handle her own finances and it's been so long since she has done those things, that her only point of reference is from decades ago, before she gained her wealth.

I work for a school system. Some resource officers get paid like a substitute. It's either 4 hours or 8 hours. I'm clerical, but I'm on salary so I get between hour pay. He might also not be eligible for any type of benefits, which would give him PTO/ paid time off. In Rochester can be pretty rough. So they're probably just thankful that he even comes to work.

A lot of guys use "Torque Sticks" in shops today. But I religiously use a torque wrench after many years of working on the same cars in the long term. It's honestly the only way to be sure they are right.

This happened to my dad. He went to a tire shop they changed his tire and he got on the highway and boom tire came right off!! Hit a lady driving behind him and messed my dad’s truck up too. The tire shop had to pay up!!!
I been in that same situation where I had to choose. Pay the lights or get a new tire. Things were hard for me then. Never been in a situation where the Lung nuts fell off, but if they did. I would be upset because....do you know I waited another 2 weeks to get paid and used my last. Last thing I need is you guys not doing the job correctly

Luckily I realized why the car was vibrating (all the nuts were loose on one wheel and one lug bolt was broken) I called my mechanic, who took full responsibility as we just had brake work done. He contacted a shop at our destination and paid our bill.

At first the plaintiff is likable and no way did he loosen the lug nuts however the $511 he sought made me like him less. He wanted extra money for things he's not due plus he had been driving around with dangerously damaged tires. The Judge doesn't reward greed. The litigants each receive an "appearance fee" of $300 so the plaintiff did very well.

First , the tires were beyond bad at least 2k miles (minimum) ago. If he works for the school system (which I do) he gets paid monthly. **Correction: unless he's paid as a sub, then it might be bimonthly** Even driving from work to school & home in Atl could put him close to that in one month. BUT there is public transportation more than not. Even in surrounding suburbs. And if he has to be to work that early, he's at the high school level. Our high schools employ minimum 500 staff, ALL staff. Custodians & cafeteria workers get in at the same time 6am. We have 10 custodians & 15 cafeteria & I'm at one of the smaller elementary schools. So you know that means there are at least twice as many of each at the high school level. Not ONE person was available? And that means that there are at least 50 people he could ask to bum a ride with. Just need to put it out there. Years ago, a young mother who went to our church was driving on bald tires (& this case goes to show that it is not necessarily just women who don't pay attention to their vehicles). She was driving w her daughter and niece. Car hydroplaned, crashed, ejected her niece, daughter died in the car fire. It was all over the news for months. Few years later, the grandmother (paternal) tried to sue her (the mother) for wrongful death of the granddaughter. As if losing your only child, the child of that mother, wasn't torture enough. Judge dismissed it. I've been in a situation where my former spouse actually would NOT take the car even to get used tires (which is what this guy did because new tires on any Volvo would be more than he paid) Anyway, I literally was on tread and the air seeeped out. Called spouse (only because I was in a dress that day. Dad had taught me how to change oil & tires before I even got my license when I was 14. Then I worked for 4 years at a Cadillac dealership in the service Dept thru hs & jr. college). Spouse wouldn't pick up. So I put a sweatshirt on upside down over my legs, changed it. Got home. Filed for dv a few months later. (This was the pinnacle of stupid isht that had befn piling up over the years.) So I got rid of two guzzlers, one was a gas guzzler, the other was a sanity guzzler! I've maintained all my subsequent vehicles top notch. But it's just my automatic habit to look at my fellow teachers' cars when I pull into the lot & I hate to see worn & bald tires & if I mention it, they just say, 'Oh, my husband will take care of it.' Then why are they bald?🙄
I wonder if this tire shop had anything to do with tightening the door plug bolts on that Alaska Airlines 737-9 Max? Seriously, the tire shop obviously didn't torque down the lug nuts to factory specs like they should've. However, Mr. School Safety Officer, the plaintiff is an idiot! Once he noticed the lug nut issue, should've parked the car and made the shop come take care of the problem on the spot or at least have the car towed in for safety reasons.

This is exactly why I never trust a shop to install my wheels, impact guns are not what you need, they need to be torqued properly and then retorqued after the car is driven a bit

This is why we take our truck/suv to one 1 shop that we trust. My audi suv, I took to another shop once and the idiot worker didn't know how to get my tire off the rim. He put a hole in my tire trying to get it off. Then tells me he couldn't do it put it back on my suv, and I live 3 miles away, I get home and 30 mins later it's flat. We had to jack it up get it off and take it to the shop I should have went to. I have also had a dealership not put all lights nuts back on my husband's truck. I always check stuff before I leave the place now. The dealership did fix it when I went back made as hell.

Many years ago this exact thing happened to me after getting a tire at Sears. When I went back the shop completely denied it of course.

Cars come with a jack and lug wrench. He could have tighten the lug and borrowed a lug bolt from other wheels to get him back to dealer.

My dad taught me (his daughter) when I bought my first car how to change a tire and that included making sure lug nuts were tightened really well before driving it. How to check all the fluids change the battery and jump-start it if I needed to. That first rumble should've had him tightening those lug nuts right away...not driving around making it worse. Duh! That's assuming he didn't loosen them himself to try and scam the defendant.

3 hours of work is 44 dollars for this gentleman. He clearly doesn’t make that much money. Being poor is expensive and I feel for him. Sometimes the judge (and the comments) are insensitive to the plight of others
At first the plaintiff is likable and no way did he loosen the lug nuts however the $511 he sought made me like him less. He wanted extra money for things he's not due plus he had been driving around with dangerously damaged tires. The Judge doesn't reward greed. The litigants each receive an "appearance fee" of $300 so the plaintiff did very well.
I think the judge overestimates people’s work ethic…anyone in management knows the lengths some people go to to avoid work

First , the tires were beyond bad at least 2k miles (minimum) ago. If he works for the school system (which I do) he gets paid monthly. **Correction: unless he's paid as a sub, then it might be bimonthly**
Even driving from work to school & home in Atl could put him close to that in one month. BUT there is public transportation more than not. Even in surrounding suburbs.
And if he has to be to work that early, he's at the high school level. Our high schools employ minimum 500 staff, ALL staff. Custodians & cafeteria workers get in at the same time 6am. We have 10 custodians & 15 cafeteria & I'm at one of the smaller elementary schools. So you know that means there are at least twice as many of each at the high school level. Not ONE person was available? And that means that there are at least 50 people he could ask to bum a ride with. Just need to put it out there.
Years ago, a young mother who went to our church was driving on bald tires (& this case goes to show that it is not necessarily just women who don't pay attention to their vehicles).
She was driving w her daughter and niece. Car hydroplaned, crashed, ejected her niece, daughter died in the car fire. It was all over the news for months.
Few years later, the grandmother (paternal) tried to sue her (the mother) for wrongful death of the granddaughter. As if losing your only child, the child of that mother, wasn't torture enough.
Judge dismissed it.
I've been in a situation where my former spouse actually would NOT take the car even to get used tires (which is what this guy did because new tires on any Volvo would be more than he paid)
Anyway, I literally was on tread and the air seeeped out. Called spouse (only because I was in a dress that day. Dad had taught me how to change oil & tires before I even got my license when I was 14. Then I worked for 4 years at a Cadillac dealership in the service Dept thru hs & jr. college).
Spouse wouldn't pick up. So I put a sweatshirt on upside down over my legs, changed it. Got home. Filed for dv a few months later. (This was the pinnacle of stupid isht that had befn piling up over the years.)
So I got rid of two guzzlers, one was a gas guzzler, the other was a sanity guzzler!
I've maintained all my subsequent vehicles top notch. But it's just my automatic habit to look at my fellow teachers' cars when I pull into the lot & I hate to see worn & bald tires & if I mention it, they just say, 'Oh, my husband will take care of it.' Then why are they bald?🙄

You are not supposed to tighten lug nuts with an impact gun. It's gotta be torqued to spec with a torque wrench.

Seriously, the tire shop obviously didn't torque down the lug nuts to factory specs like they should've. However, Mr. School Safety Officer, the plaintiff is an idiot! Once he noticed the lug nut issue, should've parked the car and made the shop come take care of the problem on the spot or at least have the car towed in for safety reasons.

every car comes with a lug wrench and a jack simply take one nut from the other 3 wheels, not too bright driving on one lug nut. How is it that a grown man has no idea how to work his nuts?

If he hadn’t asked for free tires I might believe the shop was at fault. But since he wanted the lugs and the cost of his tires to be paid for it’s possible he loosened them on his own to initiate a lawsuit. What grown man doesn’t know how to tighten a lug nut? A five yr old could figure that out. He was trying to scam.
The problem is it's super hard to loosen machine tightened lug nuts. Which is the reason that machine is used.

This is exactly why I never trust a shop to install my wheels, impact guns are not what you need, they need to be torqued properly and then retorqued after the car is driven a bit

He is irresponsible as heck to drive like that but went to file a lawsuit immediately. People and their priorities. I’m sorry but as a grown man and you someone husband you need to have sufficient funds for tires. For the tires to get that bad they had to be almost a decade old that’s trifling. Tires last like 5 years and then you can still run them down another year after that. Ain’t no excuses for the wires to be out to the point where the police stopped you that’s trifling, lazy, childish, and absurd.

3:10 Usually a “little shimmy” feeling from a car can mean a tire is off balance, or the tire is loose. Who doesn’t carry a crow bar in their car, or basic tools?
This is why we take our truck/suv to one 1 shop that we trust. My audi suv, I took to another shop once and the idiot worker didn't know how to get my tire off the rim. He put a hole in my tire trying to get it off. Then tells me he couldn't do it put it back on my suv, and I live 3 miles away, I get home and 30 mins later it's flat. We had to jack it up get it off and take it to the shop I should have went to. I have also had a dealership not put all lights nuts back on my husband's truck. I always check stuff before I leave the place now. The dealership did fix it when I went back made as hell.
