This was great info despite a lot of it being inapplicable to the unique fact pattern in my situation. Several of our claims are intentional torts, which are outside the realm of insurance coverage. Fortunately, the doctor is a straight up employee of the hospital. This one is going to end up in front a jury.

Yet missing in two certified records release. Fools don't realize that I made a personal records request and got a copy before they destroyed it:)

@@AttorneyArkady Will reach out early this week. It gets better. Doctor had a prior wrong surgery. While prior bad acts are not admissible as character evidence in this particular forum.. They are admissible as evidence of knowledge and/or motive.

If you receive an offer that you feel is satisfactory then yes. A structure is just periodic payments instead of a large lump sum. It can be good if the total pay out is much higher compared to a lump sum.
I believe the police in my accident case is 500k an it's a soft tissue case, but most likely I'ma need a surgery just not the fusion. Even though I'm categorized as a pre existing injury from about 5yrs ago. Bcuz it's not a fusion surgery are you saying that I won't be able to obtain the whole policy? An if not then from your experience, wat would be a fair an reasonable or good faith offer,
You can still obtain the full policy or large amounts even without fusion. Depending on the overall injuries and medical diagnosis so we would need to know what surgery. Also where it happened. Feel free to text me 347-566-9595. All the best to you
Sir, I need you STAT lol. Have a quick question: in an injury case where the case is still pending and in the interim, the claimant gets approved for SSA/Dis - does that strengthen or weaken the case? Typically speaking, if that’s applicable. I highly appreciate you!
I would say being approved for disability would strengthen the case bc it confirms the injury is serious if the approval is because of the injury sustained due to defendants negligence in the case

Ok good to know. The person that hit me took responsibility for the accident as long as I don't sue him personally. The lawyer I had agreed to but I didn't know. But they added that the fully policy be admitted which is 1.2 mil
I would not agree to that because then you lose the leverage of bad faith. If the insurance co knows it’s limited to the policy and there can be no excess verdict for above the policy they will offer less money.
