Dr. The Hospital provided our attorney with only 165 of 365 pages that were transcribed by a separate company and whenever we try to get them they give us partial records. Atty was unaware. The person was an attorney with high earnings from top NYC firms. The H also changed the records to misrepresent the times etc. Similarly the primary Doctor (practice bought by another H) has denied access. Now I have contacted Department of Health and Human Services - office for civil rights. The person died later. Can I sue them, not for medical records, for corruption ?

That's a great question....that is a possibility and your attorney would be able to opine on that question better than us.

The lawyer is getting ime to cancel my fce and question my doctor
I have five vertebrae fused with spinal cord damage.
The company is still trying to get me back on a roof when I have 20 pound restrictions.
I’m literally lucky to be alive and I have these strangers telling me how strong my body is . 😢

Drew, your IME will never be able to cancel the findings of a well executed FCE. The IME may give causation of your injury but it will certainly not draw conclusions as to how your life has been affected by your injuries....more specifically your ability to perform work related activities, activities of daily living, or leisure activities.
