The cop was bouncing off The Constitution like an underpowered BB hitting a 300 year old stone wall...At the same time the motorist wasn't chewing the cops ass,,,he was chewing around it until if fell in the street...THAT could have resulted in a littering charge...

      When detained for "suspicious activity"...
NEVER argue if your activity is suspicious or not. It doesn't matter.
ALWAYS argue that Brown vs Texas makes it illegal for cops to detain for mere "suspicious activity". They need reasonable suspicion OF A CRIME.

Police employees are being TRAINED to treat the American people in this manner. It isn't about "a few bad apples", this is about conditioning the masses to accept this tyrannical madness! EVERYONE should treat police employees with derision all of the time. They are drunk with power and should be ridiculed, shamed and shunned whenever possible. They're the new "King's guard" in the colonies and far worse than the Red Coats ever were. Still they see themselves as heroes!
Are criminals a concern for me? You bet!
Not enough to ever call the blue gang on myself!
Police forces in the U.S. are the standing army our forefathers warned us of.

The officer even admitted to there being no problem. At that point in time the officer should had followed his policy and left especially after he was told he was dismissed. They are public workers and if your not breaking the law they do have to serve and obey you. Even if he was in another neighborhood I doubt it would have went differently, and even if he was arrested the cop would be very very sorry. To unlawfully arrest someone is a serious crime, which comes with revocation of your police duties as well as huge fines that have to be paid out of pocket. In some cases with another cop that could have easily gotten him arrested, injured or even killed, his car towed, cost him a fee to get bailed from an illegal arrest from a charge that was dismissed and the cost of a lawyer to defend him in court if it went that far. That could have come to a several thousand dollars. I think it is important to not surrender your lawful rights, but in a less confrontational manner. I've interacted with cops just as successfully by not entering into a consensual conversation with answers to their questions. I wouldn't call a cop a clown. I would merely refuse to speak to him or encourage him with humiliating names to violate his oath to violate my rights. I have responded in this manner to the few times when a cop has "pulled me over" and proceeded to question me. It works well at least as, and maybe more often, than getting down to name calling as this person did.

You make a great but obvious point.
      Suspicion= ignorance fear and curiousity.
A suspicious person is one who holds suspicions.
Had the officer actually intended an investigation he would start with the source. Listen to the call, speak to the caller and then determine if there is actual evidence of a crime before creating an unwanted interaction in an adversarial manner that violates a person's rights.
My opinion is that RAS needs to be completely abolished.
This officer for example misconstrues the definition trying to claim he is making a Terry stop to investigate suspicious activity.
Activity is not suspicious, that is the mindset of a person observing the activity.
RAS would require actual specific facts indicative of a crime specific to an individual and a crime, not merely ignorance and curiousity.
Probable cause being a degree of certainty that is above 50% and making something more likely than unlikely, more probable than improbable.
RAS is defined as a standard lower than PC but has no defined bottom limit.
Thus RAS can only be described as never being likely or probable but always more unlikely and improbable.
Something more than nothing but never probable.
An evidentiary standard no judge would allow a warrant for a search or seizure to be granted on yet individual officers with very little basic law training are sent out every day to make these determinations at their own discretion with little if any oversight or consequences to themselves.
No accountability because few cases get to criminal trial, those that do are mostly given deference toward the officer and typically have some criminal aspect. Whether it be a result of the stop like disorderly, failure to obey a lawful command, obstruction, resisting or a warrant .
The ends justify the means type of justice.
Instances like this never get before a judge. Only a civil lawsuit could achieve that. Courts will simply dismiss a suit for lack of standing, no harm, no damages, no foul, move on.
Not to mention the time, effort and expense of filing suit.
Officers become so used to having authority whenever they want because of such low standards of cause combined with an overabundance of victimless laws that they just come to believe their authority exist always.
Require PC or exigent circumstances and police won't take their authority for granted and expect others to just submit whenever the officer decides.
Remove some of the confusion and maybe, the officer talks to the caller first. Looks at the situation as if people have a right to be free from government intervention, interference, intimidation and harassment.
The officer would not then be using his emergency lights or trying to come up with cause after already believing he has the authority to detain and issue lawful commands.
He wouldn't just naturally assume he could violate a person's rights based upon his own ignorance, curiousity or fear. He would do a real investigation and not play judge, jury and executioner.
Seems a simple solution but it would be scary for people like this homeowner who thinks with her heart and has no value for scary freedom when the illusion of security is so available.
Oh, and revamp the 911 system to include another non emergency number where calls can be assessed and investigated prior to police involvement and individual rights being violated.
Lady then calls 911 she can be charged.
As it is, try calling the police for a non emergency and they transfer you or tell you to call 911. Has happened to me several times trying to report things where I just wanted to give info and had no emergency.
Take the money we could save in not sending officers out on these calls and not paying lawsuits resulting from butt hurt cops abusing their positions. I think we can afford a better system.
      Just some thoughts

If you see a car parked on your street with a guy in it but not doing anything for an extended period of time you might have concerns. Maybe she had children who wanted to play in the yard but she was worried because this creep is just sitting there in his car with his camera pointed at her damn lawn.
And we know from what the guy said "15th time" that he does this a lot. Clearly he sought this situation out and was ready for it with his go pro ready for those internet clicks.
She had legitimate concerns and there really should be a better method under the law for dealing with situations like this.
People completely overlook that the people doing this shit to try and bait the cops are a fucking problem. The cop and the "karen" have no idea what this guy wants or is doing but they know it's not normal and he's being antagonistic and weird about it. Under the letter of the law though he hasn't broken a law but they still have concerns. There really should be some method for the cop to say "you're creeping out the people who live here, if you don't move on they have security concerns and you're not doing anything productive, if you're a law abiding citizen you have no business being here in the first place."
But what we get is a fucked up situation this guy has created where it's lose-lose for everybody involved except maybe him because he got paid by the clicks even though it marks him as a creep and should probably get him put on a list.

No. But they give anyone with a ged and a clean criminal record a chance to become a cop. There needs to be more accountability, more training for dealing with the public in a positive manner, more firearms training. There’s a huge divide racially right now in this country because of police actions and it’s so sad. These guys shouldn’t be taking this job or be allowed to keep their badge if they are aggressively dealing with random people on the street. And yeah it would probably make any situation go easier for all involved, but the truth is they don’t have any right legally to do that shit, and they shouldn’t be. And no cop should be upset or angry when a person decides to exercise those rights. 80 percent of these cops don’t even know the laws their upholding and enforcing and will straight lie to a citizens face. This is probably the most "reasonable" attitude I've seen from an office while being unreasonable. One of the biggest issues we have surrounding "Karens" and police is that they think they are serving the public and helping people but they're "helping" the wrong people. "Karens" try to use officers as their own personal armed detectives via their self feeling of privilege. Mans did a really good job keeping his cool and not provoking the officer but instead making the officer question himself as to why is he really here. Really well done.
Also, the "small of odor" seriously needs to be abolished. This policy is beyond subjective and allows for even "decent" officers to fall victim to abusing a method of detaining or searching someone. Imagine the amount of lives that could be saved from grief, legal fees and harassment if Marijuana was legalized at the Federal level and this tactic was abolished.

@@matfax technically any cop can make they claim that they smell and odor, yes. but the investigation for the state law was not at all in order because even theoretically if he was a stalker and took pictures of the women the fact of the matter is that it was his first time parking there, it’s a public place and neighborhood and he took pictures from the street which again is public. that alone is all legal even if he was stalking someone never the less; the cop took 13min into the ‘investigation’ to make the claim he smells an odor and again doesn’t even follow up with it which 100% proves that there was no real reason to search his car in the first place and he made up the claim for the sake of just because he could and was all in all unlawful

    • @matfax
      @matfax 2 года назад +1

@@SumoneAverage Well, for an initial stalking investigation you don't need that. And an investigation can happen just for the suspicion of a crime in the future. The suspicion can happen on public grounds as well. 13 minutes is far too much, I agree, especially because he didn't question the woman first if she had witnessed any substantial violations or hallmark signs for stalking or drinking. The odor thing might just be standard procedure to see how the driver reacts. He reacted how a sober guy would react, so this completed the investigation. They are legally allowed to say that, they are allowed to lie for the purpose of an investigation. They are not allowed to arrest you for it, to make false statements in their reports like that they really smelled an odor when there obviously wasn't any in this case.

Two, how goddamn quick witted and clever this guy was without uttering a single profanity. I love it. Three, how humiliated and flustered this cop was. This brings me so much joy. No it doesn't, it's called resisting arrest and obstruction there's a law for everything, if you don't give them proper information that's a crime and you get charged for that, if you dont get out of the vehicle and resist being detained you're gonna get arrested, they don't just detain people for no reason. If you are objecting to simple orders you're most likely hiding something, is it really hard to just give an ID up especially if you know you're not doing anything wrong? That raises suspicion. That's why videos like these are waaay cut and edited they don't want to show the actual crime that the person committed so they cut it up and make it seem like the cop is being an asshole, when in reality that cop is being super patient with a man-child that doesn't just want to give up an iD and information on what he's doing taking pictures, a lot of people are perverts, alot of people go and stage places they want to rob and take pictures that's why cops ask these questions and ask for your information cause it looks suspicious as hell. Imagine a guy parked across the street from your place and you see them taking pictures of your place, would that not raise alarms in your head and get suspicious? 🤦
