    • @zekelarson9644
      @zekelarson9644 8 лет назад +79

      Never heard of an NDA about talking about contracts that he didn't sign or agree to. There'd have to be an incentive for someone to agree to an NDA in the first place. If there's a settlement for a lawsuit, the incentive is the monetary value of the settlement. If there's an NDA on employment, the incentive is getting the job. Why would anyone VOLUNTARILY sign an NDA without getting anything in return?

    • @rossmanngroup

      +Zeke Larson I guess the same reasons someone would sign this shit:)

    • @truemorpheus
      @truemorpheus 8 лет назад +32

      You can sign 10 NDAs for free if you get really excited about getting to work with a giant company. And yes, there are a lot of situations where they get you to sign a NDA first so they can be sure that you don't mention a thing about the contract or the company.

    • @ptfdonte8752
      @ptfdonte8752 8 лет назад +26

      Zeke Larson
      I was asked to agree to an employment contract without reading it once. I asked about it, and was told it was confidential, so I could not read it before signing.
      Needless to say, I decided I did not want to work there that badly.
      Software contracts are the same: you are expected to "agree" to an EULA that you do not get a chance to read. Since the OS in considered an "integral part" of the computer (some Linux users got OS refunds back in the day), your only remedy is to return the whole machine for a refund.

      Vice was the best when it was a bunch of weird dudes visiting countries and getting really drunk or high, kind of like if the real life trailer park boys visited different countries. Once they sold out to HBO it became about all this serious bullshit that consumes this dumpster of a country they call the USA. It was better when they remained lighthearted because they lack the scruples to think anything through in a logical manner.

    Imagine if he actually did this, and apply the standard reality show tropes. They'd bring in a whole fake support staff to fight with him and each other. There'd be some dopey lunkhead, some tattooed fake geek-girl, and maybe his mother.... then "customers" would bring him undocumented nameless foreign equipment that failed, or equipment from named sponsors (which didn't fail but was slightly damaged in some humorous or dangerous incident). And if Louis doesn't get the equipment fixed by the end of the episode, his client will go out of business... jobs will be lost... lives will be at stake!

      A failure to specify the precise Universe in which "it" (here to fore referencing the original 15 page contract as submitted to Mr. Rossman) remain valid is a contractual flaw in the contract. By the way how do we reference our universe as opposed to the other universe? I suppose we will have to send a google mapping probe through the black hole and use its result to delineate our universe from "The other Universe" Her to fore designated as TOU for contractual purposes on Page 16 sub paragraph 134, section 3 sentence 8, line 1137, words 6 through 18.

I know of contracts like this, I have seen them signed, and they are unofficially literally known in the hallways as 'the fuck'm over contract'. And as a sidenote, I have no interest in repairing laptops. I DO watch all your videos for your bubbly personality. I like your honesty, I like your fuck against the fuck-behaviour of Apple, so I give you the advertising revenue you deserve. Because you deserve it. You work for it. You don't try to leech off the fame of others. You, sir, have my respect.

    The per-episode compensation is an outrage. That alone is a huge red flag. Viceland is an appropriate name, and we might emphasize the vice part. Sounds like another Apple. I am a bit suspicious that the whole shebang is a ruse to extract out information that you might not otherwise reveal.

Of course, it was a shotgun approach to get the rights to as many videos as possible from as many people as possible, in case any of them turn out to have any commercial value.

    The section regarding the royalty payments actually has a much more evil payload than you gave it credit for. It allows them to collect royalties until 2 years after the initial airing of the final episode, but the later severability clause means that if they exercise their right granted earlier to cancel producing the show altogether, you would be stuck paying royalties forever without them having done a single thing except sign the contract with you.

    • @rossmanngroup
      @rossmanngroup  8 лет назад +6

      they could pay me $1500 for one episode in exchange for 10% of my *gross* revenue streams, not even net(I should re-read to confirm though, it is midnight)....That's a nice $4000-$10,000/month passive income they'd make just for paying $1500 for one episode upfront.

Basically your signing the rights over to yourself, your brand and what you do, to them.

    Your characterizing of talent recruitment by "let's you and me make me rich" exploiters is spot on.
    I was lucky. My contract with a tech magazine allowed me to keep my created content with no strings attached. OTH the monthly articles I wrote for them over a couple worked out to $6/hr. A musician friend of mine almost signed a contract with a Nashville talent agent that amounted to 7 years of indentured. servitude. Want to hear some real horror stories, talk to high tech engineers who signed with head hunters.
    Never bend over to pick up the soap a talent recruiter dropped.

    A few years back, I was contacted by Leftfield Pictures (producers of "Pawn Stars" and other shows that have led to the decline of American television). The agent who called me was extremely vague about what the purpose of the conversation was... she just wanted me to send in some additional information on what I do (and how). So, I compiled a portfolio of some of the projects I'd worked on, and sent it in. I haven't heard back. My channel is incredibly random, and has a fairly small (but loyal) following. I cannot even imagine what the hell they saw in my channel that triggered a "We need to contact this guy - NOW!" reaction.
