    My ex-wife said that a prenup wasn't necessary because she loved me and would never divorce me. I said if that's the case, then what does it matter if we have one; it will never be needed. She agreed. One year later, out of the blue and completely to my surprise, she left me. Thank God I had that piece of paper.

      With the divorce rate as high as it is, prenups are starting to make as much sense as car insurance....we hope we don’t get into a car accident, but if we happen to, it makes it a lot easier and clearer in the future

    How come no one mentioned the terms of the prenup. That's probably the most important thing to know rather than jumping to conclusions.

      @@allmight9840 she's a doctor, and we don't know what type she is. She could be the kind that makes 500k a year and has a prenup that just says that all the wealth accrued prior to the marriage is kept by the individuals and everything after the marriage is split 50 50, which would be reasonable in my opinion. So if we don't know neither the terms of the prenup nor the state of her savings prior to meeting this guy, i don't think it's fair for us to slam her for it just yet.

      this is a good question but look at it from a philosophical perspective as opposed to a legal.
      A prenup as a whole, despite the terms, signifies that you aren’t all in with the marriage.
      For better or worse, for richer or poorer, in sickness and health.
      Though, this is a financial channel, but psychological and core values plays a huge foundation to achieving financial prosperity and peace.

      @@nghinguyen875 I understand what you're saying. Correct me if i'm wrong but your statement in the middle sounds like you may not be in favor of a prenup no matter what the financial circumstances of the parties concerned are, and in that case,i i have a few questions:
      1. isn't it a little naive to assume that there is no chance of divorcing in a country where the divorce rate is 50%.
      2. Isn't it disingenuous to assume that both parties carry equal risk getting into the marriage, when (and i'm bringing in this hypothetical because i'm operating on the assumption that you're against prenups no matter the circumstances) one individual has 10 million dollars and another has a negative net worth.

    fun fact, prenup is a legal contract you enter to determine property rights and legal obligations in case of divorce or death. Whether you sign up for one or not you will enter a legal contract through marriage that will define those same benefits but instead of defining them for yourself through a prenup you let the state define them for you through a marriage contract. No need to be emotional about it, don't let the idea of divorce or death hurt your feelings. If you're going to get married anyways, determining your own idea of fairness in a contract is not only logical but smart.

    I don't think pre-nups should be demonized as planning to fail. No one plans to get in a car crash but we still wear our seatbelts anyway!

      It's not about safety belts it's about trust. You need to go into marriage planning to do everything you can to work it now, not having an escape plan for when your no longer having fun.

      I am forced to wear a seatbelt by the law, if it wasn’t required I would not wear one! Problem here is, she doesn’t trust him and in that event, she shouldn’t be marrying him in the first place.

      @@ripwins true. It's America everyone had their own choice. I dig it. What if the wife is a stay at home mom or makes much less. Do you giver her an allowance ? Spilt bills 50/50 ? It becomes annoying to deal with. We have family goals because we became one. IDK. I believe in free choice and what works for some doesn't work for all. What if one person gets laid off ? It's a ton of factors. I'm not against it but it was easier for use to combine everything. Glad we did. To each there own tho. Cheers mates.

      Agreed. These comments are just insane. Relationships fail for a VAST amount of reasons. Prenups have benefits and allow more financial flexibility depending on the jurisdiction. I love Dave but I strongly disagree with him on this one.

    A young doctor with no debt tells me mommy and daddy paid for school. Which tells me she has family money. I say go ahead and do a prenup.

      It doesn’t matter gender here. I see female friends who get burn from divorce. From what we know, one have a stable and success career with financially responsible while the other one is not. I don’t see the issue signing the prenup. Most people who refuse to sign it either young but brainwashed to think very old school or have some motivation to keep things on their favor in divorce. First case is unlikely. The fact he asked is a planning process.

      as dave explained well. In extreme circumstances. If someone makes 1m a year or has a few mil net worth, marrying someone making $40k a year, it makes sense. I guess he’s saying the CPA guy can still live just fine if a divorce happened

    This is where Dave has lost touch with reality. Guy is still living in the 70’s . People change over the years Dave. You have to protect yourself and assets at any costs. Having a prenup is one of the smartest things you can do for both parties.. Keeps them honest and hard working/contributing . There’s no free ride here!

      Yeah, its a great demonstration that shes actually thinking about her financial future. Im speaking from my personal dating experience here. A lot of the woman i met do whatever they want without considering financial consequences. This female doctor would be someone who shares my concern for what the financial future looks like. In my mind it makes her more marriageable.

    I've noticed when Ramsey gives straight financial advice, it seems to be very good. When it involves other aspects of life it many times seems to be somewhat not very good. At least he said it was his opinion that they should not marry.

    What people don’t realize about prenups is that everyone has one - I.e. in the case of divorce, there WILL be a split of assets.
    When I get married, I intend to sign a prenup with my husband. Because although I will, in that moment, be certain that divorce isn’t in the future, I would still rather that potential asset split be decided by two people who love and respect each other than two people who are bitter and fighting at the end of a marriage.

      A prenup is just people putting one foot out the door... when I married my wife first thing I did was joint accounts and paid off her debts... no idea how much I had. I bet less than 10k she had nothing. We became one flesh in everything. All the bad I had plenty of problems still do, but people who don’t go all in don’t make it. This life is way to hard for people to be halfway in or out and then make it. If you truly ment for better or worse it’s just the risk you have to take. But many don’t mean it they mean as long as she fill my needs I’ll be the husband. Marriage don’t to make your self better can’t succeed.

There are numerous situations where if you partner was a different person this could have gone very wrong for you financially. It's not always easy to predict what kind of person someone could be.

      What each of them make a year doesnt matter, only what they stashed before getting married. Once married, they together make an amount, together budget, spend, invest and donate it.

      Butuc Manuela I agree but they’re not married yet. She has no debt and a salary ranging from 200-600k a year depending on specialty. He’s making no more than 70k a year and he still has his student loans. That’s more than enough for a prenup.

      Even if she was making less then him it’s smart and of the both of them to ask for prenup. You never know what the future hold for anyone. He or she can make way more or win a lottery for example and you need to protect yourself from everyone for yourself or your children.

    If you are marrying her for the right reasons then you shouldn't care if she wants a prenup. Are you marrying her because of her wealth? A prenup is a good way to find out if the person you are marrying is marrying you because you are rich or because they love you. I disagree with Dave Ramsey on this one.

      I agree, especially as a woman, she wants to make sure her earnings are secured. If anything, God forbid, happens then she will be the one most likely with the kids. Which means she will need as much of her savings, assets and earnings to care for them. Not to give it to some man who is very capable of earning his own income.

      No, prenups are a stupid decision because that implies that you're going to be committing to a nuptial agreement, which is a very stupid decision. The government and divorce courts aren't going to care about those agreements when you're getting divorced and falsely accused of domestic abuse and child molestation so she can get as big of a payout as possible.
      No "nups", period, unless you're a deadbeat with literally nothing to lose.

      I don’t think she does. It’s biologically wired into most women. Most of us usually want someone more “capable” in terms of earning power and resources. The fact that she is making her career the focus of the prenup shows she sees it as a way to up him. CPAs have potential to earn lots of money but doctors generally make more on average. So she basically wants to insure her earnings from him.

    Dave I have disagree with you this time. What she’s managed to gather in wealth that may not seem a lot, but it is a lot to her. She’s just protecting herself. If he really loves her & is emotionally mature, he wouldn’t take issue. If it were the other way around then she wouldn’t mind. Plus from what you read, on the surface how can you tell there isn’t a huge gap? No one plans to get divorced but it happens. Emotions can get out of hand. Prenups are not only for the extremely wealthy.

      Jeffrey Whitaker you must be new to Dave Ramsey. He’s said on his show for years that he believes in Pre-nups only in exceptional circumstances.
      You may disagree with his suggestions but he was consistent with what he’s said to other callers and people who write to him in the past.
      Not sure why callers keep asking him the question. They are wondering if their situation is one of Dave Ramsey’s exceptions, I guess

      It could be a big gap. In my area a well paid account makes $100k but a doctor is over $350k per year. To come out of med school debt free is pretty amazing too so she’s either very ambitious or there’s also family money to protect.

      Everyone feels that way until, God forbid, things go south and you get a divorce and she takes half. People change and can be so fickle to the point that getting a prenup often makes sense. Just because you have a prenup doesn't mean that you'll spend every waking moment thinking that your spouse doesn't love you or has one foot out the door, it means that you recognise that people and situations change. And you can always amend the prenup after the fact. In a world where half of all marriages end in divorce, unless y'all start on the same level, not having a prenup doesn't make sense.

      Kay If a country’s laws already protect people with money by assigning any property and money to the person who earned or inherited it during a divorce, then it is in the best interest of the wealthy person to stick with the law of the land rather than trying to get a prenup. So they would push against a prenup. I know couples like this, so it’s funny when people say a not signing a prenup means you love someone. The viewpoint on that is always different based on the benefits.

    Marriage counseling until the prenup isn’t needed is such an old fashioned mindset. Of course you go into your marriage completely trusting the person you are marrying, but Sometimes over time people find it ok to completely abandon their core values and vows because they changed for whatever reason. And sometimes things can’t be worked out via counselor or even want to be worked out. The way I see it, I pay car insurance hoping I won’t get into a car crash. I pay flood insurance hoping my house never floods. Pre-nups are no different.

      In theory, yes, but after years and years together sometimes people become entitled and think they own half of everything or at least a good settlement, Thats actually what a pre-nup is, it's valuing each others assests going in, and then sharing any assests aquired together. But like Dave says, for 300K is it really worth the hassle.

      Patrick Forsyth right. I used to think if a marriage survives 7-10 years, the marriage will go the distance. I was shocked to hear about people divorcing after 20, 30 and even 40 years.
      After decades together, I don’t think what someone brought into the marriage is relevant anymore, unless someone had millions or more.
      Personally, I think prenups should expire after, like 5-10 years because their only purpose is to protect someone from having their assets seized by someone who leaves you after like 6 months or something like that. But, if you suspect someone would do that, then that’s a big red flag in and of itself

    I’ve always been anti prenup until I heard it explained like this: a prenup is two people deciding how their financial relationship will be defined instead of just relying on the government’s standard plan.
    I know even with a prenup it’s not a sure thing in court, but I think it makes sense to have your own “financial contract” rather that let the government decide.

      ​@@whitneyw.7919 In my view, it really comes down to what both parties think is fair. It isn't just about money but about the time and effort you put into getting where you are. Let's say that Alice went to school for 7 years to become a doctor, and Bob only did high school and has a job that doesn't pay that much.
      If this is before the marriage, Bob contributed nothing to get Alice to where she is. So in the event of a split, Alice might feel like the wealth she largely was responsible for generating should be split a certain way. There is nothing morally wrong with that in my book, as long as it was discussed beforehand because both parties need to know what they are consenting to.
      Now if both Alice and Bob are both broke when they get married (as I and my wife were :), then it makes sense that everything is 50/50. It's like "Sure you can have my half of nothing" lol. This is even more true if Bob works to put Alice through medical school.
      At the end of the day, I just think that the government's role in marriage is too much. I think we would see more people getting married if they didn't fear losing nearly everything they own in divorce.

      Yeah, without those two numbers, and WHAT his debt is on ( school or cars or gambling or...) cannot say. Also, what is the prenup? Does she have children or other dependents like a disabled parent? Not enough info, but IMHO, she dodged a bullet if he says no.

    Many people understand divorces are emotional. Why pretend one party won’t try to hurt the other & take the car they love or force them to sell it. Pre nups aren’t about loving things more than your future spouse, it’s about making plans when rational in the event something happens.

    This is a perfect example why you don't take advice from just anybody on TV or the Tube. They both should have their own prenups. He doesn't take her money if he leaves. She doesn't take his money when she leaves. There! I solved it.

    Honestly, as a girl in my early 20s, I get it. I'd sign a prenup easily if a guy asked me to. Being financially secure is more important to me than good health. That being said, I've always been told they don't hold up in court all too well, so 🤷‍♀️🤷‍♀️

      I have also heard that they don't hold up well. It's a shame that the institution of marriage was corrupted by government and laws, that is why prenups exist.

      They hold up well if done under the right circumstances. 1. Both parties need a lawyer present when signing. 2. It must be signed long before any marriage plans and not under duress. For example it likely wouldn’t hold up if you forced the prenup 3 days before an expensive wedding. 3. It cannot be unconscionable. This means that one party can’t be left needing government assistance or with no money post divorce

    This is bad advice. Some people have a lot of debt and it's harder on a marriage if one person without debt is afraid that it could fall onto them.

    I'm a woman, and I won't marry anyone before he first signs a prenuptial. It's just a matter of fairness. He's not entitled to my 401k and houses I had before marriage. He wasn't there when I was working and saving up. Hopefully, prenup should not ever be needed, but the stats show that over 50% of all marriages end up in divorce

    I don’t agree with Dave! Requesting a prenup doesn’t mean you don’t love someone. It’s like insurance in case you guys fall out of love(which happens often ). Just because you have homeowners insurance doesn’t mean you expect your house to burn down. It’s just a precaution in case it does.

    With so many people living together, buying homes together, having kids together, and combining finances without getting married, I think prenups (or some kind of domestic partnership agreement) need to be seen more like wills. It's a legal document stating who gets what and how the kids would be cared for, if the couple splits up. Make these decisions while you two still love each other rather than dragging it out later and using your kids to get back at each other when you're angry with each other later.

    There is nothing wrong with wanting a prenup. Dave is completely out of line here. If two people have the same wealth, there is nothing wrong with getting a prenup. How does Not wanting a Prenup be a sign of loving somebody?

      You need to go into marriage planning to do everything you can to work it now, not having an escape plan for when you are no longer having fun.

      @@allmight9840 if 40-50% of marriages end in divorce, it would be foolish to think any two people are the exception. Imo the high rates tell us that people change and unforseen circumstances whether intention or accidental can happen. I think prenup or no prenup is fine but personally I would support anyone that would want to get one given the statistics.

      Mike B theoretically, yes, but if divorce rates scare you, you’re probably better off not getting married. The divorce turns acrimonious, don’t think someone isn’t going to try to get the prenup thrown out and despite what I hear about “iron clad prenups” many do get thrown out. Divorce sucks, or so I’ve heard, regardless of whether or not you have a prenup. You have to decide for yourself if you are willing to take the risk.

    A marriage is a contract. A prenup is a contract. A prenup is simply overriding the terms of the marriage contract, which aren’t fair in the case of a divorce. This is terrible advice Dave. Normalize prenups!!

    Marriage is a financial transaction. She is protecting her assets so the guy doesn't turn on her to take half her money. Prenups are necessary.

      Agreed..I just do not understand the offense taken in a situation like this. 🤦🏼‍♀️ If you have a problem with signing a prenup then you likely are not in the relationship for the right reasons. If you truly love and respect someone who has worked very hard to create wealth/assets, then why would you be the least bit intimidated.

    if you love your partner and respect your partner’s boundaries, then yes, prenups should be fine bc sometime nothing lasts forever, and sometime divorcees don’t like each other

    What if you’re “low-income” at the time of marriage and then you have massive career trajectory? I feel like a pre-nup should be put in place regardless of how much money is involved at the start.

      Only job with that level of income spike where a prenuptial agreement makes sense, is acting/music. And if someone is willing to ride the roller coaster of entertainment enterprise, they would be entitled to some of the gain should there be a divorce

      Once married, it's harder to decide that a party had no impact on the future massive benefits, or to quantify that contribution in advance. It would be weird to me to marry someone of equal income and decide together "if either of us makes any real money, we don't have to share with the other". Maybe you're onto something in a high divorce world, but may as well stay single and live with your gold (or dreams of gold).

      nope! Shared household is a thing. If you're able to work 30 minutes later at work and impress your boss because you knew your spouce would be able to pick up the kids from daycare, the promotion you get belongs partially to your spouse. Are you able to spend more time in classes or learning a skill because your partner is committed to doing housework and feeding you??? Whatever success you get out of that time spent improving yourself belongs partially to your spouse and they deserve to be compensated if you were to ever separate.

    I absolutely disagree. She DOES want to marry you, she's just protecting herself against the vast array of LIFE that happens. She's probably seen divorce, infidelity, etc and is rightfully hedging against being financially destroyed if that happens to her. Dave, not every single situation has a cookie-cutter answer.

    I disagree, her doctors wages and savings are "extreme" to her situation, afterall what's Wrong with protecting yourself if the worst happens, divorce is a 50/50! risk!, Why is insurance for homes, cars etc acceptable but pre nup insurance not?

    A prenup is like insurance, nobody buys insurance because they anticipate that something horrible will happen. they buy it as a safety net incase something horrible does happen. It's hard enough going through a divorce, but why add financial stress into that mix? All couples should have a prenup, its just an agreement between 2 people about who gets what so that there are NO SURPRISES down the road. Dave would rather let the STATE decide who gets what, instead of the couple. Thats what happens when you dont have that agreement/prenup up front

    If you have worked hard for your wealth then it’s not a crime to want to protect it when you take the RISK of attaching yourself to another human for the rest of your lives. Ppl do not stay together as long these days so even though you know and love your fiancé a preunup is not a big deal. Prenups aren’t bad omens they are a form of insurance for the RISK you take through matrimony.

    This is completely inappropriate and should not be the point of view of a counselor - RUclips or not. Dave Ramsey has one video of a man asking for a pre-nup and agreeing with the man’s point of view that he should get a pre-nup. Then Dave Ramsey has this video where a woman is asking for a pre-nup and his advice is that she’s not as special as she thinks she is. Pre-nups, in general, are not just about your current net worth. They are about future net worth as well. If the woman has invested money, time and energy into acquiring a career as a doctor (or any education that requires a doctorate) - which can be very lucrative, then she would want to protect her future earnings - end of story. The individual posing the question should not be insulted by her request to protect her future or current assets. A prenup is not a guaranteed divorce. It is insurance. A counselor should not be telling you not to get insurance. You never want to use insurance, but you should have it in case an accident happens. Bad advice. Thumbs down.
