      Probably had some brain damage from it which should be considered in her trial. The condition caused her to snap- she likely blacked out and didn't even know she was doing it.

      Well people on here are exclaiming self defense for her when they were outside of a court house, they signed papers for divorce so she didn't have to go back, he was defenseless. Two wrongs don't make a right, be so for real.
      Unless you were there, you don't know the story of why that happened, but we do know this happened with no provocation at the time. Not saying he was justified but people jumping to conclusions because they hear one side of the story, yet ignoring the otherside that shows what your arguing (for your side) is asinine.

      I was in a DV situation and I remember the judge who was a women caring more about his rights than about my safety. We worked in the same location and she wanted to have us still work there but different shifts so he wouldn't lose his job of ...security.

    That's a very sad story. I don't think her defense of previous acts against her will help her defense much since she waited and ambushed him outside the court house. Had he shown up somewhere she was unexpectedly maybe that kind of defense would work. That's what I think so far.

    A lot of the comments dont seem to have really clocked the victim's niece saying that they BOTH were shot at the incident she and her daughter described where she lost her eye. She is clearly biased and he would've been arrested if he outright shot her and it wasn't contested who was at fault

    The so called justice system is responsible for his death. How was he not in prison?
    Mental health issue? I cannot think of anything more sane than eliminating a threat to your life.
    Should she have waited until he came for her? Jumping at every noise, wondering when, how he was going to come after her next.
    Who ever was in charge and chose not to press charges for his attempt on her life is the person who should be facing charges in this case.

      Because he had trial in march and supposedly it was self defense when he shot her because she shot him and then she burned his house down. There leaving a lot out of this story.

    It was premeditated murder. There was no threat at the time of the shooting. She was supposed to leave and did not.

    At first I was like OMG this woman is so cold but than they disclosed the DV from her husband and I can't seem to blame this woman for her actions. I am a DV survivor and I know how the courts treat victims. My last physical assault was 12/2/2019 and my ex filed for divorce because I finally called the police to report the assault (there were many many other assaults I never reported please don't ask why - its complicated - review the DV cycle of abuse). It was incredible how the courts treat victims - disgusting is the word that comes to mind. While I wouldn't have taken the action this woman took against her soon to be ex - I can't necessary find a lot of blame for a victim that has been put through the pain and horror this woman faced. I don't agree with what she did but I can't help but feel the intense pain and anger and mental anguish she is has most likely faced and is going through. This really sucks all around. Why the guns were not all collected from both parties after the first shooting... I dunno.

    That was ridiculous. Her domestic abuse doesnt justify killing them.. they just divorced. And finalized the divorce. She was rid of him.... she chose to kill him after they got a divorce finalized. Its murder.
    You dont decide to be judge jury and executioner and get away with it..

      Thank you. It's crazy the hoops will people will jump through to justify their side, while going off of a one sided story, meanwhile ignoring that the side they are arguing for has an actual proven form of DV. Idk whether the dude was guilty or not, but she was divorced. She had no excuse.

    I felt bad for James before I heard what he did to Tonya back in 2023. Why was he only charged with and not convicted in that case? It was obviously a case of "attempted unaliving." If I was a juror on this latest case, there would definitely be a mistrial or a "not guilty" verdict for Tonya.

    Her behaviour is not that of someone abused. Even with him having allegedly shot her. Since it did not go to trial, no one knows whrther what he did was in self defense due to her violence. Just her call proved to me she is a violent person.

    When did she shoot him? She is going to have a difficult time with a heat of passion defense when she was laying in wait for him. She must have also known the courthouse didn’t have video and wasn’t anticipating HER attorney and walking out behind him. They were even separated during their hearings and they gave her time and space to leave SAFELY! She gave herself a prison sentence. She is not very bright!

    Why shoot him after divorce is final? The relationship is over at this point. He was drunk when he did what he did, possibly while in the heat of an argument. Taking a gun to the courthouse and being sober seems more planned than what he did to her.
