  • What do you do when the person who hit you doesn't have insurance?
    In Virginia, your insurance company is required to provide underinsured and uninsured motorist coverage in the same policy limits as your liability limits. So if your liability limits are $500,000/$500,000 then your UM/UIM limits are the same. So if the person who hit you doesn’t have insurance, or doesn’t have enough insurance, then your insurance company will step in and provide coverage for that accident.

    So, in other words, the uninsured driver gets off scot free so, you are just paying your own insurance company to defend the irresponsible driver. I often feel that we the responsible drivers are suckers for having insurance.

      Pretty much, but here in Texas the court has a couple of option for the uninsured driver. Please not guilty and go to trial, plead guilty and pay restitution, please guilty and pay restitution in payments but on probation.

      @@TekevinUnfortunately, we just had a "hit and run" accident on Nov 28th.Thankfully, there were no jnjuries and the only damage was to the driver side mirror which was knocked off and is going to cost us around $600 to repair. We aren't going to file a claim with our insurance since our deductible is $500. We haven't been able to get if fixed because my husband and I both have the flu now. Not sure how this would have been handled if the driver had stopped and had been uninsured. We live in Kentucky.

      Tax payers need to start filing class action lawsuits,in addition to small claims. Illegal immigrants filed class action lawsuit won 20million aka Lawyers won 18.5.

      @@karimaogden3875 I don’t think it would make much of a different. I was involved in a Hit and Run while following him I caught up to him 6 miles down. We found out he did not have insurance and had no asset so we couldn’t sue him. Total damage was 4,300 dollars with 2 herniated disc from me. My insurance was file for uninsured motorist and now they have been trying to force him to pay, but he doesn’t want too.

    I was taking a driving test of car to buy from a guy.he didn’t tell me car has no insurance.i was near his hom and hit car with a ford truck and his truck and my car is ride off.guy was ok and after he is acting like has pain.and now who will pay for everything

      Unfortunately, yes. Unless they have kindness in their heart and offer to pay out of pocket.
