I'm a 31 year old glass blower and had a major loss in sales during the pandemic which caused me to go through all my funds just to keep afloat. Now I have people trying to sue me for orders I just fell behind on. Seems like no one understands what you went through during the pandemic. Remember kids if you fall behind and you get into a small business not many are going to understand what you are going through. Keep your head up to anyone in here going through an honest struggle.
If people paid for orders then they should be refunded if you can not deliver. If your business can not refund or deliver the products, have you considered having your business file for bankruptcy? I am guessing people paid for products and not as goodwill to keep you afloat. I understand there may be tough times (I am homeless and have been homeless for over a year). But if they have a valid legal case against you, then they have a right to try to recover their money if you didn't deliver the product(s) or service(s) they paid for. You should stop taking new orders until you fulfill the backorders or else it could be seen as similar to a ponzi scheme if you just keep taking in money but not deliver on the orders. Since you are probably not homeless like me (who lives in a car) maybe you have collateral (eg. house) to get loans on to fund the backorders, then take on new orders, then repay the loan and get out of the hole. There are plenty of people in worse situations when compared to you.
Bring sued in California under PAGA requires a $20,000 DEPOSIT for a potentially $100,000 defense against a lawyer suing on behalf of a legally fired former employee FOR FREE ON CONTINGENCY. CALIFORNIA IS THE WORST STATE IN THE US FOR BUSINESS. It will cost $700+ just to file a response with the court. Any employee can do this to any business in California. It is a despicable law and practice by predatory attorneys.
I got into a car accident with a motorcycle, the report review was on my favor but a week later the cop that was there called me and told me that someone said that my wheel was slightly over the white line and that I was at fault, after the guy was speeding and zigzag all over the place and that my story of the events matched 2 or 3 people that were there that's what the cop said before he called me a week later. Now they are suing me for 50k and my insurance only cover 25k. I dont know what type of lawyer i need to look for or what to do at this point.

I have to sue an ex for breach of contract, civil theft, fraud, and credit card charges. It is going to be expensive to hire the attorney, but I will work 2 or 3 jobs, whatever it takes to bring him to justice.
I had a law suite Filed against me. Meet with Judge on Zoom. Judge ask me I'd I owe dept. I said yes. But when Judge ask for other side on how to meet up no was there to Represent them. I said to judge if there is nobody from their side. Should this case be dropped? He said no I needed to call them and set up terms with them. I did try that and they would not agree to terms again. This case is still ongoing? Nothing has moved forward. I did not agree to their terms. Don't know what to do. This was 3months ago.
even if you default you can request a motion to vacate the judgement, that is what the double im suing did after he defaulted. We go to court Nov 1st now but he already told my attorney if I win any settlement at all he will just file bankruptcy to make sure I get nothing. What's annoying is he was clever and deals mostly in cash and his assets (the 3 houses he owns), have been transferred into his mothers name and two into his daughters name. Insane that he can do everything he did to me and walk away with no consequences, just gets to file bankruptcy and wipe his hands of his wrong doings.

Chapter 7 means to liquidate all assets and they have to pay majority of the debt chapter 13 is a payment plan that you must know about bankruptcy is not that simple at all

I beat a court case from 3rd party debt collector cause they didn't own the debt and couldn't prove how much I owed and did I agree to pay them. Also they bought my debt for $195 when they say I owed them $21000, just show up be honest you will win
What kind of proof is needed to show they own the debt? Is it the verification debt? Because the plaintiff states they've contacted me before suing me when they've never contacted me and in the laws of the fdcpa it states a collection agency must send a verification debt after contacting the consumer and they've never contacted me (as they say) or sent me anything.
So quick question. If someone is under my car insurance and they crash a vehicle that's under my insurance to someone else's car. Can I get sued too even though I wasn't inside the vehicle? Or only the person that was in the vehicle?. Here in Michigan

I wonder what would happen if you get sued for a debt and if you are living in poverty and unemployed and have almost nothing in the bank? I would think in that scenario, even if they did get a judgment against you, there is still nothing that they can do to actually force money out of you that you don't have and its not like they can take our clothes off of our backs or take the food out of our stomachs.

Don't just talk one , call 2 or 3 to get a better feel if which one seems the most helpful. They would be able to steer you in the best way possible. I know it must be nerve-racking but this happens everyday so just know the lawyers are out there for the same reason. Hope you get good news.

This happened to me too. The insurance company even told us it was bullshit that we were being sued. The party that is prosecuting is actively committing perjury. I’m scared because I know that the justice system is already broken.

They are claiming that my friend used their client pictures and they want settlement money and they want their pictures to take down. So funny part if before they send her the 1st email she kinda delete those pictures because they were closing down the website. Question sir= I am not sure if BofA or debt collection agency is suing me. I know debt was charged off from BofA. Lawyer of plaintiff say they are representing BofA. If BofA has charged off debt then can BofA be suing me or suing plaintiff is debt collection law firm.

I’m getting sued for fraud for a small business that is under my name but my ex kids father put down all the money. He never responded to my lawyer before the suit if he was going to pay rent so that’s when I took over. Since he put all money down he’s fighting but he left me with bad credit he purposely stopped paying sales taxes is delinquent and wasn’t doing taxes and all this debt on my name. I am ok with giving him back business as long as he pays all debt on my name that he benefitted it on. My poor kids are not even getting anything karma will get him back

Hi, 7 months ago, I was involved an accident with my electric scooter. The car insurance sent me a letter suing me for the damage of the car. Actually, this happened in NYC downtown. I was driving my scooter in the bike lane, the driver made left turn and blocked the bike lane and I was not able to brake on time. My body was in pain, scratches all over. Here is the issue (I am really stupid), I didn't a get report for the police and or being hospitalized. I don't know maybe I was panic and nervous. Now, the driver sued me to pay him his damage of his car. Please any suggestion.

I also thought I give my fully trust b’coz I haven’t encountered crooked people this race. I let them move in w/ 1 month rent deposit only b’cuz they said ‘ haven’t got the pay check. 2 make d story short they stayed their for 6 months. Texted us they lose their job, kid is sick, everybody got covid etc. My mistake though is I let them abuse me. I told them I’’ll See them in court & they’ll get evicted . She answered with “ We haven’t received the letter from d court. I had our realtor attend the hearing & won d case. However though, I won’t get my money b’cause they declare them selves as low income, work from home w/ 3 kids & Grandma . She knows how to play this well …Oh she knows… Now…..am I not the victim for having a good heart? Tell me…where’s the justice in this?
Here's a million dollar question for you. Let's say you're named in a will and you stand the chance to inherit something of value. Or how about if you win the lottery or winnings at a casino. Is the defendant supposed to inform the judge of that for their way that they check.
That depends on whether the defendant is under some sort of obligation to disclose their financial condition in general, which may or may not be the case, depending on a huge number of factors. That’ll be a million dollars, please! 💰
@LydaGroup if a defendant were to hit the lottery, I am pretty sure that the first thing a lottery agency would do is check records to see if the winner has any writ of execution attachments. I'm sure the same thing would apply if child support or back taxes were owed.
If the person I'm suing won the lottery (and found out about it thru publicity, which is why many winners chose not to go public), who do you think would be the first person to ask for a share of it?

Good point, certain government benefits, whether for seniors or others, are shielded from collections. But the devil is in the details so consult an attorney on your specifics before assuming you are judgment proof.

I just watched Coffeezilla's video where Logan Paul is suing him for defamation. It is clear as day that Logan has no case. In the video Coffeezilla easily combats Logan's accusations with videos of Logan himself that Logan uploaded. The suit says Coffee has malice intent and is a poor journalist spouting lies. Well there is a video of Logan saying what a thorough journalist and stand up guy Coffee is. Clearly Logan shouldn't even be able to sue. Is there no one checking the basics of a lawsuit to see if they are even creditable to go to the next stage? How are false accusations even legal? Like suing with no grounds or a woman trying to get child support out of a man who isnt the father or someone who is in the most minor of car accidents claiming to be hurt. How are there no repercussions in place to make sure people have to think twice before accusing someone else of anything? It's a clear scam and abuse of the legal system. You never hear "He isn't the father AND the mother now owes the father what the mother was asking." I remember one case where a woman sent a man to jail for 15 YEARS for grape or something. He was in jail for 15 years before they finally released him cuz they found new evidence that he was at a different location on the accused night or something completely obvious showing the clear lack of an investigation. But the woman didn't go to jail for 15 years. I don't think she was punished at all. Or if she was, it was probably something minor. I just remember thinking "That is such bull she can do that to him and not get it done to her back" Explain how that is possible? And explain the threat of burying someone in legal fees. If I get sued, why am I paying the court? Why is payment even happening during the proceedings and not part of the punishment of who ever loses? Coffeeziilla is clearly being attacked by Logan. And the one thing Logan has over Coffee is he's rich. So he is going to win the case cuz of money rather than clear logic? How on earth is that even a thing? Why should anyone even follow the law if the law doesn't follow the law?
It's useless if involved with governance or Biggest Companies.. Any effort will return with bad Results on it... How many percent the the success process? 0.00001...finally lost everything... not trust to the Law.. Bcoz many way can manipulate on it... Some the result is Vice versa..
What if I have the money? Will they take all of it or demand that I have to pay something? What if even though I make a lot, I still don't have the money to pay and support myself? What if I get so overwhelmed that I just jump off a bridge and kill myself because I'm so deep in debt?
Please talk to someone before that happens. There are various ways that judgment creditors can try to collect, but for instance with garnishing wages, they typically have to leave enough for you to live on. Bankruptcy can be another option, which is not as bad as some people think. Do not get overwhelmed, there are ways to figure it out and move forward.
@tiffanybishop-zz9pf you are correct...BUT they are not exempt once they hit the BANK ACCOUNT lol. So while you can't "garnish" those things, you CAN levy bank accounts. Unless they'd like to pay exorbitant fees at some check-cashing place, then go right ahead. I say...PAY YOUR DEBTS INSTEAD, it'll be cheaper for you, in the long run.

I got into a car accident with a motorcycle, the report review was on my favor but a week later the cop that was there called me and told me that someone said that my wheel was slightly over the white line and that I was at fault, after the guy was speeding and zigzag all over the place and that my story of the events matched 2 or 3 people that were there that's what the cop said before he called me a week later. Now they are suing me for 50k and my insurance only cover 25k. I dont know what type of lawyer i need to look for or what to do at this point.

I had a law suite Filed against me. Meet with Judge on Zoom. Judge ask me I'd I owe dept. I said yes. But when Judge ask for other side on how to meet up no was there to Represent them. I said to judge if there is nobody from their side. Should this case be dropped? He said no I needed to call them and set up terms with them. I did try that and they would not agree to terms again. This case is still ongoing? Nothing has moved forward. I did not agree to their terms. Don't know what to do. This was 3months ago.

even if you default you can request a motion to vacate the judgement, that is what the double im suing did after he defaulted. We go to court Nov 1st now but he already told my attorney if I win any settlement at all he will just file bankruptcy to make sure I get nothing. What's annoying is he was clever and deals mostly in cash and his assets (the 3 houses he owns), have been transferred into his mothers name and two into his daughters name. Insane that he can do everything he did to me and walk away with no consequences, just gets to file bankruptcy and wipe his hands of his wrong doings.

What kind of proof is needed to show they own the debt? Is it the verification debt? Because the plaintiff states they've contacted me before suing me when they've never contacted me and in the laws of the fdcpa it states a collection agency must send a verification debt after contacting the consumer and they've never contacted me (as they say) or sent me anything.

I would think in that scenario, even if they did get a judgment against you, there is still nothing that they can do to actually force money out of you that you don't have and its not like they can take our clothes off of our backs or take the food out of our stomachs.

Don't just talk one , call 2 or 3 to get a better feel if which one seems the most helpful. They would be able to steer you in the best way possible. I know it must be nerve-racking but this happens everyday so just know the lawyers are out there for the same reason. Hope you get good news.

I’m getting sued for fraud for a small business that is under my name but my ex kids father put down all the money. He never responded to my lawyer before the suit if he was going to pay rent so that’s when I took over. Since he put all money down he’s fighting but he left me with bad credit he purposely stopped paying sales taxes is delinquent and wasn’t doing taxes and all this debt on my name. Hi, 7 months ago, I was involved an accident with my electric scooter. The car insurance sent me a letter suing me for the damage of the car. Actually, this happened in NYC downtown. Here's a million dollar question for you. Let's say you're named in a will and you stand the chance to inherit something of value. Or how about if you win the lottery or winnings at a casino. Is the defendant supposed to inform the judge of that for their way that they check.
That depends on whether the defendant is under some sort of obligation to disclose their financial condition in general, which may or may not be the case, depending on a huge number of factors. That’ll be a million dollars, please! 💰
@LydaGroup if a defendant were to hit the lottery, I am pretty sure that the first thing a lottery agency would do is check records to see if the winner has any writ of execution attachments. I'm sure the same thing would apply if child support or back taxes were owed.

I just watched Coffeezilla's video where Logan Paul is suing him for defamation. It is clear as day that Logan has no case. In the video Coffeezilla easily combats Logan's accusations with videos of Logan himself that Logan uploaded. The suit says Coffee has malice intent and is a poor journalist spouting lies. Well there is a video of Logan saying what a thorough journalist and stand up guy Coffee is. Clearly Logan shouldn't even be able to sue. Is there no one checking the basics of a lawsuit to see if they are even creditable to go to the next stage?
How are false accusations even legal? Like suing with no grounds or a woman trying to get child support out of a man who isnt the father or someone who is in the most minor of car accidents claiming to be hurt. How are there no repercussions in place to make sure people have to think twice before accusing someone else of anything? It's a clear scam and abuse of the legal system. You never hear "He isn't the father AND the mother now owes the father what the mother was asking." I remember one case where a woman sent a man to jail for 15 YEARS for grape or something. He was in jail for 15 years before they finally released him cuz they found new evidence that he was at a different location on the accused night or something completely obvious showing the clear lack of an investigation. But the woman didn't go to jail for 15 years. I don't think she was punished at all. Or if she was, it was probably something minor. I just remember thinking "That is such bull she can do that to him and not get it done to her back" Explain how that is possible?
And explain the threat of burying someone in legal fees. If I get sued, why am I paying the court? Please talk to someone before that happens. There are various ways that judgment creditors can try to collect, but for instance with garnishing wages, they typically have to leave enough for you to live on. Bankruptcy can be another option, which is not as bad as some people think. Do not get overwhelmed, there are ways to figure it out and move forward.

@tiffanybishop-zz9pf No, it's NOT! Once it hits your bank account, it is not the "property of the government " anymore. That money gets comingled with alllllll other monies in the account. There is no more differentiation at that point. But, you don't have to believe me AT ALLLLLL. Why? Because it doesn't effect me 😀

I am getting sued , they want me to fill out the affidavit of no liabity insurance form but have no knowledge about it or what to do.. cannot find the right attorney for this case and have a few weeks til further actions are taken , anything helps right now as for advice , attorneys info, or if I should fill out.
My insurance has terrible communication with me and looking for an attorney myself isn’t looking to good..
I rent our 2 story house 4B, 2.5 bathroom 2 Hispanic family of 5.
$1,200 2 month deposit, 1 yr contract.
‘ was to go out of d country & doesn’t have time 2 back ground check. I also thought I give my fully trust b’coz I haven’t encountered crooked people this race.
I let them move in w/ 1 month rent deposit only b’cuz they said ‘ haven’t got the pay check.
2 make d story short they stayed their for 6 months. Texted us they lose their job, kid is sick, everybody got covid etc. My mistake though is I let them abuse me. I told them I’’ll
See them in court & they’ll get evicted . She answered with “ We haven’t received the letter from d court.
I had our realtor attend the hearing & won d case.
However though, I won’t get my money b’cause they declare them selves as low income, work from home w/ 3 kids & Grandma .
She knows how to play this well …Oh she knows…
Now…..am I not the victim for having a good heart?
Tell me…where’s the justice in this?
