      I’m not going to go to court for this ! I don’t know if they can take my Ss they call over & over it was my card someone used it if I didn’t do anything about it bc it was a family member get I have 3000 although do have to accounts they said they will garnish, wages ! I don’t have much in my name

    Thank you so much for your video. I'm a 75 year old widow from suicide. I only receive Social Security, I still make payments on a 2006 car. I have been so upset since I got this summons and came close to ending my life. Your video has helped me so much God bless ❤️

    In my 60s my spouse of over 35 years battle cancer for 5 years having to be on a speical liquid diet costing over 80 dollar a week plus travel medical supplies our credit cards run to the roof. My spouse died in aug bank of america america express have been calling three to four times a day now with the death of my spouse my income has been cut in half. I can barely afford rent water electric I have my own health issues stop me from going back to work feeling alone and under all this pressure. To know my home is safe and income is such a weight off my heart I been feeling for months now

      Simply inform them that ALL future corespondence MUST be done in writing. If the phone calls continue, they may owe YOU money.

    I went to the IRS when I was 65 and they put me on a “ noncollectible status” this takes me off of debt collectors list.

    You guys are the BEST! Thank God I came across your RUclips video! All other RUclips videos I have been watching do not provide helpful advice for Seniors or for those on social security disability. I have talked to five lawyers and not one of them informed me that my widows social security benefits were protected, but only to file chapter 13 which is very expensive and I cannot afford to do that. I am a widow age 63. My only income is widows social security benefits. I am a homeowner and have equity. The state of Utah has a homestead but I believe it's only 20K-30K that is exempt, more than that it is not protected. I will be giving you a call ASAP and I will be informing my widows group platform about HELP Nonprofit Law Firm. It's unfortunate that many widow seniors are being tormented by credit card debt collectors and often are terrified what will happen to their income if sued. Thanks a mil! Keep up the great service you are doing for many of us!

      Unfortunately, in amerika, it's just all about scams and corruptions.
      When your debt is charged off, you owe nothing. Why? The lender already got its money back by deducting its loss from lts profit.
      Selling your debt to the bottom feeders is just a way for your lender to make extra money from the debt you do not owe. It's all just a scam and the people should put a stop to this.

      They CAN'T do that, Lynn. I know they are trying to, but your husband's debts are NOT your debts. I know that for SURE. Yes, get in touch with these folks ASAP. I'm a widow, too, and I know what people can try to pull on you. Good luck and God bless! ❤

      They put my husbands gas bill after he passed by 2 years put in my first bill now after struggling I got it paid off. Now they won't give it back.

    Thank you so much for this info. I go to court tomorrow for a 7 year old medical bill. I am 66 on SSD and struggle to make ends meet. My bp has gone up fretting about this. Your info has calmed me down and now I am going out of curiosity how it will turn out.

      "You" owe NOTHING.. All Debt is Gov, Obligations.. You've been deceived and agreed that you "owe" due to ignorance.. USC 18 & 8 . Every SSN is Insured/Bonded.. Gov Account. These BAR crooks are screwing people (the Creditors) Up..

      How did it end up with that debt? I could be wrong, but I think 7 years would be outside the statute of limitations and it would be considered a time-barred debt.

    Thank you so much for this video. Everything happens for a reason, and this video popped up on my RUclips list, the day after I got a summons 05/21/24). I am a Senior turning 65 next month, and this info was just what I needed. I made the call to HELPS and will hear back tomorrow. The timing on this was so spot on.👍👍

    I'm definitely sharing this. I think that some companies threaten the elderly, scaring them into paying for things they no longer have the income for.
    Timeshares come to mind for example. They won't even let them out of the contract to pay maintenance fees. Nearly 90, and STILL expected to pay. 🤷 Such a con!🤦🙎

    In my State of South Carolina, if a senior owes money for medical bills or to a nursing home.....the creditors pounce as soon as you die. They attach liens on land, homes, or any real property that the deceased owns. If the children want to "keep the family farm" they have to pay off the medical bills before the probate court will allow any property be transferred to the survivors.

    Thank you both for helping seniors. Some seniors are loosing there homes nationwide due to the Hoa's with out being able to afford an attorney or to defend the Default Forclosures Judgements.
    Are there any laws on a senior who was in her final two years in a senior center who could not appear in court, the court awarded the default judgement to the Hoa. After she passed, daughter was served who did not appear in court, Forclosure Judgement was awarded and lien on property of deceased that has complicated Probate and handling the estate.
    So many seniors need help especially financially.

      NOONE, I repeat NOONE should EVER get involved with an HOA. Why on earth would ANYONE want to pay hundreds of thousands of dollars or more for SOMEONE ELSE to tell you how you can live in or what you can do with YOUR own property? WHYYYYYY??? Why would you do that to yourself. You pay all that money and are told how you can live in it and what you can do with it. If you get sued over something then I say that's your own stupid fault for buying there. I have no sympathy for anyone like that. None.

    I would ADD pack your mind set, pack your positive attitude, you think you can do this???, " think again it's hard NOT for the weak minds,.. my son 22 y/o extremely physical fit with 5 years gym experience, his mindset BROKE!!!... not sure if he will continue :( it's a sad realty, this new generation is not made to last, and that's a scary thought,... my advice as a father is you find yourself in this hole of doubts, REFOCUS, ADJUST, QUITTING IS NOT AN OPTION!!.. at the end of the day you don't want to disappoint your love one's that are home cheering for you!....

    I only saw the beginning of the video, so my comment may be way off. But the same applies to EVERYONE, not just seniors. If you are not disputing the debt then not showing up means the court decision goes against you by default! It’s not a criminal matter.

    It is my understanding that seniors and non seniors both, need to ignore the collection agencies - never respond to their calls and wait it out as after 7 years the debt goes off your record and you can start over to build good credit having learned a big lesson. Is this true? I am not in debt at all & I have great credit but I do wonder if this information is correct. I also have heard that you can file bankruptcy but that is a bad idea.

    I worked for the government in Guatanamo Bay, Cuba and have a debt with the hospital there because the bills were being sent to Diego Garcia, British Indian Ocean Territory. I worked with a department which was supposed to be a liason to help me get the issue resolved. It never happened (complicated) but next thing I knew, an allotment is being taken from my social security every month. Who do I go to for help?

    I'm 6 years old and I have barely walk and I was a quart and got manhandled by the security guard whose hands on me instead of force me to sit down. The security guard is not enough for them in the last time I was there before that I got held up downstairs and when I went up to the courtroom I missed my name so I told the security guard to tell The Sessions Clerk that I was here. Solicitor's she dismissed all my cases!!

    was told by credit union that if there is ANY other deposits besides ss are made you lose protection.

      Listen to the video beginning at 9:00 Bank and Credit Unions officers know nothing about these rules. But the department within the bank or credit union that handles garnishments understands the rules. Although after 40 years of dealing with Credit Unions, they would be more likely to make a mistake. But this law has been effective for nearly ten years so hopefully, they finally have learned, The branch manager or local employees however likely don't have a clue. But then they aren't the ones handling garnishments, Listen beginning at 9:00. Eric HELPS

    Several questions that come to mind: What age is the definition of senior(s) what age? I would assume that once a debt is established then that debt ends up on your credit report correct? Another important issue many seniors are renters and need to to be able to protect their ability to find another space to rent? Anyone have answers or comments!

    My husband is 79, and I’m 75. We just got a summons that Discover Card is taken us to court, we live on SS, and a small check of $45 that is paid to my husband from when he was a volunteer fireman. Our only asset is our home. Which we still make mortgage payments on. Can they put a lean on the house? .My son is thinking about buying the house from us. Would we be able to sell the house to him The letter I got said that if we don’t show up at court, we will lose by default. I’m a wreck , over this Thank you for helping us seniors

    can a lien be put on real estate? My grandma is in Pennsylvania Nd has credit card debt she defaulted $4000 in 2022. The credit union credit card charged it off. After 2 years in 2024 she saw a sheriff notice on her door while she was in rehab. Sheriff never came back as her neighbors told sheriff to leave her be. The re was a collections company that bought the charge off debt from her credit union visa card.
    Should she wait intil she us properly served to worry about her property?
    Is there a reauirement in Pennsylvania to serve summons / complaint in person?

      We had a debt collector freeze our account and the bank would not tell us who or why it was froze and wanted to give them our line of credit

      In Texas you are responsible for your spouse debt and if you can’t pay and you own land or valuables they can put a lien on your property

    Unless I missed itOne of the elephants in the roomThat was missed is… So how old is someone to be considered a "senior" - some businesses and schools of thought say 55 others say it has to be over 65. At 62 being in the gray area I really don't know if this applies to me or not when he says "seniors." Anyone know the answer to that?

      There's no minimum age, but some issues and protections only affect people collecting Social Security (62+) or those on Medicare (65+). But some of our senior discounts apply to people in their 50's!

    The Department of Defense was taking over $100 bucks out of my moms SSI for over 10 years for something my dad did. I wish they would give it back to her, but I doubt it!

    But I was forced to go to court in my state in Arizona. That's messed up. I'm so aggravated bu these debt collectors of all kinds..No one ever said that this was an option to NOT GO TO COURT

    I am heading to court in October for a debt that's not mine, but my name is on it. I tried to find out what, and who, credit the debt.       If this isn't your debt then you certainly should challenge the lawsuit. You might want to forward information to the attorney who filed the suit that can prove you are not the same person that they sued. Eric HELPS

      @@seannewoods2296 i think the clock restarts on the debt only if you make a payment or verbally agree to something, but speaking to them without verifying or admitting anything won't restart the clock. At least that's the way I understand it.

    Hi, I'm 68 retired with soc sec and a small pension for income. I am apx 45,000 in credit card debt that is currently being handled by National Debt Relief on a settlement program.. From what I've gathered from your videos, I could cancel the program abandoning payments and not have to worry about any repercussions. Is this correct? Any reason why I should continue with NDR?

    My mom is being sued and on social security. She can no longer work and on oxygen 24/7. She has her account where the ss is deposited and instantly used for bills. However, her and I have a joint one, since we live together, and she helps pays the bills while I work my small business. My paycheck is direct deposited in the account. Can they garnish my wages since she is on it? We are filing just a basic answer letter directly to the court tomorrow but it probably will proceed further. Also, both our names are on our house. Is there any threat to our funds and if so, what should I do? We barely live paycheck to paycheck and I work my tail off to do it. Tia!!!

      yes having her name on YOUR bank account is BAD! having anything in her name is considered her property. if there are 2 owners then the value is divided by 2, ect. its been 10months since ur comment i hope youve figured things out!

It is Very helpful Video , I recently got a summons because I got a car accident two years ago and with the law it is my fault because the other car has right away when I left turned even though the other car speeded. My insurance had already paid and settled with the driver. However, after 2 years the passenger has hired a attorney to sued me. I am very worry because I lose my job few years ago and basically I just live with my saving until two months ago, I have decided to start receive my SS benefit. I did passed on my Summons to my car insurance just two days ago. But they already paid the Max settlement with my policy. would you share some suggestion with me because I do have the 401k and I am worry they are going they a ways from me.

      Your retirement income is protected you won't have to pay anything. I very much doubt they would push a lawsuit to get a judgment out of someone they would never collect from. You don't have to worry one bit. Eric HELPS

      I’m surprised ur insurance company didn’t handle the frivolous claim against u/them for more money! This happened to my parents and the insurance company went to court and had it thrown out because they’d already paid a large amount and the lady didn’t have a reason for the suit other then she wanted more money..they dropped it and told her to leave us alone…they even threatened my brother and I when we were minors …the lady and her husband did this all the time as a way to make money…insurance fraud by causing car accidents

    I got 3 letters, and never heard until yesterday. I get my SSN, but I work from home for 28 an hour. So that money goes into a checking account so that's protected right.

    I am a senior, living in my vehicle,in Michigan, receiving a very small retirement from social security (less than $900 per month) and am being tested for metastatic cancer. My credit card debts are in a payment program yet I have an individual showing up repeatedly at my mailing address, trying to serve me papers. I am still making payments on the vehicle I am living in. Can they take my vehicle or order that it be sold?

    I have been listening to Eric and I did the debt consolidation loan. But realized that I can't afford to pay 275.00 for it a month so I canceled it. It was either pay my house payment or pay my credit cards. I have to have a place to live. Am I going to get in trouble for not paying my credit cards. Can they touch my social security?

    My only income is protected Social Security Retirement (with less than 2 months benefit in the checking account) but I also have a Roth IRA with a balance of $20K. I know ERISA-qualified retirement accounts are protected but the Roth IRA is NON-ERISA-qualified.
    If I have a $500 copay medical debt (after Med Advantage insurance has paid) to a doctor (not a hospital) that goes to collections and creditor obtains a default judgement, is my Roth IRA at risk? Or, even if it is non-ERISA-qualified and technically not protected, in practice do collection agencies not pursue the debt even though they could?
    Also, can the doctor deny me future treatment because they never received payment for the previous copay medical debt?

    I'm 77 , owe ~$5k in CC debt ! been paying 90 a month to each CC ! I live off SS of $897 a month ! My rent is going up , so , if I just quit making payments to Cc's and don't file Ch7 , will my bank let me keep my debit card , and will the CC's come after me in Ct ? I have less than 15k in assets and live in Tx !

      You can actually make an agreement to pay as low as $1 to $2 dollars per month per account. You don’t even have to call to make the agreement you can just send a check or pay online as normal. Accepted payments go towards you paying your bill. A lot of people think if they can’t keep up with the demanded minimum payments then ignoring is best but paying an amount you can afford reasonably that won’t leave you homeless or unfed is still best and seen as you trying to be responsible under federal guidelines. Credit companies and collection agencies don’t want you to know this, but it’s true.
      Even without a conversation a credit card company that takes these payments and put them towards your bill is in essence accepting your payment for that month. I found that out long ago.
      If you quit paying your bills they’ll go into default and the company will probably charge them off.
      After that if a collection agency purchases them then you’re in the category that the people above are talking about. Make it a rule to deal with the original creditor and not the collection agencies. Don’t ever communicate with collection agencies that claim they bought your debt.
      The best way to avoid all of that is to do that dollar per month payoff but if even that’s too much (and I understand it can be) then the above is what will happen: charge off then eventually collection agencies.
      Monthly government benefits are protected and can’t be garnished.

      You need to be careful with how much money you keep in the bank account. Because for example, if you have a credit card from chase bank and you have a checking account from chase bank and you decide not to pay the credit card, then chase bank can actually Take your funds from your checking account without your authorization.
      I would suggest maxing out your credit cards, i'm having a checking account with a bank that it has no connections with any of the credit card companies. if you keep your checking account separate from a different bank that holds your credit card debt then yes yes you can keep using the debit card because the debit card only is usable with the cash that is available in your checking account.

    Hi there we live in Texas and lost everything in hurricane Harvey like thousands of others
    We had to stay with my sister in law went pretty good
    Our 29yr old son got a job about 8 months after that he started showing bizarre paranoid behavior I'm his mom and I begged him to let me take him somewhere for help. He kept refusing so he jumped off a bridge and broke his back and had his left ankle reconstructed so he was released from the hospital a mental health hospital
    The place were living was alright. His Dad and I needed more room for the 3 of us and they're telling us we owe $1400 because we only lived there 11months
    Is this legal? We're both elderly 72 68.

    I am a senior and being charged for a utility bill back 25 years ago my landlord added $160.00 to my billi dont know maybe she was trying to be somekind of a cheepskate . Within the years mention I never recieved or even knew of this bill till days ago when I went in to open a new account.

      If you borrowed money to purchase the car or you put the car up for collateral on a new loan they hold the title until paid and can repossess the car Eric HELPS
