I have a question regarding NVC one-year contact requirement. Is this the maximum time we have to submit our case to NVC for final review or is this just for contacting NVC? I have an I-130 application which has been approved and received by NVC but I wanted to delay it for more than a year due to some family issues and wondering if I have the option to do that.

The first step is over for my wife , looking forward for step 2 which is nvc to send me the welcome letter ! My wife I 130 application took 14 long months, but I finally got approved on September 27, 2024. I submitted my wife's application on July 25, 2023, and we got an update on August 10 2023 that her case is being actively reviewed. The process is stressful, but hang in there - patience is key!
We were on a roll with our I-130 petitition. It was approved in 6 months. The USCIS retained it becasue I did not indicate where my husband plans to apply. On the notice it also says that I have to file a I-824 just to get the USCIS to forword my petition to the NVC. I also applied for a I-129f which was denied a day later. On that form it says that the I-129f has been denied and they are going to forward my petition to the NVC. A month later as I wait I started to ask questions. It turns out that I still have to submit the I-824 which is $465, just to move the petition. Rotten luck. ( funny thing I was so stressed out filling out the I130. Was affraid I was going to miss something. Well....... It did.

From the 28 of may my card was sent to a mailbox in Texas and I don’t understand what going on every time I check my status it tells me that my card was delivered at a mailbox in Allen Texas I not sure what that means and why is it sent there .
I once failed to appear in an immigration court because I did not receive a notice to appear and that automatically put me on removal from the country .. I got married to my long-time girlfriend and we filed the I-130 and it was approved after one year.. is it possible I apply for a change of status at this point or close the case with immigration court? I filed the I-130 in aug 2021 me being a permanent resident for a spouse from California it’s been more than there is no movement at all when I go to case status online it only says being actively reviewed, I changed my address in the meantime and also updated the change of address through uscis.I also received the notice of address change but my uscis account has still the old address and when i try to change it it goes to the same address change lick which I already did.What is the next process will I get a notice soon, either in my email or my physical mail .Is there an another way to get an updated on my case. right now i only have a case number. Bro... hold on okay... you most definitely will get a visit and after the visit everything speeds up somehow, in stl Missouri here where i am that has been the trend and i have seen alot of pple shared personal stories like what i just said this year alone and guess what it happened me too, filed in 2019, first interview in november 2019, second interview in june 2021 and all of a sudden roughly 2 weeks after they showed up at one of my brothers house who now has his green card already, they showed up at my house on the 3rd of February, spent over 1hr grilling me, called my wife the next day and as i speak with you, my third work permit just deleivered last Saturday and said was approved on the 24th of February (which i applied for a renewal since August of 2021 and waiting on it since) and my I130 already approved on the 1st of march. So ill just say don't give up, it's frustrating we all know that but with your petition timeline it's probably your turn very soon. Peace my brother, i hope u recieve a good news soon. 🙏🏽
By the way i will advice u prepare for a visit and make sure everything is in order at home. They showed up early in the morning and i had no time to fix anything, and yes they entered every room. 😆 🤣.
My adopted daughters I-130 is currently at the NVC. We also have our emergency expedite approved due to my medical ongoing treatment. So how long we have to wait for an appointment.
Thanks for your updates, Ms.McBean. In this video you mentioned that if you need an adjustment of status it should have been filed when your I-130 was filed. If your filing was done online would you have been able to submit that form too?
Yes if you filled I-130 online and you’re the immediate relative of a US citizen, then print out form I-485, fill it, add the necessary evidences to support your claim and add a copy of I-130 receipt notice and then mail the package to the designated USCIS building.
Question: if we have an approved i130 for a child over the age of 21 and at the time we applied beneficiary was a permanent resident but now is a us citizen. And both are currently in the US, what would be our next steps?
What Is the Purpose of Form I-824? Use Form I-824, Application for Action on an Approved Application or Petition, to request further action on a previously approved application or petition.

Hello, Latoya Could you please help with your advice? My friend is Ukrainian, she does have travel us visa, her boyfriend does not. She wants them to get married and to come to the states for political asylum. But that would take longer time for them to change the passports. As long as your friend and her bf have a married certificate indicating they are married, then they are good to go. USCIS doesn’t really care if the wife adopts her husband’s name neither will the US immigration courts care.

All documents had been deemed completed and the adult child was receiving monthly notifications re awaiting an appointment. What is the process for obtaining a new petitioner? Can the new petitioner pick up where the deceased father left off? (I've been searching through your past videos, but I am still looking.)
I am sorry for your friend’s lost. He doesn’t need a new petitioner but rather a sponsor. The sponsor who could be anyone but it’s preferably when such a person family or blood related. The sponsor will have to demonstrate to the US state department that when your friend and his family move to the US, they will NOT become subject to public charge, in other words mean they will not apply for any benefits like food stamps etc. The sponsor demonstrates this by submitting his or her tax returns of the previous year to the State Department and if his returns can’t meet the threshold, he or she can submit more documents like stocks portfolio details, bank account balances, and others assets. Once all these are satisfied, your friend and his family should receive their visas provided they meet other requirements too.

You can but that will prolong your green card application since it will require USCIS to approve your I-485 before your green card can be produced and mailed to you. Just wait for NVC to complete the process with the US embassy
It’s like they swear for that NVC in Nigeria.. I’m US citizen and my wife has finished all the process, she is at the last phase - meaning that she is Documentarily Qualified. What that means is that she only needs and interview to get her green card, can you believe we have been waiting since December 2020 😭😭 I just pray they haste things up because we are tired already

Hello, I filed the 1-130 for my wife after our wedding, who's from Colombia in 2019. Last year June USCIS asked for additional information, which was given through our attorney. Understanding that things are much slow because of the pandemic but what should we expect at this moment? Because your wife has an approved I-130 application and a pending I-485 adjustment of status case, then she can apply for an advanced parole which will permit her to visit her family home and then return without any problems. Make sure you get advice from an immigration attorney before you do this.

USCIS will consider the age the child was when petition was filled

There's something wrong with their categorization. Let's face facts, you can't get more immediate than child or blood brother and sister.

You can’t do anything, USCIS will process the case and mail his green card out once they review the case and do the necessary changes in the system.

Bro... hold on okay... you most definitely will get a visit and after the visit everything speeds up somehow, in stl Missouri here where i am that has been the trend and i have seen alot of pple shared personal stories like what i just said this year alone and guess what it happened me too, filed in 2019, first interview in november 2019, second interview in june 2021 and all of a sudden roughly 2 weeks after they showed up at one of my brothers house who now has his green card already, they showed up at my house on the 3rd of February, spent over 1hr grilling me, called my wife the next day and as i speak with you, my third work permit just deleivered last Saturday and said was approved on the 24th of February (which i applied for a renewal since August of 2021 and waiting on it since) and my I130 already approved on the 1st of march. So ill just say don't give up, it's frustrating we all know that but with your petition timeline it's probably your turn very soon.

Thanks for your updates, Ms.McBean. In this video you mentioned that if you need an adjustment of status it should have been filed when your I-130 was filed. If your filing was done online would you have been able to submit that form too?
Yes if you filled I-130 online and you’re the immediate relative of a US citizen, then print out form I-485, fill it, add the necessary evidences to support your claim and add a copy of I-130 receipt notice and then mail the package to the designated USCIS building.

What Is the Purpose of Form I-824? Use Form I-824, Application for Action on an Approved Application or Petition, to request further action on a previously approved application or petition.

My friend is Ukrainian, she does have travel us visa, her boyfriend does not. She wants them to get married and to come to the states for political asylum. But that would take longer time for them to change the passports. Is it necessary for them to wait for the passport change or they can just have a paper proving that they’re married.

As long as your friend and her bf have a married certificate indicating they are married, then they are good to go. USCIS doesn’t really care if the wife adopts her husband’s name neither will the US immigration courts care.

Who says they can’t apply for I-130? That’s not accurate. The law provides a way for EWI to obtain a green card: waiver plus consular process.

I am sorry for your friend’s lost.
He doesn’t need a new petitioner but rather a sponsor. The sponsor who could be anyone but it’s preferably when such a person family or blood related. The sponsor will have to demonstrate to the US state department that when your friend and his family move to the US, they will NOT become subject to public charge, in other words mean they will not apply for any benefits like food stamps etc. The sponsor demonstrates this by submitting his or her tax returns of the previous year to the State Department and if his returns can’t meet the threshold, he or she can submit more documents like stocks portfolio details, bank account balances, and others assets.
Once all these are satisfied, your friend and his family should receive their visas provided they meet other requirements too.

You can but that will prolong your green card application since it will require USCIS to approve your I-485 before your green card can be produced and mailed to you. Just wait for NVC to complete the process with the US embassy

It’s like they swear for that NVC in Nigeria.. I’m US citizen and my wife has finished all the process, she is at the last phase - meaning that she is Documentarily Qualified. What that means is that she only needs and interview to get her green card, can you believe we have been waiting since December 2020 😭😭 I just pray they haste things up because we are tired already

Understanding that things are much slow because of the pandemic but what should we expect at this moment? Because your wife has an approved I-130 application and a pending I-485 adjustment of status case, then she can apply for an advanced parole which will permit her to visit her family home and then return without any problems.
Make sure you get advice from an immigration attorney before you do this.
My husbands i-130 was approved. The letter says to file i-485 is there anything else i should file for him with that.
There are several other forms you ought to include. You need to do your own research. A different channel (Ksenia) has a lot of guides
