They have to do it to a degree but the fact they won't go in and issue them for example, a $1 paid license saying they take all liability for the fan-game and that they can revoke their distribution and rights at any times, Nintendo choses to play it extremely safe and shut down any fan project. If you have a copyrighted work and the legal department refuses to take it down knowing about it, that can be used against them on whether they completely lose their copyright or not.

Take a look at Garry Newman's X account yourself and see what people are saying, he has NOT received any further confirmation from Nintendo beyond those takedown emails
