The diversity hires know they never would have ended up as a Justice without getting special treatment for their brown skin and/or hole between their legs.
The liberal ones are arguing for affirmative action because 2 of them needed it.
The way Supreme Court trails work is the justices argue with the lawyers while the lawyer makes their case. They do this with the plaintiff side then the defense side. Afterwords they discuss it privately then vote.
Instead of the plaintiff and defendant, it is more like the petitioner and respondent. The Supreme Court will take on a case that has standing. Once the case is heard, the court will determine if there was a constitutional violation on the state actor's part.

Asian students have to work far harder to complete with students that don't have to make the same sacrifices...that is not fair in any way...we cannot continue to reward students who do not work hard.
I don’t think that’s true, the Asian people have different values compared to other cultures. There schools system is very well oriented. They have teachers who truly care about making students the best they am be, there families put school in front of everything. There don’t have the ability to run around like kids do today, they are very focused on there future . There’s a reason you don’t see them in public schools. Kids now will never know how America became what it is today, and the wars fought to make America strong, and independent.

Why is affirmative action important to them? It's their way of offsetting and protecting their legacy admissions system for kids of white elites who would otherwise not qualify.
If it is not a significant factor, why is it being discussed? I would venture to say it is pretty significant to the person who is denied admission because they don't have the right skin color. Isn't the reason for affirmative action to begin with? It's wrong that it ever happened to anyone, it's even more wrong to attempt to right a wrong with revenge against those who look similar and justify it by some confused sense of morality. There are far more white people who despise racism than there are who condone it. What's the difference between a using skin color vs boob size? Also, how is race used against someone if it is unknown? Shouldn't a merit based system base admissions on merit? I personally think all of the subjective criteria for admissions should be eliminated. With objective criteria being established and accessible to all students it would be fair to all regardless of their race. I don't think anyone needs a head start or a thumb on the scale. I also think when discrimination occurs there should be consequences severe enough to deter it from happening.

I had two sons who applied to UNC in 2019. Twin boys, both white. They were both in the top 10 of their high school class. Both were denied admission to UNC. They had a classmate, who is black and a female, who was in the top 30 of the same high school class. She was admitted and given a large scholarship. Both families live in the same town, went to the same school, and have similar middle class financial positions. Maybe this is just coincidental, or maybe this is empirical evidence for the case against UNC.
My gf in high school was black, I'm white. She wasn't dumb but she was lazy, a solid C student with no extracurriculars. I was A and B, all honors, multiple clubs, varsity track. Her test scores were mediocre and mine were top five percent. She got into every school she applied to, including ones she was comically unqualified for. I got denied to every California state college she got into.
It's all a scam meant to screw over good white folk out of a misguided desire for revenge.

Seems like the more they talk about race not merit they're being racist.
I'd love the see the grades and drop out rates after admission and see how many of those who're struggling got 'extra points for diversity' in the admissions process. If Thomas Sowell is to be believed, these diversity actions force children into academic environments where they can't keep up, and essentially make failures out of students who would've performed fine or great at a less challenging University that their actual grades actually qualify them for.
And yes, it's hard to have faith in someone's abilities when you know they're an affirmative action recruit. I'm literally waiting to count the amount of times Jackson uses the word 'constitution', she'd better be exceptional, or I'll assume she doesn't belong there....just like Harris doesn't belong in the VP seat.

I disagree in that we would see anything. After doing a degree from an Ivy, I know that for many programs it's harder to get into the school than to survive or do well in them. An Ivy isn't inherently that much tougher than another decent private or public and difficulty is more dependent on the professor who can make challenging courses either challenging or impossible. And this is for tough STEM majors. For nonSTEM, it's even easier to survive. At the end of the day, this is about fairness and whether hard work in HS should pay off and whether hard work in undergrad should pay off in grad/professional schools.

If I have to have open heart surgery, I am concerned about the competency of the surgeon, not whether the medical school he or she attended included questions about things like "friendliness" on the student's application, questions which should have no bearing in an intellectual setting and which the liberals want to have included so that they can gerrymander in their version of social engineering.

I could tear them all up. Data. Admission rates over all based on race. Admission rates based on population percentage. Admissions based on academic aptitude, ability to read, write, and reason at a standardized competitive level expectation. If the applicant coming from an under funded poor school with poor instruction is not the problem of the university and should be dealt with at a different level, all this demonstrates is that the student will not likely be at a level of competitive readiness and problems that will pose upon the university and its overall competitiveness on the collegiate platform. I have worked with so many blacks who had college educations that could not read, write, or spell correctly. One spelled phonetically, graduated suma cum laude from Georgia Tech. He was admitted, promoted, and graduated at honors via his race, it was obvious working with him. To add insult to this injury, he was hired in fresh out of college in a leadership position and was unable to do his work and relied heavily on his peers and subordinates to get his work done, he couldn’t even write a simple technical report. I was also demoted by another college educated black man. He couldn’t do the job. I was told to do the job he was brought in to replace me over. I quit, and the company went belly up. It even made the news. This is all nonsense, i have travelled the world for work and people globally view this all as a joke. There is a reason why asians are super competitive in college admissions, they work hard. And to punish them, or another group due to blacks lack of academic performance is insulting, disheartening, creates animosity, and unfair. As I hear some of these pushbacks, it disgusts me that certain people are using historical situations to justify race based admissions, obviously benefiting blacks. Drop the crutch, work hard, earn what you want to achieve, stop the racism, stop punishing us all as we had nothing to do with history. I was the smartest kid in my underfunded poor school district per the testing and I ranked nationally as number 2 in science back in the 80s. The kids in the gifted classes where gay, hispanic, asian, black, and women. My school’s ratings were raised due to me. Yet, the school paid no attention to me, with the exception of a caring science teacher one year. Take a guess my race and sex. I will say this, I became the cheif technical expert for my field in one of the largest pharmaceutical companies in the world. Unlike these idiots looking for crutches to excuse them from buckling down and earning what they have, I plowed thru everything I faced. No scholarships, no preferential treatment, just aptitude, talent, hard work, dedication, and perseverance. No harvard, no stanford, just a public university education once I graduated from a crappy poor school disrrict that made it obvious as to why I was neglected. I climbed the corporate ladder to be over most of the 30,000 people working there along with all their plants globally. I made it happen without this nonsense. I am jewish too, by the way.

I have worked with black teachers that could not speak standard English much less conduct a coherent lesson BUT the district needed to fill a "quota" and so students suffer.

Yep. Very interesting story, and tragic, too. I continuously remind myself of what MLK, Jr. said about the content of character versus color of skin. We as a society have devolved culturally from the 1960s/1970s and are truly embodiments of the old chestnut “those who do not learn from history are doomed to repeat it.” The seemingly constant focus on race and, now, sanctioned racism not only through what this video describes but also by those in the “minority” requesting and advocating for segregation (e.g., “no-white zones” in some schools) is a tragic backlash to the pre-civil rights era of Jim Crow, but now in reverse. It seems history is lost on the youth and powerful today. Many physical and legal battles were fought over the last 150 years attempting to end and correct for this racism. Seems that now it is all in vain. I pine for the best ideals that were originally espoused as freedom in this country. Seems rather clear that the U.S.A. is gone.
DEI applies to Hispanics & Blacks only, try using that for Asians, Arabs, Persians, whatever other race.

Affirmative action prevented son from entering Cal Poly in San Luis Obispo, California. Assian and White male applicants were excluded from admissions. Non-white and non-assians applicant were given an additional grade point. Non-male applicant were given an additional grade point. The cutoff GPA was 4.01. Son applied to admissions to West Point through Vice President and Representative. Son applied to admissions to US Coast Guard Academy. Son never attended four year college. Son has left this country.

Can't we stop this whole circle the law for loop holes logic and just say if you have the grades to succeed in college and the money to pay for it that is enough.

The only criteria that should be looked at is whether the student is the best applicant regardless of their skin color, religion, economic status. I would think we want the best. For example how much racial diversity do you see in the NBA??? There are very few Asians in it. What about the running backs and receivers in the NFL??? How about the......you name it. We want the best for leadership positions, I could care less what color they are. I thought we were supposed to be color-blind???

Economic status can be such a weight for or against a student that it should be a factor. For example, if a student scores 1398 yet came from a depressed neighborhood with low opportunities comes up against a 1399 student who came from a wealthy neighborhood, consideration should be given to the student who achieved much with less.

I was in court for ten years because of a "trespassing" issue in which the complainant FINALLY admitted that I didn't trespass and I was acquitted. I would no "cop a plea".
Government should shape up, clean up the tax codes that put undue burden to the taxpayer, don't hinder or put undue bureaucratic hurdles to small and medium sized business, maintain law and order. If the government will just do its job, people will prosper and race issues will gradually resolve it self. People will always be tribalist no matter how they deny it. They will only accept people who are their peers. So be it, make America the biggest tribe of peers, prosperous peers.

I have been observing for years in my very diversified city, that as I pass by middle schools, the whites are together, the blacks are together, the Asians, and on and on. I have been on many college campuses. Same. Just let them be. It's never going to change, as hard as the people try to change it.
People like my daughter got a rejection letter from UCLA (she likely wouldn't have gone there) coming right out and saying she did not meet the criteria of preferences. She was accepted at many other colleges and universities. Was offered money at some. She was rejected, due to affirmative action, from her first choice law school. She went on to another and has done well. But that's twice in a white family of affirmative action rearing it's ugly head to let in a lesser qualified person over my daughter. This was 20 years ago and there was a lawsuit at that law school and affirmative action lost, but here it is, still ongoing. Affirmative action is very unfair to good students.
You can't believe people will always be tribalist in this country! Most people in this country are a mix of different kinds(not necessarily color of skin, but certainly different ,"tribes"). If liberals would shut up and stop trying to stir people up, it would die a slow death-like it was doing in the 60's and 70's. Most people do not care about superficial traits much at all in the USA.

The conservative justices highlighted just how much fluff is imbued in the argument for affirmative action. There are so many buzzwords like "diversity" that are often repeated, yet seldom defined.

Assign each applicant a number so they don't have to use their name, that way race can be fairly left out of the equation. Whenever race is allowed as criteria for admissions, people will be excluded because of it, period! If the box is checked and the person doing the evaluation is racist it could be an issue. What does a white person do when they experience discrimination based on their skin color? Has everyone forgotten that more than half of the white people in the country won a war to end slavery? Not every white person is responsible for the actions of a few. Will hair style be used as criteria? What about big boobs? Physical attributes have no place on an admissions application!
Divisive policies like these are designed to paper over cracks instead of addressing the root cause of issues, because it would uncover corrupt criminality. It creates the division and emotion just distracting enough so the problems remain and the corruption remains unchecked.

It's difficult for the public schools to fire incompetent teachers because of unions and politicians (strike / votes).
Why can’t the smartest most capable people be educated in a field they aspire? Higher education should be based on merit. Nothing else. You don’t need a degree in selling retail phones or selling coffee or working at Walmart…just saying too many teenagers are unsuccessful and there is far too much pressure to go to college or university…full stop. This creates so many disillusioned young people, more men then women.

Affirmative action only weakens society and lowers the recipients of affirmative actions lives standards and dignity. Who would want any professional working for them that had to achieve their goals through affirmative action, especially a doctor or someone that could harm someone if they're incompetent.
When I was in grad school in New Mexico there were signs posted saying...If you are a minority and don't have the grades, we will help you get into medical school.
Even if someone was admitted into medical school as a result of AA, wouldn’t their successful graduation at least indicate adequate competence?

I burst out laughing. The Supreme Court, in my opinion, lost credibility as a whole at that moment. She was installed using the principal of affirmative action and is an example of why doing so is a bad idea. We should use competence and qualifications as criteria.

A common theme from the Democrat judges is they just talk like lawyers, leading in yes or no questions while telling the story they want, and if the lawyer begins to answer more they cut them off.
These activist judges don't ask questions they lead the debate in the direction that they want.
First, they are justices. Their role is very different from a judge. Their role is to administer justice by interpreting law. They don't adjudicate. Second, that's not activism you are hearing, that's dialogue. They are asking questions and directing conversation to poke holes in argument so they can make a decision. This is part of the whole process of understanding an argument to interpret a law. It's called advocacy for a reason. The attorneys are meant to advocate for their positions and the Supreme Court justices are supposed to push and prod so they can interpret as the Constitution dictates. These hearings work very differently than a traditional trial hearing. The justices come into these hearings having read the briefs prepared by both sides and intend to push the arguments where they consider weaknesses. You have to direct the conversation in the short period of time that someone can speak in order to accomplish your goal.

From what I understand, NY state has a good program. Just about any NY state resident can get into one of the many community college and take classes that are the same as those offered at Cornell. If they do well at a local (live at home), less expensive community college, they can eventually apply to Cornell. If accepted, they graduate with an Ivy League degree, with nothing indicating that a portion of their learning was at a community college. This allows disadvantaged students the ability to ease into the pressure of a more competitive environment and graduate without an insurmountable mountain of debt. Maybe Massachusetts and North Carolina could try something like this. A more gradual transition from high school programs of different quality to a more competitive college program.

I am a teacher (high school/college). Teachers work 9 months a year; get every holiday known to man and wonderful benefits. I was always pleased with my "pay". More money, as has already been documented, will not churn out higher achieving students. Parental support is needed...THAT makes all the difference.

I feel like some of the justices know how to actually pose critical questions and play devil's advocate (even if their bias would fall in support of the counselor they are questioning). In other words, they at least try to do their job and bring out the strongest argument from each side. However, some of the justices don't know how to separate their personal feelings or biases, and effectively just help argue on behalf of the lawyer's side for whom they agree.
When questioning the side they disagree with, they pose straw-man arguments and then try their best to not let the counselor answer, and when they "question" the side they agree with they use the opportunity to add in their own arguments and bolster the counselor's position (by posing an argument in the form of a question, and asking the counselor if they agree).
I literally cannot comprehend why a supreme court justice would act like this. For example, if a second amendment case were brought forth before the court, and I were a SC justice who was very anti-gun- I am still going to ask the anti-gun lawyer/side of the argument the hardest possible questions I can and basically put myself in the most pro-2A position I can to steel man the argument (and vice versa if I were a pro-2A justice). The reason you would do this, is because you want to force the strongest argument to be teased out from each side- even your "own" (though they shouldn't have a side, we all know that they do). Furthermore, and I hate to say it- but it seems like the justices who argue this way fall towards a particular side of the political spectrum.

I'm a property manager and we have a set criteria to get approved. Your credit, Rental history & income. We don't "Change or reconsider our Criteria standards because someone chooses to share their race or cultural history with us. Can you imagine, we'd Lose our licenses!! Our criteria is applied to every person equally and that is overseen by Fair Housing laws therefore ensuring fairness to everyone equally! Our Rental criteria stops at our CRITERIA, PERIOD! The rental industry has operated this way for decades successfully without issue! How is it that our nations SUPREME COURT can't maintain such basic Human Standards of Rationalle????

Won science fair in Santa Clara Valley for four consequitive year while attending high school. Received several patents while attending high school. Attended college math courses while attending high school. Attended honors courses while attending high school. Attended math contests at Stanford University while attending high school. While there were attempts to define diversity, the definition provided couldn't be given without including diversity in the definiendum, no one broached the question of "race consciousness." However, I think generally "race consciousness" was seen as a negative. On the other hand, race neutrality was seen as a positive. Still there were a few judges who would like to discriminate admissions on the basis of race as a corrective measure. This was tempered by a general admission that it not be the sole basis for admission. The race neutrality arguments seem the more powerful because they properly address the issue of race as a factor in admissions: that it should not be used.
