I am a S.C. native and a veteran . About a month ago I graduated our CWP class and submitted my package to SLED . It will take about two more months to receive my CWP license through the mail . For many years the S.C. CWP liccence law provided that veterans did not have to qualify on a range test or pay the $20 fee that civillians were required to pay ., What is not mentioned is that a S.C. CWP holder can currently purchase a weapon without a background check , but the new law does not allow a non-CWP holder to do so . Part of the new law established a system wherein a few hundred millions of state dollars are to be spent training non-CWP holders in gun safety and law compliance free of charge to the students . The new law requires every S.C. county to conduct two classes per month . The list of prohibited places was not changed , but I would like to see the restriction on carrying in a daycare facility to be amended so that daycare staff can defend their charges .
Not sure If I somehow missed you mention it but does this apply to visitors from out of state or is it only for SC residents? Also does this effect the ability of those who have a CWP to keep them up to date for reciprocity purposes or are they still running the CWP process as it stood prior? I tried finding these answers myself but seem to get mixed answers- appreciate the breakdown videos as always!

Senator Shane Martin added a severability clause to the bill specifically because of Massey's two tiered justice amendment #36. They anticipate this being challenged in court. One thing MrGunsNGear didn't cover was that this new law moved the age of legal carry from 21 to 18.
Bill was relatively short and simple too, I am no legal scholar and it seemed comprehensible to me. Simply removed the need for a permit, bad part is you must be 21 to partake in constitutional carry or be issued a permit.
Granted, the bill should have been better, but we removed the requirement to have a permit in order to carry concealed or open and we made the legal age 18. There's work to be done for sure. We'll do it and clean this up. At least SC finally did something positive.
4:45 - This cannot hold up in court. The wording of the statute implies that concealed carry is tantamount to evidence of intent to commit a crime unless you paid the government an extortion fee. Just moved to South Carolina from VA. I didn't realize beforehand that the moment I obtain my SC drivers license, my VA CCW is voided, so I would not have been able to legally carry as I always do until I went through the SC permit process (90 days). Thankfully this bill passed so I don't have to worry about the in between permits phase. I'm surprised there's no official process for permit transfers between states, it's really unfortunate, it forces people to either give up their protection, or risk incarceration by carrying "illegally." 🤦🏻

I'm not sure why anyone wants to or needs to carry in most places. If I was approached by a criminal seeking money or my truck I could open the door and immediately defend myself and my property. I don't feel the same level of threats every time I am in public so... that's my question why are so many so paranoid..

I live in South Smack-a-lacky, and I carry just about everywhere I go. You know, I thought that constitutional carry would be way cooler than what it actually is. 😏
Can someone explain if this bill allows both open and conceal carry regardless of having a permit? Most of the articles only mention open carry so it is unclear to me.
Open carry was passed last year but all of the articles are going to make it seem worse than it is by saying “anyone can carry openly without training or a permit”
I live in Spartanburg County S.C. I "ve seen a few instances of open carry since the law was changed . One guy was open carrying in the Spartanburg Costco a few months ago . I have seen a couple of instances of guys carrying open in my local Circle K . Nobody seemed to care .
You missed some of the very important things. It changes the age to carry and to apply for a permit to 18, the age in the state for owning a handgun. Previously, it was 18 to own and 21 to carry outside private property. Additionally, it deletes the duty to inform a LEO, and puts more restrictions on the type of sign that is enforceable as 'no gun' signs. For instance, a store that I frequent(but really shouldn't patronize since it tries to restrict my rights) has a small 1inx1in sign, in white font in front of a white floor, that is at the very bottom of the storefront. So basically impossible to see if you're not looking for it. That is not notice anymore. Previously, it was very ambiguous and I couldn't find anything in courts trying it.
While I agree that some of the "sensitive places" you mention should not exist, the new permitless carry law does not prohibit carry in any of them, it simply does not remove the existing prohibitions. Of course, if they were removed without also removing the "force of law" provision from gun-buster signage, it wouldn't change much, since it's a pretty safe bet that most of them would simply keep the signs up that they have posted.
South Carolina has always sucked for concealed carry due to having rino fudds. They’re the only state where I’ve lived that they can charge you criminally for carrying in a posted business. In most other states it’s just a trespassing charge if you don’t leave when asked. Even when I lived in Minnesota, a blue state, their ccw laws were better than SC.
Of course, it's the guy from Lexington that messes it up. I know he's in the senate, but back in the day Nikki Haley represented us in the state House of Representatives.
1:45 I'm pretty sure most if not all of these are exactly the same as it's always been. I got my permit to carry 2 years ago when I moved to SC and the short answer is that everyone of those places has a no carry sign at the entrance to the facility. I don't think that these locations are newly restricted but clearly I didn't pay that much attention when I took that class because if anyone knows you're concealed carrying then you aren't doing a good job of the concealed part. Unless there is an alcoholic beverage in front of me you can guess what's inside my waistband.
SC should be 28 since ours goes into effect immediately. That said, get some training. Know for sure when you can or cannot use deadly force and the other points will be a non-issue
So people in SC are able to conceal carry without a permit now? Many of the news articles I see only refer to open carry… Anyone have an answer for this?
Sadly, stuck in MD. Waiting for gun shops to finally start selling handguns without an HQL. I believe the full appeals court will re-hear the case later this month. HQL currently ruled unconstitutional in MD, but stores and police are ignoring the ruling!
Can someone explain how constitutional carry works for out of state residents? I come from a tyrranical blue state but I have a concealed carry permit. I plan to move to SC in the next couple of years but I was curious if this works for out of state residents as well.
LA resident ............................ Firmly of the belief whatever inevitable stupidity is baked will have played out by then. It will have little to no benefit because t is not going to be implemented before the chaos ensues.
So, does this mean I will have more rights in SC with my Indiana permit than an SC resident doing constitutional cc? Indiana was not previously on the reciprocity list, and I wonder if things really stayed the same
I’ve been following this since it was announced as a bill in the state house a little over a year ago. And I had gotten my cwp already but that is okay because there are many states that still respect South Carolina’s cwp.
One thing the video is missing is the definition of "person". In 1862 Congress changed the definition to mean a corporation. In reviewing the state statutes for GA and SC the word "person" means a corporation. It does not mean a man, woman or people. All statutes are commercial. You need to learn definitions. Law enforcement doesn't and most attorneys do not.

I don't think that these locations are newly restricted but clearly I didn't pay that much attention when I took that class because if anyone knows you're concealed carrying then you aren't doing a good job of the concealed part. Unless there is an alcoholic beverage in front of me you can guess what's inside my waistband.
What part of SC do you live in? I'm in the upstate. There are very few places with signs prohibiting carry here.
SC should be 28 since ours goes into effect immediately. That said, get some training. Know for sure when you can or cannot use deadly force and the other points will be a non-issue
So people in SC are able to conceal carry without a permit now? Many of the news articles I see only refer to open carry…
Anyone have an answer for this?
Yes, conceal or open carry without a permit. For some reason, the news outlets are hung up on permitless open carry.

@@nickscarinzi9997 Thanks for the clarity

Too many RINO's in my state
The primary us in June. Let's vote them out.
Sadly, stuck in MD. Waiting for gun shops to finally start selling handguns without an HQL. I believe the full appeals court will re-hear the case later this month. HQL currently ruled unconstitutional in MD, but stores and police are ignoring the ruling!
How do you lose the governor race in a state where you have a super majority? Pathetic.
What about Louisiana?
Can someone explain how constitutional carry works for out of state residents? I come from a tyrranical blue state but I have a concealed carry permit. I plan to move to SC in the next couple of years but I was curious if this works for out of state residents as well.
Freedom
Louisiana did too, goes into effect July 4th
LA resident ............................ Firmly of the belief whatever inevitable stupidity is baked will have played out by then. It will have little to no benefit because t is not going to be implemented before the chaos ensues.
Not one state has true constitutional carry because they don't actually understand what "shall not be infringed " means. So its only permitless carry.
Hoping NC gets the rinos out of the way.
Before anyone primaries this guy, see if he had to add the provisions to get it passed. Sometimes, in politics , it’s not as simple as it seems
Good afternoon.
Louisiana just passed Constitutional Carry also.
Yeah!

Not sure how it can be considered constitutional carry if they still require you to have a permit
They don't require a permit now. They're encouraging you getting your permit.
Lets see how the winning looks in a few years
Tennessee has constitutional carry however if you get a permit and for a lifetime license it’s only 300$ at an dmv
It doesn't cost South Carolinians anything to renew. They got rid of the sled fee when open carry was allowed.
Where can we put our truck
gun/ long gun while traveling in SC now. I do live in SC.
Wherever you want. You can walk down the road with a loaded long gun. We have never had restrictions on long guns.
@@scottmclemore7034 I was told the long gun must be in latched case in rear of vehicle buy a gun school Owner.
@@tonyalexander5789it can be anywhere in your vehicle and you're not obligated to tell the police. That was one of the things they put in this law.
Good news thank you for the video
You bet
Yeah. Awesome
Tennessee doesn't have true constitutional carry either. I can't carry while walking on the Greenway because it's considered a park. Bullshit
Uh...After a close call to cancel it all something is better than nothing. Quit complaining and try to see the glass as half full.
It took over 10 years of hard work to get here. It isn't perfect, and we need to clean up some stuff, but it's a big step in the right direction.
Just want to confirm. When does it start and are there restrictions for non residents ?
It went into effect yesterday. I'm trying to find out about non residents. Nothing in the bill addressed them.
Thanks for posting the information. I recently moved my family to Mr. Massey’s district from Florida. Man it’s hard to get away from the RINOs. I will make it one of my priorities to have him replaced ASAP.
The primary is this June. If Massey has a primary challenger, please get out there and help his campaign.
