Lol they would not even bother sueing a smaller streamer. There is literally no point to sue smaller streamers because they don't have enough money for it to be worth it. I work in the legal practice and I can tell you for a fact that it is not worth sueing someone if they don't have much money. Why waste money on legal fees when you won't get anything in return? I remember the fight with Viacom. They were the most hated company around RUclips back in 2007-2012. Every single creator had stuff being taken down for the smallest thing. This was one of the first times I had seen so many creators pull together against something so big, along with SOPA and PIPA. My god that was so long ago
The biggest problem with big streamers like this completely just breaking clear and obvious copyright law is that they know they will not suffer major consequences. They know they are the big moneymakers on twitch and they want them to stay on their platform. The only people that are going to be harmed by their actions are the small streamers who are going to be affected by whatever rule changes twitch puts through because of this.

And big hedge funds, and financiers exist *outside of the system* in regards to trading laws, with the exception only being for obvious fraudsters they can't get away with ignoring. And twitch will absolutely pass new rules for the platform which they will only enforce for the majority of small streamers, then ignore for the big ones.
I've noticed a lot of v-tubers do this as well but as watch-a-longs. Basically, they'll let the audience know what movie they plan to watch(and where it can be bought) so everyone can get it, then they start the movie at specific time and watch it together. You can't see or hear the movie on their streams, it's just pure reaction and it makes a lot of sense, it's as legally transformative as it gets when it comes to "reaction" type content. Not sure why people on twitch can't just do something like that, seems like an obvious thing to do.

IIRC Pekora is currently the second highest-viewed female streamer in the world. Some of the ones who do this sort of content semi-regularly are also among the most popular.

A lot of review channels don't do this and show a lot of unnecessary stuff, use the OST as background music etc. Still, a lot more integrity than these reaction streamers just redistributing entire movies
In all fairness, she was streaming an entire show that's locked behind paid subscription services. She should've known the risk of streaming an entire show on twitch, even though a lot of other people get away with it.

I’ve seen streamers like Hololive get around the problem in a smart way. They only stream their reaction, with no audio or video of what they’re watching being present. Instead they require the viewer to also watch the movie, show, etc on their end, synchronized with the streamer’s reaction. They call it a watchalong, and I’m like 99% sure it’s completely legal to do it.

Copyright laws are messy and everyone would just like to chill about it and whatever but you still have to be responsible and follow the rules. The ironic thing is that she has striked people who has made negative yt videos of her with completely fair-use which is kinda basis of why this is so stupid of her. There is videos about the completely no ground strikes since youtube commentators take strikes pretty seriously since it's 3 and you are out and the appeal system is moronic. It's kinda something like you take the strike or appeal and wait for some period of time and when it ends if they don't sue you it dissappears. Bigger youtubers get them handled manually by having to many times reach out thru twitter to youtube (if they aren't so big that they got like a yt representive as a contact).. aka it's so scary for the channel because say you have made 3 videos of pokimane and she strikes all of them then it's 3 strikes and you have to work thru to get them removed because the system is broken. And I think your channel would be down in that case for the waiting period if you don't get it handled before that. So nobody likes people who abuse the system like she blatantly did and at the time read on the law and now is watching movies on stream while eating.
If Twitch actually pulled through with all the bans and stuff, the most popular streamer roster would be so much different than it is, most streamers that people watch and those who are the most popular, have already been banned a couple of times, some of them even passing that 3 ban limit. I've always been annoyed with the internet's understanding of fair use. There is zero consistency to what they think is fair use beyond "I liked the thing," and apparently writing "no copyright infringement intended, I own nothing" is all they think they need to do. From her perspective you either get: 1. No-effort stream content as subs/donations come rolling in 2. A 2 day vacation And Twitch refuses to seriously punish them as they're bringing in the bulk of Twitch's revenue.

The biggest difference here to the RUclips case back in 2014 is that for the RUclips case, there were too many individuals and none of them were worth suing, so Viacom took the suit to RUclips themselves. For this particular case, Viacom could probably sue Pokimane and actually recover damages, based on public information about what she earns. It would probably be the best outcome, because it wouldn't significantly affect Twitch as a platform, and would properly put the fear of legal action into big-name streamers that are DMCA-baiting.

Her infractions of over 30+ will result in them targeting her for nearly the full charge of the strike which is 1.8 billion (or million can't remember which it was). IMO twitch and YT are missing out BIG TIME on this. They could literally AND EASILY implement a "watchalong" button where the content creator can link legitimate places to watch the content along with them. It could have timestamp integration and everything, and I bet amazon, netflix etc would love it since it drives sales for them.
Amazon prime video already has something like that on the platform but the streamer only broadcasts their reaction and their timestamp and everybody else is responsible for having prime video and to sync it up with the stream but that way you can see the streamers reaction to what you're all essentially watching together
Unfortunately the process for setting up a big collaboration like that is slow and tedious for big companies. Twitch is literally owned by amazon and it still took them a while to implement amazon watch parties. You're right that it's a good idea and it will probably come eventually.

If twitch was smart about this I feel like they could leverage a lot of opportunity out of it. People clearly want to have watch parties with their favourite streamers, I feel like it would be possible to strike a deal with streaming services like netflix into integrating the actual streaming service itself into the platform. I have no idea how the technical specifications of this would work but if viewers could link their paid netflix account with their twitch account and then gain access to the integrated stream with the netflix stream synced up with the twitch content creator's netflix stream, only users who have paid for the service already could watch and the streamer isn't actually streaming the movie/tv show, they're essentially a second video overlayed over the netflix stream. There would be an issue arise when there are geolocational blockers, in which case those viewers wouldn't be able to access the integrated stream without a vpn. This could be taken a step further with netflix acting as a sponsor for streamers who use their platform for watch parties and providing streamers with sponsorship codes and benefits to make up for the streamer having a smaller audience due to (whether or not viewer has a paid netflix account linked), since this would undoubtedly bring more customers to netflix because they don't want to miss out on these watch parties with their favourite streamers. Seems like everybody wins in this scenario. I'm sure similar things could be achieved with watch parties for youtube videos.

Viacom sucks but I really don’t see what they did wrong in this case. Even if copyright law was massively reformed it’s not like this is some 70 year old show that’s teethering on the public domain. You’re not criticizing it, you’re hardly adding anything transformative to it (which is already a tenous excuse to begin with), you’re simply stealing content and restreaming it for free to thousands. It’s like the straight-up textbook definition of a copyright violation, short of literally ripping a dvd and selling it there’s next to no way this could be any more clear cut. RUclips’s «ad-claim» feature is a gesture of kindness, not something that is specified in law anywhere. Companies can and likely will sue people and companies who attempt this, and they’re no doubt going to have a slam dunk in court.
The problem here isn't that they violated the law. Yeah they did. It's that copyright is a horrible law. It's essentially just NFTs but they actually do something. It gets even worse when it comes to inventions because now people can't take other people's design and implament it into their own invention because that piece is copyrighted. It's just anti-art, anti-tech, and protects the interests of big buisnesses.

Y know German has a neat law called parody law. You could take an entire movie and as long as you make fun or comment on every single Szene you are using, it's transformative enough not to be copyright claimed.

That's why people are wanting DMCA to come down on the top Streamers just to make it a point that their popularity is not a shield for them. i don't think the solution is to shaft everyone MORE. dmca needs fixing, and the unfairness of bans speaks more to how corrupt these money hungry corporations are. having dmcas cause perma bans for even big streamers will just throttle and corporatize streaming faster. there's a better way to deal with this than making the system suck harder for everyone. the way things are now im waiting for the day companies like viacom just buy a mascot streamer who is the only one allowed to stream their content and force monetize what used to be a free (or at least pay what you want) form of entertainment.

When it comes to bigger streamers they stream to a bigger audience, meaning when it comes to stuff like this, there is a bigger loss of income from the original creators. Yeah, these streamers really need to stop poking the bear. If streamers keep infringing copyrights so brazenly, and Twitch does not start dealing with copyright violations with a heavier hand, the door could be opened for a big rights holder like Viacom or, even worse, Disney, which can afford a lot of very expensive lawyers, to make the argument that Twitch isn't making a good faith effort to remove infringing materials. If a court were to entertain that argument, Twitch would be in danger of losing its DMCA safe harbor, and if that happened, suddenly Twitch would be liable for every single copyright infringement that occurs on the platform, which, considering all the effort Sonny Bono and Disney's lobbyists put into making U.S. copyright law as Draconian as possible, could be enough to even drag Amazon down.
Honestly, if a streamer is going to watch a film in it’s entirety with their audience, their stream should not be protected by fair use. The content then becomes the film itself and the streamer playing “hangout” with their audience is then just an auxiliary piece of the content at least in the legal sense. I would encourage streamers to “sync” the playback of a movie or show with their audience by using an onscreen timer and play it off screen. That way they can still hangout and watch movies with their fans while still advocating for ownership of the media in question to their audience so that way they can still keep their format and have it be 100% legal.

Listen, I'm almost always supportive of free-artists, especially against media corporations that are notorious for shitting on independent creators. However, I think I'm going to side with Twitch on this one. While copyright is a bit messy and companies like to take advantage of that, piracy is still a real thing that isn't allowed, and if she actually WAS streaming a full-ass show on Twitch... yeah, you can't do that. That's not the same as playing a game or reacting to a show with edits and cuts, you're literally just providing people a way to watch the show without paying for it. Apparently it's not even a permanent ban, which I was under the impression it was. I’m all for fair use being used correctly and for people to stop abusing loopholes. But when it comes to what type of content they make, so long it’s not harmful, I don’t see why they should stop? If I remember right fair use law primarily considers whether the new piece of media has been transformed enough to be a new thing, and also not infringe on the primary market of the original copyrighted media. Watching an entire episode and talking over it doesn't turn the show into a new product, and it absolutely infringes on Nickelodeons ability to market their IP. This probably wouldn't be fair use if it got to the courts

This was like the highschool equivalent of "all the cool kids do drugs why don't you." Literally everybody knew it was a ticking timebomb but people kept doing it because everybody else was doing it. Hopefully it's a reminder for people that they need to do original content to be, you know.. "a creator."

The biggest problem with big streamers like this completely just breaking clear and obvious copyright law is that they know they will not suffer major consequences. They know they are the big moneymakers on twitch and they want them to stay on their platform. I've noticed a lot of v-tubers do this as well but as watch-a-longs. Basically, they'll let the audience know what movie they plan to watch(and where it can be bought) so everyone can get it, then they start the movie at specific time and watch it together. You can't see or hear the movie on their streams, it's just pure reaction and it makes a lot of sense, it's as legally transformative as it gets when it comes to "reaction" type content. Not sure why people on twitch can't just do something like that, seems like an obvious thing to do.

They only stream their reaction, with no audio or video of what they’re watching being present.
Instead they require the viewer to also watch the movie, show, etc on their end, synchronized with the streamer’s reaction.

The ironic thing is that she has striked people who has made negative yt videos of her with completely fair-use which is kinda basis of why this is so stupid of her. There is videos about the completely no ground strikes since youtube commentators take strikes pretty seriously since it's 3 and you are out and the appeal system is moronic. It's kinda something like you take the strike or appeal and wait for some period of time and when it ends if they don't sue you it dissappears. Bigger youtubers get them handled manually by having to many times reach out thru twitter to youtube (if they aren't so big that they got like a yt representive as a contact).. aka it's so scary for the channel because say you have made 3 videos of pokimane and she strikes all of them then it's 3 strikes and you have to work thru to get them removed because the system is broken. And I think your channel would be down in that case for the waiting period if you don't get it handled before that. So nobody likes people who abuse the system like she blatantly did and at the time read on the law and now is watching movies on stream while eating.
If Twitch actually pulled through with all the bans and stuff, the most popular streamer roster would be so much different than it is, most streamers that people watch and those who are the most popular, have already been banned a couple of times, some of them even passing that 3 ban limit. Having influential streamers see "how far they can get with abusing DMCA" and not coming through with actual bans just shows how greedy Twitch actually is, because everyone knows if the top earner gets banned, they lose money.

The biggest difference here to the RUclips case back in 2014 is that for the RUclips case, there were too many individuals and none of them were worth suing, so Viacom took the suit to RUclips themselves.
For this particular case, Viacom could probably sue Pokimane and actually recover damages, based on public information about what she earns. It would probably be the best outcome, because it wouldn't significantly affect Twitch as a platform, and would properly put the fear of legal action into big-name streamers that are DMCA-baiting.

IMO twitch and YT are missing out BIG TIME on this. They could literally AND EASILY implement a "watchalong" button where the content creator can link legitimate places to watch the content along with them. It could have timestamp integration and everything, and I bet amazon, netflix etc would love it since it drives sales for them.
Amazon prime video already has something like that on the platform but the streamer only broadcasts their reaction and their timestamp and everybody else is responsible for having prime video and to sync it up with the stream but that way you can see the streamers reaction to what you're all essentially watching together
Unfortunately the process for setting up a big collaboration like that is slow and tedious for big companies.
Twitch is literally owned by amazon and it still took them a while to implement amazon watch parties.

If twitch was smart about this I feel like they could leverage a lot of opportunity out of it. People clearly want to have watch parties with their favourite streamers, I feel like it would be possible to strike a deal with streaming services like netflix into integrating the actual streaming service itself into the platform. I have no idea how the technical specifications of this would work but if viewers could link their paid netflix account with their twitch account and then gain access to the integrated stream with the netflix stream synced up with the twitch content creator's netflix stream, only users who have paid for the service already could watch and the streamer isn't actually streaming the movie/tv show, they're essentially a second video overlayed over the netflix stream. There would be an issue arise when there are geolocational blockers, in which case those viewers wouldn't be able to access the integrated stream without a vpn. This could be taken a step further with netflix acting as a sponsor for streamers who use their platform for watch parties and providing streamers with sponsorship codes and benefits to make up for the streamer having a smaller audience due to (whether or not viewer has a paid netflix account linked), since this would undoubtedly bring more customers to netflix because they don't want to miss out on these watch parties with their favourite streamers. Seems like everybody wins in this scenario. I'm sure similar things could be achieved with watch parties for youtube videos.

Viacom sucks but I really don’t see what they did wrong in this case. Even if copyright law was massively reformed it’s not like this is some 70 year old show that’s teethering on the public domain. You’re not criticizing it, you’re hardly adding anything transformative to it (which is already a tenous excuse to begin with), you’re simply stealing content and restreaming it for free to thousands. It’s like the straight-up textbook definition of a copyright violation, short of literally ripping a dvd and selling it there’s next to no way this could be any more clear cut. RUclips’s «ad-claim» feature is a gesture of kindness, not something that is specified in law anywhere. Companies can and likely will sue people and companies who attempt this, and they’re no doubt going to have a slam dunk in court.

When it comes to bigger streamers they stream to a bigger audience, meaning when it comes to stuff like this, there is a bigger loss of income from the original creators. If they have the required distribution license then it’s fine, but when they don’t, it needs to be shown that things like that can be really serious when it comes to the breach of law. Like the smaller streamers will be permanently banned, but if people like Pokimane, XQC, and others that size get a lighter sentence, it doesn’t effect them that much and doesn’t give a good look to outside parties like Viacom, Fox, etc.
Yeah, these streamers really need to stop poking the bear. If streamers keep infringing copyrights so brazenly, and Twitch does not start dealing with copyright violations with a heavier hand, the door could be opened for a big rights holder like Viacom or, even worse, Disney, which can afford a lot of very expensive lawyers, to make the argument that Twitch isn't making a good faith effort to remove infringing materials. If a court were to entertain that argument, Twitch would be in danger of losing its DMCA safe harbor, and if that happened, suddenly Twitch would be liable for every single copyright infringement that occurs on the platform, which, considering all the effort Sonny Bono and Disney's lobbyists put into making U.S. copyright law as Draconian as possible, could be enough to even drag Amazon down.

Honestly, if a streamer is going to watch a film in it’s entirety with their audience, their stream should not be protected by fair use. The content then becomes the film itself and the streamer playing “hangout” with their audience is then just an auxiliary piece of the content at least in the legal sense. I would encourage streamers to “sync” the playback of a movie or show with their audience by using an onscreen timer and play it off screen. That way they can still hangout and watch movies with their fans while still advocating for ownership of the media in question to their audience so that way they can still keep their format and have it be 100% legal.

How do we get from “we have issues with copyright laws and we need them reformed” to “all copyright is bad we should be able to take whatever we want”? The mental gymnastics people go through to simp for their streamers. They’re not trying to “push the limits of copyright laws” they’re just lazy.
I honestly hope Twitch does do something, this trend of just "reacting" to other peoples content or creating daily content from popular Reddit posts is just lazy. Now streamers want to just lay in bed and watch movies, like come on if you want to be an artist/creator then be one. The moment people realized you can be paid for views is the moment the world turned for the worst.
Nothing is stopping people from making better content to fill the void. If anything, I'd say the real laziness is just complaining about it.

I’m all for fair use being used correctly and for people to stop abusing loopholes. But when it comes to what type of content they make, so long it’s not harmful, I don’t see why they should stop? Even if it is lazy work, there’s still an audience. Why is there an audience, I don’t know. I find reactions boring if the content creator doesn’t create anything out of it as you’ve said. But if lazy work still gets them paid, I really can’t blame them lol. If people stopped giving them views, they will naturally stop.
Edit: I’d like to re-iterate. I don’t agree with their misuse of the fair use law. I don’t agree with them stealing content from other creators including movies and shows. That is breaking fair use, and that’s wrong. What I meant was I disagree with preventing content creators being “lazy.” So long they’re not doing anything wrong and they still get views, I find it okay.
I saw this being brought up as an issue recently and I was suprised they were getting away with some of that stuff. It's pretty insane that some people don't care about the future effects of what's going on. Entire twitch channels will have to change completely to stay afloat. Think about all the huge streamers that base a significant amount of their stream on watching youtube. This could be a time of drastic change. Or maybe a bunch of people will get strikes and then once they stop nothing will change. I dunno.
I would say watching RUclips content is worse than watching TV shows and movies because you're literally stealing from small time creators and not massive companies.
It sucks that everyone is doing it and nobody is being cautious even when some upload to RUclips and know how dmca can fuck everyone over I hope people listen and don't fuck it up for everyone

If I remember right fair use law primarily considers whether the new piece of media has been transformed enough to be a new thing, and also not infringe on the primary market of the original copyrighted media. Watching an entire episode and talking over it doesn't turn the show into a new product, and it absolutely infringes on Nickelodeons ability to market their IP. This probably wouldn't be fair use if it got to the courts

In my defense I didn't know the context, I just saw the title and wondered what was going on.
This was like the highschool equivalent of "all the cool kids do drugs why don't you." Literally everybody knew it was a ticking timebomb but people kept doing it because everybody else was doing it. For a lot of the streamers, breaking the copyright was the brand building because it was "hey look at me, I'm cool too."
This has been a stale few months in Twitch content. Hopefully it's a reminder for people that they need to do original content to be, you know.. "a creator."

I like what he said here, it stops being "fair use" when you upload the whole thing in its entirety. At the very least, pause it, don't show the whole thing, talk over it, maybe talk about it instead of just watching it. In my personal opinion, you can have people look at stuff and transform it in some way, but if all you do is just watch and call it a "reaction", you're untalented and have no business putting out something like that and expect people to pay you for it.

Ludwig had a deal with crunchyroll to watch 3 episodes of onyx equinox on stream so it's definitely possible.
