    She put him through a personal hell?!? This dude basically got a $19k loan interest free for 4 years, was able to put his mother in a home right away, didn't lose any money because she paid for the month he was out without argument and was super patient for 4 years getting paid back in small sums. This guy's nuts 😳

      You're semi nuts like that guy. That's not how it works. If you don't make a lot of money and suddenly need a $20k lump sum to pay for some surgery and you sell your car in order to pay for it, and when the sale goes through you get the surgery and pay the $20k, you are now out the money. If the buyer comes around next week saying he decides he doesn't like the car and demands his $20k back wtf are you going to do about it? The only thing you can do is offer him to resell it and once that happens pay him back. Now let's say in this case the only new buyer is only willing to buy it using 6 installments over a year. Obviously you can't pay it all back at once so you're going to pay back in parts. In the case of rent you're losing money if you pay the full income back each month because you're then stuck making double payments and losing income. The fair thing would be to pay over double or triple the timeframe which would on this case be 1yr or 1
      5yrs. So yea 4yrs was a lot. But at the end of the day the Asian lady was the one breaking a contract and putting both of them in the situation.

      @Public Square exactly. Except even worse you had to use that 20k right away for medical bills so you literally don't have it. And you can't pay exactly what the new buyer is giving you or else you're still losing money. So you can maybe pay half or a third on order to deal with with the unexpected loan you're stuck with.

      I agree with you guys that he was put into a loan unexpectedly that he didn't ask for. I'm just saying it worked out for him because he needed that money right away, according to him, to be able to pay for his mother's care in a nursing home. So, he had all that money upfront to do that got to keep the months rent so he wasn't out any money AND got a new tenant right away so he was collecting rent all that time. If she did move in he wouldn't have seen another rent check for over half a year because she paid 6 months upfront and that money still would have gone to his mothers care. At least this way it was kind of a blessing in disguise that he had that money upfront still got rent checks every month and got to pay it off slowly in small sums he could afford over the course of 4 years. Just saying it seemed to work better for him that she backed out and he found another tenant right away.. but that's just my opinion 🤷‍♀️

      And it most definitely is an interest free loan! Whether he wanted or asked for the loan or not is completely irrelevant and has nothing to do with paying interest on a loan. Interest is a percentage of money you pay extra to have a loan. He paid her back exact dollar for dollar, nothing more, no interest. So yes, it most definitely is an interest free loan by definition!

      He didn't ask for a loan. She signed a contract and broke the contract. And put him in a very bad position. He did everything he could to pay her back. He does have the right to keep a month's rent because he could not rent it out immediately.
      The plaintiff is absolutely ridiculous.

    It should NEVER have taken 4 years to pay back. He had rent coming in every month equaling 2600. Why wasn’t he turning this over to her?

      Better yet, he should have been holding that money in escrow and pulling the appropriate rental amount out each month, not taking it all and spending it all up front.

    I told my landlord I would pay 3months in advance because I knew I had bad credit. She gave me the place but said legally she couldn't take that much in advance. Luckily I've never been late once in 4years

    4 years to pay back the money? So he nickeled and dimed her at zero interest and now he complains? I bet it was him mother’s house and the rent was supposed to cover her care elsewhere but he just didn’t want to pony up the difference. If it was 4 years you can bet he’s probably getting 3600 hundred or more for the rental now .

    First off, the entire deposit should have been paid back immediately. Landlords aren't supposed to spend your deposit at all...they're supposed to put it in an account and hold on to it. Second, its really strange to me he went out and spent her entire first 6 months of rent before she even moved in. What if the place had issues, like an appliance goes out? Or the roof needs fixing? Would he have had the cash to pay for that?

And second stupidity is what stupidity does...the reason I rent is because I cannot come up with a deposit for a 🏠 of my own,and thipese people throw around nearly 20$ dollars for the first 6months rent!!! The house I'm in now is only worth $22,000!

      I don’t know it it varies by state but the Judge mentioned in another case that in NY or NJ a landlord has to put deposits in a separate account if they have 10 or more rental properties.

    The plaintiff is bonkers. She saw that the house was across from a school - she gave the landlord a $4000 security deposit + SIX MONTHS RENT IN ADVANCE - and then broke the lease because it’s across from a school. 🤪

      @@Aceofwolves He didn't have to let her out of the lease because her reason for breaking it was not something the law would recognize. He was being nice about it. And you try being stuck with a loan you never signed for and suddenly have to pay back.

    Disappointed that JM didn’t call him out at the end for complaining about how hard it was to re-rent. In the beginning it was said he told her she really needed to be sure because a lot of people are interested plus the fact of the 6mo. rent advance to make herself a more competitive renter (b/c it’s a hot commodity property).

    Not sure why the judge made such a big deal out of the plaintiff breaking the lease. Sometimes you make a decision and then change your mind. She accepted the consequence of breaking and that should've been the end of it. Weird how they gathered so many defendant sympathizers on the sidewalk. I doubt any of them would feel the same in the plaintiff's shoes.
    As for the defendant, he seemed likeable throughout the case but once he started boohooing about having to re-rent and pay the plaintiff back, I was done with him. She was extremely patient to let it go on for almost 4 years and he was just being greedy.

    I guess it’s a common thing in California to pay several months up front. I always paid my rent at least 4 to 6 months in advance. My landlord loved me. Why? So he doesn’t have to bother me and vice versa. I took very good care of the property and was there for 16 1/2 years. Loved doing it that way because it was less stressful for me.

    There was about zero tension in this case. Seems like the plaintiff, defendant and judge were all laughing at some point or another. The defendant took the judge's decision well enough even if he wasn't happy about losing. While the plaintiff was in the right, I think it is really dumb to change your mind about renting a place based on something you were able to see when you first checked the place out. As for paying six months' rent in advance, I am glad I don't live in that part of the country! That's insane.

    What pain and suffering? He used her money to get his mother in nursing home or whatever. So who put who through suffering? She helped him with her money, pretty much like a loan with no interest.

    I still think there is something fishy......he needed $19,000 to put his mom in an assisted living facility? Where was she staying, Buckingham Palace? BTW, I am a nurse, and have worked in long term care facilities. They can be pricey but I am not buying the story about where the money went. Plus the fact that he had zero payment records. Not to mention the fact that, there were so many people wanting the property that she put 6 months rent up to make sure she had it, and then he said it was so hard to rent. I just don't buy his case.

    They can afford to pay $19.6k in advance for an apartment, why not use the $ as a down payment on a house, condo, etc?

      Do you realize how much house's are in Los Angeles? A million just to start. That's for a basic house! It's ridiculous there 🙄. So that money wouldn't go far unfortunately 😕. ✌
