- The plaintiff says she bought wall-to-wall carpeting from the defendant, but they brought the wrong color on they day they were going to install it, so she refused the delivery. She still doesn’t have the correct carpet, so she’s suing for a refund. The defendant says the plaintiff did pick that carpet at the store but didn’t like it when it was delivered. He let her order three different carpets and she still isn’t satisfied.

If you're complaining that your feet are too cold in the kitchen, why not a) wear slippers, especially with those comfy fluffy socks, or b) get one of those area/runner rugs or mats that you place in front of the stove, that you can easily remove and wash if something spills on it?
Some people like to be extra picky and dramatic
It always blows my mind when owners act like they went above and beyond. They had the wrong color. Any client would get aggravated after two times and leaving the kitchen a mess.
Defendant should have seen the red flags once she asked for her kitchen to be carpeted.

Ive rented apts that had carpet in the kitchen.they used indoor/ outdoor carpet n u could sweep it with a broom

As the Judge pointed out, the sample color AND texture were not the same because they changed the carpet formula but don't update the samples. Get a sample from what is in the store on the roll and if what shows up doesn't match, tell them to take it back if you don't want it. Having said that, I didn't follow that advice but it was with granite countertop. I searched over 2 years for a specific piece and finally found the EXACT piece I had been looking for. They came and measured and gave me an A cut and a B cut meaning the slab would be cut one way or the opposite direction. I chose A and emailed the associate. On a Sunday (which I thought was odd) the installers show up. 1 shows up and does the demolition and the other comes later and does the installations. They start putting in the countertops and immediately realized they did the wrong cut! They guys just kept working and said we just install so I'm on the phone frantically trying to reach the company but it is Sunday and no one is answering. I could have had the guys stop but they worked quickly and in 20 minutes it was done while I'm in the other room on the phone. I couldn't get my old countertop back and I'd have no countertops for who knows how long trying to get another piece. After sleeping and looking at it, I thought I could live with it and she blamed the cutters for choosing the wrong file. I settled for 1/2 off what I still owed and used that money to buy a new microwave and dishwasher. I will make sure work is not on weekends going forward.

The plaintiff is at fault for paying for the job in full before it was complete. I'm glad she didn't get $5,000 like she was suing for. Also, never in a million years would I have carpet installed in a kitchen, that's just bizarre.
They generally do not install a fluffy carpet. It is low grade non shag carpet. Hard to keep clean. Like linoleum flooring instead,

We had carpet in our kitchen growing up as a kid. I’m thinking it was probably installed in the early/mid 80’s. It was a low pile but I’d say thicker than a typical indoor/outdoor style, ours had a red brick pattern. It was bizarre, but for a kid, much better to vacuum the kitchen floor than to sweep and mop it. 😂 I totally agree tho, it’s weird. I have no idea what my parents were thinking. 🤷🏻♀️
My mom always did industrial carpet in our kitchens. She was an immaculate housekeeper so there was never a problem. I never did ask her why she preferred that. Maybe because it was warmer than tile. 🤷🏼♀️

I owned a floor covering store for many years. I could see from the first carpet sample that it was the wrong color. Either the salesman made an error when caret was ordered, or the mill sent wrong color. Could be the roll was mislabeled at the mill. Nothing wrong with that type of commercial carpet for kitchen. It is designed for easy clean up due to the fiber content....olefin which is a non absorbing carpet fiber.

The plaintiff is a nice woman but suing for $5,000 pain and suffering for having to walk on a cold floor makes her not so nice. So many people have cement floors. You put down a durable insulated kitchen floor and then put AREA RUGS where you stand! The first time some cooking grease or tomato sauce spills on a wall-to-wall kitchen carpet, it's going to look like hell.

The plaintiff was being greedy (and I get the feeling she wasn't such a sweet old lady to the defendant out of court). The defendant had that "deer in the headlights" look which never plays well in court. In my opinion, she must have been a jerk to him for him to freely admit calling her one. I've known old people who were SOOO sweet in public, but one-on-one, were downright NASTY.

When I was growing up my mom had carpet in the kitchen. It was an easy to clean type but it sure was better than walking and standing on cold concrete.

Every sample (Carpet, paint, ceramic, tile, curtain,...) has different code numbers. So, when you order the sales person will put the code what you ordered in the receipt for the warehouse pull what you order. Judge M. M. should see the receipt or the invoice to make sure what customer order and what they gave the customer.
I believe the defendant is out of the stock what the plaintiff ordered and wants to install closed color for gets her money. He saw an elderly lady and he thought she won't tell the differences.That's why he didn't bring sample book for the second carpet. Judge M. M. should gave the plaintiff $$$ for aggravation.
When I go shopping for ceramics, tile I always take 1 piece sample of what I ordered. And for the paint I take picture of paint code #.

Slippers! I have lived in many homes with either tile or hardwood floors, i would do small mats in the kitchen and bathroom, and wear slippers with socks if my feet got cold but not full on carpet in the kitchen lordy the messes would be awful to take care of!

Maybe it is different in the US but the judge seems surprised they didn't put back her stove and fridge after moving them to install carpet. I am surprised they moved them in the first place. Here, in the UK, it is not up to carpet fitters to move your stuff, the floor space must be free for them to install the carpet.

I think the BEST samples are the most expensive. I would still show some better materials to my clients if they hate the cheaper ones. An amicable deal could possibly be struck.

The defendant should have just given her money back for the kitchen carpet in the first place. Would t have to go through all this hassle and disputation. And also keep future business .
It is likely the actual carpet will not be exactly like the sample. The lighting and shading differ, and the manufacturer makes different rolls where the dyes might differ. Best to buy from a roll that’s already there, and cut to size you want .

When will litigants have an understanding of how "pain and suffering" works in a court case? Do your research! It's completely ignorant of the Plaintiff to try to sue for this over carpet.
I don't know I she should have probably gotten the $500 that the judge awarded her plus another 500 for a time and aggravation! The fact that there was proof that the first sample didn't match what was ordered probably means that the second one also didn't match, also the fact that the judge said that the carpet wasn't installed in a timely fashion and the installer came and ripped the carpet out before it was time to install and then didn't put the appliances back for the lady that most definitely warranted some aggravation cost.
