The pick up wasn’t aware of the Mercedes coming out of nowhere or its speed, but once he was he should have stayed in the center lane (safer option) or sped up. When he attempted to move back to the center lane and clear the left lane for traffic behind he technically did the right thing according to passing laws, but the Mercedes was angered by the mistake and was too impatient to let him return to the center lane. His reaction and timing was poor, but he did nothing wrong except follow through with the decision to unsafely pass. He wasn’t being a defensive driver and misjudged the situation. So legally he was right, but “real world” he was not. He meant no harm, give him the benefit of the doubt.
