    The injustice is this woman experienced is frightening. What is going on? Are these police just not trained? I hope she sues. When did we lose our rights? She was taken advantage of because they thought no one would care. Thank you for making a difference. I’m confident you won this case! God bless!😊❤🙏🏻

      They learn that if they are sued, it won't come out of their pockets, so they don't have to care about people's rights.

      They're trained by government. Every so many years it gets worse. And they are thought to obey orders. I wish they would wake up. They are not taught to help citizens and protect citizens rights.
      Basically the reason why we had a police force to start with is to protect people. Instead They are taught that we are all out to harm them and it is them against us. Which we don't want to harm them. But they're being told we do. Why I is that ???
      Out of 100,000 stops throughout the day how many times does a police officer get hurt? It should not be them against us, it should be all of us against government, and they're out there to protect all of us from overreach. They do not see that they are ponds at this point. Ponds are something you can sacrifice for the good of the higher-ups. . And these officers are nothing more than a human that they can sacrifice when things get rough. I hope one day they will wake up.

    The not showing the defendant the results of the PBT is enough to cast reasonable doubt. As there's reasonable doubt the officer lied under oath.
    And with her vomiting a short time before the PBT, that could have resulted in an abnormally high reading. For the same reasons a PBT just after drinking will give a false high reading.

    I bet the cop didn’t show her the breathalyzer results because he’s a liar and that proved her innocence. Wouldn’t the results be in the discovery?

      The results of the PBT are inadmissible in court in this case so that's why it wasn't entered

      No result the field result is not admissible in court so it is not recorded.

      Inadmissible as evidence, but may be used as probable cause for an arrest. No reason to take it at the roadside or do their other stupid field sobriety tests. They will find reasons to fail you, not pass you. Gotta get that MADD money.

      @@markbrown8097 Yep... can't be used as evidence to convict, however can be exculpatory as well as show no PC for arrest. If field test is 0.06+, definitely PC to take to station and try to get blood/breath for a confirmatory test. If PBT is 0.02... no F-ing PC no way.

      Because if they would’ve questioned her, they would’ve looked like assholes. She was a very sympathetic witness and Toomy. She was telling the absolute truth of what happened that night.

    wish I could hear the jury delibeate.... because I'm certain that someone in there has gotten sick after eating something disagreeable, someone has had their GPS do that to them with split highways and roads, and I'm very certain that someone has not had access to their phone when it mattered most.

    She lied about the vomit. She lied about dropping off a work colleague. Her ability to follow the road rules are in question. And she refused the breath test at the station which would've proven either way. I'm not saying she is guilty but if i was on the jury i would have concerns about her honesty.

      It's down to the threshold required for finding her guilty. Which is "beyond all reasonable doubt".
      There is clearly reasonable doubt as to whether she was DUI. Therefore the verdict must be not guilty.
      Telling lies is never a reason - on its' own - to find someone guilty beyond all reasonable doubt.
      This does mean that there are times when people get away with crimes. But that's better than having a system where too many innocent people get convicted.

    I have a question... when you were questioning your client, would you have gotten in trouble with the court had you said something like: so the officer showed you at the beginning that the device showed triple zeroes and he said so you know I'm not cheating, correct?
    She says yes.
    Then you say:
    Do you think it would it be safe to assume he was doing his best to show you he was being fair with you?
    We'll assume she would answer yes
    Then you continue
    But after the test the officer refused to show you the results, correct?
    Again she says yes.
    Then you scratch your chin for a moment like you're thinking and say
    Interesting...
    Prosecutor objects, you withdraw that last bit, but the jury hears it and that gets them to really focus on the pbt and ask themselves why wouldn't he just show her. Especially since he later says it showed the presence of alcohol
    Would you doing that bit of theatrics get you into any kind of trouble with the court?

    I have my own PBT and I have tried different tests at .08, .15, and.20 with myself and other individuals during house parties. There is NO WAY at .165 she was reciting D thru Q and counting backwards with no mistakes (even though she went past 58). Also, walk and turn without losing balance (AND walking backward (perfectly). Lastly, there was no slurred speech. This provides reasonable doubt multiple ways that she was not under the influence, and secondly the credibility of the LEO calling out .165 (twice the legal limit) in court. PBT's are inadmissible, but they are pretty damn close to the expected result from a breathalyzer. Interested to hear what the jury heard in the next episode. Based on previous videos. jury's can pick out one thing, get laser focused, and convict over the silliest of things.

    Sorry but I flat out don't believe she only had one shot. The shift ended at 1130, but she didn't leave till 230. As a server for 15yrs, I know for a fact that only reason you hang out after your shift is to have a drink.

      I don't care how many shots she had! They should not be policing citizens. That is not what we gave them a job for. They were supposed to go after bad guys. They were never supposed to pull people over, stop them, ask for their papers, and if they did not obey throw them in jail. That is not why they are there to start with.
