I think parishioners get to have privileged conversations with their priests or pastors. If one of the church members confessed to his pastor and asked for spiritual guidance they legally can’t be compelled to testify about it. It’s entirely possible I made that up from a Law and Order episode though

That being said, further context shows that he clearly believes that the killing was justified. I am not a fan of vigilantism, but something had to give, so this may have been one of the rare cases where an exception could be made.

I would like to read this book. This is a fascinating case. I guess 60 Minutes only had so much air time and were trying to show both sides to the argument to be fair. (They probably realized that most people WOULD side with the town's actions) To me, shooting (attempted murder) was the worst thing. Almost as bad, was the fact that he was a child molester. We had a bully in our small town. He was a huge guy who started lifting weights and taking steroids back when he was in high school. He was tying to go pro with football, but after that fell through he took up boxing, which is the last thing you want a guy like that getting good at. He would go to a neighboring college town and get in fights just for fun. One night he gets on top of some guy he's beating up, then stands up clutching his abdomen. He got stabbed. You can only beat up so many people before you cross paths with someone who will put you in the hospital, or worse.

Gary Weaver: The attorney was acting as he should. What failed in the justice system is not protecting witnesses sufficiently and allowing bail for the perp, not to mention the fact that the U.S. judicial system can be too slow for the circumstances. The other failure seems to be having insufficient detective work and forensics which may have garnered better evidence against the perp. This is probably due to having insufficient funds that would allow such tools.

The prosecution should prosecute crime vigorously and within the bounds of the laws and ethics of the legal system. I'd guess that, due to lack of funding, it appears that the prosecutors were hamstrung and couldn't afford the forensics and detective work their cases required, not to mention the judge allowing bail for such a threat to the community and witnesses (who should have been placed in a witness protection program, again requiring funds). THAT was probably the problem, not the defense lawyer. It was a failure of the U.S. justice system.
Something NEVER discussed is why the legal system was so inept. This Earl guy should of been off the streets years ago but for some reason he was allowed to roam their streets causing havoc for years. That’s what the documentary should be about!!!!!

There’s a RUclipsr that I follow called Lamont at Large and he goes around the country visiting various cemeteries and graves. Lamont traveled to Skidmore, Missouri to visit this guys grave. As he was going to the cemetery Lamont did tell the story of how the towns people took matters into his own hands and got rid of the guy. But I couldn’t believe that when Lamont got to this guys grave written on his headstone was he was loyal, compassionate and a gentle soul. I’m like how awkward is it to have those things written on your head stone knowing you were none of those things in life. And other people can vouch for that.
McElroy had people in that town that were loyal to him. It was said that after the Suicide of McElroy,. The residents of Skidmore spoke little to none about it, as to NOT unknowingly upset one of McElroy's Loyalists.
Interesting story from a small town friend, there was a guy who was "bad with the young girls if you know what I mean" disappeared during a bicycle ride in the Fall. Winter comes and goes, Spring runoff arrives and there's a culvert blocked down by a secondary road. Road crew finds buddy and his bicycle all tangled up in the pipe. Nobody could ever say what happened except "He ended up right where he belonged, alone and dead in a sewer."
McElroy finally was sentenced to some jail time but was released on bail pending his appeal of the sentence. That was apparently the final straw for the people who had signed the original complaint against McElroy. He shows up in town with a gun threating to finish Mr. Bowenkamp, and they know that the psycho will be becoming after them all. I think that the men meeting in the American Legion hall agreed that this was the "throw down", and acted accordingly. No law agency ever helped protect them and they knew that none would.
Read the book "In Broad Daylight" by Harry L. Maclean. It goes into more detail about Ken Rex McElroy, and the various crimes he committed over the years. He also preyed on underage girls (this detail was left out of this clip). As the years went by, and the crimes piled up, his lawyer always got him off the hook, and McElroy paid him handsomely to do so. And the justice (?) system always had some loophole that McElroy's lawyer managed to take advantage of. The citizens of Skidmore had more than enough of McElroy's bullying, stealing, assaulting w/ intent to kill, etc. and the law could not stop him. He was sitting in his brand new 1981 Silverado pickup with his wife Trena sitting next to him. When the shooting started, someone opened the passenger side door and pulled Trena out, so she wouldn't get shot. BTW, she peed herself, according to the book. When the shooting was over, the townspeople vanished from the scene. To this day, the town has protected the shooter(s) with silence.
I read the book to. This man terrorized the whole town. The only person that stood up to him was a elderly store owner and his family. McElroy purposely started confrontations with people. He not only terriozed the town, but his own family. He bruttaly beat both of his wives, and forced the parents of Trina to let them get married. He always drove the lead the truck and his wives drove the other two trucks. After the shooting no one in that town would speak.

This had gone on for years and years with McElroy and from their perspective so called justice was turning it's back on them so this was the last option for them. I just finished watching the 1991 made-for-TV movie, here on "RUclips", "In Broad Daylight", starring Brian Dennehy, Marcia Gay Harden, and Chris Cooper. It's amazing how much Dennehy looked like McElroy and he played the obnoxious, sneering fictionally named "Len Rowan" beautifully.

I would like to read this book. This is a fascinating case. I guess 60 Minutes only had so much air time and were trying to show both sides to the argument to be fair. (They probably realized that most people WOULD side with the town's actions) To me, shooting (attempted murder) was the worst thing. Almost as bad, was the fact that he was a child molester. In all, there were 46 potential witnesses to the shooting, including Trena McElroy, who was in the truck with her husband when he was shot. No one called for an ambulance. Only Trena claimed to identify a gunman; every other witness either was unable to name an assailant or claimed not to have seen who fired the fatal shots. The DA declined to press charges. We had a bully in our small town. He was a huge guy who started lifting weights and taking steroids back when he was in high school. He was tying to go pro with football, but after that fell through he took up boxing, which is the last thing you want a guy like that getting good at. He would go to a neighboring college town and get in fights just for fun. One night he gets on top of some guy he's beating up, then stands up clutching his abdomen. He got stabbed. You can only beat up so many people before you cross paths with someone who will put you in the hospital, or worse.

What failed in the justice system is not protecting witnesses sufficiently and allowing bail for the perp, not to mention the fact that the U.S. judicial system can be too slow for the circumstances. The other failure seems to be having insufficient detective work and forensics which may have garnered better evidence against the perp. This is probably due to having insufficient funds that would allow such tools.

The prosecution should prosecute crime vigorously and within the bounds of the laws and ethics of the legal system. I'd guess that, due to lack of funding, it appears that the prosecutors were hamstrung and couldn't afford the forensics and detective work their cases required, not to mention the judge allowing bail for such a threat to the community and witnesses (who should have been placed in a witness protection program, again requiring funds).
THAT was probably the problem, not the defense lawyer.

There’s a RUclipsr that I follow called Lamont at Large and he goes around the country visiting various cemeteries and graves. Lamont traveled to Skidmore, Missouri to visit this guys grave. As he was going to the cemetery Lamont did tell the story of how the towns people took matters into his own hands and got rid of the guy. But I couldn’t believe that when Lamont got to this guys grave written on his headstone was he was loyal, compassionate and a gentle soul. I’m like how awkward is it to have those things written on your head stone knowing you were none of those things in life. And other people can vouch for that.

Interesting story from a small town friend, there was a guy who was "bad with the young girls if you know what I mean" disappeared during a bicycle ride in the Fall.
Winter comes and goes, Spring runoff arrives and there's a culvert blocked down by a secondary road. Road crew finds buddy and his bicycle all tangled up in the pipe.
Nobody could ever say what happened except "He ended up right where he belonged, alone and dead in a sewer."

McElroy finally was sentenced to some jail time but was released on bail pending his appeal of the sentence. That was apparently the final straw for the people who had signed the original complaint against McElroy. He shows up in town with a gun threating to finish Mr. Bowenkamp, and they know that the psycho will be becoming after them all. I think that the men meeting in the American Legion hall agreed that this was the "throw down", and acted accordingly. No law agency ever helped protect them and they knew that none would.
Read the book "In Broad Daylight" by Harry L. Maclean. It goes into more detail about Ken Rex McElroy, and the various crimes he committed over the years. He also preyed on underage girls (this detail was left out of this clip). As the years went by, and the crimes piled up, his lawyer always got him off the hook, and McElroy paid him handsomely to do so. And the justice (?) system always had some loophole that McElroy's lawyer managed to take advantage of. The citizens of Skidmore had more than enough of McElroy's bullying, stealing, assaulting w/ intent to kill, etc. and the law could not stop him. He was sitting in his brand new 1981 Silverado pickup with his wife Trena sitting next to him. When the shooting started, someone opened the passenger side door and pulled Trena out, so she wouldn't get shot. BTW, she peed herself, according to the book. When the shooting was over, the townspeople vanished from the scene. To this day, the town has protected the shooter(s) with silence.
I read the book to. This man terrorized the whole town. The only person that stood up to him was a elderly store owner and his family. McElroy purposely started confrontations with people. He not only terriozed the town, but his own family. He bruttaly beat both of his wives, and forced the parents of Trina to let them get married. He always drove the lead the truck and his wives drove the other two trucks. After the shooting no one in that town would speak.

Try looking for it your local library, and if they don't have it, look through a used bookstore, or look for it online. @xirsamoht x To a certain point you are right however, if the townspeople had not acted when the did (remember he bonded out) McElroy would have killed each of them. This had gone on for years and years with McElroy and from their perspective so called justice was turning it's back on them so this was the last option for them. The reason no one person claimed responsibility if I remember correctly, was from their point of view they all did it. They could not afford to wait and see if he would finally be put behind bars.
This is why good people have GUNS
I just finished watching the 1991 made-for-TV movie, here on "RUclips", "In Broad Daylight", starring Brian Dennehy, Marcia Gay Harden, and Chris Cooper. It's amazing how much Dennehy looked like McElroy and he played the obnoxious, sneering fictionally named "Len Rowan" beautifully.
Everyone knows that the shooter did the town a huge favor, so authorities may as well stop trying to figure out who pulled the trigger. The witnesses will never tell.
