This 143-year-old law embodies an American tradition that sees military interference in civilian affairs as a threat to both democracy and personal liberty. However, recent events have revealed dangerous gaps in the law’s coverage that Congress must address."
      "The Posse Comitatus Act is a United States federal law (18 U.S.C. § 1385, original at 20 Stat. 152) signed on June 18, 1878, by President Rutherford B. Hayes which limits the powers of the federal government in the use of federal military personnel to enforce domestic policies within the United States. Congress passed the Act as an amendment to an army appropriation bill following the end of Reconstruction and updated it in 1956, 1981 and 2021.
      The Act originally applied only to the United States Army, but a subsequent amendment in 1956 expanded its scope to the United States Air Force. In 2021, the National Defense Authorization Act for Fiscal Year 2022 further expanded the scope of the Act to cover the United States Navy, Marine Corps, and Space Force. The Act does not prevent the Army National Guard or the Air National Guard under state authority from acting in a law enforcement capacity within its home state or in an adjacent state if invited by that state's governor.       All threats, foreign and domestic; a condition in the Oath, cops, military, officials, etc.
      But there are jurisdictions within reason. But cops act military when they themselves are civilians.

      Unfortunately, there is a fallacious correlation between LE, and military service. Ask any ex-military and they will tell you, military do not make good cops, and cops do not make good military. Military experience is desired in potential LE candidates, if you have military experience your chances of being hired are greater than those without it. Military experience does not translate well into the private sector. When you are military, your dominion over all things military is boundless, you can use your authority in any and all situations as long as the situation falls under military jurisdiction. When LE with military experience move into the private sector, they think that their influence is boundless, which it is not. Military and civilian are completely different environments, and it's this bad marriage that has been become a pivotal reason why LE believes that their influence has no bounds. This experiment has been running for fifty years, and to say that it is a failure is an understatement of monumental proportions.

    There seems to be an epidemic of sorts in many police departments and it involves a lack of proper training. Cops are put on the street not knowing many laws and are expected to uphold the law. They are put on the streets to protect the Constitution not knowing many, if any, of the amendments. Because of their ignorance, they somehow have determined that they can make up laws as they go along so that when they meet citizens who actually stand up for their rights, they can attempt to baffle them with their stupidity.

    COP: "You are trespassing." Auditor: "You, as a cop, cannot trespass me. It has to be the owner." COP: "Well, I will get the owner." Auditor: "So you are gonna solicit a trespass? Do you know that soliciting a trespass is an illegal act, cop?"
    At the very least, if a police officer solicits a property owner to trespass someone from their property, most FAIR judges would consider it to be an abuse of authority.
    Whether or not such an action would constitute a felony depends on the specific laws of the jurisdiction and the severity of the actions involved.

    I'm on board with all this auditing, my only issue is the initial communication. A lot of times these public officials do try to handle it politely and I'm sure it appears to be odd to them.
    I know it's not good for RUclips numbers, but if we really just want to show them as the people, that we can film in public, be in public and how they should accept it and do their job, among all the other stuff we see going on...bare minimum when a public employee does approach politely and says they just want to understand, just communicate something like your purpose is to exercise your rights
    I know you don't have to. But here's the thing, from their perspective it's new and unusual. Not illegal, but someone in a mask filming is going to cause alarm. As it should, as a govt worker I expect them to investigate if someone in a mask is filming around our property. Dispel their suspicion and send them on their way.
    Why not take the ground and start getting them used to it? If we only keep saying "there's no law" then they will make a law. Then we lose ground having to fight unjust laws. Don't tell me they won't try, they make laws trampling the constitution all the time. Look at airports now compared to 25 yrs ago. Look at the the DMV, irs etc...they will make or change laws if they can make a case for it to themselves.
    Just specifically the polite employees who initially approach very polite. They don't know what you are doing, and I expect them to find out. If it's just a citizen exercising rights then great leave them alone. But they don't know till you tell them

      @@LyonsM yes, we all know the basics. I'm trying to have a deeper conversation about the long term effects.
      It's definitely a good thing, but it's wise to consider potential negatives or how things can go wrong, and prevent them, or recognize a way to do things better.
      The reason this is even a thing is because 95%+ of ppl don't understand our rights and how the law protects them. If these videos don't educate and win the hearts of people, then it's just a spectacle for you tube views. Maybe some counties change some things but the ppl will be bitter about it and create more division among the community. And if they see someone in public with a camera they think "oh it's one of them, here we go" instead of realizing it's a benefit to them too.
      And again, I'm not talking about police, I'm saying to the ppl working in these places or the security or whatever, and when they approach politely and try to figure out if they should be worried or not. If they have an attitude right off saying "you can't film here" then fuk em. I'm specifically talking about ppl who are being polite and have to ask and figure out if they should be worried.

      Not all jurisdictions assign the number on the badge to the officer wearing it. It is necessary to know if they do or not so you can ask for the proper identification number.

      True. And yet they often play games and act as if they do not. So what makes you believe that a cop, when asked for their name and badge number will happily give you there badge number when that badge number is not their proper employee identification number.
      But you are wrong about one thing. A LAW ENFORCEMENT officer would have no problem. A cop on the other hand would and is a cop because they are eager to play games.

      Your lack of reading comprehension does not mean that nothing was said, just that you do not comprehend what was said. That is why so few first amendment auditors even try to explain why what they are doing is perfectly legal and that the upset snowflakes feelings and egos do not trump the law.

      Unfortunately here, if a cop asks us for id, we have to give them name and birthdate.
      Here in WA that is. Most states are the same tho.
      We also don't have freedom of speech, as we can be arrested for swearing in public.
      I few people have tried doing audits here, but you need to be aware they can id you and will probably find a reason to charge you with disorderly conduct.
      We are a freaking big police run prison colony!!!

    When are we going to stop accepting “suspicious “ as a legitimate call for service? The dispatchers need to be trained to discern the difference between a crime and not a crime. No crime, no response.

The State National Guard is deployed when an event reaches a certain threshold danger. The Federal Government enacted the aforementioned laws then break them at their whim. We have lived in a Banana Republic since 11/22/63.

      -i.a.m. free inland auditing media (relative new/small vell versed in law does follow ups killes with kindness and sometimes has really good cops, very refreshing)
      -press nh now (sometimes a little annoying but very persistant and a lot of gems like dressing down da´s in court and election workers)

    To the officer standing at the gate: Please don't stand at the gate, we have cars coming in and out all the time. We don't want people having to clean up a big pile of bacon on the ground.

    People, they try to get your ID not just to run your name for warrants. For several years they add a note to their system and ADD your name as “hostile” or Uncooperative”. Doesn’t even matter if you are or not. We are not expecting to ever see it, so it the secret police keeping secret records on us. We should rename cops to KGB, because every day they behave like this more and more. So, be aware, when they get your name they are going to add you to their system with a label such as hostile. And then its all downhill from there. You think for a second you have an even chance with the blue line gang when the hang the “hostile” label on you?

    It never ceases to puzzle and amaze me that so many police officers are afraid of a camera and will attempt all sorts of illegal tactics in order to prevent you from conducting legal activities. What are they afraid of? Is the camera going to capture some restricted information or is it just going to put their nefarious actions up for scrutiny? I would assume it is the latter that they fear. If they are conducting themselves professionally and upholding their oaths then they should have nothing to fear.

      Government bureaucrats, school administrations, businesses, etcetera, are why the cops are confident that they will not get into any trouble when they take a man whose hands are cuffed behind his back, is laying on the ground, is a threat to no one, and then press their knee into the back of the man's neck or shoulder, even for minutes after he stops breathing, just for shits and giggles. All while three other cops stand around and do nothing about the abuse happening right in front of them.

    We definitely are in need of a revamped system of policing. Qualified Immunity should be abolished and officers should be made to acquire their own liability insurance so that when incidences of misconduct by police arise it is not the taxpayer that foots the bill for their errors in judgment. And I am being generous when I use the term errors of judgment. It is frequently a case of abuse of power by those charged with upholding the law and the Constitution. There have been too many occurrences of bullying from those wearing a badge and carrying a gun. There needs to be put in place an improved system of screening and vetting officer candidates for psychological issues that would prevent them from properly carrying out their duties as law enforcement. As it stands right now, the system isn't working. You just have to look at the statistics.
