    Thank you for the information presented here. I recently started seeing letters from lawyers in my mail, opened one & realized I'm being sued by portfolio, the letter states 9/15, I went to the courthouse to see if this was true, the clerk printed out the lawsuit papers against me. I was stunned. I haven't been served any papers. I'm researching how to handle this. I've had so much stress this year, dog death, my mom passed in May, no job, I'm depressed enough, didn't need any additional squeeze on me. 🥺😢

    So much knowledge here, I have been sued in GA where i live on a 2nd mortgage loan by a loan servicer from Colorado with a lawfirm that they are working with in Florida ,i am trying to settle with them but they are difficult ( is a bit over $20k)

    Listen to Alabama Consumer Protection Lawyer. He has decades of experience suing the debt collectors. You’d be surprised at the violations and damages you can get.

      You have a right to dispute anything on your credit report that’s inaccurate.

    Personally, I am preferable to US District Court, as most consumer law falls within the ambit of federal statute and code. Almost no court appearances. all communications between plaintiff's and defendants can be done via email and telephone and US mail. The beauty of Federal court is that you are timely notified of every doc filed in the case by US mail and its easy to set up a pacer account to keep track of your case online, because you can check the docket report and there are no surprises.

      Federal courts are also much more favorable for defendants.

    Do consumers in Florida have to pay filing fees when responding to a debt collector lawsuit in form of a hearing or filing an answer?
    If so, is it a state wide requirement?

    Can a debt buyer change a acct they bought to open acct on my credit report. It was closed and now it showing opened. Then i have a letter showing 2 different amounts one from them and from there lawyer. Waiting on court hearing.

      If you have a court hearing, it's a mistake to focus on your credit report.
      Deal with the court hearing by getting a lawyer, then you can attack the credit reporting.
      Priorities matter.

    So say I have a Hospital bill from Florida back in 2018, I currently live in Illinois; however; the collection agency is from Texas. Who's statute of limitations do I follow? Florida is 5yrs, Illinois is 7yrs

      If they tried to sue you in Florida, the shorter would apply.
      I can't say whether Illinois would apply the longer or shorter limit because that's a question of Illinois law.

    It is happening!
    Working on fixing my credit and trying to resolve one thing at a time within the last 2 weeks and suddenly I have received strange phone messages threatening legal document service and robotic voice messages, etc. 😡
    Trying to get things done rightly and they come out of the wood work I guess

      Those are probably scam calls, and probably just a coincidence. If they're not sending you mail, they're probably just garden-variety crooks.

    Can u help post judgement? I am very confused by the fact that the attorney requested interrogatories and again this is post judgment. I filled out the interrogatories and returned them prior to the deadline, I was able to see that there was a hearing schedule and then come to find out that the judge just went ahead and appointed a receiver without even giving me a chance to present my circumstances, etc.

    What can I do if I completed the interrogatories on time and submitted them to the attorney but then found out my hearing had been canceled and then my bank account frozen. Am I not entitled to a hearing?

      It varies state by state.

    What if I’m being sued in El Paso, TX but I live in Charlotte, NC? I only know of this is because it was mailed to my moms house.

      Getting sued in the wrong state is a violation, but if they don’t know where you are now, it may not make tactical sense to clued them in.
      Yes, however, the amount of the debt is small, then pursuing a claim under the FDCPA. It was probably going to be enough to wipe it out.
      You’ll need to find a lawyer in North Carolina and in Texas to let you know what you should do next in each of those states.

    You should really consult with John Watts the Alabama Consumer Protection lawyer. He has great you tube videos. He talks like you can get so much more by their violations with punitive etc. more like up to 6 figures 😊😊😊

    Who would you recommend I call for Mississippi I need help. LVLN lawyer sent a letter to me about a credit card debt that was opened in 2015 and I didn’t see that report on my credit report at all. It looks like to me that they may have re-aged the account after it was closed in 2017.

    Got served in Florida on Oct.8 2021. My court date is on Dec 14, 2021. But in Florida you have 20 days to answer. Will i lose my case if i dont have answer in 20 days?

      Generally speaking ,the four years starts from the date of non-payment (at least in Florida) but every state has different laws. Check with a lawyer in your state to be sure.

    Can debt collectors put a lean on my property? They acquired my HOA debt and added insane fees. My original debt was $200 and now wasn’t $900.

      In Florida, HOA's have enormous power-and can lien property easily.
      Some lawyers specialize in fighting them, but it can be expensive. Usually it just digs the hole deeper.

    I just got served from Midland. I’ve been reading they don’t usually buy documentation, just names and amounts, but what if the citation includes a couple of credit card statements? I’m in South Texas.

      In Florida, they don't need contracts or more than one statement to prove an "account statement" claim.
      This is something that a LOT of people get wrong, and it's why junk debt buyers never sue for breach of contract.
      But even "account stated" claims have defenses. If you know what these are AND know how to raise them, you can beat these debt collectors like Neil Peart attacked a drum kit.

    I got a personal loan through FREEDOM FINANCIAL which 2 months later changed name to Achieve personal loan.
    However, the personal loan was originated by Cross River Bank.
    I got a letter from Axion Acquisition Ventures on July 3,2023.
    I responded by phone and requested more info. The rep kept offering deals from the beginning. Nothing was done i had to go .
    2 days later call back ,I asked for the same rep, however, the second rep wanted my personal info including SSN.
    I ended up talking with the first rep i spoke before and requested a Validation letter .The rep kept telling me that it was going to take 15 days or 20 days. Then He said they might not be the owner of the account by then . He wanted me to take advantage of the deals.
    Also the account/debt was sold prior to another collection company i never heard of .It seems to me they may sell this account again . The question is why. What are the chances to be sued by whoever collection company ends up buyind this account,
    Also The letter shows the name Freedom Financial but mi credit report show Achieve personal loans. The balances are different as well.
