    I was a debt collector for years before retiring. Three magic words make calls stop but you must say them verbatim: cease and desist.

    It may sound strange, but I saw you (Hoyt) in a dream. Next day I searched Internet and You tube and found your channel. OMG, so much useful info.     The best advice about debt collectors calling you on your phone? Don't answer your phone unless you recognize the caller. Let your voice mail fill up and leave it that way. Don't answer any mail unless it's registered mail. It works. You are retired and you don't need to be bothered. As an old person, you don't need good credit anymore.

    Vicki Quade…I had them calling me over and over. I blocked each call only to get a call from another #. I called HELPS. They sent out Cease and Desist letters. After that, I got 2 calls from a debt collector. I notified HELPS and they sent a letter…nothing since.

      I am a retired handicapped and homebound 78 yr old senior living on a fixed SS income.. if I could pay my debt, I would as I did ALL my life before now. Life and health issues have put me into the position I'm in today. As of 01/01/2023, I shredded any credit cards I had used for medical and food; I have no more wants, only spend for actual needs. Anything I buy is a need. Two years ago, my fico score was over 750. Life can change in an instant... and it did for me. I used credit cards for food and medical, not luxuries. I found out about HElLPS just two days ago. I will be calling them on Monday . I wanted to file bankruptcy but due to my age and fixed income, a local attorney said not necessary. Creditors cannot garnish SS money and that's my only income and it's used for rent, utilities, food and medical. My nerves are shot over this debt; cannot wait to talk with HELPS!

    For iPhones:
    >Settings
    >Phone
    >Silence Unknown Callers: ON
    This will silence all calls from numbers not in your contact list. You’ll still see the number calling on your banner notification (tagged as silenced) and it will log in your missed call list, so you have the option to answer legitimate calls.

      Trouble with that is…. Computers call numbers looking for the ones that go to voice mail (or get answered). Then a note is made that this is a legit number…it is then sold on the web to scammers. I always pick up the phone and hang up right away. No voice mail, no answer. You can then go an block it if you want..but..do not let it get to voice mail.

      I use the STI tone generator on unknown numbers. This is supposed to mark the number as "not in service" to the equipment dialing numbers.

    This is SO INFORMATIVE! I am 100% debt free at the time and hope to always be debt free but it is still very important to have this information. I really appreciate that they are making these videos for seniors. I remember when I was little debt collectors came to our house and my mom always sent me to the door. I remember they came and repossessed practically everything we owned. We were watching T.V. and they came in and unplugged it and took the T.V. away right in the middle of our cartoon.

    Never ever communicate with debt collectors,just by doing that you can extend the time the debt times out ,Stop letting collectors use your phone against you,IT IS OK to ignore your phone,YOU DO NOT HAVE TO ANSWER YOUR PHONE,AND DO NOT ANSWER ANY EMAIL THEY SEND YOU AS THERE IS A WAY THEY KNOW IF YOU OPENED THE EMAIL.

    Excellent job by the attorney and the interviewer. Wish I’d known about this law group long ago. Would loved to have worked with them. Have had a few senior collection cases over the years and while resolved satisfactorily, I now realize I could probably have done better.

      Refuse to deal with the collector. They hired out a collector for my back taxes and I REVOLTED because I knew my rights. I called the IRS and demanded they deal with me direct. They did not hesitated. I knew I owed it, but was severely poor. A tax payer funded person took in my 200 faxes pages only to find out that I couldn’t truly afford anything. They confiscated my income tax returns and it was paid off quickly.
      NEVER DEAL with collectors.

    Get smart and get real. ... Debt notification letters are never sent certified with signature required. Debt collectors cannot prove you received the LETTER unless you acknowledge receipt.

    In canada if one has debts while on pension they can not take your money from your pension

      situations where
      income is protected
      from garnishment.
      Google -Income that
      is protected from
      garnishment.

    Can you keep blocking their number till they run out of phone numbers to use? Or do they have tons of numbers they can use to call you?

      They have a computer program that will "spoof" different numbers, so you can block,, they will just generate another number.

      There is something called "spoofing a number". If they are using a VOIP service you can program any number into the outgoing telephone number ID. This is a common practice used my Microsoft scammers from India. They can program area codes and phone number from any country any time. Any number you don’t know don’t answer or answer as a department of the Government or CIA, YOU CAN PLAY PSYC OPS with scammers or debt collectors.

    i get a number of computer calls. i never answer. and no message is left. but the numbers are spoofed. from all over the country. even from nat parks.
    unknown senders of all emails and texts i just delete.

      Just get a phone that screens calls and people have to say their name and press a number etc to get through to you.

      Get a device that answers the phone and plays the STI tone, if it’s an auto dial system they use the equipment should mark that call as a disconnected number. I have used a device that plays the tones and then followed by the typical female voice stating "the number you have called is no longer in service". These were available in the mid nineties but I don’t know if that are still available today.

    An important point about attorney fees: Lawyers who do this do not take a cut of the consumer's recovery. These are fee-shifting cases. The defendant must pay the attorney fees on top of whatever damages are recovered on behalf of the consumer. This is very different from typical car accident cases where an attorney gets 1/3 of your recovery. However it is similar in that most attorneys will agree to represent the consumer without taking any payment up front.

    I never answer any phone call if the number isn't in my contact list, and I never open texts unless from someone in my contacts. So, I can't possibly respond. With all the scares about hacking phones and emails, I will never open texts or emails, and will never answer calls if it is not for sure from a friend that I know.
    Also, I am so far below the poverty level with my social security so am I somewhat safe?
    And, anything that I may or may not owe is over 5/6 years old. Does that make me any safer?

    I have one small account that I intend not to pay because of very poor service and violation of pt rights..WE have gone through debt problems ocasionaly through the years,because of the ups and downs in our nation's economy.We know how the debt collectors play,it is a psychological attack,and most these creditors do not have ethics.they also pay pennies for the debts.

    When companies do a write off of a debt, if that amount exceeds $600..
    They can send a tax form to make you pay taxes on the written off amount.

    what about the medicare calling us 20 times a day on landline and cell phone? I have to pay 30 a month on my landline so i can get internet. so I unplugged house phone so I don/t get driven mad by both. Still get a dozen a day on cell phone. Year round bow. It's harassment!!!!

    Can you sue a phone company when they try to make you pay for the phone number of a previous person debt, when they issued that number to you. They claim a cycle you are in but never had that number in that cycle. What about how they turned it over to a debt collector, and that's before you bought the phone and got that number. If so how much can you sue them for in annoyance and anguish for sending it to a debt collector?

      Change your number. Sometimes when you get a new number, so many places have that old number and still attempt to contact the previous person. It has happened to me also. I just block and then go to several websites and whitewash my information out of the system.

      When my Mom and Dad moved to Tennessee, they got a “new-to-us” phone number. It is the same number my family has used since 1980, and that I currently have, so our families can contact us without having to remember a new number, even though my parents are no longer living, they know how to get in touch with me. I WILL NOT BE CHANGING MY NUMBER FOR YEARS TO COME FOR THIS REASON .

    I can’t afford to pay a debt because the interest is high, so do I stop paying them or do I ask them to take off the interest and I could just try to keep paying the debt ? if they won’t take off the high interest can I just stop paying them and I don’t if they put a lien against my house???     I have a creditor texting me, emailing me, and leaving phone messages. with no option to opt out. I filed a CFPB and the creditor answered back that they have not violated any laws. I responded with a copy of Regulation F. til today, they are still contacting me with no option to opt out

    Why is bankruptcy not mentioned? Also demand a copy of the loan or other papers, they never have them. You can tell them to stop calling and send letters. Don't let them bully you or make life miserable for you.

    A couple of things you DIDN'T address: These "collection agencies/debt buyers" purchase bad debt in bulk for PENNIES ON THE DOLLAR. So if you owe $500.00 they paid around FIVE DOLLARS for that debt and ANYTHING they make over that is pure profit. If they DO take you to court and win a judgement, THEY ARE REALLY MAKING BANK even after paying their lawyers. A LOT of these companies are multi billion dollar enterprises. Second: They now have a way to "spoof" phone numbers so a number shows up on our caller ID as from your area code, most times they are in a different state miles away. Third: They CAN AND DO contact neighbors and ask them to go to your house and have them call so and so. With all the information out there that MOST PEOPLE FREELY GIVE, all it takes is a couple clicks on a keyboard and they can zoom in on your neighborhood and start calling your neighbors, I have had them pull that on me, saying they are trying to get a hold of Mary Smith who lives next door to you, could you please go over and ask them to call ABC company. I tell them sure and promptly "forget" to talk to them. A LOT of people are in a financial mess but I don't feel sorry for those who spent their stimulus money on new big screen TV's and gaming consoles that end up in pawn shops a month later when they run out of money again, AND those who got the "rent pause" and didn't even bank ANY money so when the program ended they could pay their back rent, but, on, no, they spent THAT money and when the Sheriff came a knocking they act all indignant. Just because you got a "pause" on your rent or mortgage, DOESN'T MEAN you don't have to pay it EVER. I used MY stimulus money to purchase routing maintenance items for my car, stocked up on food, water etc and put 3 months rent away. I receive Social Security and that is my ONLY income, so as long as our politicians stop playing games and our checks keep rolling in, I am OK.

      I am SS$. What I saw in Orlando Winter Park area with the $1400 was not people buying big screen TVs and consoles and bullshit. I saw people with their masks on buying food. Yes. Radical concept. Buying clothing at Thrift Shop’s for the kids in themselves. Not big screen TVs. My $1400 was one tire at Costco, an air fryer for $39 at Costco. That was my treat. And I had real estate taxes coming up that had to be paid. Yes, I got my Social Security but it was a boost that helped us. Let’s stop making a Sumption’s that just because you give people that don’t have a lot of money a little bit more money if they’re going to go out there and have wine caviar and a big screen TV. Stupid. Rude. Disrespectful to a fellow human being and you are not walking in their shoes at all for one tiny second

    Question based on real instance but not myself, yet. If some is having a life threatening medical emergence like a stroke, and hospital administration employees ask you to sign a document saying the patient agree to have their bills covered by a credit lending agency if you dont make payment within 30 days, and that person being under extreme duress agrees and signs, is that a legal contract ? What is or is not considered legally binding when your under duress in an ER situation ?

      Signing any affidavit under duress can place that organization in legal limbo. Understand that hospitals and clinics are run by lawyers and not doctors in todays society. They might have you by the kojones if you sign anything. Tell them to send it to your lawyer for review but inform them that if that patient came in via the ER the hospital is required to preform life saving measures. They can worry about the money later. Most hospitals can write off a lot of the debt incurred by the ER department.

    We are getting sued by Wast Lake financial l working part time for Goodwill wife is disabled and on SSI and Food stamps that's all the money we have we are both stressing we dont know how to fight this here in Klamath Falls Oregon this is like A SOS on what to dov..

    Debt collectors can fkoff. The debt is not to them. The debt is to someone else. Being vultures, they hope to make money by buying the debt and harassing you for it. If they are dumb enough to do that, that's their fault. You owe them nothing. Also, if you don't have the money, they cannot sweat blood from a stone. I had a debt to a doctor who spent a whole 5 minutes on me without touching my broken ankle. He let his staff handle me and HE worked for the hospital, who also got paid by the insurance. I refused to pay him above what the insurance paid. The collectors came after me, and when I told them what I've told you, They finally left me alone. I don't give a fk about my credit rating. I don't use credit for anything. I don't live beyond my means like most people do. I refuse to live in fear from any authority and this is how all people should live and be, and don't.

    Divorced during 2020 in the midst of ' Pandemic', got sick, lost insurance and a mess developed financially. Needed to Semi retire at 62. Sued by multiple debt collectors and now have been garnishing my wages for over a year. Are they allowed to take 25% of my paycheck when I am barely making ends meet? My income used to be above average as a nurse. However, now I am at poverty level considering some dramatic life changes. HELP!!!!!!😱😱

    This is seriously basic information, fyi just because you say stop, doesn’t make the debt go away , prevent it from credit or being sued!
    Why not teach Americans how to spend responsible and pay their bill rather than how to avoid a call? SMH.

      There’s nothing special about you. Corruption, shadiness and abuse are not legal even for people who have made bad financial decisions in the past. Much debt is HEALTHCARE with their bloated charges and their own corruption. Be careful what you say, karma will bite you. If I were you, I’d count my lucky stars and keep quiet. How’s that inflation doing for ya? Think your pride will wipe out the rising inflation?
