    Happening in Court
Cross Exam/Redirect - Det. Martin Howard - Kenosha PD
Direct Exam of Richard McGinnis - Eyewitness/Reporter On Scene
Direct Exam of Ryan Balch - With Defendant Prior to the shooting
    Charges:
    1. First Degree Reckless Homicide, Use of a Deadly Weapon (Joseph Rosenbaum)
    2. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (Richard
McGinnis, reporter for Daily Caller, not injured but near Rosenbaum when Rittenhoue
    fired)
    3. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (unknown male)
    4. First Degree Intentional Homicide, Use of a Deadly Weapon (Anthony Huber)
    5. Attempt First Degree Intentional Homicide, Use of a Deadly Weapon (Gaige
    Grosskreutz)
    6. Possession of a Dangerous Weapon by a Person under the Age of 18
    7. Fail to Comply with Order of Local Government - Emergency Management Activity
(citation, carries no penalty) - everyone present was breaking the 7pm curfew issued by
    the sheriff.
JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

I was, however, expecting that the prosecution wouldn't be so obvious with their method of questioning that I felt like they were playing darts with their eyes closed. It just seems like they are stabbing all over the place in the dark, hoping for a lucky "wrong" answer. Perfect example was cross against Rittenhouse; "So you wanted to kill him?" "Don't you think they were scared for their lives also?" "You like to kill people in video games, right?" Such a bunch of obvious, deliberately obtuse and leading questions that i felt they were insulting every single person they examined.

    • @elyastoohey6621
      @elyastoohey6621 2 года назад +16

The problem is Binger knows he has no case.
You see, self defence has to technically be proven by the defence. And Binger has to rebutt that premise.
The problem for Binger is. It is clearly self defence.
Binger knows there is no denying the facts.
What his strategy is, is more emotional manipulation. To make Kyle out to be someone who wanted to kill.
Ironically he is seeking to cast doubt.
Frankly this case should never have been brought to a courtroom, let alone have a jury sit and hear it..Prosecution should have thrown it out last year.
And the funniest part is that Binger comes off as completely untrustworthy.
Especially when contrasted immediatly afterwards against Kyle’s lawyers..
Binger uses single frames of a video to paint the picture.
The defence then shows the video in full in context..
Binger, “I’m this frame it looks like you’re pointing your gun at Mr Grosskreutz’s legs”
Kyle, “yes, but if you watch the whole video I think I’m lowering the gun to the ground during this”
Video gets played again, clearly lowering the gun, before Gaige charges back in.
      It’s prosecuting in bad faith.
There’s trying to win a case. And then there’s just blatant manipulation and cherry picking..
And those his aweful blurry photos, that already went under the digital interlope process still showed nothing.
You can’t show a jury say CCTV footage, and because it’s blurry use a computer program to show what the computer program thinks the guys face looks like..that’s not an original photo.
And his enhanced photos still showed nothing.
Absolutely zero case. The trial has been more of a farce, and the defense lawyered know it.

Because his statements which were given today and 3 days after the events are pretty damning that Rosenbaum was intent on attacking the people there to protect property. @@peanutbutterbruv It's legal cause it doesn't seem to present any issue. In the US we have a federalist framework, powers not explicitly delegated to the government are given to the state, and from the state to the people. So any actions that laws don't explicitly say are illegal are not illegal actions to take. When we look at laws to make in the US we consider their effect and impact before removing that right from the entire population, rifles make up for one of the lowest causes of death in the US, even as a murder weapon they make up less than 4%, this includes the AR-15, even though it is one of many rifles.
There are millions of them present and one of the most popular rifles in America is the AR-15. It's used for sport, hunting, protection, and fun.
Now that you have context you should put yourself into the context of an American rather than a foreigner's perspective. Do you think Huber was so ignorant to American gun laws and ownership that attacking a fleeing alleged murderer would be justified? I don't know of a single self defense precedent in US law where you could argue you were defending yourself or another from a fleeing alleged felon. If there is no imminent threat he was going to attack you or anyone else then you have no right to pursue him, especially while he is fleeing toward police. This is the true vigilante action. It was not Kyle taking law into his own hands, but actors such as Huber, when they weren't rightfully in the position to do so. It's not justified by law, and it's not justified ethically, misdiagnosing someone as a mass killer who is fleeing after shooting a single person is a major mistake.

Pretty much what the defense is trying to say. Prosecutors are trying to say that he shouldn’t have been there with a weapon in the first place. Legal age to have a gun is 18, he was 17. He isn’t from Kenosha. If he was acting as a medic, as he says, why did he have a weapon? Other medics were present, some with and some without weapons, but none with that type of weapon system. Most likely why the main charge is for negligent homicide. In all likelihood, he probably didn’t mean to kill two people and maim a third, but he was also an untrained adolescent that could easily get into a situation that he couldn’t handle. The abundance of detail is in the event the prosecution wins and the defense decides appeal - the more info, the less likely someone can say the jury wasn’t well informed about the situation.

This witness confirmed how gullible and immature Killer Kyle is which contributed to the poor choices he made that night. No accident that Kyle was the youngest one (of their group) but the only one who killed people that night. His actions must have consequences or they will continue.
