  • Detroit police officers that interrogated and later arrested a woman for credit card fraud may have violated her constitutional rights during her interrogation, according to two independent legal experts.

    A lawsuit is her only option. She's lost her job and her home because cops were lazy and violated her rights. DA was hugely incompetent to even bring the case to trial. This is likely common practice in Detroit. It's got to stop.

      She should offer to settle only on the condition that every one of those despicable cops is terminated. If I were on the jury and the city refused to settle on those terms, there's no limit to the amount of money I would happily award her.

I have done that plenty of times outside of my job and especially within my job so it’s ludicrous for these detectives to not pursue the truth but just randomly frame someone …… if it can happen to her it can happen to us. Those cops need to be fired cuz they are not only incompetent but they have done wrong and destroyed an innocent woman’s life

      The tactic that you see being used against her is how they do every single interrogation. Once you are in that room, they do not care if you are innocent or not they just want you to either admit to something you didn't do or they want you to sign an apology letter that they have already written for you

      They never ever let you get a lawyer. Once you're in that room and they already owe your rights, they basically just drill you and drill you until you either admit to a crime that you didn't commit or they just get you all upset have you answer a bunch of questions to try to build a case and then arrest you

    That the DA would even TRY to argue that she was not entitled to an attorney because she hadn't been arrested yet is just unbelievably stupid.
    They had her sign her Miranda rights! There is literally a piece of paper with her signature and that of the detective saying, "YOU HAVE THE RIGHT TO SPEAK TO AN ATTORNEY"!
    This isn't mere incompetence. It's outright corruption. Deliberate knowing subversion of the law.

      @@crazyknarf No, that's wrong. That court ruling has nothing to do with the case in the video and doesn't really change much of anything. Basically, it EXPLICITLY says that police cannot be sued for failing to inform people of their Miranda rights... which isn't really a change because under the doctrine of qualified immunity police can't be sued for ANYTHING they do as part of their duties unless the courts have specifically said that they CAN be sued for that specific thing previously. So until now they couldn't be sued for failing to mirandize because the courts hadn't said that they could, and now they can't be sued because the courts have said that they can't. No real change.
      It also doesn't change the fact that if they DON'T inform you of your Miranda rights then any testimony / evidence they gather as a result cannot be used in court. So yeah, they still "need to read your Miranda rights" just as much as they did before.

    That is so funny!!! So the cops are saying she was not in "custody" until they handcuffed??? I guess they forgot that they had her read her rights and initial. Which states ( You have the right to speak to an attorney, and to have an attorney present during any questioning).

      You do not have to be in handcuffs to be considered to be in custody. If any reasonable person believes they are not allowed to leave, than they are in custody.
      Brought her into a room and had her signing papers, she was absolutely detained

      In this case both the reading of Miranda warnings and whether she was in custody or not is irrelevant.
      Miranda Warnings have nothing to do with a civil rights violation. You can't sue based on Miranda warnings. Being in custody or not only dictates if Miranda is required for statements to be used against them. These are evidence suppression questions not rights violation questions.
      For a rights violation the only question is: Did the person affirmly evoke their rights and did the questioning continue.

      They also brought multiple officers into the room once the interrogation got a little emotional, which is a show of force, which is another way of letting the person know that they are not in control of this situation and they are not allowed to leave.
      It is all implied.

    I can't even tell you the number of times I've found something and immediately returned it to a customer service desk. Someone once left their purse in a cart outside of a grocery store. I pushed the entire cart into the store, up to the customer service counter, never touching the purse, a bit nervous the whole time. When I made it there, I immediately let them know and walked away.
    Most recently at the same grocery store-- years apart-- as I was walking up to a self-service register, the man ahead of me requested cashback but forgot to grab it. As soon as I saw it, I started yelling, "Sir, sir!" He didn't hear me but I told the attendant and asked him to stop him. He did and also came over to grab the money. The guy whose money it was looked at me crazy, as if I had done something wrong and thanked the attendant. The attendant came over and thanked me while acknowledging that most probably would have taken it. Well, I'm not "most people"-- I have morals, a conscience, and am blessed. I don't know what was going through that guy's head but it definitely wasn't gratitude. Glad my hands were too full to touch that money. After watching this video, even for something as cut and dry, I won't be touching anybody anything.

      Well you did the right thing, you gave it to someone at the store. The wrong thing is what she did when she gave the card to someone without making sure it was actually their card. She only asked if they left a card inside, she never asked for the name on the card or ask for additional ID. She thought that she was doing the right thing, but she actually aided the theft to some extent. But is her poor judgment, or negligence equal a crime?

    Disgusting, they made this woman lose her job and put her under emotional and financial stress. Now they trying to not admit their wrong and rectify the situation. For anyone else. Better to just give the lost credit card or wallet to the clerk. They can hold it until the owner remembers. Its their business and customer. I lost my passport and wallet at a pizza joint and after two or three weeks ordered another pizza and the joint kept my item but gave it to me when they saw me again.

      @@giaelie3283they didn’t trick her, she was the one that claimed that she gave the card to the clerk which the video shows she didn’t. And what would a guilty person say, would they admit they took the card? She was the last person seen with the card, there was no video that showed who she gave the card to. The person that left the card was the one that went to the police (most likely) and she would have told the police that she wasn’t the one Wilson gave the card to in the van. So it goes back to why did Wilson give the card to someone else? Was she in on it, or was she just careless and gave the card to the wrong person. She was the only lead to the crime and when she “lied” about who she gave the card to, it was enough evidence to charge her with the crime or being involved in it.
      The person that really messed up was her attorney. He should have gotten the video and had her go through what she did, like she told the reporter. Then he should have brought that information to the DA and demanded that the charges should be dropped. Or file a motion with the court to have it dropped. The whole thing could have been settled in a couple days. Now her lawyer is trying to cover his ass by suing the city. And I am sure he will get paid whether she wins the case or not.

They still haven't found the actual person who used the card illegally..and needed someone to punish. They didn't bother to look at all the evidence because they did Not want to see anything else..they had already made up their minds who was guilty. You cannot find what you never bother to look for..especially the Truth.

    This shows how quickly your life can be ruined by police who are so callous they take this as a days work. Along with the fact that friends and relatives turn on you because it is the police as your accuser so they must be right. Trying to get work after that comes up on your background check is hopeless. Try explaining it was a mistake and see what people tell you. Your life is never the same, and it follows you where ever you go.

      Is there no way for them to clear this off her record completely? I had a case against me that was not just dropped but discharged and all records were destroyed, fingerprints, etc. I am in Canada, if they wouldn't have properly removed it from my record I wouldn't even be able to cross the border into the US and I am so I know they did do that properly. This is so unfair to her, she was an honest person and it all goes to shit because of lazy cops. Wow.

      @@mtaylor1498 I had this happen to me through identity theft. Even though I was exonerated, there is still a record that it happened. It still follows you around. Most employers would just rather not deal with it. It is much easier to hire someone that doesn't have the baggage. Mine happened in the late 90s. I watched my prospects dry up pretty quick. Once you drop in income, people give up on you.

When they confirmed mine was cleared it was such a huge weight that was lifted, an innocent person shouldn’t have to carry that around.

    If lawyers and judges need degrees in law then police need to go to school for law before they ever strap a gun and handcuffs on. They have to provide their own insurance and that stupid qualified immunity needs to go away so they will slow their role knowing if they mess up it's Literally their ass !!!

      Not every judge has a law degree. Depends on the state/type of court. Only 28 states require law degrees to be a judge or put people in jail.

    Once she asked for an attorney the questing has to stop. However, Dumb and Dumber kept asking her questions for 30 minutes. The worse interrogation ever recorded in history of law enforcement. The Judge let them have it in open court "Absurd". You don't need the Supreme Court for this one.

    She also needs to sue her former employer for wrongful termination, unless she signed an "at will agreement" when she was first hired. Otherwise, she was innocent until proven guilty and her former employer had no grounds to fire her, unless she was convicted of a crime. The city has deep pockets and so does the security company she used to work for!

    The detective who was 1000% sure she was lying will plead the 5th in the civil trial.
    Hope she wins big.
    The DA must be insane and should be held accountable.
    At least the judge has the sense to see what a terrible case this was.

      In some jurisdictions if a cop pleaded the 5th they are instantly terminated… but DPD is so horribly incompetent and corrupt, it’s probably not applicable there.

    Too many things going on. They thought she was apart of a ring of some sort. They women goes in and out of the store everyday after this happened. They have the footage she never got into the car with the theft. Plus the card was left on the counter not stolen. So how the heck did DPD come up with that concept? It's clearly there that she thought it was the other person's credit card.

    This woman goes to this gas station multiple times per week. I'm sure she's given the clerk tons of cards and returned tons of cards to people walking away. Most of us do! People have done it for me also. This woman has no way of recalling every scenario and they should have shown her the video they were using against her.

    I think the only reason DPD had not caught the real crook is that she looked mean, and she might say something to hurt an officers feelings. So they going to let her go, and pick on some more honest, more helpless looking people of color.

    The irony here is that Miranda Warnings probably didn't need to be given in the first place. If she went to the police station on her own and was never told she couldn't leave, was locked, or blocked in, she wouldn't be considered to be in custody and any statements made would be admissible. The reading of the Miranda is likely what prompted her to request a lawyer. Bottom line once that request is made, the questions have to stop. Even if she changed her mind 5 min later and said she wanted to answer questions, the cop still couldn't question her until the woman spoke with an attorney and they Oked it.
    Failing to read Miranda is not a rights violation but can lead to the suppression of evidence. Continuing to question after 5th rights were evoked, whether issued Miranda or not, becomes compelling and likely coercive. That is a clear rights violation.

    They wont learn. This is standard proceedure for them if they believe the person is vulnerable and does not know their rights. They hound them in turns, until the person is so confused and upset, they make an involuntary statement that is taken as an admission of guilt. NEVER talk to cops ! They don't care about you. All they want, is to make an arrest and to hell with your life and reputation.

    If this situation ever happens to you, the smart thing to do is ask the person their name to see if it matches the card. Then ask to see ID to confirm the name. Otherwise, give it to the clerk.

Returning property to the wrong person is not a smart thing. it is a simple mistake. Unfortunately for her, a mistake that became costly. The police royally screwed up the investigation by lazily assuming that she had nefarious intent. Only the absolute worst of detectives would watch that video and infer that she had criminal intent. She should sue their pants off

    The company I work for reached out to the news to offer her a job that paid more... actually 30 different jobs to choose from with free health, dental, life, retirement, gym membership and more and offered to buy her a new car of her choice up to $30k so the base mustang qualifies. the news put us in touch with her lawyer. We gave lawyer offer details. And she turned down the new car and job. Lawyer said she is not in any kind of desperate need for a job or benefits or health care or dental work or money and loves the car she has and just wants to do security work. Hopefully she finds another security job. Bless your heart Ms Wilson..... Bless your heart.

    I encourage everybody to write 3 things down on an index card and hand it to law enforcement if you ever have any sort of interaction with them. 1) I remain silent 2) I do not consent to any searches 3) I want a lawyer Then you literally do not say a word...not one! There is not one good thing that has ever come from talking to a cop. It's perfectly legal to remain silent and there's not one thing they can do about it.

    i had someting similar happen to me twice😔 this is whyyy i feel we must separate bc they cant be fair to us.... Most of them. Thank God the judge was a fair judge. In my case the judge tried to arrest me when i pled my case in court instead of righting the wrong. 2nd case they hid the video that would prove my case. They didnt care that i had been wrongly attacked, all they wanted was to ruin my life. This is not justice for black ppl in this system, not when racist are in position. They need polygraph test to work in these positions, they cant be trusted. This has happend thousands, millions of time. God will judge them all and need to pay for their deeds.

    This is insane and is scary, I'd end up in the same ship as her if this happend to me?!? It's insane how fast your life falls apart after an arrest and how long it takes to get it back together, now she has an eviction, good luck finding a rental, no job, so no congruent job history, also makes it hard to find a rental, but all this happend so fast within 4 days her whole life fell apart it will take years for the courts to fix it. It took 4 months just to get the arrest vacated, ridiculous, and the police, no apology instead they try to defend what they did to her. Just awful!

    Just wanted to defend her somewhere on this. Our days get muddled as we do the same stuff constantly. In the video we have evidence of her at least trying to find someone who owned the card and return it honestly. The idea that she and an accomplice worked together to steal a credit card at such an opportune moment (as most of us don't forget that sort of thing too often) is absurd. What could have occured would have been a crime of opportunity, which does not permit the idea of conspiracy that was used against this woman. In her own head, she went to the gas station for some smokes or a snack like any other day, found a card that wasn't hers, and took it to someone in an attempt to honestly return it. Guy behind the counter would have been a better option, but the intent is clear and it pisses me off that it took months to get to a reasonable judge to help her. I hope she gets absolved in social media and the workplace.
